4. All taxes including (Proposed GST)/ Sales Tax, VAT, Service Tax or any other taxes on materials or on finished work like contract tax, Turn over Tax etc or any other tax subsequently levied / the present taxes enhancement in any other manner by Govt will have to be paid by the contractor only. Bank will not entertain any claim whatsoever in this respect, other terms of Tender are mentioned in the Tender document. It is hereby clarified that the tender same needs to be collected from architects’ office against payment of non- refundable tender document fee.
5. The Bank reserves the right to accept/ reject any or all the tenders without assigning any reason whatsoever.
ELIGIBILITY CRITERIA- MUST SATISFY ALL POINTS GIVEN BELOW
The eligibility criteria and general scope of work to be carried out by the contractors / firms are as under and will include –
1. The interior and civil contractor should have at least 5 years experience in Interior and Civil Renovation Works of Banks works/other PSU/ Office works.

2. The interior and civil contractors should have executed 02 (two) such type of similar (Interior and civil) work in the last 02/03 years for Banks successfully, If any contractor’s two or more work is pending/ is running delayed as per tender conditions their tenders will not be considered for this project and summarily rejected on technical grounds. Contractors /firms /Cos should submit the latest IT return/ extracts of form 26AS in this regard. Failing which the tender may be liable to be rejected. It is desirable to submit the completion certificate along with the technical bids for the works carried out in recent times.
3. The interior and civil contractors /firms are requested to submit the completion certificate from the user departments / project architects/bank’s having completed the works satisfactorily and within time schedule from the user dept/ of PSU / Banks.
4. The interior and civil contractors /firms should be an income tax assesses and should have filled income tax return for the last assessment year. Failing which their tender is liable to be rejected.
5. The interior and civil contractors /firms should have carryout the plumbing work through the licensed plumber of municipal/local fire authority or Other regulating agency for carrying out the required works and if required they should obtain the permissions from Municipal and other Local Authorities and bank will pay the official charges only and contractor has to obtain the permissions from the local authority If required.
BROAD SCOPE OF WORK: -
A The contractors shall submit a proper PERCHART/ Bar chart incorporating all the activities required for the completion of the project within one week of the receipt of the work order and well in time.
B Contractors will keep one site supervisor for above work in compliance with rules applicable to the local area and regulations of statutory/local authorities and Bank’s guidelines. The work should be carried out as per the tender specifications all other terms and conditions as per the bank’s norms. Contractors are required sign an agreement with the Bank as per the bank’s standard agreement format immediately on placing the work order to them.
C Submission of the required drawings to the Municipal and other Local Authorities If required.
D Contractor should submit a detailed account of various materials used on daily basis and enclose the same with each bill failing which their bill will not be paid. J No deviations or substitution will be allowed to the contractor and obtaining approval of the bank.
K The contractor shall be wholly and solely responsible for the successful completion of the project in all respect consistent with safety and structural stability from the inception up to the handling over the site for use.
L The contractor shall verify and confirm that identification marks and quality of material and ISI marks are made on all service installations/electric panel/valves/pump/wiring etc. for easy identification to carry out maintenance jobs. \

AND WHEREAS the said Drawings numbered...... To..... With ... Layout plan, the specifications and the Schedule of quantities have been signed by or on behalf of the parties hereto.
AND whereas the contractor has agreed to execute upon and subject to the condition set forth herein and Schedule of items and quantities, General & special Conditions of Contract, specification etc. contained in the tendered documents including all correspondences exchanged by or between the parties from the submission of tender till the award of work, both letters inclusive, (all of which are collectively hereinafter referred to as “the said conditions” details of which are described in the said specification and included in the schedule of Quantities at the respective rates therein set forth amounting to the sum as there in arrived at or such other sum as shall become payable there under (hereinafter referred to as the said Contact Amount”)
NOW IT IS HEREBY AGREED AS FOLLOWS:
1. In consideration of the said Contract amount to be paid at the times and the manner set forth in the said Conditions, the Contractor shall upon and subject to the said conditions execute and complete the work shown upon the said this form of Agreement, letter of acceptance, form of performance Bank guarantee or bond, Tender and appendix, instructions to tenderers, bills of quantities and schedule of supplementary, technical specification, Drawings, special conditions of contract, general conditions of contract, the notice inviting tender etc.
2. The employer shall pay the Contractor the amount or such other sum as shall become payable, at the times and in the manner specified in the said conditions.

3. The term “the Architect” in the said condition shall mean the said “M/s. Dilip Kulkarni & Associates” or in the event of their ceasing to be the Architect for the purpose of this contract for whatever reason, such other person or persons as shall be nominated for that purpose by the Employer, not being a person to whom the Contractor shall object for reasons considered to be sufficient by the Employer provided always that no person or persons subsequently appointed to be Architect under this contract shall be entitled to disregard or over rule any previous decisions or approval or direction given or expressed in writing by the architect for the time being.
4. The said general conditions, special condition, technical drawings, Notice Inviting Tender, specifications, Guarantee, Instruction to Tenderers Price Bid (Schedule of quantities), correspondences, Letter of acceptance, Agreements and appendix there to contained in the tendered documents / said conditions shall be read and constructed as forming part of this agreement, and the parties hereto shall respectively abide by submit themselves to the said conditions and perform the agreements on their part respectively in the said conditions contained.
5. The plans, agreement and documents mentioned herein shall form the basis of this contract. This contract is neither a fixed Lump sum contract nor a piece work contract but is a contract to carry out the work in respect of the entire project on item rate basis to be paid for according to actual measured quantities at the rates contained in the schedule of rates and probable quantities or as provided in the said conditions.
6. The Bank reserve to itself the rights of altering the specifications and nature of work by adding to or omitting any item of work or having portions of the same carried out without prejudice to the contract.
7. The contractors represent that they have experience and competent staff which will enable them to ensure proper quality check on the materials, whether brought by the contractors or supplied by the Bank to the contractors and which will ensure that the contractor will carry out proper tests as required by the specifications and will supervise the day to day working and execution of the contract work.
8. It the contractors have any doubt about the quality of the materials or any difficulty in supervision of the day to day work it shall be duty of the contractors to report the matter in writing forthwith to the employer and for the time being suspend that portion of the work about which difficulty is experienced, and the contractors will abide by the directions given by the employer.
9. The contractors are aware that the Bank will not give day to day supervision by will periodically supervise and the contractor has to perform their obligations under the instructions given to him periodically.
10. The contractors covenant and warrant that completed items of work as well as the entire work on completion will be in conformity with the specifications and the terms and conditions contained in the said conditions and will be of contract quality and description.
11. The Employer reserves to itself the right of altering the Drawings and nature of the work by adding to or omitting any items of work or having portions of the same carried out without prejudice to this contract.

12. Time shall be considered as the essence of this contract and the contractor here by agrees to commence the work soon after the site is made open to him or from the date of issue of intimation to you as provided for in the said conditions of contractor whichever is later and to complete the entire work within 8 Weeks subject never the less to the provisions for extension of time.
13. All payments by the Employer under this contract will be made only at Ahmedabad.
14. All disputes arising out of or in any way connected with this agreement shall be deemed to have arisen at Ahmedabad and only courts in Ahmedabad shall have jurisdiction to determine the same.
15. That all the parts of this contract have been read by the contractor and fully understood by the contractor. They further agree to complete the said work to fullest satisfaction of Architect / Employer. If The Contractor is a partnership or an individual

INSTRUCTIONS TO THE TENDERERS
1.0 SCOPE OF WORK Sealed Tenders are invited by M/s. Dilip Kulkarni & Associates – 5, Laxmi Building, Municipal Chawl, Ground Floor, Dr. Ambedkar Road, Near Jaihind Talkies, Chinchpokli (E) Mumbai - 400 033, for and on behalf of State Bank of India for the work of INTERIOR/ CIVIL AND FURNITURE WORK FOR STATE BANK OF INDIA - GROUND & 1 st FLOOR, SAIKRUPA BLDG., ZUNJARRAO COMPLEX, KALYAN MURBAD ROAD, SONARPADA, MURBAD, MAHARASHTRA – 421 401. st 1.1 SITE AND ITS LOCATION: State Bank of India – Ground & 1 Floor, Saikrupa Bldg., Zunjarrao Complex, Kalyan Murbad Road, Sonarpada Murbad, Maharashtra – 421 401.

2.3 Complete set of tender documents including relative drawings can be obtained in person from the Architects M/s. Dilip Kulkarni & Associates – 5, Laxmi Building, Municipal Chawl, Ground Floor, Dr. Ambedkar Road, Near Jaihind Talkies, Chinchpokli (E) Mumbai - 400 033 from --- / --- /2017 to ---/ --- /2017 between 10.30 a.m. to 06.00 p.m. (Saturday upto 2:30 p.m.) on any day except holidays during the period mentioned in the NIT on payment of Rs.1,000/- (Rupees One Thousand Only) by Cash /Demand Draft in the name of Dilip Kulkarni A/C Maintenance which sum is non-refundable.
2.4 The tender documents are not transferable.

3.0 SITE VISIT The tenderers are requested to visit the site and make themselves familiar with the work before submitting the tender.
3.1 The tenderer must obtain himself on his own responsibility and his own expenses all information and data which may be required for the purpose of filling this tender document and enter into a contract for the satisfactory performance of the work. The Tenderer is requested to satisfy himself regarding the availability of water, power, transport and communication facilities, the character quality and quality of the materials, labour, the law and order situation, climatic conditions local authorities requirement, traffic regulations etc;
The tenderer will be fully responsible for considering the financial effect of any or all the factors while submitting his tender.
4.0 EARNEST MONEY:
4.1 The tenderers are requested to submit the Earnest Money of Rs.27,000/- (Rupees Twenty Seven Thousand Only) in the form of Demand Draft or Banker’s Cheque in favour of State Bank of India drawn on any Bank in India.
4.2 EMD in any other form other than as specified above will not be accepted. Tender not accompanied by the EMD in accordance with Clause 4.1 above shall be rejected.
4.3 No interest will be paid on the EMD.
4.4 EMD of unsuccessful tenderers will be refunded within 30 days of award of Contract.
4.5 EMD of successful tenderer will be retained as a part of security deposit.
5.0 INITIAL SECURITY DEPOSIT The successful tenderer will have to submit a sum equivalent to 2% of contract value Less EMD by means of Demand Draft drawn in favour of State Bank of India within a period of 15 days of acceptance of tender.
6.0 SECURITY DEPOSIT
6.1 TOTAL SECURITY DEPOSIT SHALL BE 5% OF CONTRACT VALUE. Out of this 2% of contract value is in the form of initial security deposit which includes the EMD. Balance 3% shall be deducted from the running account bill of the work at the rate of 10% of respective running account bill i.e. deduction from each running bill account will be 10% till total 3% of contract value reaches.
50% of the total security shall be paid to the contractors on the basis of architect’s certifying the virtual completion. The balance 50% would be paid to the contractors after the defects liability period as specified in the contract.
6.2 No interest shall be paid to the amount retained by the Bank as Security Deposit.

7.0 SIGNING OF CONTRACT DOCUMENTS The successful tenderer shall be bound to implement the contract by signing an agreement and conditions of contract attached herewith within 15 days from the receipt of intimation of acceptance of his tender by the bank. However, the written acceptance of the tender by the Bank will constitute a binding agreement between the Bank and successful tenderer whether such formal agreement is subsequently entered into or not.
8.0 COMPLETION PERIOD Time is essence of the contract. The work should be completed in all respects in accordance with the terms of contract within a period as mentioned in NIT. You should start the work from the date of handing over site or within 15 days of mobilization period, whichever is later.
9.0 VALIDITY OF TENDER Tenders shall remain valid and open for acceptance for a period of 3 (Three) months from the date of opening price bid. If the tenderer withdraws his/her offer during the validity period or makes modifications in his/her original offer which are not acceptance of the Bank without prejudice to any other right or remedy, the bank shall be at liberty to forfeit the EMD.
10.1 LIQUIDATED DAMAGES. The liquidated damages shall be 0.5% per week subject to a maximum of 5% of contract value.
11.0 RATES AND PRICES
11.1 In case of item rate tender
11.1.1 The tenderers shall quote their rates for individual items both in words and figures in case of discrepancy between the rates quoted in Words and figures the unit rate quoted in words will prevail. If no rate is quoted for a particular item the contractor shall not be paid for that item when it is executed.
The amount of each item shall be calculated and the requisite total is given. In case of discrepancy between the unit rate and the total amount calculated from multiplication of unit rate and the quantity the unit rate quoted will govern and the amount will be corrected.
11.1.2 The tenderers need not quote their rates for which no quantities have been given. In case the tenderers quote their rates for such items those rates will be ignored and will not be considered during execution.

11.1.3 The tenderers should not change the units as specified in the tender. If any unit is changed the tenders would be evaluated as per the original unit and the contractor would be paid accordingly. The tenderer should not change or modify or delete the description of the item. If any discrepancy is observed he should immediately bring to the knowledge of the Architect/Bank.
11.1.4 Each page of the BOQ shall be signed by the authorized person and cutting or overwriting shall be duly attested by him.
11.1.5 Each page shall be totaled and the grand total shall be given.
11.1.6 The rate quoted shall be firm and shall include all costs, allowances, taxes, GST levies, etc.

SECTION IV GENERAL CONDITIONS OF CONTRACT 1.0 Definitions “Contract” means the documents forming the tender and the acceptance thereof and the formal agreement executed between State bank of India (Client) and the contractor, together with the documents referred therein including these conditions, the specifications, designs, drawings and instructions issued from time to time by the Architect/ Bank and all these documents taken together shall be deemed to from one contract and shall be complementary to one another.
1.1 In the contract the following expressions shall unless the context otherwise requires, have the meaning hereby respectively assigned to them.
1.1.1 “SBI” shall mean State Bank of India (client) a body corporate created under state Bank of India Act 1955, having Corporate Centre at State Bank Bhavan, Madam Cama Road, Mumbai 400 021 and a LHO at 3rd Floor, ‘G’ Block, Synergy Building, Bandra Kurla Complex, Bandra (E), Mumbai 400 051 and includes the client’s representatives, successors and assigns.
“Architects/ Consultants” shall mean M/s. Dilip Kulkarni & Associate. 5, Laxmi Building, Municipal Chawl, Ground Floor, Dr. Ambedkar Road, Near Jaihind Talkies, Chinchpokli (E) Mumbai - 400 033 and includes its representative successors and assigns.
1.1.2 “Site Engineer”: shall mean and Engineer appointed by the Bank at their representative to give instructions to the contractors.
1.1.3 ‘The Contractor’ shall mean the individual or firm or company whether incorporated or not, undertaking the works and shall include legal personal representative of such individual or the composing the firm or company and the permitted assignees of such individual or firms of company.
The expression ‘works’ or ‘work’ shall mean the permanent or temporary work described in the ‘Scope of Work’ and /or to be executed in accordance with the contract and includes materials, apparatus, equipment, temporary supports, fittings and things of all kinds to be provided, the obligations of the contractor hereunder and work to be done by the contractor under the contract.
1.1.4 ‘Engineer’ shall mean the representative of the Architect/ consultant.
1.1.5 ‘Drawings’ shall mean the drawings prepared by the Architects and issued by the Engineer and referred to in the specifications and any modifications of such drawings as may be issued by the Engineer from time to time ‘Contract value shall mean the value of the entire work as stipulated in the letter of acceptance of tender subject to such additions thereto or deductions there from as may be made under the provision herein after contained. 1.1.6 ‘Specifications’ shall mean the specifications referred to in the tender and any modifications thereof as may time to time be furnished or approved by the architect/ consultant ‘Month’ means calendar month.

