"It'll be a fantastic fight between two of the most aggressive and talented welterweights in the world," said Kenny Florian, who calls the fights with UFC on FOX teammate Jon Anik. "Both are excellent finishers, excellent on the ground with phenomenal striking games. They're also similar in that they get a lot of knockouts using their knees." According to Florian, Condit has been putting in extra work on his ground game to prepare for Kampmann this time around. "Kampmann probably won their last match with his wrestling, as the takedowns were likely the difference,” Florian added. “Condit has been working on his wrestling a lot these last few months and because of that, I have Condit as the slight favorite heading into this one." The television week gets started Tuesday, Aug. 27 (7:00 PM ET) with the UFC WEIGH-IN SHOW on FOX Sports 2 from Bankers Life Fieldhouse in Indianapolis, IN. Karyn Bryant hosts, with analysis from the loquacious Chael Sonnen and former UFC light heavyweight champion Rashad Evans, along with backstage reporting from three-time MMA Journalist of the Year Ariel Helwani. On-set interviews with Condit (28-7-0) and Kampmann (20-6-0) highlight an evening of insight and analysis of all of the fights leading to the main event. On Wednesday, Aug. 28, the evening gets started with the UFC PRE-FIGHT SHOW on FOX Sports 2, with Bryant, Sonnen, Evans and Helwani manning their posts. The program features a profile on Condit, interviews with Kampmann, fighter Kelvin Gastelum and UFC President Dana White, as well as a FOX Sports Strikezone breakdown of the Condit-Kampmann rematch, which ended with Kampmann scoring a split-decision victory in 2009. By examining the events of the UFC and how music is used, I focussed primarily on three issues that create a multi-layered understanding of Mixed Martial Arts (MMA) fighters and the cultivation of identity. First, I examined ideas of identity formation and cultivation. Since each fighter in UFC events enters his fight to a specific, and self-chosen, musical piece, different aspects of identity including race, political views, gender ideologies, and class are outwardly projected to fans and other fighters with the choice of entrance music. This type of musical representation of identity has been discussed (although not always in relation to sports) in works by past scholars (Kun, 2005; Hamera, 2005; Garrett, 2008; Burton, 2010; Mcleod, 2011). INTRODUCTION The fighters who compete in the Ultimate Fighting Championship (“UFC”) are currently classified as independent contractors. However, this classification appears to contradict the level of control that the UFC exerts over its fighters. This independent contractor classification severely limits the fighters’ benefits, workplace protections, and ability to unionize. Furthermore, the friendship between UFC’s brash president Dana White and President Donald Trump—who is responsible for making appointments to the National Labor Relations Board (“NLRB”)—has added a new twist to this issue.1 An attorney representing a former UFC fighter claimed this friendship resulted in a biased NLRB determination in their case.2 This article provides a detailed examination of the relationship between the UFC and its fighters, the relevance of worker classifications, and the case law involving workers in related fields. Finally, it performs an analysis of the proper classification of UFC fighters using the Internal Revenue Service (“IRS”) Twenty-Factor Test. II. UFC BACKGROUND The UFC is the world’s leading mixed martial arts (“MMA”) promotion. MMA is a one-on-one combat sport that combines elements of different martial arts such as boxing, judo, wrestling, jiu-jitsu, and karate.
