Plaintiffs seek injunctive relief to stop Defendants from unlawfully pirating their spectrum and damages from Defendant T-Mobile US, Inc. (“T-Mobile”) for its wrongful taking of Case 1:20-cv-10998 Document 1 Filed 05/22/20 Page 2 of 37 that spectrum. Plaintiffs are six nonprofit organizations that have been granted more than 60 licenses by the Federal Communications Commission (“FCC”) to operate Educational Broadband Service (“EBS”) channels in the 2.5 GHz spectrum band for educational purposes in markets across the country. In furtherance of their educational purposes, Plaintiffs agreed in July 2006 to lease their excess EBS spectrum capacity (“Spectrum”) to Defendants Clearwire Spectrum Holdings II LLC and Clearwire Legacy LLC (together, “Clearwire”) for commercial use over a thirty-year term. -

We recognized that a shift was occuring in consumer mindset from some of the extravagances of the previous few years to a focus on value. At Virgin Mobile USA, we have always focused on providing value and fl exibility to our customers, allowing them to change plans according to their budgetary needs so they can get the most from their wireless service. We realized that now more than ever, we needed to emphasize our value proposition and focus our message on the value we off er to consumers. And so we began to implement a number of strategic and operational initiatives in 2008 that focused on value – on the value we bring to consumers, as well as putting the right operational initiatives in place to build shareholder value.