1.1.7 “Week” means seven consecutive days.
1.1.8 “Day” mean a calendar day beginning and ending at 00 Hrs. and 24 Hrs. respectively.
CLAUSE 2.0 Total Security Deposit. Total Security Deposit comprises of: Earnest Money Deposit Initial Security Deposit Retention Money
(a) Earnest Money Deposit: The tenderer shall furnish EMD of Rs.27,000/- (Rupees Twenty Seven Thousand only) in the form of Demand Draft or Bankers cheque drawn in favour of State Bank of India on any Scheduled bank. No tender shall be considered unless the EMD is so deposited in the required form. No interest shall be paid on this EMD. The EMD of the unsuccessful tenderer shall be refunded soon after the decision to award the contract is taken without interest. The EMD shall stand absolutely forfeited if the tenderer revokes his tender at any time during the period when he is required to keep his tenderer open acceptance by the SBI or after it is accepted by the SBI, the contractor fails to enter into a formal agreement or fails to pay the initial security deposit as stipulated or fails to commence the work within the stipulated time.
(b) Initial Security Deposit (ISD) The amount of ISD shall be 2% of the accepted value of tender including the EMD. Balance of ISD (i.e. excluding EMD) is to be submitted in the form of D / D drawn on any scheduled Bank and shall be deposited within 15 days from the date of letter of acceptance of tender.
(c) Retention Money Besides the ISD as deposited by the contractor in the above said manner the retention money shall be deducted from the running account bill at the rate of 10% of the gross value of work done by the contractor and claimed in his bill provided the total security deposit i.e. the ISD plus retention money shall both together not exceed 5% of the contract value. 50% of the total security deposit shall be refunded to the contractor without any interest on issue of virtual completion certificate by the Architect/ Consultant. The balance 50% of the total security deposit shall be refunded to the contractor without interest within 15 days after the end of defect liability period provided the contractor has satisfactorily attended to all defects in accordance with the conditions of the contract including site clearance.

3.0 Language Errors, Omissions and Discrepancies In case of errors, omissions and/or disagreement between written and scaled dimensions on the drawings or between the drawings and specifications etc., the following order shall apply.
i) Between scaled and written dimension (or description) on a drawing, the later shall be adopted. ii) Between the written or shown description or dimensions in the drawings and the corresponding one in specification the former shall be taken as correct. iii) Between written description of the item in the specifications and descriptions in bills of quantities of the same item, the later shall be adopted. iv) In case of difference between rates written in figures and words, the rate in words shall prevail. v) Between the duplicate/subsequent copies of the tender, the original tender shall be taken as correct.
4.0 Scope of work The contractor shall carry out complete and maintain the said work in every respect strictly in accordance with this contract and with the directions of and to the satisfaction of the Bank to be communicated through the architect/ Consultant. The architect/ consultant at the directions of the bank from time to time issue further drawings and/or written instructions, details directions and explanations which are hereafter collectively referred to as Architect’s/ Consultant’s instructions in regard to: the variation or modification of the design, quality or quantity of work or the addition or omission or substitution of any work, any discrepancy in the drawings or between the BOQ and/or drawings and/or specifications, the removal from the site of any material brought thereon by the contractor and the substitution of any other materials thereof, the demolition, removal and/or re-execution of any work executed by him, the dismissal from the work of any person employed/engaged thereupon.
5(i) Letter of Acceptance
Within the validity period of the tender the bank shall issue a letter of acceptance either directly or through the Architect by registered post or otherwise depositing at the address of the contractor as given in the tender to enter into a Contract for the execution of the work as per the terms of the tender. The letter of acceptance shall constitute a binding contract between the SBI and the contractor.
5(ii) Contract Agreement On receipt of intimation of the acceptance of tender from the SBI /Architect the successful tenderer shall be bound to implement the contract and within fifteen days thereof he shall sign an agreement in a non-judicial stamp paper of appropriate value.
6.0 Ownership of drawings All drawings, specifications and copies thereof furnished by the SBI through its architect/Consultants are the properties of the SBI. They are not to be used on other work.

7.0 Detailed drawings and instructions. The SBI through its architects/consultants shall furnish with reasonable promptness additional instructions by means of drawings or otherwise necessary for the proper execution of the work. All such drawings and instructions shall be consistent with the contract documents, true developments thereof and reasonably inferable therefrom.
The work shall be executed in conformity therewith and the contractor prepare a detailed programme schedule indicating therein the date of start and completion of various activities on receipt of the work order and submit the same to the SBI through the Architect/Consultant.
Copies of Agreement Two copies of agreement/tender document duly signed by both parties with the drawings shall be handed over to the contractors.
8.0 Liquidated Damages If the contractor fails to maintain the required progress in terms of clause 30 of GCC or to complete the work and clear the site including vacating their office on or before the contracted or extended date or completion without justification in support of the cause of delay, he may be called upon without prejudice to any other right of remedy available under the law to the SBI on account of such breach to pay a liquidated damages at the rate of 0.5% of the contract value per week subject to a maximum of 5% of the contract value.
9.0 Materials, Appliances and Employees Unless or otherwise specified the contractor shall provide and pay for all materials, labour, water, power, tools, equipment transportation and any other facilities that are required for the satisfactory execution and completion of the work. Unless or otherwise specified all materials shall be new and both workmen ship and materials shall be of best quality. The contractor at all times enforces strict discipline and good order among his employees and shall not employ on the work any unfit person or anyone not skilled in the work assigned to him. Workman whose work or behavior is found to be unsatisfactory by the SBI/Architect/Consultant, he shall be removed from the site immediately.
10.0 Permits, Laws and Regulations Permits and licenses required for the execution of the work shall be obtained by the contractor at his own expenses. The contractor shall give notices and comply with the regulations, laws and ordinances rules, applicable to the contractor. If the contractor observes any discrepancy between the drawings and specifications, he shall promptly notify the SBI in writing under intimation of the Architect/Consultant. If the contractor performs any act which is against the law, rules and regulations he shall meet all the costs arising there from and shall indemnify the SBI any legal actions arising there from.

11.0 Setting out Work The contractor shall set out the work and shall be responsible for the true and perfect setting out of the same and for the correctness of the positions, levels, dimensions, and alignment of all parts thereof and get it approved by the Architect/Consultant before proceeding with the work, if at any time any error in this respect shall appear during the progress of the works, irrespective of the fact that the layout had been approved by the architect/consultant the contractor shall be responsible for the same and shall at his own expenses rectify such error, if so, required to satisfaction of the SBI.
12.0 Protection of works and property The contractor shall continuously maintain adequate protection, of all his work from damage and shall protect the SBI’s properties from injury or loss arising in connection with contract. He shall make good any such damage, injury, loss due to his fault or negligence except which are due to causes beyond his control.
He shall take adequate care and steps for protection of the adjacent properties. The contractor shall take all precautions for safety and protection of his employees on the works and shall comply with all applicable provision of Government and local bodies’ safety laws and building codes to prevent accidents, or injuries to persons or property of about or adjacent to his place of work. The contractor shall take insurance cover as per clause 24.0 at his own cost. The policy may be taken in joint names of the contractors and the SBI and the original policy may be lodged with the SBI.
13.0 Inspection of Work The SBI /Architect /Consultant or their representatives shall at all reasonable time have free access to the work site and/or to the workshop, factories or other places where materials are lying or from where they are obtained and the contractor shall give every facility to the SBI, Architect/Consultant and their representatives necessary for inspection and examination and test of the materials and workmanship. No person unless authorized by the SBI /Architect / Consultant except the representative of Public authorities shall be allowed on the work at any time. The proposed work either during its construction stage or its completion can also be inspected by the Chief Technical Examiner’s organization a wing of Central Vigilance Commission.
14.0 Assignment and subletting The whole of work included in the contract shall be executed by the contractor and he shall not directly entrust and engage or indirectly transfer assign or underlet the contract or any part or share thereof or interest therein without the written consent of the SBI through the Architect and no undertaking shall relieve the contractor from the responsibility of the contractor from active superintendence of the work during its progress.
15.0 Quality of Materials, Workmanship & Test (i) All materials and workmanship shall be best of the respective kinds described in the contract and in accordance with Architect / Consultant instructions and shall be subject from time to time to such tests as the architect / Consultant may direct at the place of manufacture or fabrication or on the site or an approved testing laboratory.

The contractor shall provide such assistance, instructions, machinery, labour and materials. (ii) Samples All samples of adequate numbers, size, shades & pattern as per specifications shall be supplied by the contractor without any extra charges. If certain items proposed to be used are of such nature that samples cannot be presented or prepared at the site detailed literature/test certificate of the same shall be provided to the satisfaction of the Architect / Consultant. Before submitting the sample / literature the contractor shall satisfy himself that the material/equipment for which he is submitting the samples/literature meet with the requirement of tender specification. Only when the samples are approved in writing by the Architect / Consultant the contractor shall proceed with the procurement and installation of the particular material / equipment. The approved samples shall be signed by the Architect /Consultant for identification and shall be kept on record at the site office until the completion of the work for inspection / comparison at any time. The Architect / Consultant shall take reasonable time to approve the sample. Any delay that might occur in approving the samples for reasons of its not meeting the specifications or other discrepancies in adequacy in furnishing samples of best qualities from various manufacturers and such other aspects causing delay on the approval of the materials/equipment’s etc., shall be to the account of the contractor.
(iii) Cost of Tests a) The cost of making any test shall be borne by the contractor, if such test is intended by or provided for in the specifications or BOQ.
(iv) Cost of Tests not provided for If any test is ordered by the Architect/Consultant which is either: (a) If so intended by or provided for or (in the cases above mentioned) is not so particularized or through so intended or provided for but ordered by the Architect/ Consultant which is either to be carried out by an independent person at any place other than the site or the place of manufacture or fabrication of the materials tested or any Government/approved laboratory, then the cost of such test shall be borne by the contractor.
16.0 Obtaining Information related to execution of work No claim by the contractor for additional payment shall be entertained which is consequent upon failure on his part to obtain correct information as to any matter affecting the execution of the work nor any misunderstanding or the obtaining incorrect information or the failure to obtain correct information relieve him from any risks or from the entire responsibility for the fulfilment of contract.
17.0 Contractor’s Superintendence The contractor shall give necessary personal superintendence during the execution of the works and as long, thereafter, as the Architect/consultant may consider necessary until the expiry of the defects liability period, stated hereto.
18.0 Quantities i) The bill of quantities (BOQ) unless or otherwise stated shall be deemed to have been prepared in accordance with the Indian Standard Method of Measurements.

The rate quoted shall remain valid for variation of quantity against individual item to any extent subject to maximum variation of the contract value by 25%. The entire amount paid under Clause 20 hereof as well as amounts of prime cost and provisional sums, if any, shall be excluded.
ii) Variation exceeding 25%: The items of work executed in relation to variation exceeding 25% shall be paid on the basis of provision of clause 21(e) hereto.
19.0 Works to be measured The Architect/Consultant may from time to time intimate to the contractor that he requires the work to be measured and the contractor shall forthwith attend or send a qualified representative to assist the Architect in taking such measurements and calculation and to furnish all particulars or to give all assistance required by any of them. Such measurements shall be taken in accordance with the Mode of measurements detailed in the specifications. The representative of the Architect/Consultant shall take joint measurements with the contractor’s representative and the measurements shall be entered in the measurement book. The contractor or his authorized representative shall sign all the pages of the measurement book in which the measurements have been recorded in token of his acceptance. All the corrections shall be duly attested by both representatives. No over writings shall be made in the measurement book. Should the contractor not attend or neglect or omit to depute his representative to take measurements then the measurements recorded by the representative of the Architect/consultant shall be final. All authorized extra work, omissions and all variations made shall be included in such measurements.
20.0 Variations: No alteration, omission or variation ordered in writing by the Architect/Consultant shall vitiate the contract. In case the SBI / Architect / Consultant thinks proper at any time during the progress of works to make any alteration in, or additions to or omission from the works or any alteration in the kind or quality of the materials to be used therein, the Architect/ Consultant shall give notice thereof in writing to the contractor or shall confirm in writing within seven days of giving such oral instructions the contractor shall alter to, add to, or omit from as the case may be in accordance with such notice but the contractor shall not do any work extra to or make any alteration or additions to or omissions from the works or any deviation from any of the provisions of the contract, stipulations, specifications or contract drawings without previous consent in writing of the Architect/ Consultant and the value of such extras, alterations, additions or omissions shall in all cases be determined by the Architect/ Consultant and the same shall be added to or deducted from the contract value, as the case may be.
21.0 Valuation of Variations No claim for an extra shall be allowed unless it shall have been executed under the authority of the Architect/ Consultant with the concurrence of the SBI as herein mentioned. Any such extra is herein referred to as authorized extra and shall be made in accordance with the following provisions.8 a) i The net rates or prices in the contract shall determine the valuation of the extra work where such extra work is of similar character and executed under similar conditions as the work priced herein.

ii) Rates for all items, wherever possible should be derived out of the rates given in the priced BOQ. b)The net prices of the original tender shall determine the value of the items omitted, provided if omissions do not vary the conditions under which any remaining items of works are carried out, otherwise the prices of the same shall be valued under sub clause (c) hereunder/ c)Where the extra works are not of similar character and/or executed under similar conditions as aforesaid or where the omissions vary the conditions under which any remaining items or works are carried out, then the contractor shall within 7 days of the receipt of the letter of acceptance inform the Architect/ Consultant of the rate which he intends to charge for such items of work, duly supported by analysis of the rate or rates claimed and the Architect / Consultant shall fix such rate or prices as in the circumstances in his opinion are reasonable and proper based on the market rate. d)Where extra work cannot be properly measured or valued, the contractor shall be allowed day work prices at the net rates stated in the tender of the BOQ or, if not, so stated then in accordance with the local day work rates and wages for the district, provided that in either case, vouchers specifying the daily time (and if required by the Architect/ Consultant) the workman’s name and materials employed be delivered for verifications to the Architect/ Consultant at or before the end of the week following that in which the work has been executed. e)It is further clarified that for all such authorized extra items where rates cannot be derived from the tender, the contractor shall submit rates duly supported by rate analysis worked on the “market rate basis” for material, labour, hire/running charges of equipment and wastages etc., plus 15% towards establishment charges, contractor’s overheads and profit. Such items shall not be eligible for escalation.
22.0 Final Measurements The measurement and valuation in respect of the contract shall be completed within six months of the virtual completion of the work.
23.0 Virtual Completion Certificate (VCC) On successful completion of entire works covered by the contract to the full satisfaction of the SBI, the contractor shall ensure that the following works have been completed to the satisfaction of the SBI.
a) Clear the site of all scaffolding, wiring, pipes, surplus materials, contractor’s labour, equipment and machinery. b) Demolish, dismantle and remove the contractor’s site office, temporary works, structures including labour sheds/camps and constructions and other items and things whatsoever brought upon or erected at the site or any land allotted to the contractor by the SBI and not incorporated in the permanent works. c)Remove all rubbish, debris etc., from the site and the land allotted to the contractor by the SBI and shall clear, level and dress, compact the site as required by the SBI. d) Shall put the SBI in undisputed custody and possession of the site and all land allotted by the SBI. e) Shall hand over the work in a peaceful manner to the SBI. f) All defects/imperfections have been attended and rectified as pointed out by the SBI to the full satisfaction of SBI.

