महोदय, ी बी.के . हांिडक -- ये हमारी पाटीर् के मेबर नहीं ह, ये आपकी पाटीर् के मेबर थे। वे Committee on Welfare of OBCs के अध्यक्ष थे। उन्हने पहली िरपोटर् 2012 म दी, दूसरी िरपोटर् 2013 म दी और थडर् िरपोटर् भी दी। उन्हने हर िरपोटर् म दोहराया िक 2 Uncorrected/Not for publication 11.08.2021 िपछड़े वग के िलए अलग से आयोग बनना चािहए और उसको संवैधािनक दजार् िदया जाना चािहए। म जानना चाहता हूँ िक ी बी.के . हांिडक की िरपोटर् को िकसने ठंडे बते म डाला? नरिसहा राव जी धान मंतर्ी थे, वे िकस पाटीर् के थे? वे कांगर्ेस के नेता थे। आज म सदन को बताना चाहूँगा िक नरिसहा रावजी ने Economically Weaker Sections को 10 परसट का आरक्षण देने का एलान िकया था। 25 िसतबर, 1991 को Official Memorandum stated 10 per cent for other Economically Weaker Sections not covered under any other scheme of reservation, यह आपने देने का काम िकया था। लेिकन महोदय, म खरगे साहब से जानना चाहता हूँ िक सुीम कोटर् ने इंिदरा साहनी के मामले म जब ऊँ ची जाित के गरीब लोग के 10 परसट के आरक्षण को र कर िदया, तब आपने क्य नहीं संिवधान संशोधन लाकर 3 Uncorrected/Not for publication 11.08.2021 उनको आरक्षण देने का काम िकया? ...(यवधान)... उसे सुीम कोटर् ने र कर िदया। वह इसिलए र कर िदया िक जहाँ एक ओर ी नरेन्दर् मोदी जी ने संिवधान म संशोधन करके EWS के िलए आरक्षण का ावधान िकया, आपने एक official memorandum, 4 लाइन की एक िची िनकाल कर खानापूिर्त करने के िलए ऊँ ची जाित के गरीब लोग के िलए, Economically Weaker Sections के िलए आरक्षण देने का एलान कर िदया और वह struck down हो गया। वह 1993 म struck down हुआ। 1993 के बाद आज िकतने साल हो गये? आज तक आपने Economically Weaker Sections के िलए additional reservation देने का ावधान क्य नहीं िकया? ...(यवधान)... महोदय, यह नरेन्दर् मोदी जी की सरकार है, िजन्हने 103वाँ संिवधान संशोधन 2019 म िकया और आिर्टकल 15 तथा 16 म एक नया sub-section-6 जोड़ा गया, िजसम इस बात का ावधान िकया गया िक "Nothing in this Article shall prevent the States from making any special provision for the advancement of any Economically Weaker Sections of citizens other than....." इसम एक और ावधान िकया गया िक "in admission to educational institutions" और संिवधान की धारा-16 म एक नयी धारा-6 जोड़ी गयी। कांगर्ेस के समान नरेन्दर् मोदी जी ने कोई Official Memorandum िनकाल कर Executive Order से आरक्षण लागू नहीं िकया, बिक हमने संिवधान म संशोधन करके , िजसका आपने भी समथर्न िकया, इसम आरक्षण लागू िकया। 4 Uncorrected/Not for publication 11.08.2021 महोदय, चँूिक हम मालूम है िक इसम 50 ितशत की सीमा है, इसिलए हम लोग ने इसको 16(4) म लागू नहीं िकया। (1क्यू/एके एम पर जारी) AKM-KSK/1Q/1.05 ी सुशील कु मार मोदी (कर्मागत) : इसिलए हमने इसको धारा 15(4), 16(4) म लागू नहीं िकया, बिक संिवधान म एक नई धारा जोड़कर हमने वीकर सेक्शन के िलए 10 ितशत का अितिरक्त आरक्षण िदया। मुझे पूरा िववास है िक कल जब भी सुीम कोटर् के अंदर यह मामला आयेगा, सरकार की जीत होगी। ऊं ची जाित के लोग को आरक्षण देने का जो काम आदरणीय नरेन्दर् मोदी जी की सरकार ने िकया है, उसका लाभ इस देश के लोग को िमलेगा। उपसभाध्यक्ष महोदय, ये बार-बार कहते ह िक ‘देर आये, दुरुत आये।‘ SC/ST (Prevention of Atrocities) Act, 1989, अनुसूिचत जाित-जनजाित अत्याचार िनवारण अिधिनयम, 1989 की कु छ धाराओं को सुीम कोटर् ने िशिथल कर िदया, dilute कर िदया। यह नरेन्दर् मोदी जी की सरकार है, िजन्हने िफर से िबल लाकर उस पावर को restore िकया और कहा िक हमारे दिलत और आिदवासी भाइय के साथ िकसी कार का अत्याचार हम बरदात नहीं करगे। इतना ही नहीं, जो एस.