    Children in Lockdown: Solitary Confinement of Teens in Adult Prisons January 30, 2010 By Jean Casella and James Ridgeway 23 Comments While there are no concrete numbers, it’s safe to say that hundreds, if not thousands of children are in solitary confinement in the United States–some in juvenile detention facilities, and some in adult prisons. Short bouts of solitary confinement are even viewed as a legitimate form of punishment in some American schools. In this first post on the subject, we address teenagers in solitary confinement in adult prisons. In large part, this grim reality is simply a symptom of the American criminal justice system’s taste for treating children as adults. A study by Michele Deitch and a team of student researchers at the University of Texas’s LBJ School found that on a given day in 2008, there were more than 11,300 children under 18 being held in the nation’s adult prisons and jail. According to Deitch’s 2009 report From Time Out to Hard Time, ”More than half the states permit children under age 12 to be treated as adults for criminal justice purposes. In 22 states plus the District of Columbia, children as young as 7 can be prosecuted and tried in adult court, where they would be subjected to harsh adult sanctions, including long prison terms, mandatory sentences, and placement in adult prison.” These practices set the United States apart from nearly all nations in both the developed and the developing world. Pipeline Transportation, Refinery Services and Supply and Logistics improved over 2012 by approximately 13%, 3% and 3% respectively. In Pipeline Transportation, our volumes increased on our Florida system due to volumes from our integrated rail unload facility at Walnut Hill, Florida. Volumes also increased on our offshore Cameron Highway Oil Pipeline System as the completion of facility work by producers at the connected production fields resulted in higher volumes transported in 2013. In Refinery Services, customer demand for NaHS remained high. Our new Tulsa facility continues to add to our supply diversification and our other existing facilities continue to perform well. In Supply and Logistics, we benefited from the acquisition of our offshore marine transportation business and experienced early contribution from our crude oil rail loading and unloading operations. Challenges in our fuel oil business resulted in lower volumes handled at reduced margins.

  • What Amounts to a Surrender by Operation of Law?

What amounts to a surrender by operation of law? Where a landlord and tenant bring a lease to an end, they usually do so by completing a deed of surrender. However, sometimes, it may be implied that a surrender has occurred. The term commonly used for an implied surrender is a surrender “by operation of law”. In a recent case, QFS Scaffolding v Sable1 , the court considered some of the relevant principles for a surrender by operation of law to take place. Facts The landlord (Mr and Mrs Sable) granted a lease to a tenant company which eventually entered into administration. Prior to the administration, a new company (QFS) was formed with a view to taking over the tenant’s business. The Sables negotiated terms for a new lease with QFS who, in fact, went into occupation. However, the negotiations faltered and no new lease was entered into. Instead, QFS asked the administrator of the tenant to assign the lease to it and, as a result of this request, a deed of assignment was executed.