Upon the satisfactory fulfilment by the contractor as stated above, the contractor shall be entitled to apply to the Architect/ Consultant for the certificate. If the Architect/Consultant is satisfied of the completion of the work, relative to which the completion certificate has been sought, the Architect/ Consultant shall within fourteen (14) days of the receipt of the application for virtual completion certificate, issue a VCC in respect of the work for which the VCC has been applied.
This issuance of a VCC shall be without prejudice to the SBI’s rights and contractor’s liabilities under the contract including the contractor’s liability for defects liability period nor shall the issuance of VCC in respect of the works or work at any site be construed as a waiver of any right or claim of the SBI against the contractor in respect of works or work at the site and in respect of which the VCC has been issued.
24.0 Work by other agencies The SBI / Architect / Consultant reserves the rights to use premises and any portion of the site for execution of any work not included in the scope of this contract which it may desire to have carried out by other persons simultaneously and the contractor shall not only allow but also extend reasonable facilities for the execution of such work. The contractor however shall not be required to provide any plant or material for the execution of such work except by special arrangement with the SBI. Such work shall be carried out in such manner not to impede the progress of the works included in the contract.
25.0 Insurance of Works 25.1 Without limiting his obligations and responsibilities under the contract the contractor shall insure in the joint names of the SBI and the contractor against all loss or damages from whatever cause arising other than the excepted risks, for which he is responsible under the terms of contract and in such a manner that the SBI and contractor are covered for the period stipulated in clause 28 of GCC and are also covered during the period of maintenance for loss or damage arising from a cause, occurring prior to the commencement of the period of maintenance and for any loss or damage occasioned by the contractor in the course of any operations carried out by him for the purpose of complying with his obligations under clause.
a) The works for the time being executed to the estimated current Contract value thereof, or such additional sum as may be specified together with the materials for incorporation in the works at their replacement value.
b) The constructional plant and other things brought on the site by the contractor to the replacement value of such constructional plant and other things.
c)Such insurance shall be effected with an insurer and in terms approved by the SBI which approval shall not be unreasonably withheld and the contractor shall whenever required produce to the Architect/ Consultant the policy of insurance and the receipts for payment of the current premiums.
25.2 Damage to persons and property The contractor shall, except if and so far as the contract provides otherwise indemnify the SBI against all losses and claims in respect of injuries or damages to any person or material or physical damage to any property whatsoever which may arise out of or in

consequence of the execution and maintenance of the works and against all claims proceedings, damages, costs, charges and expenses whatsoever in respect of or in relation thereto except any compensation of damages for or with respect to:
a) The permanent use or occupation of land by or any part thereof. b) The right of SBI to execute the works or any part thereof, on, over, under, in or through any lands. c) Injuries or damages to persons or properties which are unavoidable result of the execution or maintenance of the works in accordance with the contract. d) Injuries or damage to person or property resulting from any act or neglect of the SBI, their agents, employees or other contractors not being employed by the contractor or in respect of any claims, proceedings, damages, costs, charges and expenses in respect thereof or in relation thereto or where the injury or damage was contributed to by the contractor, his servants or agents such part of the compensation as may be just and equitable having regard to the extent of the responsibility of the SBI, their employees, or agents or other employees, or agents or other contractors for the damage or injury.
25.3 Contractor to indemnify SBI The contractor shall indemnify the SBI against all claims, proceedings, damages, costs, charges and expenses in respect of the matters referred to in the provision sub- clause 26.2 of this clause.
25.4 Contractor’s superintendence The contractor shall fully indemnify and keep indemnified the SBI against any action, claim, or proceeding relating to infringement or use of any patent or design or any alleged patent or design rights and shall pay any royalties which may be payable in respect of any article or part thereof included in the contract. In the event of any claim made under or action brought against SBI in respect of such matters as aforesaid the contractor shall be immediately notified thereof and the contractor shall be at liberty, at his own expenses to settle any dispute or to conduct any litigation that may arise there from, provided that the contractor shall not be liable to indemnify the SBI if the infringement of the patent or design or any alleged patent or design right is the direct result of an order passed by the Architect / Consultant in this behalf.
25.5 Third Party Insurance 25.5.1 Before commencing the execution of the work the contractor but without limiting his obligations and responsibilities under clause 26.0 of GCC shall insure against his liability for any material or physical damage, loss, or injury which may occur to any property including that of SBI or to any person including any employee of the SBI, by or arising out of the execution of the works or in the carrying out of the contract, otherwise than due to the matters referred to in the provision to clause 26.0 thereof.
25.5.2 Minimum Amount of Third Party Insurance Such insurance shall be affected with an insurer and in terms approved by the SBI which approval shall not be reasonably withheld and for at least the amount stated below. The contractor shall, whenever required, produce to the Architect/ Consultant the policy or policies of insurance cover and receipts for payment of the current premiums.

25.6 The minimum insurance cover for physical property, injury, and death is Rs.5.0 lacs per occurrence with the number of occurrences limited to four. After each occurrence contractor will pay additional premium necessary to make insurance valid for four occurrences always.
25.7 Accident or Injury to Workmen
25.7.1 The SBI shall not be liable for or in respect of any damages or compensation payable at law in respect or in consequence of any accident or injury to any workmen or other person in the employment of the contractor or any sub-contractor, save and except an accident or injury resulting from any act or default of the SBI or their agents, or employees. The contractor shall indemnify and keep indemnified SBI against all such damages and compensation, save and except as aforesaid and against all claims, proceedings, costs, charges and expenses whatsoever in respect thereof or in relation thereto.
25.7.2 Insurance against accidents etc. to workmen The contractor shall insure against such liability with an insurer approved by the SBI during the whole of the time any person employed by him on the works and shall, when required, produce the architect/ consultant such policy of insurance and receipt for payment of the current premium. Provided always that, in respect of any persons employed by any sub-contractor the contractor’s obligation to insure as aforesaid under this sub-clause shall be satisfied if the sub-contractor shall have insured against the liability in respect of such persons in such manner that SBI is indemnified under the policy but the contractor shall require such sub-contractor to produce to the Architect/ Consultant when required such policy of insurance and the receipt of the payment of the current premium.
25.7.3 Remedy on Contractor’s Failure to Insure If the contractor fails to effect and keep in force the insurance referred to above or any other insurance which he may be required to effect under the terms of contract, then and in any such case the SBI may effect and keep in force any such insurance and pay such premium or premiums as may be necessary for the purpose and from time to time deduct the amount so paid by the SBI as aforesaid and also deduct 15% of contract value from any amount due or which may become due to the contractor, or recover the same as debt from the contractor.
25.7.4 Without prejudice to the other rights of the SBI against contractors, in respect of such default, the Bank shall be entitled to deduct from any sums payable to the contractor the amount of any damages costs, charges, and other expenses paid by the SBI and which are payable by the contractors under this clause. The contractor shall upon settlement by the insurer of any claim made against the insurer pursuant to a policy taken under this clause, proceed with due diligence to rebuild or repair the works destroyed or damaged. In this event all the monies received from insurer in respect of such damage shall be paid to the contractor and the contractor shall not be entitled to any further payment in respect of the expenditure incurred for rebuilding or repairing of the materials or goods destroyed or damaged.

26.0 Commencement of Works The date of commencement of the work will be reckoned as the recorded date of handing over site by the SBI or 15 days from the date of issue of Letter of Acceptance of bank, whichever is later.
27.0 Time for completion Time is the essence of the contract and shall be strictly observed by the contractor. The entire work shall be completed within a period of 08 Weeks (including mobilization period) from the date of commencement. If required in the contract or as directed by the Architect/ Consultant, the contractor shall complete certain portions of work before completion of the entire work. However the completion date shall be reckoned as the date which the whole work is completed as per the terms of the contract.
28.0 Extension of Time If, in the opinion of the Architect / Consultant, the work be delayed for reasons beyond the control of the contractor, the Architect / Consultant may submit a recommendation to the SBI to grant a fair and reasonable extension of time for completion of work as per the terms of contract. If the contractor needs an extension of time for the completion of work or if the completion of work is likely to be delayed for any reasons beyond the due date of completion as stipulated in the contract, the contractor shall apply to the SBI through the Architect / Consultant in writing at least 30 days before the expiry of the scheduled time and while applying of extension of time he shall furnish the reasons in detail and his justification if any, for the delays. The architect/ Consultant shall submit their recommendations to the SBI in the prescribed format for granting extension of time. While granting extension of time the contractor shall be informed the period extended time which will qualify for levy of liquidated damages. For the balance period in excess of original stipulated period and duly sanctioned extension of time by the SBI the provision of liquidated damages as stated under clause 9 of GCC shall become applicable. Further contract shall remain in force even for the period beyond the due date of completion irrespective whether the extension is granted or not.
29.0 Rate of Progress Whole of the materials, plant and labour to be provided by the contractor and the mode manner and speed of execution and maintenance of the works are to be of a kind and conducted in a manner to the satisfaction of the Architect /Consultant. Should the rate of progress of the work or any part thereof be at any time be in the opinion of the Architect/ Consultant to slow to ensure the completion of the whole of the work by the prescribed time or extended time for completion, the Architect / Consultant shall thereupon take such steps as considered necessary by the Architect / Consultant to expedite progress so as to complete the works by the prescribed time or extended time. Such communications from the Architect/ Consultant neither shall relieve the contractor from fulfilling obligations under the contract nor shall he be entitled to raise any claims arising out of such directions.
30.0 Work during Nights and Holidays Subject to any provision to the contrary contained in the contract no permanent work shall save as herein provided be carried on during the night or on holidays without

the permission in writing of the Architect/ Consultant, save when the work is unavoidable or absolutely necessary for the saving of life or property or for the safety of the works in which case the contractor shall immediately advise the Architect / Consultant. However, the provision of the clause shall not be applicable in the case of any work which becomes essential to carry out by rotary or double shifts in order to achieve the progress and quality of the part of the works being technically required and continued with the prior approval of the Architect/ Consultant at no extra cost to the SBI.
All work at night after obtaining approval from competent authorities shall be carried out without unreasonable noise and disturbance.
31.0 No Compensation for Restrictions of Work If at any time after acceptance of the tender SBI shall decide to abandon or reduce the scope of work for any reason whatsoever and hence not require the whole or any part of the work to be carried out, the Architect / Consultant shall give notice in writing to the effect to the contractor and the contractor shall act accordingly in the matter. The contractor shall have no claim to any payment of compensation or otherwise whatsoever, on account of any profit or advantage which he might have derived from the execution of the work fully but which he did not derive in consequence of the foreclosure of the whole or part of the work.
Provided that the contractor shall be paid the charges on the cartage only of materials actually and bona fide brought to the site of the work by the contractor and render surplus as a result of the abandonment, curtailment of the work or any portion thereof and then taken back by the contractor, provided however that the Architect/ Consultant shall have in such cases the option of taking over all or any such materials at their purchase price or a local current rate whichever is less.
In case of such stores having been issued from SBI stores and returned by the contractor to stores, credit shall be given to him at the rates not exceeding those at which were originally issued to the contractor after taking into consideration and deduction for claims on account of any deterioration or damage while in the custody of the contractor and in this respect the decision of Architect/ Consultant shall be final.
32.0 Suspension of Work i) The contractor shall on receipt of the order in writing of the Architect / Consultant (whose decision shall be final and binding on the contractor) suspend the progress of works or any part thereof for such time and in such manner as Architect / Consultant may consider necessary so as not to cause any damage or injury to the work already done or endanger the safety thereof for any of following reasons. a) On account any default on the part of the contractor, or
b) For proper execution of the works or part thereof for reasons other than the default of the contractor, or

c) For safety of the works or part thereof.
The contractor shall, during such suspension, properly protect and secure the works to the extent necessary and carry out the instructions given in that behalf by the Architect/ Consultant.
ii) If the suspension is ordered for reasons (b) and (c) in sub-Para (i) above:
The contractor shall be entitled to an extension of time equal to the period of every such suspension. No compensation whatsoever shall be paid on this account.
33.0 Action when the whole security deposit is forfeited
In any case in which under any clause or clauses of this contract, the Contractor shall have rendered himself liable to pay compensation amounting to the whole of his security deposit the Architect/ Consultant shall have the power to adopt any of the following course as they may deem best suited to the interest of the SBI.
a) To rescind the contract (of which rescission notice in writing to the contractor by the Architect/ Consultant shall be conclusive evidence) and in which case the security deposit of the contractor shall be forfeited and be absolutely at the disposal of SBI. b) To employ labour paid by the SBI and to supply materials to carry out the work, or any part of the work, debiting the contractor with the cost of the labour and materials (the cost of such labour and materials as worked out by the Architect/ Consultant shall be final and conclusive against the contractor) and crediting him with the value of work done, in all respects in the same manner and at the same manner and at the same rates as if it had been carried out by the contractor under the terms of this contract the certificate of Architect/ Consultant as to the value of work done shall be final and conclusive against the contractor. c) To measure up the work of the contractor, and to take such part thereof as shall be executed, out of his hands, and to give it to another contractor to complete in which case any expenses which may be incurred in excess of the sum which would have been paid to the original contractor, if the whole work had been executed by him (of the amount of which excess the certificates in writing of the Architects/ Consultant shall be final and conclusive) shall be borne by original contractor and may be deducted from any money due to him by SBI under the contract or otherwise, or from his security deposit or the proceeds of sale thereof, or sufficient part thereof. In the event of any of above course being adopted by the SBI the contractor shall have no claim to compensation for any loss sustained by him by reasons of his having purchased or procured any material or entered into any engagements or make any advances on account of, or with a view to the execution of the work or the performance of the contract and in case the contract shall be rescinded under the provision aforesaid, the contractor shall not be entitled to recover or to be paid any sum or any work thereto for actually performed under this contract, unless, and until the Architect/Consultant will have certified in writing the performance of such work and the value payable in respect thereof, and he shall only be entitled to be paid the value so certified.

