The Filibuster and Reconciliation: The Future of Majoritarian Lawmaking in the U.S. Senate Tonja Jacobi†* & Jeff VanDam** “If this precedent is pushed to its logical conclusion, I suspect there will come a day when all legislation will be done through reconciliation.” — Senator Tom Daschle, on the prospect of using budget reconciliation procedures to pass tax cuts in 19961 Passing legislation in the United States Senate has become a de facto super-majoritarian undertaking, due to the gradual institutionalization of the filibuster — the practice of unending debate in the Senate. The filibuster is responsible for stymieing many legislative policies, and was the cause of decades of delay in the development of civil rights protection. Attempts at reforming the filibuster have only exacerbated the problem. However, reconciliation, a once obscure budgetary procedure, has created a mechanism of avoiding filibusters. Consequently, reconciliation is one of the primary means by which significant controversial legislation has been passed in recent years — including the Bush tax cuts and much of Obamacare. This has led to minoritarian attempts to reform reconciliation, particularly through the Byrd Rule, as well as constitutional challenges to proposed filibuster reforms. MISSISSIPPI GULF COAST NATIONAL HERITAGE AREA MANAGEMENT PLAN Mississippi Department of Marine Resources Comprehensive Resource Management Planning Biloxi, MS This Management Plan document was prepared in accordance with the requirements of H.R. 4818 Consolidated Appropriations Act 2005 (Enrolled as Agreed to or Passed by Both House and Senate); Title VII - Mississippi Gulf Coast National Heritage Act. December 2005 Mississippi. Chapter Thirty-four “The Wisest Radical of All”: Reelection (September-November, 1864) The political tide began turning on August 29 when the Democratic national convention met in Chicago, where Peace Democrats were unwilling to remain in the background. Lincoln had accurately predicted that the delegates “must nominate a Peace Democrat on a war platform, or a War Democrat on a peace platform; and I personally can’t say that I care much which they do.”1 The convention took the latter course, nominating George McClellan for president and adopting a platform which declared the war “four years of failure” and demanded that “immediate efforts be made for a cessation of hostilities, with a view to an ultimate convention of the states, or other peaceable means, to the end that, at the earliest practicable moment, peace may be restored on the basis of the Federal Union of the States.” This “peace plank,” the handiwork of Clement L. Vallandigham, implicitly rejected Lincoln’s Niagara Manifesto; the Democrats would require only union as a condition for peace, whereas the Republicans insisted on union and emancipation.
