SERVICE TO THE PUBLIC THROUGH SELECTED PUBLIC INTEREST LITIGATIONS

 Suit No. W/437/2013: Olukunle Edun vs. Gov. Delta State & Ors. The first judgment in Delta State to uphold and make applicable the FOI Act, 2015 to Delta State.

 Suit No. UHC/186/2014: Olukunle Edun vs. Gov. Delta State & Ors. Successfully got judgment restraining VIOs from stopping private vehicles on the road and declared the issuance of Road Worthiness Certificate to private vehicle owners as unlawful.

 Suit No.W/01/2015: Okiroro Iki-Ebieroma Esq. vs. Gov. Delta State. An unsuccessful attempt to declare as unconstitutional the restriction of movement of persons and vehicles on environmental sanitation days in Delta State. Now on appeal.  CA/B/378/2016: Olukunle Edun v. Gov. Delta State. Unsuccessful attempt to challenge the constitutionality and also stop the humongous sums and benefits being given to former Governors and Deputy Governors of Delta State as pensions and gratuity. Both the trial court and Court of Appeal held that the Claimant lacked the requisite locus standing. Appeal now pending at the SC.  Suit No.W/377/2015: Olukunle Edun vs. Gov. Delta State. Successfully obtained judgment under the FOI Act, 2015 demanding for information from the Delta State government regarding the 13% derivation receipts.

 Suit No. FHC/WR/CS/90/2017: Darlington Ugo Ehirim Esq. v. FRSC. Successfully obtained judgment declaring that the FRSC has no right to carry out their operations on roads belonging to States and municipal governments.

 Suit No.W/256/2016: Frederick Tuoyo Egbe Esq. v. Chief Registrar, Delta State High Court. Unsuccessfully challenged the unilateral and unlawful imposition of court filing fees by the Governor of Delta State without complying with the provisions of the law. Matter now at the CA.  Suit No.W/386/2014: Michael Ukusare Esq & Ors v. Delta State House of Assembly. Acted as lead counsel in another successful action under the FOI Act, 2015 pursued under the auspices of NBA Warri.  Suit No. FHC/ASB/CS/14/2017: Tareri Avwomakpa Esq. v. DG, DSS: Successful action challenging the unlawful remand of the Plaintiff (a lawyer) by the DSS.  Suit No. FHC/ABJ/CS/281/2019: Olukunle Edun vs. (1) Code of Conduct Bureau (2) Mr. Danladi Umar. Action challenging the refusal of the Defendants to honour an FOI request for the assets and liabilities declarations of Mr. Mr. Danladi Umar.  Suit No. FHC/CA/FHR/31/2020: Olukunle Edun & Ors. v. Speaker, House of Assembly & Ors. A fundamental right enforcement action filed at the Federal High Court, Calabar to protect and seek remedy for the violation of the right of Hon. Justice Akon Ikpeme to freedom from discrimination by the Cross River State House of Assembly by purporting to reject her nomination as the substantive Chief Judge of Cross River State on the ground that she is from . The trial court dismissed the case but it is presently on appeal.  Suit No. FHC/ABJ/CS/317/2020: Monday Ubani, Olukunle Edun & Ors. v. A.G. Federation & 20 Ors. This action challenges the constitutionality of allocating funds from the Federation Accounts to Caretaker or Interim Committees of Local Government and seeks to stop it. 16 State governments that are culpable of this constitutional infraction are Defendants in the case.