34.0 Owner’s Right to terminate the contract If the contractor being an individual or a firm commit any ‘Act of Insolvency’ or shall be adjusted an insolvent or being an incorporated company shall have an order for compulsory winding up voluntarily or subject to the supervision of Government and of the Official Assignee of the liquidator in such acts of insolvency or winding up shall be unable within seven days after notice to him to do so to show to the reasonable satisfaction of the Architect / Consultant that he is able to carry out and fulfil the contract, and to give security therefore if so required by the Architect / Consultant.
Or if the contractor (whether an individual firm or incorporated Company) shall suffer execution to be issued or shall suffer any payment under this contract to be attached by or on behalf of any of the creditors of the contractor.
Or shall assign or sublet this contract without the consent in writing of the SBI through the Architect / Consultant or shall charge or encumber this contract or any payment due to which may become due to the contractor there under.
a)Has abandoned the contract; or
b)Has failed to commence the works, or has without any lawful excuse under these conditions suspended the progress of the works for 14 days after receiving from the SBI through the Architect / Consultant written notice to proceed, or c)Has failed to proceed with the works with such diligence and failed to make such due progress as would enable the works to be completed with the time agreed upon, or has failed to remove the materials from the site or to pull down and replace work within seven days after written notice from the SBI through the Architect / Consultant that the said materials were condemned and rejected by the Architect/ Consultant under these conditions; or has neglected or failed persistently to observe and perform all or any of the acts, matters or things by this contract to be observed and performed by the contractor for seven days after written notice shall have been given to the contractor to observe or perform the same or has to the detriment of good workmanship or in defiance of the SBI’s or Architect’s/ Consultant’s instructions to the contrary subject any part of the contract. Then and in any of said cases the SBI and or the Architect/ Consultant, may not withstanding any previous waiver, after giving seven days’ notice in writing to the contractor, determine the contract, but without thereby affecting the powers of the SBI or the Architect/ Consultant or the obligation and liabilities of the contractor the whole of which shall continue in force as fully as if the contract had not been so determined and as if the works subsequently had been executed by or on behalf of the contractor. And, further the SBI through the Architect/Consultant, their agents or employees may enter upon and take possession of the work and all plants, tools, scaffoldings, materials, sheds, machineries lying upon the premises or on the adjoining lands or roads, use the same by means of their own employees or workmen in carrying on and completing the work or by engaging any other contractors or persons to complete the work and the contractor shall not in any way was interrupt or do any act, matter or thing to prevent or hinder such other contractor or other persons employed for completing and finishing or using the materials and plant for the works.

When the works shall be completed or as soon thereafter as convenient the SBI or the Architect/ Consultant shall give a notice in writing to the contractor to remove his surplus materials and plants and should the contractor fail to do so within 14 days after receipt thereof by him the SBI sell the same by public auction after due publication and shall adjust the amount realized by such auction. The contractor shall have no right to question any of the act of the SBI incidental to the sale of the materials etc.
35.0 Certificate of Payment The contractor shall be entitled under the certificate to be issue by the Architect / Consultant to the contractor within 10 working days from the date of certificate to the payment from SBI from time to time. The SBI shall recover the statutory recoveries and other dues including the retention amount from the certificate of payment.
Provided always that the issue of any certificate by the Architect/ Consultant during the progress of works or completion shall not have effect as certificate of satisfaction or relieve the contractor from his liability under clause.
The Architect/ Consultant shall have power to withhold the certificate if the work or any part thereof is not carried out to their satisfaction.
The Architect/ Consultant may be any certificate make any corrections required in previous certificate. The SBI shall modify the certificate of payment as issued by the Architect/ Consultant from time to time while making the payment.
The contractor shall submit interim bills only after taking actual measurements and properly recorded in the Measurement book (M.B)
The contractor shall not submit interim bills when the approximate value of work done by him is less than Rs………. And the minimum interval between two such bills shall be one month.
The final bill may be submitted by the contractor within a period of one month from the date of virtual completion and Architect / Consultant shall issue the certificate of payment within a period of two months. The SBI shall pay the amount within a period of three months from the date of issue of certificate provided there is no dispute in respect of rates and quantities.
The contractor shall submit the interim bills in the prescribed format with all details.
36.0 Settlement of Disputes and Arbitration Except where otherwise provided in the contract all questions and disputes relating to the meaning of the specifications, design, drawings and instructions herein before mentioned and as to the quality of workmanship or materials used on the work or as to any other question, claim, right, matter or thing whatsoever in any way arising out of or relating to the contract, designs, drawings, specifications, estimates, instructions, orders or these conditions or otherwise concerning the work or the execution or failure to execute the same whether arising during the progress of the work or after

the cancellation, termination, completion or abandonment thereof shall be dealt with as mentioned hereinafter.
i)if the contractor considers that he is entitled to any extra payment or compensation in respect of the works over and above the amounts admitted as payable by the Architect or in case the contractor wants to dispute the validity of any deductions or recoveries made or proposed to be made from the contract or raise any dispute, the Contractor shall forthwith give notice in writing of his claim, or dispute to the Assistant General Manager (Premises & Estate) / Dy. General Manager (Premises) and endorse a copy of the same to the Architect, within 30 days from the date of disallowance thereof or the date of deduction or recovery. The said notice shall give full particulars of the claim, grounds on which it is based and detailed calculations of the amount claimed and the contractor shall not be entitled to raise any claim nor shall the Bank be in any way liable in respect of any claim by the contractor unless notice of such claim shall have been given by the contractor to the Assistant General Manager (Premises & Estate) / Dy. General Manager (Premises) in the manner and within the time as aforesaid. The contractor shall be deemed to have waived and extinguished all his rights in respect of any claim not notified to the Assistant General Manager (Premises & Estate) / Dy. General Manager (Premises) in writing in the manner and within the time aforesaid. ii) The Assistant General Manager (Premises & Estate)/ Dy. General Manager (Premises) shall give his decision in writing on the claims notified by the contractor. The contractor may within 30 days of the receipt of the decision of the Assistant General Manager (Premises & Estate)/Dy. General Manager (Premises) submit his claims to the conciliating authority namely the Circle Development Officer/General Manager (Corporate Services) for conciliation along with all details and copies of correspondence exchanged between him and the Assistant General Manager (Premises & Estate) / Dy. General manager (Premises) iii) If the conciliation proceedings are terminated without settlement of the disputes, the contactor shall within a period of 30 days of termination thereof shall give a notice to the concerned Chief General Manager/Dy. Managing Director & Corporate Development Officer of the Bank for appointment of an arbitrator to adjudicate the notified claims failing which the claims of the contractor shall be deemed to have been considered absolutely barred and waived. iv) Except where the decision has become final, binding and conclusive in terms of the contract, all disputes or differences arising out of the notified claims of the contractor as aforesaid and all claims of the Bank shall be referred for adjudication through arbitration by the Sole Arbitrator appointed by the Chief General Manager/ Dy. Managing Director & Corporate Development Officer. It will also be no objection to any such appointment that the Arbitrator so appointed is a Bank Officer and that he has to deal with the matters to which the Contract relates in the course of his duties as Bank Officer. If the arbitrator so appointed is unable or unwilling to act or resigns his appointment or vacates his office due to any reason whatsoever another sole arbitrator shall be appointed in the manner aforesaid by the said Chief General Manager / Dy. Managing Director & Corporate Development Officer. Such person shall be entitled to proceed with the reference from the stage at which it was left by his predecessor.
It is a term of this contract that the party invoking arbitration shall give a list of disputes with amounts claimed in respect of each dispute along with the notice for appointment of arbitrator.

It is also a term of this contract that no person other than a person appointed by such Chief General Manager aforesaid should act as arbitrator.
The conciliation and arbitration shall be conducted in accordance with the provisions of the Arbitration & Conciliation Act 1996 or any statutory modification or re- enactment thereof and the rules made there under.
It is also a term of the contract that if any fees are payable to the arbitrator these shall be paid equally by both the parties. However, no fees will be payable to the arbitrator if he is a Bank Officer.
It is also a term of the contract that the arbitrator shall be deemed to have entered on the reference on the date he issues notice to both the parties calling them to submit their statement of claims and counter statement of claims. The venue of the arbitration shall be such place as may be fixed by the arbitrator in his sole discretion. The fees if any, of the arbitrator shall, if required to be paid before the award is made and published, be paid half and half by each of the parties. The cost of the reference and of the award (including the fees, if any of the arbitrator) shall be in the discretion of the arbitrator who may direct to any by whom and in what manner, such costs or any apart thereof shall be paid and fixed or settle the amount of costs to be so paid.
37.0 Water Supply The contractor shall make his own arrangements for water required for the work and nothing extra will be paid for the same. This will be subject to the following conditions: i) That the water used by the Contractor shall be fit for construction purpose to the satisfaction of the Architect/ Consultant. ii) The Contractor shall make alternative arrangements for the supply of water if the arrangements made by the Contractor for procurement of water in the opinion of the Architect / Contractor is unsatisfactory.
37.1 The contractor shall construct temporary well/ tube well in SBI land for taking water for construction purposes only after obtaining permission in writing from the SBI. The Contractor has to make his own arrangements for drawing and distributing the water at his own cost. He has to make necessary arrangements. To avoid any accidents or damages caused due to construction and subsequent maintenance of the wells. He has to obtain necessary approvals from the local authorities, if required at his own cost. He shall restore the ground to its original condition after wells are dismantled on completion of work or hand over the well to the SBI without any compensation as directed by the Architect / Consultant.
38.0 Power Supply The contractor shall make his own arrangements for power and supply / distribution system for driving plant or machinery for the work and for lighting purpose at his own cost. The cost of running and maintenance of the plants are to be included in his tender prices. He shall pay all fees and charges required for the power supply and include the same in his tendered rates and hold the owner free from all such costs. He has to obtain necessary approvals from the appropriate authorities, if required.

39.0 Treasure Trove etc. Any treasure trove, coin or object antique which may be found on the site shall be the property of SBI and shall be handed over to the Bank immediately.
40.0 Method of Measurement Unless otherwise mentioned in the schedule of quantities or in mode of measurement, the measurement will be on the net quantities of work produced in accordance with up to date. Rules laid down by the Bureau of Indian Standards. In the event any dispute/ disagreement the decision of the Architect / Consultant shall be final and binding on the contractor.
41.0 Maintenance of Register The contractor shall maintain the following register as per the enclosed format at site of work and should produce the same for inspection of SBI / Architect / Consultant whenever desired by them. The contractor shall also maintain the records/ register as required by the local authorities /Government from time to time. i) Register for secure advance ii) Register for hindrance to work iii) Register for running account bill iv) Register for labour
43.1 FORCE MAJEURE 43.1 Neither contractor nor SBI shall be considered in default in performance of their obligation if such performance is prevented or delayed by events such as war, hostilities revolution, riots, civil commotion, strikes, lockout, conflagrations, epidemics, accidents, fire, storms, floods, droughts, earthquakes or ordinance or any act of god or for any other cause beyond the reasonable control of the party effected or prevented or delayed. However, a notice is required to be given within 30 days from the happening of the event with complete details, to the other party to the contract, if it is not possible to serve a notice, within the shortest possible period without delay.
43.2 As soon as the cause of force majeure has been removed the party whose ability to perform its obligations has been affected, shall notify the other of such cessation and the actual delay incurred in such affected activity adducing necessary evidence in support thereof.
43.3 From the date of occurrence of a case of force majeure obligations of the party affected shall be suspended during the continuance of any inability so caused. With the cause itself and inability resulting there from having been removed, the agreed time of completion of the respective obligations under this agreement shall stand extended by a period equal to the period of delay occasioned by such events.
43.4 Should one or both parties be prevented from fulfilling the contractual obligations by a state of force majeure lasting to a period of 6 months or more the two parties shall mutually decide regarding the future execution of this agreement.

44.0 Local Laws, Acts, Regulations The contractor shall strictly adhere to all prevailing labour laws inclusive of contract labour (regulation and abolition act of 1970) and other safety regulations. The contractor shall comply with the provision of all labour legislation including the latest requirements of all the Act, laws, any other regulations that are applicable to the execution of the project. i) Minimum Wages Act, 1948 (Amended) ii) Payment of Wages Act 1936 (Amended) iii) Workmen’s Compensation Act 1923 (Amended) iv) Contract Labour Regulation and Abolition Act 1970 and Central Rules 1971 (Amended) v) Apprentice Act 1961 (Amended) vi) Industrial Employment (Standing Order) Act 1946 (Amended) vii) Personal injuries (Compensation Insurance) Act 1963 and any other modifications. viii) Employees’ Provident Fund and Miscellaneous Provisions Act 1952 and amendment thereof. ix) Shop and Establishment Act. x) Any other Act or enactment relating thereto and rules framed there under from time to time.
45.0 SAFETY CODE: 1. All personnel at site should be provided with Helmets and Safety Boots with some Identification Mark. Visitors also should be provided with Helmets. It should be ensured that these are used properly. 2. First Aid Box should be kept at site with all requisite materials. 3. No one should be allowed inspect/ work at a height without Safety Belt. 4. Suitable scaffolds should be provided for workmen for all works that cannot be done safely be done from the ground, or from solid construction except such short period work as can be done safely from ladders. When a ladder is used and extra Mazdoor shall be engaged for holding the ladder and if the ladder is used for carrying materials as well as suitable foothold and handhold shall be provided on the ladder the shall be given an inclination not steeper that ¼ to 1(1/4 horizontal and 1 vertical).
5 .Scaffolding or staging more than 3.5m above the ground or floors, swung or suspended from an overhead support or erected with a stationary support shall have a guard rail properly attached, bolted, braced and otherwise secured, at least 1 mtr. Above the floor or platform of such scaffolding or staging and extending along the entire length of the outside and ends thereof with only such openings as may be necessary for the delivery of materials. Such scaffolding or staging shall be so fastened as to prevent it from swaying from the building or structure.
6. Working platforms, gangways and stairways shall be so constructed that they do not sag unduly or unequally and if the height of the platform, gangway or stairway is more than 3-5 Meters above ground level or floor level, they shall be closely boarded and shall have adequate width and should be suitably fenced, as described.

7. Every opening in the floor of a building or in a working platform be provided with suitable means to prevent the fall of persons or materials by providing suitable fencing or railing whose minimum height shall be 1 Meter.
8. Safe means of access shall be provided to all working platforms and other working places. Every ladder shall be securely fixed. No portable single ladder shall be over 9 Meters in length while the width between side rails in rung ladder shall in no case, be less than 30cms for ladder up to and including Meters in length. For longer ladders this width should be increases at least 6mm for each additional 30cms. Uniform steps spacing shall not exceed 30 Cms.
9. Adequate precautions shall be taken to prevent danger from electrical equipment. For Electrical on line works gloves, rubber mats or rubber shoes shall be used.
10. All trenches, 1.2 Meters or more in depth shall at all times be supplied with at least one ladder each 30 Meters length or fraction thereof. The ladder shall be extended from bottom of the trench to at least 1 Meter above the surface of the ground. The sides of the trenches, which are 1.5 Meters or more in depth shall be stepped back to give suitable slope, or securely held by timber bracing, so as to avoid the danger of sides collapsing. The excavated materials shall not be placed within 1.5 Meters of the edges of the trench or half of the depth of the trench whichever is more cuttings shall be done from the top to bottom. Under no circumstances undermining or under cutting shall be done.
11. Before any demolitions work is commenced and also during the process of the work: a) All roads, open areas adjacent to the work site shall either shall be clo sed or suitably protected.
b) No electric cable or apparatus which is liable to be a source of danger over a cable or apparatus used by the operator shall remain electrically charged.
c) All practical steps shall be taken to prevent danger to persons employed from the risk of fire or explosion or flooding. No floor, roof or other part of the building shall be so overloaded with debris or materials as to render it unsafe.
d) All necessary personal safety equipment as considered adequate by the Site Engineer should be kept available for the use of the person employed on the site and maintain in a condition suitable for immediate use; and the Contractor should take adequate steps to ensure proper use of equipment by those concerned.
e) Workers employed on mixing asphaltic materials, Cement and line mortars shall be provided with protective footwear and protective goggles.
f) Those engaged in white washing and mixing or stacking of cement Bags or any materials shall be provided with protective goggles.
g) Those engaged in welding works shall be provided with welder’s protective eyes-shields.

h) Stone breakers shall be provided with protective goggles and protective clothing and seated at sufficiently safe intervals.
i) When workers are employed in sewers and manholes, which are in use, the contractor shall ensure that the manhole covers are opened and are ventilated at least for an hour before the workers are allowed to get into manholes so opened shall be cordoned off with suitable railing and provided with warning signals and boards to prevent accident to the public.
12) Use of hoisting machines and tackle including their attachments, anchorages and supports shall conform to the following standards or conditions:
a) These shall be of good mechanical constructions sound material and adequate strength and free from patent defect and shall be kept in good repair and in good working order.
b) Every rope used in hoisting or lowering materials or as means of suspensions shall be of durable quality and adequate strength and free from patent defects.
c) Every crane driver or hoisting appliance operator shall be properly qualified and no person under the age of 21 years should be in charge of any hoisting machine including any scaffold, which or give signals to operators. d) In case of every hoisting machine and of every chain ring hook, shackle working load shall be ascertained by adequate means.
e) Shovel and pulley block used in hoisting or as means of suspension the safe hoisting machine and all gear referred to above shall be plainly marked with the safe working load. In case of a hoisting machine having a variable safe working load, each safe working load and the conditions under which it is applicable shall be clearly indicated. No part of any machine or any gear referred to above in this paragraph shall be loaded beyond the safe working load except for the purpose of testing.
f) Motors, gearing, transmission, electric wiring and other dangerous parts of hoisting appliances should be provided with efficient safeguards, hoisting appliances should be provided with such means as will reduce to the minimum the risk of accidental descent of the load, adequate precaution should be taken to reduce to the minimum the risk of any part of the suspended load becoming accidentally displaced.
g) When workers are employed on electrical installations, which are already energized, insulating mats, wearing apparel, such as gloves, sleeves and boots as may be necessary, should be provided. The workers should not wear any rings, watches and carry keys or other materials, which are good conductors of electricity.

