Parliamentary Bulletin ParliamentaryRAJYA SABHA Bulletin PART-II Nos.56344-56347] FRIDAY, JANUARY 27, 2017 No.56344 Legislative Section President's Address (1) Date of Address- As already intimated through Rajya Sabha Bulletin Part-II No. 56193 dated the 7th January, 2017, the President will address both Houses of Parliament assembled together at 11.00 a.m. on Tuesday, the 31st January, 2017 in the Central Hall, Parliament House, New Delhi. Half an hour after the conclusion of President's Address on the 31st January, 2017, the Rajya Sabha will hold a separate sitting for the transaction of Government Business. (2) Supply of Copies of the President's Address- Copies of the President's Address will be made available to Members in the Lobby immediately after a copy of the Address has been laid on the Table of the Rajya Sabha by the Secretary-General. Members who do not take their copies in the Lobby on the 31st January, 2017 may obtain them from the Rajya Sabha Publications Counter. (3) Discussion on the President's Address- Three days, viz, , Thursday, the 2nd February(along with other Government Business), Friday, the 3rd February and Monday, the 6th February, 2017 have been provisionally allotted for discussion on the Motion of Thanks on the President's Address to be moved by a member and seconded by another member. __________ 2 No.56345 Legislative Section NO-DAY-YET-NAMED MOTIONS LIST NO._1_ Motions admitted under rule 170 BY DR. "That this House expresses its deep concern over the threat being posed by the bio-medical waste due to its improper disposal by the hospitals and urges upon the Government to take necessary steps in this regard." 2. "That this House expresses its serious concern over vulgar programmes and news reports appearing in electronic and print media and urges upon the Government to take effective steps to ban such programmes and news reports." 3. "That this House expresses its deep concern over the flourishing business of spurious medicines in the country and urges upon the Government to take effective steps to curb this practice." 4. "That this House expresses its serious concern over the increasing cases of female foeticide in the country and urges upon the Government to take stringent action against the persons involved in female foeticide." 5. "That this House expresses its serious concern over the crisis of pure drinking water in the country and urges upon the Government to implement an action plan at national level to overcome the crisis." 6. "That this House expresses its serious concern over the situation arising out of increasing number of AIDS and cancer patients in the country and urges upon the Government to take measures to create public awareness about these diseases, provide adequate latest facilities for their prevention, diagnosis and treatment and take such other effective steps as may be required in this regard." 7. "That this House recommends to the Government to take steps to sensitise the people against the agencies and organisations that promote communalism and casteism and thus divert the attention of the people from matters concerning development, social justice, empowerment and national progress." 8. "That this House recommends to the Government that a high level Committee of Experts be constituted to survey and study the Coast Line 3 of India for development of coastal region and protection of coastal ecology and environment." 9. "That this House expresses its deep concern over the situation arising out of increasing pollution, especially in metropolitan cities and urges upon the Government to take steps to restrict the unnecessary expansion of pollution causing industries." 10. "That this House expresses its deep concern over the growing number of cardiac patients in the country and inadequate facilities for their treatment, particularly in rural and semi-urban areas, and urges upon the Government to provide the latest facilities for diagnosis and treatment of cardiac ailments in these areas." 11. "That this House expresses its concern over non-reaching of financial assistance allocated under the various rural development programmes to Panchayats and local bodies and urges upon the Government to bring forward a suitable legislation in this regard." 12. "That this House expresses its concern over the costly medicines in the country due to huge difference between their retail price and manufacturing cost and urges upon the Government to announce a pricing policy for medicines." 13. "That this House expresses its deep concern over the lack of adequate health care facilities in rural, backward and tribal areas of the country and urges upon the Government to take necessary steps in this regard." 14. "That this House expresses its concern over the increasing number of train accidents, and deaths at level crossings in the country and urges upon the Government to take necessary steps in this regard including feasibility of installing anti-collision devices, satellite imagery and communication system." 15. "That this House expresses its serious concern over the growing number of school dropouts due to lack of harmony among primary, secondary and higher-secondary education in the country and urges upon the Government to take remedial measures for all round personality development of children in this regard." 16. "That this House expresses its concern over the non-availability of medical treatment to the people due to shortage of specialist doctors in the country and urges upon the Government to provide medical facilities to all citizens by availing the services of traditional Ayurvedic, Unani and Homeopathic doctors." 17. "That this House expresses its serious concern over the threat being posed to the internal security of the country from across the borders and 4 urges upon the Government to take steps to provide foolproof security in order to stop cross-border infiltration." 18. "That this House expresses its concern over the huge increase in the cost of infrastructure projects like road project, power project due to inordinate delay in acquisition of land, environmental clearance and their implementation and urges upon the Government to bring transparent system and make the coordinating agencies responsible for implementing these projects accountable." 19. "That this House expresses its deep concern over the shortage of coal and its adverse impact on the economic development of the country and urges upon the Government to bring reforms in the coal sector so as to provide sufficient quantity of standard coal to the power sector and the industry at competitive rates."     Honorable Shri Venkaiah Naidu, Vice-President, Republic of India, Chairperson, Rajya Sabha December 19, 2018 Sub: Oppose Transgender Persons (Protection of Rights) Bill, 2018 and Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2018 STOP CRIMINALISING BODIES AND LIVES We, the undersigned transpersons, sex workers, activists, academics, and allies in Karnataka, work on various forms of extreme exploitation and with the transgender community and sex workers (including but not limited to transgender sex workers). We express grave concerns with the regressive Transgender Persons (Protection of Rights) Bill and the Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2018. Both bills are pending consideration before the Rajya Sabha now. We request the Honorable Speaker to not ​ introduce the Transgender Bill and Trafficking Bill in the Rajya Sabha and to please refer these Bills to a Select Committee of the Rajya Sabha. ​ Recently in August 2018, the Delhi High Court in Harsh Mander and ors. vs. UoI has observed that the approach of criminalising begging was not a solution to addressing the problem. “The State simply cannot fail to do its duty to provide a decent life to its citizens and add insult to injury by arresting, detaining and, if necessary imprisoning persons who beg in search for essentials of bare survival”. Both the Bills (Transgender Bill and ​ Trafficking Bill 2018) are fundamentally motivated by a criminalizing impulse. Issues which have to be seen within the lens of development are sought to be dealt with by criminal law. The state instead of taking on welfarist / developmentalist functions chooses to focus on incarcerating the poor.