13. All scaffolds, ladders and other safety devices mentioned or described herein shall be maintained in safe condition and no scaffold, ladder or equipment shall be altered or removed while it is in use. Adequate washing facilities should be provided at or near places of work.
46.0 Accidents The contractor shall immediately on occurrence of any accident at or about the site or in connection with the execution of the work report such accident to the Architect/ Consultant. The contractor shall also report immediately to the competent Authority whenever such report is required to be lodged by the law and take appropriate actions thereof.
47. NON-AVAILABILITY OF ANY MATERIAL: If for some reasons, the materials mentioned in the Approved Brand of Manufacturer’s or the Bill of Quantities are not available, the same shall be brought to the notice of the Employer/Consultant in writing by the Contractor. No alternative material shall be used without Employer’s and Consultant written approval.

SECTION V SPECIAL CONDITION OF CONTRACT
01. INSPECTION OF DRAWINGS: Before filing in the tender, the tenderer will have to check up all Drawings and Schedules of quantities and will have to get an immediate clarification from the Consultant on any point that he feels is vague or uncertain. No claim for damages or compensation will be entertained on this account.
02. EXECUTION OF WORK: The whole of the work as described in the Contract (including the schedule of quantities the specifications and all drawing pertaining hereto) and as advised by the Consultant from time to time is to be carried out and completed in all its parts to the entire satisfaction of the Employer/Consultant. Any minor details of work which are obviously and fairly attended, or which may not have been definitely referred to in this contract, but which are usual in sound construction practice and essential to the work, are to be included in that contract. Rates quoted in the Schedules shall be inclusive of all freights, taxes, duties such as Octroi, Sales Tax, Work Contract Tax, Excise Duty, Royalties etc., as well as transportation to as to execute the contract as per the rules and regulations of Local Bodies. State Government and the Government of India and to the full intent of tender document.
Following shall be deemed to be provided for in the quoted rates.
02a Labour, maintenance, flying, carrying, cleaning, making good, hauling, wastage etc.
02b Plant, double scaffolding frame work, English ladders, ropes, nails, spikes, tools, material and workmanlike-protection from weather, shuttering, temporary supports, plant for and the maintenance of the same.
02c Covering for the walling and other works during inclement weather or strikes or whenever directed as necessary.
02d All temporary canvas, lights, tarpaulin, barricades, water sheets etc.
02e All stairs and steps thresholds and any other requisite protection of the works.
02f All such temporary weather-proof sheds at such places and in a manner approved by the Consultant for the storage and protection of materials against the effects of Sun or Rain.
02g All such temporary fences guards’ approaches and roads say be necessary for execution of the contract works and for safeguarding the public.
02h The necessary scaffolding, labour and removal of the same after the completion of the work. The Consultant will be sole judge in deciding as to the suitability of the tools and plant that say be brought at the works by the Contractors for the proper execution of the work.

The rates quoted by the tenderer in the schedule of probable quantities will be deemed to be for the finished work inclusive of the list of providing the above items
03. SCHEDULE OF QUANTITIES – NO CLAIM BECAUSE ACTUAL QUANTITIES DIFFER FROM PRELIMINARY STATEMENT: A schedule of probable quantities in respect of work and specifications accompany these conditions. The schedule of probable quantities is liable to alterations by omission, deductions or additions at the discretion of the Consultant / Employer.
The quantities of the various kind of work to be done and materials to be furnished under this Contract which have been estimated and are set forth in the proposal of the Agreement or the list or Contract prices, are the best available but may not be accurate in any of all particulars and are only, for the purpose of comparing on a uniform basis the bids offered for the work under this Contract. The Contractor agrees that neither the Employer nor the Consultant nor any of the employees or agents hereof shall be held responsible if any of the said estimated quantities shall be found to be not even approximately correct in the execution of the work and that he will not at any time dispute or complain of such statement nor assert that there was any misunderstanding in regard to the characters, size and type of work to be done or the kind or amount of the materials to be furnished or work to be done. Further, the Contractor shall make no claim for anticipated profits, for loss of profits or for damages because no work is ordered under certain items or because of a differences between the quantities of the various kinds of work to be done or materials actually delivered and the estimated quantities set forth by the Employer or the Consultant.
04. ACCESS FOR INSPECTION: The Contractor is to provide at all times during the progress of the works and the maintenance period proper means of access, ladders, gang ways etc., and the necessary attendants to move and adapt the same as directed for the inspection or measurement of the works by the Consultant/Employer or their representatives.
05. DIMENSION: Figured dimensions are in all cases to be followed and no case should they be scaled? Large scale details kike precedence over small scale drawings. In case of discrepancy the Contractor is to ask for an explanation before proceeding with the work.
06. PROGRAMME OF WORK: The Bidder shall, along with his bid, submit completion of work, either in the form of CPM Net Work or in the form of a bar chart, showing how he proposes to complete the works. This programme shall be prepared in sufficient detail and shall – indicate, among other things, the following details on month-to-month basis (for each month) or week to week.
06a Quantum of work under each major item of work that should be carried out.
06b Amount of resources that would be deployed e.g. skilled/unskilled labour carpenter’s equipment etc.
06c Schedule of delivery of materials to site.

06d Approximate value of work contemplated to be completed each month/week.
06d Schedule and manner in which detail is or material (to be issued by the – Employer) are required from the Consultant/Employer.
06e Time period allowed for other agencies work.
06f Various milestones to be achieved.
This program, suitably amended after discussions with the Consultant/Employer, shall become binding on the, Contractor. However during the execution of project, should it become necessary in the opinion of the Consultant / Employer to reschedule some of the activities the Contractor shall do so at no extra cost and/or without any other claim.
Acceptance of bidder’s tender does not necessarily, imply acceptance of the schedule submitted and the Consultant/Employer reserves to himself the right to modify/amend this schedule to suit the overall project schedule and the Contractor shall adhere to these revisions/modifications at no extra cost to the Employer.
Open space for storage could be provided by the Employer. The Contractor has to make arrangements for enclosing open space for providing safety Arrangements.
07. WORK ON HOLIDAY / WEEK DAYS: Major work is required to be carried out after office hours and holidays without disturbing the departments/occupants in the building / floor and during office hours on working days may be permitted provided care is taken by the Contractor for not causing any disturbance to the working staff.
08. ACTION WHERE THERE IS NO SPECIFICATION: In the case of any class of work over which there is no specification mentioned, the same shall be carried out in accordance with the Indian Standard Specifications subject to the approval of the Consultant and clients.
09. REPORTING OF ACCIDENT TO LABOUR: Contractor shall be responsible for the safety of persons employed by him on the works and shall report accidents to any of them, however and wherever occurring on the works, to the Consultant / Employer. The Contractor shall make every arrangement to render all possible service to such workman. This shall be without prejudice to the responsibility of the Contractor to under the Insurance Clause of the General Condition.
10. CLEARING THE SITE OF WORKS: The Contractor shall clear the site of works as per the instructions of the Consultant. The site of works shall be cleared of all men, materials, sheds, etc., belonging to the Contractor. The site shall be delivered in a clean and neat condition as required by the Consultant within a period of one week after the job is completed. In case of failure by the Contractor, the Employer under advice to the Consultant will have the right to get the site cleared at the risk and cost of the Contractor to the satisfaction of the Consultant.

11. OCCUPATION OF PARTIALLY COMPLETED BUILDING BY THE EMPLOYER: The Employer shall be entitled to and at liberty to occupy even the partially completed premises or any portion thereof by themselves or through their agents and servants if they so desire in which even. Necessary extension of time & on this account for completing the work shall however, be granted to the Contractor, but he shall have no claim for any compensation whatsoever due to the delay involved in completing the work.
12. PREPARATION OF BUILDING FOR OCCUPATION AND USE ON COMPLETION: On completion of the work, the Contractor shall inform the Consultant in writing that he has finished the work and it is ready for the Consultants inspection. The Contractor/Employer shall clean all windows and doors including the cleaning and oiling if necessary of all hardware, inside and outside, all floors, staircase and every part of the building. He will leave the entire building neat and clean and ready for occupation and to the satisfaction of the Consultant.
13. WAGES OF LABOUR EMPLOYED BY THE CONTRACTOR: The Contractor shall pay all labour employed by him at rates fixed by his at the commencement of the Contract as per the Labour Laws. Wages as applicable for the construction work as per norms stipulated by the Bombay Metro Corporation shall be followed by the Contractor. No variation of such statutory laws & rules shall be permissible. This will also include the minimum & maximum allowable wages for various categories of labour to be employed by the Contractor
All wages shall be paid in full and without any deductions whatsoever at the approved rates and for the full time actually worked during the wage period. The Engineer or such other office of the Employer maybe authorized in that behalf and shall have power to exercise supervision over the labour employed by the Contractor and or such purpose any of these officers may inspect the wage books, muster books and other labour records of the Contractor. In the event of the report of the inspecting officer showing that the proper rates of wages are not being paid, or that in any manner whatsoever the dealings between the Contractor and his labour are not satisfied, the Engineer shall pass such order upon the report as he considers desirable, and those orders shall be final and binding upon the contractor. The Contractor shall indemnify & keep indemnified the Consultant against any claim arising from failure of the Contractor to comply with such labour laws.
14. EXTRA ITEMS / DEVIATIONS: The Contractor shall not commence work in respect of any extra items/deviations without obtaining the approval of the Consultant/Employer in writing. The Contractor shall immediately submit the rate analysis for such items, with necessary details to support the rate quoted. The rate shall then be settled by the Consultant and necessary certificate based on this shall be given to the Employer while incorporating the item in the Interim Bills. Claim for extra / deviated items shall be submitted in the yellow/pink proforma respectively (as per specimen copies of proforma included in the tender document), which indicate authority / order for such items.

15. INSURANCE POLICIES: The Contractor shall not commence any work at site, until all the Insurance Policies, as required in terms of the General Conditions of Contract, have been submitted to the Employer. Renewal of the same if required due to extension of time of the completion or similar reasons is also the responsibility of the Contractor.
Notwithstanding anything to the contrary mentioned in the contract, Contractors have to submit all Insurance policies in original to the Client directly to sake the Client satisfy themselves regarding adequacy of the value of Insurance, validity etc. as per contractual clauses and furnish a copy to the Consultant. The Contractor shall arrange for renewals on their own, any omission to do so or delay in non-receipt of such information will be no excuse for failure to renew them or keep thee in force without a break.
16. INDEBTEDNESS AND LIENS: The Contractor agrees to furnish the Employer from time to time during the progress of the work as requested, verified statements showing the Contractors total outstanding indebtedness in connection with the work covered by the contract. Before final payment is made the Employer may require the Contractor to furnish the Employer with satisfactory proof that there are no outstanding debts or liens in connection with the contract. If during the progress of the work, the Contractor shall allow any indebtedness to accrue to sub-contractors or others and shall fail to pay or discharge same within five (5) days after demand then the Employer may withhold any money due to the Contractor until such debt is paid, or apply the same towards the discharge thereof.
17. INDEPENDENT CONTRACTOR: The Contractor agrees to perform this contract as an independent Contractor and not as a sub-contractor, agent or employee of the Employer.
18. WORK PERFORMED AT CONTRACTORS RISK: The Contractor shall take all precautions necessary and shall be responsible for the safety of the work and shall maintain all lights, guards, signs, temporary passages or other protection necessary for the purpose. All work shall be done at the contractors risk and if any loss or damage shall result from fire or from other cause, the Contractor shall promptly repair or replace such loss or damage free from all expenses to the Employer. The Contractor shall be responsible for any loss or damage to materials, tools or other articles used or held for use in connection with the work. The work shall be carried on and completed without damage to any work or property of the Employer or of others and without interference with the operation of existing machinery or equipment’s, if any.
During the contract period, the Contractor shall appoint at the site a Senior Engineer to the satisfaction of the Consultant and shall continue in such appointment for three months after the grant of the “Virtual Completion Certificate” to him. The Consultant shall be entitled to approve or disapprove without assigning reasons the appointment of such Engineer proposed by the Contractor. This condition shall be reckoned as being the essence of the contract and its breach shall make the contract revocable at the option of the Employer.

The Engineer so appointed shall coordinate the execution of work by Contractors of other trades in general and shall perform the following function in particular:
18.1 The Senior Engineer, in-charge of co-ordination shall be responsible for providing all the necessary support, required to be given by the Interior Contractor by virtue of the contract, to the various services Contractors for the purpose of commissioning the testing of their respective services.
18.2 The Senior Engineer shall have adequate knowledge about the various services involved in the job to appreciate the importance of various interface activities to be performed by the main Interior Contractor in the desired sequence so as to hold up the work of the services Contractors as regards commissioning and testing of their respective services.
18.3 The Senior Engineer should have preferably past experience of shouldering similar responsibilities to appreciate the importance of this final critical phase of the project where utmost co-ordination is required for cutting down the delays in successful commissioning of the entire facility.
19. CONSTRUCTION DRAWINGS: The successful tenderer shall state on receiving the letter of intent, what drawings are yet to be issued by the Consultant for execution purposes and what further details are required by him from the Consultants. Silence on the part of the successful tenderer in this regard will be construed to mean that he has all the information that he needs for ordering out materials and for contractual purposes. Unless specifically asked for in writing, delays later claimed by the successful tenderer on account of drawings will not be construed as reasons for delay the execution of work.
Apart from clarifications sought during the periodic visits to site by the Consultants representatives, the successful tenderer shall obtain all clarifications and the Consultants drawings from their offices in Mumbai.
Extra / variation not registered within 3 weeks on receipt of drawings will not be entertained.
20. COMPLETION DRAWINGS / ACCEPTANCE OF INSTALLATION: The Contractor shall furnish 3 sets of drawings ‘as erected’ and approved by different statutory authorities in accepting the work in its entirety and completion.
The Contractor shall submit the written acceptance of the installation by the different statutory authorities in respect of the different components of the installation and commission the system in the presence of the Consultant and Employer’s representative before asking for the Virtual Completion Certificate.
21. KEEPING THE AREAS AND ACCESS ROAD CLEAN: The Contractor shall be required to maintain the site all the building areas in a neat and clean condition at all times to the satisfaction of the Consultant. The Contractor shall also be required to maintain all access roads to the sit and within the site and keep, them free from all obstructions, material dropping etc. to the satisfaction of Consultant and local authorities.

22. TYPOGRAPHICAL OR CLERICAL ERRORS: The Consultant’s clarifications regarding partially omitted particulars or typographical or clerical errors shall be final and binding on the Contractor.
23. INFORMATION TO BE SUPPLIED BY THE CONTRACTORS: The Contractor shall furnish the Employer the following:
23a Detailed Industrial statistics regarding the labour, employed by his etc.
23b The Power of Attorney, name and signature of his authorized representative who will be in charge for the execution of the work.
23c A list of technically qualified persons employed by his for the execution of the work.
23d The total quantity and quality of materials used the work.
24. TESTING OF WORKS, MATERIALS & PREPARATION OF SAMPLES: The Contractor shall arrange to test materials and / or portions of the works as instructed by the Consultant / Employer wherever possible to ISI standards at his own cost in order to prove their soundness and efficiency. If after any such test, the work or portions of the works are found to be detective or unsound the Contractor shall pull down and re-erect the same at his own cost. Samples of various materials shall be submitted by the Contractor for approval prior to ordering out the same, wherever necessary the Contractor shall at his own cost, prepare samples to indicate the workmanship.
25. COVERING UP OF WORKS: The Contractor shall cover up and protect the works from the weather and from wear and tear as directed by Consultant /Employer and shall suspend all wet operations during weather which in the opinion of Consultant, will be detrimental to the works.
26. NOTICES: The Contractor shall give all notices and pay all fees charges royalties, which may be levied/ leviable to any authority and shall comply with all Acts and Regulations for the successful completion of the Contract Works.
27. MUNICIPAL REGULATION: The whole of the work including sanitation is to comply with the requirements and byelaws of the concerned Municipal Corporation, local bodies & Chief Fire Officer.
28. MEASUREMENT TO BE RECORDED BEFORE WORK IS COVERED UP: The Contractor shall take joint measurement with the Consultant’s representative before covering up or otherwise placing beyond the reach of measurement any item of work. Should the Contractor neglect to do so, the same shall be uncovered at the Contractors expenses or in default thereof, no payment or allowance shall be made for such work or the materials with which the same was executed.
29. WORK AT NIGHT: If the Contractor is required to work at night in order to complete the work within the ‘Time Schedule’, the Contractor shall provide and maintain at his own cost sufficient lights to enable the work to proceed satisfactorily without danger. Approaches to the

site also shall be sufficiently lighted by the Contractor. No extra payment will be made for night. Prior intimation of approval should also be taken from the Consultant.
30. ISSUE OF EXTRA CONSTRUCTION DRAWING: Architects will supply six sets of drawings to the Clients for construction. Extra prints of drawings for construction will be issued on chargeable basis by Architect/Structural Consultant as detailed hereunder:
A0-Size Rs.150/- each to Rs.200/- each depending on size of drawing. A1-Size Rs.125/- each A2-Size Rs.100/- each A3-Size Rs.75/- each A4-Size Rs.50/- each
The Contractor shall ensure that all the bills furnished from the Architect’s Office in this regard are hachured, failing which the certificate for payment of Contractor’s next Interim Bill will be withhold. The drawings are to be used for the project concerned.
31. DISPLAY OF NOTICES: Except where otherwise provided in the contract all questions and disputes relating to the meaning of the specifications, design, drawings and instructions herein before mentioned and as to the quality of workmanship or materials used on the work or as to any other question, claim, right, matter or thing whatsoever in any way arising out of or relating to the contract, design, drawings, specifications, estimates, instructions orders or these conditions or otherwise concerning the work or the execution or failure to execute the same whether arising during the progress of the work or after the cancellation, termination, completion or abandonment thereof shall be dealt with as mentioned hereinafter.
31a If the Contractor considers that he is entitled to any extra payment or compensation in respect of the works over and above the amounts admitted as payable by the Architect or in case the Contractor wants to dispute the validity of any deductions or recoveries made or proposed to be made from the contract or raise any dispute, the Contractor shall forthwith give notice in writing of his claim or dispute to the Assistant General Manager (Premises & Estate) in writing in the manner and within the time aforesaid.
31b Assistant General Manager (Premises & Estate e) shall give his decision in writing on the claims notified by the Contractor. The Contractor may within 30 days of the receipt of the decision of the Assistant General Manager (Premises & Estate) submit his claims to the conciliating authority along with all details and copies of correspondence exchanged between him and the Assistant General Manager (Premises & Estate ).
If the conciliation proceeding are terminated without settlement of the disputes, the Contractor shall, within a period of 30 days of termination thereof shall give a notice to the Deputy General Manager & Circle Development Officer of the Bank for appointment of an arbitrator to adjudicate the notified claims failing, which the claims of the Contractor shall be deemed to have been considered absolutely barred and waived. Except where the decision has become final, binding and conclusive in terms

of the contract, all disputes or differences arising out of the notified claims of the Contractor as aforesaid and all claims of the Bank shall be referred for adjudication through arbitration by the sole arbitrator appointed by the Assistant General Manager (P&E). It will also be no objection to any such appointment that the Arbitrator so appointed is a Bank Officer and that he had to deal with the matters to which the contract relates in the course of his duties as Bank Officer. If the Arbitrator so appointed is unable or unwilling to act or resigns his appointment or vacates his office due to any reason whatsoever another sole Arbitrator shall be appointed in the manner aforesaid by the said Assistant General Manager (P&E). Such person shall be entitled to proceed with the reference from the stage at which it was left by his predecessor.
It is a term of this contract that the party invoking arbitration shall give list of disputes with amounts claimed in respect of each dispute along with the notice for appointment of arbitrator.
It is also a term of this contract that no person other than a person appointed by such Deputy General Manager & Circle Development Officer as aforesaid should act as arbitrator.
The conciliation and arbitration shall be conducted in accordance with the provisions of the Arbitration & Conciliation Act 1996 or any statutory modification or reenactment thereof and the rules made thereunder.
It is also a term of the contract that if any fees are payable to the arbitrator these shall be paid equally by both the parties. However, no fees will be payable to the arbitrator if he is a Bank Officer.
It is also a term of the contract that the arbitrator shall be deemed to have entered on the reference on the date he issues the notice to both the parties calling them to submit their statement of claims.
32. WORK TO BE CONTINUED DURING THE PENDENCY OF THE ARBITRATION: The Contractor shall continue with the construction work with due diligence and speed so as to complete the same within the period agreed upon, notwithstanding any dispute or different or question as referred to arbitration. The works shall not be delayed on account of any such reference made to the Arbitrators.
33. LIEN ON SUMS PAYABLE TO THE CONTRACTORS: Any sum of money due and payable to the Contractor including any deposits returnable to them under this contract may be withheld or retained by the Employer, against any claims of the Employer.
34. APPROVAL OF MOCK-UPS AND SAMPLES: It will be the Contractors responsibility to obtain written approval of mock-ups and samples from the Consultant and Employer. If this is not done, such items where these materials are used will be rejected by the Consultant / Employer.

35. APPROVAL OF FINAL FINISH IN CASE OF POLISHING AND PAINTING: In case of items for painting and polishing, normally primer and three coats should suffice. However, to achieve the final finish, to Employer’s/Consultants satisfaction, it may become necessary to have more than three coats. This will have to be done by the Contractor at no extra cost.
36. NON-AVAILABILITY OF SPECIFIED MATERIALS / ITEMS: In case of materials/items which are not available, the Contractor shall have to submit a letter from manufacturer to that effect. After proper verification, alternative material may be selected by the Employer / Consultant. In the case there will not be any increase of the quoted rates. However, if accepted alternative is cheaper the cost benefit is to be passes or to the Employer.
36.1 COST VARIATION IN MOCK-UPS Any cost variation upto 3% of quoted rates for all items of mock-ups except sofas and chairs and in case of sofas and chairs 7% of the quoted rates shall be absorbed by the Contractor & he will not claim such amount in case of alternation in design.
37. ADDRESS FOR SERVICE: All letters and notices under or pursuant to these presents shall be hand delivered against acknowledgement or sent by Registered Post with acknowledgement due at the respective addresses mentioned below. Any change in the addresses shall be duly intimated by the concerned party to all others.

SECTION VI
PREAMBLE TO SPECIAL CONDITIONS OF CONTRACT
GENERAL: The tenderer must obtain for himself on his responsibility in at his own expense all the information which may be necessary for that purpose of filling this tender and for entering into are contract for the execution of the same and must examine himself / themselves with all local condition and all the bye-laws and rules and regulation various authorities and matter pertaining thereto.
This is intended to be a performance based contract whereto the Contractor will be liable to execute the work on the basis of the plans and design offered by him or the plans and design hereby given and accepted by him. The Contractor will have to guarantee for the due and proper performance of the work agreed to be so erected and installed by him. The Contractor shall be paid his bills from time to time “on account” basis and the payments so made shall be adjusted against the money becoming due and payable to him at the agreed rates at the conclusion of the contract if the work erected and installed under the contract is found to be giving the due and proper performance.
TO SPECIAL CONDITION OF CONTRACT
01. The prices shall be firm for the duration of contract plus all authorized extensions of time plus three months period after completion of work. All rates will be including turnover tax, sales tax, works contract tax, VAT etc.
02. The Contractor is to furnish the basic of various materials likely to be used in the interior work so as to serve as guidelines for working out the rate analysis for extra/taxes, duties etc.
03. The Contractor is to quote for all sections of the Bills of Quantities. However, the Contractor will have to quote for all items including those where only rate is asked for a particular section. If all such items of & section are not quoted, the tender shall be treated as incomplete and is likely to be rejected.
04. Clients / Consultant reserve the right to ask the Contractor to prepare ‘Mock-up’ of any item for their approval before proceeding with the work.

METHOD OF MEASUREMENT

PREAMBLE TO BILL OF QUANTITIES
01. Quantities mentioned are approximate and payment shall be made on actual measurement.
02. The rate of partition, paneling shall include necessary additional frame work supports that may be required to suit site conditions or stability of the items. Decision of consultant regard to the need for such additional support shall be final.
03. All T.W. frame work sizes mentioned are out of “Ex”. Size with maximum planning tolerance as per standard IS code.
04. Rate of doors, shall include all hardware locks, floor, springs, door closures, special door handle etc. as specified in respective items.
05. Rate of partition paneling shall include making of necessary cutouts, chasing to be made for conduits, switch board etc. and provision of extra timber members if necessary.
06. Rate of pelmet, fascia’s and soffits shall include heavy duty aluminum certain channels and nylon runners and stoppers wherever required.
07. Rate of painting and polishing includes cleaning of glass panels, fans, doors etc. It will also include cost of additional costs if found necessary to achieve desired finish.
08. After completion of work, the site shall be handed over walls also absolutely clean after ensuring that all laminates, floors, walls etc. are spotlessly clean, with no variation in color.
09. Rates of all items remain constant irrespective of floor level and no extra shall be paid for handling and stating of materials, receiving debris etc. from the site.
10. Contractor shall clean the site and mark the line out of the floor with brown adhesive tape for approval. The same shall not be paid for separately.
11. All the items shall include required scaffolding, ladders, temporary supporting, machinery & equipment.
12. If Contractor quotes different rates for execution in different areas for the same item, the lowest of the quoted rates shall be considered for comparison of bid and payment of work done.
13. Laminate sheets of thickness 1.00mm as shall be used for the work any approved shade and finish.

14. The Contractor shall submit to the Consultant/Owner vouchers for collecting materials like marine plywood, particle board, block board, laminate sheets and for other materials as directed.
15. In case of non-availability of any specified manufacturers materials, the Contractor shall submit samples of materials later to that effect for Consultants and Owners approval allowed, necessary price adjustment as per Consultant’s scrutiny shall be applicable.

SAFETY CODE
01. First aid appliances including adequate supply of sterilized dressing and cotton wool shall be kept in a readily accessible place.
02. An injured person shall be taken to a public hospital without loss of time, in case where the injury necessitates hospitalization.
03. Suitable and strong scaffolds should be provided for workmen for all works that cannot safely be done from the ground.
04. No portable single ladder shall be over 8 meter in length. The width between the side rails shall not be less than 30 cm (clear) and the distance between two adjacent rungs shall not be more than 30 cm. When a ladder is used an extra mazdoor shall be engaged for holding ladder.
05. The excavated material shall not be placed within 1.5 meters of the edge of the trench or half of the depth of trench whichever is more. All trenches and excavations shall be provided with necessary fencing and lighting.
06. Every opening in the floor of a building or in a working platform be provided with suitable means to prevent the fall of persons or materials by providing suitable fencing or railing whose minimum height shall be on meter.
07. No floor, roof or other part of the structure shall be so overloaded with debris or materials as to render it unsafe.
08. Workers employed on mixing and handling material such as asphalt, cement mortar or concrete and lime mortar shall be provided with protective footwear and rubber hand gloves.
09. Those engaged in welding works shall be provided with welder’s protective eye- shields and gloves.
10.1 No paint containing lead or lead products shall be used except in the form of paste or readymade paint.
10.2 Suitable face masks should be supplied for use by the workers when the paint is applied in the form of spray or surface having lead paint dry rubbed and scrapped.
11. Overalls shall be supplied by the Contractor to the painters and adequate facilities shall be provided to enable the working painters to wash during the periods of cessation of work.
12. Hoisting machines and tackle used in the works, including their attachments, anchorage and supports shall be in perfect condition.
13. The ropes used in hoisting or lowering material or as a means of suspension shall be of durable quality and adequate strength and fee form defects.