Political Parties Last week, when Prime Minister Narendra Modi convened an all-party meeting to discuss the idea of ‘one nation, one poll’, several parties stayed away, calling the idea “anti-democratic” and “anti-federal”. In a discussion moderated by Anuradha Raman, Tiruchi Siva and Jagdeep S. Chokkar speak of the implications of the proposed move. Edited excerpts: Tiruchi Siva: One of the reasons the ruling party puts forth [to hold simultaneous elections] is the huge expenditure involved in the election process. In a democratic country, it the right of the people to exercise their franchise. It is the discretion of the people to elect or unseat a government. Citing expenses incurred in elections is not such a big issue in a country as vast as ours. Our main contention is that as long as we have Article 356 in the Constitution, which allows any State government to be removed by the Central government, how can you be sure that the Centre will not unseat a State government for its own personal reasons by using Article 356 if simultaneous elections are held? What will happen to the remaining tenure of that elected Assembly? As long as Article 356 is in the Constitution, no State government is assured its full term of five years. Will somebody give us an assurance that Article 356 will be removed from the Constitution? Jagdeep S. Chokkar: Well, are we trying to get the cheapest possible democracy or are we trying to get the most effective and representative democracy? I think it is wrong to put a monetary value on democracy and elections.

For the first time, administration of oath will be done in the chamber of the House during inter-session. Subscribing to oath or affirmation is usually done either during the session or in the chamber of the Chairman of Rajya Session, if the House is not in session. 2. Rajya Sabha Chairman Shri M. Venkaiah Naidu has decided to this effect, keeping in view resumption of meetings by the Department Related Parliamentary Standing Committees of both the Rajya Sabha and Lok Sabha and keen interest expressed by the new members to participate in such meetings. 3. Some newly elected/re-elected members of Rajya Sabha like Dr. K. Keshava Rao and Shri Tiruchi Siva are the Chairmen of Parliamentary Committees, who, without being administered oath or affirmation, cannot convene the meetings of respective Committees. Newly elected members also cannot participate in the Committee meetings without making or subscribing to oath or affirmation. 4. In view of the recent election of 61 members from 20 States to the Rajya Sabha and the requirement of social distancing, the oath or affirmation will be administered by the Chairman in the chamber of Rajya Sabha.

    Summary of Rajya Sabha Debates on The Transgender Persons (Protection of Rights) Bill, 2019 20 November 2019 Thawarchand Gehlot, Minister of Social Justice and Empowerment As the Minister of Social Justice and Empowerment he moved the Transgender Persons (Protection of Rights) Bill, 2019 for consideration by the Rajya Sabha. In 2012, a PIL was filed in the Bombay High Court with a view to provide protection and justice to transgender persons. A civil writ petition was preferred before the Supreme Court of India in January 2012. The Ministry of Social Justice and Empowerment was informed of this litigation, and it constituted a Special Committee to make recommendations on the basis of which the Supreme Court issued its decision. Further, a private member Bill was introduced by Tiruchi Shiva here in the Rajya Sabha and was passed. At that time, we told Shiva that the Supreme Court has issued a decision wherein it was expected from the Ministry of Social Justice and Development, Government of India, to frame a law to extend protection to transgender persons and to extend to them social justice and to bring them into mainstream society. Thus, this matter was referred by the said Ministry to the Standing Committee for their recommendations. The Standing Committee gave its recommendations in 2017 and on the basis of it a Bill was presented in the Lok Sabha. However, the Bill was lapsed due to the Lok Sabha being dissolved on account of general elections. Once again, the Bill has been presented in the Lok Sabha and has been duly passed by it on August 5, 2019.