SECTION VII
SPECIFICATION OF MATERIALS
HARDWARE METALS The hardware throughout shall be approved manufacturer and supply well-made and equal in every respect to the samples to be deposited with the Consultant / Employer. The Contractor may, be required to produce samples from many different source before the Consultants / Employer takes a decision and he should allow, in his rates for doing so.
Fittings generally shall have satin chrome or anodized finish, unless otherwise specified and shall be suitable for their intended purpose as per Consultant / Employer’s approval.
Screws are to match the finish of the articles to be filed, and to be round or flat-headed or counter sunk as required.
The Contractor should cover up and protect the Brass and Bronze surfaces with a thick grease or other suitable protective material, renewal as necessary and subsequently clean off and clear on completion.
Aluminum and stainless steel shall be of approved manufacturer and suitable for its particular application. Generally, the surface or aluminum shall have an anodized finish and both shall comply with the samples approved by the Consultant. All stainless steel sheets shall be 304 S.S. Japan or equivalent with gauge as specified but not less than 16 GL.
All steel, brass, bronze, aluminum & stainless steel articles, shall be subjected to a reasonable test for strength, if so required the Consultants at the Contractor’s expense.
All brazing and welds are to be executed in a clean and smooth manner, rubbed down and left in the flattest and tidiest way particularly where exposed.
Chromium plating shall be in accordance with BS 1224 standard or as per approved specifications for normal outdoor condition shall be on & base material of copper or brass.
GLAZIER All glass to be of approved manufacture, complying with IS 3542-1966 as per approved quality and sample to be of the qualities specified and free from bubblers, smoke, wanes, air holes and other defects.
Polished plate glass shall be “Glazing Glass” (G.G.) quality that for mirrors shall be “silvering quality” (S.O.) conforming to IS-3438-1965 or as per approved sample and quality. The compound for glazing to metal is to be a special non hardening compound manufactured for the purpose and of a brand and quality approved by the Consultant.
While cutting glass, proper allowances to be made for expansion, each square of glazing to be in one whole sheet. On completion of work, clean all glass inside and out, replace all cracked scratched and broken panes and leave in good condition.

PAINT & POLISHES All material required for the works shall be of specified and approved manufacturer delivered to the site in the manufacturer containers with the seals etc. unbroken and clearly marked with the manufacturer’s name or trade-mark and description of the contents and colour. All materials are to be stored on the site of the work.
Spray painting with approved machines will be permitted only if written approval has been obtained from the Consultant prior to painting. No spraying will be permitted in the case of priming neither coats nor where the soiling of adjacent surfaces is likely to occur. The nozzle and pressure to be so operated as to give an even shade. The paint used for spraying is to comply generally with the specification concerned and is to be specially prepared by the manufacturer for spraying. Thinning of ready mixed paint made for brushing will not be allowed.
Wood preservatives shall be Solingen or other equal and approved impregnating wood preservative and all concealed wood work shall be treated with wood preservative.
All brushes, tools, pots, kettles etc. used in carrying out the work shall be clean and free from foreign matter and are to be thoroughly cleaned out before being used on a different type of class of material.
All iron or steel surface shall be thoroughly scrapped and rubbed with wire brushes and shall be entirely free from rust will scale etc. before applying the priming coat.
Surfaces of the wood work which is to be painted are to be rubbed down and cleaned down to the approval of the Consultants.
Surfaces of previously painted wood work which are to be painted are cleaned down with soap and water, detergent solution or approved solvent to remove dirt, grease etc. whilst wet, the surface shall be flatted down with a suitable abrasive and then rinsed down and allowed to dry. Minor areas of defective paint shall be removed by scrapping back to a firm edge and exposed surface touched in with primer as described and topped with putty. Where wood work has been previously painted or polished and is to be newly polished, scraping, burning off or rubbing down of the surface shall be satisfactorily done. Surfaces of previously painted metal which is to be painted are to be cleaned down and flatted wood work. Minor areas of defective paint and any rust and loose scale shall be removed completely by chipping scrapping and wire brushing back to the bare metal and touched up with primer as described.
Where glued joinery and carpentry work is likely to come in contact with moisture, the glue shall be waterproof. The use of animal glues will not be permitted.
Timber is to be cut to the required sizes and length as soon as practicable after the works are begun and stored under cover so that the air will circulate freely around it. Joinery is to be prepared immediately after the placing of the contract, framed up but not bounded and stored until required for fixing in position, when it is to be bounded and wedged up. Any portions that warp of develop shakes or other defects are to be replaced before wedging up. The whole work is to be formed and finished in a proper and workmanlike manner, in accordance with the detailed drawings, and fitted with all necessary metal ties, straps belts, screws etc.

Turning bended joints are to be cross tongued with teak tongues and where over 1 ½ thick double cross tongued, joiner work generally is to be finished with fine class prepared surfaces unless otherwise specified.
Templates, boxes and molds shall be accurately set out and rigidly constructed so, as to remain accurate during the time they are in use.
Grounds are to be clean free from large knots, splayed as required plugged and fixed to walls etc. at 150 centers.
Wood plug are to be cut on the twist. Patent plugs or plastic filling may be in lies of wood plugs with the approval of the Architect.
Block board shall be of Mysore, Anchor or P.G. Brand shelves generally shall be constructed of plywood with edging of ½ teak tongued on.
One of the following I.S. specification or such approved adhesives shall be used.
I.S. 851.1957 Synthetic resin adhesive for construction work in wood. I.S. 849-1957 Cold setting case in glue for wood.
nd 01. Teak Wood Means 2 quality C.P. Teak
Seasoned Kiln dried, moisture content less than 12% free from worm holes, loose or dead knots or other defects such as warping, splitting, chemically treated with wood preservatives of approved manufacturer.
02. Plywood Plywood shall be closed grain weather proof ply. It will be phenol bonded plywood shall be complying to IS- 303-1960
03. Block Board Block board to comply with IS-1659.
04. Particle Board Complying with IS code No. 1734-1966
Board (Exterior Grade) Teak particle board shall have phenol bond and will comply with IS 3478
05. Veneer Veneer to have straight grains and will be selected from matching group. Veneer to comply with IS-1328-1930. Anchor brand of Indian Plywood or equivalent.

PLUMBING WORK SANITARY SYSTEMS
1.0 SCOPE
1.1 Scope of work covers supply, installation, testing and commissioning of: i) Sanitary ware ii) Chromium plated (CP) fittings
2.0 STANDARDS
2.1 All sanitary ware shall generally conform to IS: 2064 & IS 2556 Ref ISCDR-08 unless stated otherwise.
3.0 MATERIALS
3.1 General
3.1.1 All sanitary ware and CP fittings shall be new and of approved make, type and colour. All samples of materials with catalogues, performance data, shall be submitted and got approved before use on the work.
3.1.2 In cases where the materials are supplied by the clients, all such materials shall be inspected and received in good condition and thereafter, it will be totally under the safe custody of the contractor till they are handed over satisfactorily after installation, testing and commissioning.
3.1.3 Wherever multiple choices of fixtures are offered, the client shall have the final choice.
3.1.4 All fixtures shall be complete with all accessories as required for the working of the said fixture as specified.
3.2 Indian W.C / Orissa W.C
3.2.1 Indian W.C / Orissa W.C shall be in glazed vitreous chinaware (colour choice as per client). The W.C shall be provided with a 100 mm white vitreous chinaware P or S trap with or without vents as required.
3.2.2 Each W.C shall be provided with an exposed or concealed type CP brass flush valve or flushing cistern.
3.3 European W.C
3.3.1 European W.C shall be wash down or symphonic, floor or wall mounted in white or colour glazed vitreous chinaware with integral P or S trap as required. Wall hung W.C shall be supported by C.I or G.I floor mounted chair. The W.C shall be provided with an exposed or concealed type brass flush valve or flushing cistern as specified in the schedule of work.

3.3.2 Each W.C shall be provided with a solid plastic seat. The seat shall be fixed to the W.C with acrylic pillar bar hinges. PVC / Rubber buffers shall be provided for the cover.
3.4 Urinals
3.4.1 Urinals shall be lipped type large flat back in white or colour glazed vitreous chinaware of size shown in schedule of work.
3.4.2 Urinals shall be provided with: i) 15 dia spreader ii) 32 dia CP dome waste iii) 32 dia CP P-trap (50 deep) with unions. iv) CP wall flange and pipe up to the wall All exposed pipes and fittings shall be of C.P brass. The urinals shall be fixed with C.P brass screws. CP bottle traps may be used only with the approval of the Engineers-in-charge.
3.4.3 Urinal flushing shall be through one of the following methods as specified in the schedule of work: (Sizes as per Ref Specs Vol-2, 17.4). i) Small urinal flush valve with push button. ii) Auto flush valve with DC long life battery or AC supply. Auto flush shall be concealed in wall and flush pipe shall be of copper or G.I except the exposed parts which shall be C.P brass.
3.4.4 Waste pipe for urinals shall be any one of the following: - a) G.I pipes, heavy quality as per I.S 1239 b) Lead pipes c) Copper pipes as specified in the schedule of work or shown on drawings.
3.4.5 Wash Basin
3.5.1 Wash basins shall be white or color glazed vitreous chinaware synthetic or polymarble or any other material and of size, shape and type specified in the schedule of work.
3.5.2 Each basin shall be complete with: i) C.I or galvanized steel supporting brackets & clips as required. ii) 32 dia CP waste and overflow.

3.6 Sinks
3.6.1 The sink shall be of size specified in the schedule of work with glazed vitreous chinaware or stainless steel as specified.
3.6.2 Each sink shall be complete with: i) C.I or galvanized steel brackets & clips as required. ii) 40 dia waste fitting with brass/rubber plug & chain. iii) 40 dia P-trap (50 deep) with clean out, unions, CP pipe to wall & wall flange. iv) 20 dia CP control valve/s with CP connections. v) Mixing or CP fittings with spout as specified in the schedule of work.
3.7 Bath tub
3.7.1 Bath tub shall be polymarble /synthetic marble or reinforced acrylic or pressed steel stove enameled as specified in the schedule of work.
3.7.2 Each bath tub shall be complete with i) 40 dia CP waste fitting ii) Pop-up or CP brass plug with chain. iii) 40/50 dia P or S trap iv) Supply fittings shall consist of: a) One or two CP brass pillar taps with hot & cold mixer diverter and spout with/without hand shower. b) One single lever mixing fitting and spout with diverters for shower and / or hand shower. c) A manual shower set with one or two CP brass stop cocks exposed or concealed and a high pressure shower head of approved make. All as specified in the schedule of work.

4.0 INSTALLATION
4.1 All sanitary ware and CP fittings shall be installed in accordance with the interior requirements. Neat workmanship and maintaining exact position and level of each fixture shall be the objective of the installation. Care shall be taken to fix inlet and outlet pipes at correct positions. Faulty positioning shall be made good without any damage to the finished floor or wall tiling and any damage to the finished surfaces shall be made good at the contractor’s cost.
4.2 In order to ensure quality of workmanship and compliance with interior requirements, one or two mock-up installations shall be done and got approved. Fixtures used in the mock- up may be reused with the approval of the Project Architect / Engineer.
4.3 All fixing accessories like bolts, nuts, brackets etc. may be supplied along with the ware as defined in the mode of measurement and schedule of work. All such accessories shall be CP brass or galvanized or stainless steel as approved by the Project Manager. All exposed pipes, fittings, bolts & nuts shall be of CP brass.
4.4 The Indian W.C shall be fixed to level in a neat workmanlike manner. The W.C and trap shall be set in brick bat 1:2:4 concrete mixes. Joints between W.C and flush pipe shall be made with a putty or white lead and linseed oil and caulked well or with approved rubber joints. The joint between W.C and trap shall be made with 1:1 cement mortar and shall be rendered leak proof.
4.5 The Orissa W.C shall be fixed in level in a neat workmanlike manner. The W.C & trap shall be set in brick bat concrete 1:2:4. Joint between W.C & flush pipe shall be made with putty of white lead in linseed oil and caulked well or with approved rubber joint. Joint between W.C & trap shall be made with 1:1 cement sand mortar and shall be rendered leak proof.
4.6 Wall-hung European W.C shall be mounted on C.I chairs which are fixed to the floor using anchor fasteners. The bolts and nuts used for fixing the chairs shall be stainless steel and the fixing bolts for the W.C and chairs could be CP brass or stainless steel. Floor- mounted W.C shall be fixed with anchor fasteners using stainless steel CP brass bolts and nuts. The gap between the WC and floor or wall shall be neatly sealed with water proof non-hardening sealant of approved type and colour. The sealant should not protrude beyond the foot print or WC outline.
4.7 All W.C’s shall be aligned and leveled with the floor and wall tiles so as to present an integrated look. Utmost care and skill shall be exercised to achieve a good installation in keeping with the interior designs.
4.8 Urinals shall be fixed to the wall using CP brass bolts and nuts. The urinals shall be held in line and level according to the interior designs and tile modules. Partitions, wherever required to be provided, shall also maintain line and level as shown on drawings and as required. Supply spreader and drain piping and P-trap shall be of CP brass and installed in a neat and workman like manner. No unseemly bends or wooden support pieces shall be permitted.

4.9 Wall-mounted wash basins and sinks shall maintain line and level as specified by the interior drawings and also with the tile modules. The supply connections shall be of CP brass from the angle stop valves to the pillar taps or single lever fixture and shall display good workmanship. Drain connections shall have a CP P-trap with unions and exposed CP drain pipe and a wall flange or escueheon. In the case of counter mounted basins and sinks extreme care shall be taken to independently and adequately support the basin and aligning with the opening in the counter slab. Supply and drain connections shall be same as for wall mounted basins. The crevices between basin and wall or counter shall be neatly sealed with a non-hardening sealant of approved.
4.10 Bath tubs shall be fixed true to level and firmly fixed to anchors or supports provided by the manufacturer. Bathtub flanges shall be truly aligned with the wall on all the sides so as to make a watertight joint. Sealants if any used for edge ceiling shall be non-hardening type. Bath tubs shall be sloped 1:30 towards the drain.
4.11 All accessories like the mirror, soap trays etc. shall be neatly fixed as per interior designs. Good workmanship is the essence of all sanitary installation for achieving the interior design objectives.
4.12 During the construction period, the contractor shall protect all the sanitary fixtures from damage due to accidental or even intentional mechanical impact with hard objects and also misuse and vandalism. 5.0 TESTING AND ACCEPTANCE
5.1 The sanitary fixtures form the final terminal units of the water supply and drainage system and should meet the performance needs as a terminal unit. Each fixture shall be inspected for scratches or chippings and alignment before acceptance.

1.0 SCOPE
1.1 The scope of work shall cover supply, installation, testing and commissioning of water piping required in but not limited to the following applications wherever they come up and shall meet the intents of these specifications. i) Cold, hot and Flush Water distribution piping. ii) Connections to sanitary ware, kitchen and other equipment etc. iii) Municipal water connection including meter connection. iv) Secondary storage tanks, if any. v) All valves, masonry valve chambers etc. vi) Pipe inserts in walls & storage tanks. vii) All inserts and vents for underground and overhead storage tanks. 2.0 STANDARD

3.0 MATERIALS
3.1 General
3.1.1 All materials shall be new of the best quality conforming to the specifications. Where different makes are specified, the choice of make shall rest with the client.
3.1.2 All samples of materials with necessary catalogues, performance data shall be submitted and got approved before use on the work.
3.2 Steel Pipes & Fittings
3.2.1 All steel pipes shall be heavy quality galvanized steel tubes conforming to IS 1239 for sizes upto 150 dia.
3.2.2 Fittings shall be malleable cast iron fittings of approved make conforming to IS 1879 (I to X). All fittings shall have manufacturer’s trade mark stamped on it. Fittings shall include couplings, bends, tees, reducers, nipples, union, bushes etc. All fittings shall be suitable for the class of pressure of the piping system.
3.2.3 Flanges shall be steel screwed type conforming to IS 6392 and the pressure class of the piping system. Flanges should mate with equipment or valve flanges as the case may be and shall be complete with bolts and nuts and gaskets suitable for the temperature and pressure of water in the system concerned. Gasket selections shall be got approved before use and samples of approved gaskets shall be put on display.
3.3 Cast Iron Pipes & Fittings
3.3.1 Cast iron pipes shall be of ‘LA’ class conforming to IS 1536 suitable for lead jointing with spigot and socket joints and if flanged they shall be ‘A’ class conforming to IS 1537. Pipes shall be in maximum lengths available.
3.3.2 Fittings shall be of the class required conforming to IS 1538. If spigot-socket, they shall be suitable for lead jointing. 4.0 PIPE INSTALLATION
4.1 General
4.1.1 Shop drawings for the routing of pipes shall be prepared generally on the basis of layout drawings issued. The shop drawings shall reflect the site conditions, structural beams and columns, obstructions by way of any construction elements or any other service pipes, ducts etc. The drawings should clearly indicate openings required in brick or concrete walls, drain valves at low points, air valves at high points, isolating valves, if any, and invert levels at every 15m intervals. The drawings should also indicate typical details of hangers, supports, brackets etc. After approval of the drawings, pipe routes shall be marked with a distinct colour of paint on the site and got it approved by the Project Architect/Bank.

4.1.2 All openings and chases in brick walls shall be made neatly and refilled to a reasonable finish. However, final finishing will be done by the civil contractor. Openings in concrete walls or floors shall, however, be made only with the approval of the Architect/Bank. All such openings for pipe penetrating shall be core-drilled and pipe penetrations, through wall or floor, shall be sealed with an approved non-fire resistant sealant
4.1.3 Good workmanship and neat pipe layout are the prerequisites of these specifications. Horizontal pipes shall be truly horizontal with necessary slopes and hangers or supports as specified and shown on drawings. Vertical pipes shall be truly vertical and shall be laid away from the walls at least by 10mm or as required by the Project Architect / Bank. All pipe runs shall be parallel to the ceiling or walls for presenting a neat appearance. Pipes buried in wall shall be laid in machine-made chases with galvanized steel anchors and shall be protected with polythene – faced – Hessian tape & bitumen.
4.1.4 All pipes before and after testing shall be protected with wooden or brass plugs to prevent ingress of dust, sand or any extraneous matter.
4.2 Pipe supports; hangers & clamps
4.2.1 Pipe supports, clamps, suspenders shall be pre-fabricated and galvanized (after fabrication). The support systems shall generally follow the types specified under “PIPE SUPPORTING SYSTEMS”. Application of support systems shall follow the guidelines in the above specifications. Any other types of support, suspension or clamping to meet the site conditions shall be got approved before use.
4.3 Cast Iron Piping
4.3.1 Cast iron piping shall be used largely for underground piping. Where it is used over ground, the pipe installation shall follow the specifications for galvanized steel piping except that the support spacing shall be as shown in section “PIPE SUPPORTING SYSTEMS”. Supports and suspenders shall be at the joints and shall be robust enough to withstand caulking.
4.3.2 Joints shall be spigot and socket or double flanged. Spigot and socket joints shall be lead filled generally as specified for cast iron underground drainage piping while flanged joints shall have a non-asbestos gasket of approved make and type.
5.0 ACCEPTANCE, TESTING & COMMISSIONING
5.1 Before testing and commissioning, water shall be filled and circulated through the piping system and flushed out to ensure clean piping. Entire piping installation with all valves fully open, except the terminal fixture valves shall be subjected to a hydraulically test pressure whichever is higher of the following:

i) 2 times the dynamic head of the pump plus the gravity head of an overhead storage or pressure tank. ii) 2.5 times the no-delivery head (head developed when the discharge valve is closed) of the pump.
5.2 The test shall be for the entire water supply system and shall hold for a minimum of 3 hours without loss of pressure. During the testing period, the contractor should walk along the entire piping system along with the Project Architect / Engineer and validate that there are no leaks anywhere in the system. Such validation shall be carried out segment by segment and recorded. Should there be any leaks in any segment, the system shall be drained, leaks attended and tested once again as above till the entire piping system is rendered leak-tight and acceptable.

3.2 Cast Iron Pipes & Fittings

3.2.2 Centrifugally a cast low pressure iron pipe without sockets (socket-less) shall generally follow requirements of IS 6163. Fittings shall be socket-less and all joints shall be with a synthetic rubber sealing collar with a stainless steel clamp with two S.S bolts for application of uniform pressure. All materials shall be from approved manufacturers.
3.2.3 Wherever specified centrifugally cast pressure pipes of ‘LA’ class shall be used. The pipes and fittings shall conform to IS 1536. Fittings shall be spigot and socket type suitable for molten lead caulking. Where necessary flanged pipes and fittings may be used with a teflon gasket.
3.2.4 Fittings shall be cast iron compatible with the pipes used. Tees, bends, crosses and other specials shall have easy sweep as specified. Cleaning eyes shall be provided wherever required and shall be complete with a sealing gasket and suitable bolts. Cleaning eyes should not be along the flow (such as bends) but behind (such as Y or T).
3.3 Steel Pipes and Fittings
3.3.1 Steel pipes shall be galvanized heavy quality tubes to IS: 1239. Fittings shall be galvanized malleable iron conforming to IS: 1879 (i to x). Fittings shall include long radius bends, tees, reducers, unions etc.
3.4 PVC Drainage Systems
3.4.1 PVC drainage piping shall be factory made complete systems of any approved makes with all the fittings. The pipes and fittings shall meet with the following specifications: Pipes : IS: 13592 Fittings : BS: 4574 DIN 19531
3.4.2 All joints shall be snap fit type with rubber ring and shall always produce a 100% water tight joint. Pipe and fittings shall be suitable for the snap fit joint.

3.5 Traps & Seals
3.5.1 All traps shall be self-cleaning and the material and the seal depth shall be as specified below wherever the traps are not integral with the appliances or ware. Bottle type traps shall be used only with the approval of the engineer. Any other appliance shall have an appropriate trap as specified by the Engineer-in-charge or as required.
3.5.2 All floor drains shall be cockroach proof covered with perforated stainless steel grating of size specified or required. Roof drain outlets shall have dome grates unless specified otherwise. Plant room floor drains shall have cast iron or fabricated steel grating.
3.6 Cleanouts
3.6.1 Cleanouts other than those integral with the fitting, shall be of brass and screw down type. Wherever cleanouts are required in cast iron piping, galvanized steel adaptor shall be provided as part of the cleaning system. Cleanouts shall be accessible from the floor served. 4.0 DRAINAGE SYSTEM INSTALLATION
4.1 General

4.2 Pipe supports; hangars & clamps
4.2.1 All pipe supports, hangers & clamps shall be standard pre-fabricated galvanized (after fabrication) units. Pipe supports shall generally follow the types specified under “PIPE SUPPORTING SYSTEMS” and the associated drawings. Any other type of support, suspension or clamping to meet site conditions shall be got approved before use.
4.3 Soil & Waste Piping
4.3.1 Horizontal pipes shall be suspended from the structural ceiling slab or wall brackets at centers specified in the section “Pipe Supporting Systems”. Pipes shall be laid to an optimum slope of 1 in 60 as far as possible. A liberal provision of easily accessible cleanouts shall be made on all horizontal pipes. Cleaning facility shall preferably be from the floor above the ceiling slab for all under floor installations. Where horizontal pipes are laid in a sunken floor slab, adequate slopes shall be achieved through galvanized saddles or cement mortar bedding. All such pipes, after testing, shall be covered with and set in cement concrete (1:2:4) so that the pipes are not disturbed during the filling up of the sunken floor.
4.3.2 Vertical stacks shall be truly vertical and parallel to the wall and supported on saddles so that the pipes are at least 50mm away from the finished surface. Branch pipe connections shall be aligned with the bend or tee on the stack. Where the vertical stack meets the horizontal run or a manhole, a 45o tee connection with a cleanout shall be employed to facilitate smooth flow and easy cleanability.
4.3.3 Cast iron spigot and socket pipes and fittings shall be jointed through lead caulking. The annular space between the socket & spigot will be first well packed with bitumen-soaked spun yarn and dried, leaving the required space for lead. The joints may be headed by wrapping a ring of hemp rope covered with clay around the pipes at the end of the socket, with a hole through which molten lead shall be poured in. Lead used shall conform to IS 782. The joint shall be filled in one pour only. Before caulking the overflow of lead shall be removed by chiseling. The joint shall then be caulked all-round with proper caulking chisel and hammer weighing 1 to 1.5 Kg in such a manner as to make the joint neat and flush with the socket and totally water and air tight.
4.3.4 Cast iron socket-less pipes shall be joined by using rubber/neoprene sealing tube and a stainless steel clamp with two bolts. All materials and method of jointing shall strictly conform to manufacturer’s standards and recommendations.

4.3.5 Galvanized steel drain piping shall be used except when exposed for appliances, wash basins, sinks, bath tubs etc. using screwed malleable galvanized fittings with approved sealants. Elbows may be avoided as far as possible and long- sweep bends are preferred for smooth flow. Joints between the galvanized steel pipe and cast iron shall be done through appropriate fitting and lead caulking as shown on drawings or as instructed by the Project Manager / Engineer – in charge. Exposed pipes shall be CP brass.
4.3.6 Where specified, lead pipes may be used for waste, vent and WC connections. Pipe size shall be as shown on drawings or as required for the appliance. Lead pipes shall be straightened by wooden mandrels and bent to shape by dry sand filling. Joints of lead pipes shall be wiped solder joints. The pipe ends to be jointed shall be cleaned with a wire brush and freed from oxide if any. Chalk shall then be rubbed to kill the greasy nature of lead. After this plumber’s black shall be applied. A fine shaving of lead shall be removed from this with shave hook. Mutton tallow shall then be smeared over the prepared surface. The molten solder, and alloy composed of 3 parts of tin and 7 parts of lead shall be poured in a thin stream from a ladle moved in an elliptical direction over the joint position including a portion of the pipe at each end beyond the mark. When sufficient solder has been poured the joint shall be wiped with pad of wiping cloth with long continuous movements in one direction only so as to leave a neatly formed elliptical shaped joint. Surplus solder remaining on the joint shall be removed. The joint shall be water tight, air tight and shall be free from burrs, strings or droppings and shall be 60 to 90mm in length depending on the pipe diameter.
4.3.7 Joint between lead pipe and cast iron pipe or stone ware pipe shall be made as follows: One end of a brass thimble shall be slipped into or over the lead pipe and jointed to it by means of a wiped solder joint. The other end of thimble shall then be inserted into the socket of the cast iron or stone ware pipe. In case of cast iron the joint shall be made with molten lead and in case of the stone ware the joint shall be made with cement mortar 1:1.
4.3.8 Where specified, PVC pipes may be used for waste, vent and WC connections. Pipe size shall be as shown on drawings or as required for the appliance. Pipe connection to the cast iron piping shall be through appropriate adapter.
4.3.9 All pipes shall be fixed in a gradient towards the outfalls of drains. Pipes inside a toilet room shall be in chase unless otherwise shown on drawings. Where required, pipes may be run at ceiling level in suitable gradient and supports as shown in the section “PIPE SUPPORTING SYSTEMS”.
4.3.10 Cast iron floor drains shall be set in 1:2:4 cement concrete. Kitchen floor drain boxes shall be as shown in drawings and kept flush with the finished floor. The drain boxes shall have a minimum of 50mm water seal and a suitable perforated grating. Drain boxes shall be connected to the cast iron drain piping through a flanged galvanized steel drain connection.

4.4.1 Building vent stacks shall be not less than 75mm dia. Where the vent stack becomes one with the main soil or waste stack the main stack size shall not be reduced. Vent connections on any branch waste drain line shall be at least two thirds the diameter of the branch drain subject to a minimum of 25mm. Vent connection to a soil drain line shall be a minimum of 32mm dia. Vent connections shall be as near to the crown of the trap as possible.
4.4.2 No water shall enter vent lines. Vent lines shall be laid vertically terminated at least 150mm above the open-to-air roof. Vents may be connected back to the waste or soil stack above the highest appliance connection and the said stack extends beyond the roof by at least 150mm into the air.
4.5 Cleaning plugs
4.5.1 Cleaning plugs shall be easily accessible and convenient for rodding. Such plugs shall be liberally provided so that the entire drainage system could be easily cleared of all possible chokes. All clean outs shall be behind the flow and as far as possible, plug bends may be avoided. In the case of under slung drainage systems, the clean outs should be on top of the floor and NOT under the floor. 5.0 ACCEPTANCE, TESTING & COMMISSIONING
5.1 Pre-commissioning checks
5.1.1 A walk-through inspection shall be carried out and the following checks made: i) Layouts are according to the drawings and identify variations. ii) Material used are as specified, new and as per approved samples. iii) All fixtures viz. suspenders, brackets, clamps etc. are adequate and firmly fixed and spaced as specified. iv) Cleaning eyes are duly plugged and are easily accessible. v) No visible damages or cases of bad workmanship. vi) Check water seals in traps by discharging adequate number of appliances.

5.1.2 During construction, the piping shall be tested in sections so that the maximum static head of water is not more than 4.5m. All such sectional tests shall be witnessed and signed by the Engineer-in-charge. Records of these tests shall form the Acceptance Test documentation.
5.1.3 An air test shall be conducted as specified in IS: 5329 with a test pressure of 50mm water gauge. If the pressure is not holding, then a smoke test shall be conducted through a smoke generator to track down the leaking points. After attending to the leaks, the piping shall be air tested again.
5.1.4 Hydraulic Performance Tests shall be conducted on each stack by simultaneous release of water through various appliances like WC’s and bathtubs to ensure water sealing of traps.

FLOORING WORK 1.0 GENERAL 1.1 INDIAN STANDARDS Indian and other international standards followed for this section shall be as listed below. In case any discrepancies or ambiguities noticed it shall be brought to notice of the Bank/ Architect and clarification/confirmation sought. His decision shall be final. However as general rule more stringent specifications shall be followed. (1) IS 269 Specification for ordinary and low heat Portland cement. (2) IS 383 Specification for Coarse and fine aggregates from natural sources for concrete. (3) IS 8042 Specification for white Portland cement (4) IS 8112 Specification for 43 grade ordinary Portland cement (5) IS 1489 Specification for Portland pozzolana cement (6) IS 12118 Specifications for two parts polysulphide based sealants: Part 1 General requirements. (7) IS 15622 Pressed Ceramic tiles – Specification (8) IS 3812 Specification for fly ash use as Pozzolona and admixtures 1.2 Quality Assurance 1.2.1 Cement used on site shall be from all leading manufacturers having minimum 5 years of experience of manufacturing and confirming to IS. 1.2.2 Stones received shall be from approved quarries and of approved lot. 1.2.3 Tiles manufacturer shall confirm that material is as per specification and within acceptable tolerances. Tiles shall be of one production run, of consistent quality, appearance and physical properties. 1.2.4 The contractor shall procure mortar, grout etc. of approved quality design and standard and he will not change source of supply without written permission and with revised samples being approved. 1.3 Submittals 1.3.1 The contractor shall submit manufacturer's each product data sheet covering technical literature and test certificates of independent laboratories. 1.3.2 The contractor shall submit comparative statement showing what is specified and what is proposed by him. 1.3.3 The contractor shall prepare shop drawings for layouts based on architectural concept drawings. Drawings shall include Detail plan with material & sizes of each element including joint widths. Pattern to full scale with assembly details at each location for each type.