सी./एस.टी. एक्ट को restore िकया, उसम 11 और नई धाराएं जोड़ दी गईं। Tonsuring of head, moustache, अगर कोई िकसी का बाल मंुडाकर, मंूछ मंुड़ाकर उसको बाजार म घुमाता है, तो उस पर भी एस.सी./एस.टी. एक्ट लागू होगा। अगर 5 Uncorrected/Not for publication 11.08.2021 कोई जूते की माला पहनाकर घुमाता है, तो उस पर एस.सी./ एस.टी. एक्ट लागू होगा। अगर मृत जानवर को ढोने के िलए बाध्य िकया जाता है या उसको गाड़ने के िलए बाध्य िकया जाता है तो यह उस पर भी लागू होगा। ...(यवधान)... अगर कोई नॉिमनेशन म बाधा पैदा करता है तो भी लागू होगा। उपसभाध्यक्ष जी, म के वल आपकी जानकारी के िलए बताना चाहता हूं िक ी राजीव गांधी जी के समय म दोन सदन से पािरत हुआ, लेिकन एस.सी./एस.टी. एक्ट को लागू करने का काम उस सरकार ने िकया जो िक वी.पी. िंसह की सरकार थी, िजसम जनसंघ के लोग शािमल थे। आप इितहास को उठाकर देख लीिजए। Though it was passed during Shri Rajiv Gandhi's Government, but it was implemented when Shri V.P. We express grave concerns with the regressive Transgender Persons (Protection of Rights) Bill and the Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2018. Both bills are pending consideration before the Rajya Sabha now. We request the Honorable Speaker to not ​ introduce the Transgender Bill and Trafficking Bill in the Rajya Sabha and to please refer these Bills to a Select Committee of the Rajya Sabha. ​ Recently in August 2018, the Delhi High Court in Harsh Mander and ors. vs. UoI has observed that the approach of criminalising begging was not a solution to addressing the problem. “The State simply cannot fail to do its duty to provide a decent life to its citizens and add insult to injury by arresting, detaining and, if necessary imprisoning persons who beg in search for essentials of bare survival”. Both the Bills (Transgender Bill and ​ Trafficking Bill 2018) are fundamentally motivated by a criminalizing impulse. Issues which have to be seen within the lens of development are sought to be dealt with by criminal law. The state instead of taking on welfarist / developmentalist functions chooses to focus on incarcerating the poor.

Edited excerpts: Tiruchi Siva: One of the reasons the ruling party puts forth [to hold simultaneous elections] is the huge expenditure involved in the election process. In a democratic country, it the right of the people to exercise their franchise. It is the discretion of the people to elect or unseat a government. Citing expenses incurred in elections is not such a big issue in a country as vast as ours. Our main contention is that as long as we have Article 356 in the Constitution, which allows any State government to be removed by the Central government, how can you be sure that the Centre will not unseat a State government for its own personal reasons by using Article 356 if simultaneous elections are held? What will happen to the remaining tenure of that elected Assembly? As long as Article 356 is in the Constitution, no State government is assured its full term of five years. Will somebody give us an assurance that Article 356 will be removed from the Constitution? Jagdeep S. Chokkar: Well, are we trying to get the cheapest possible democracy or are we trying to get the most effective and representative democracy? I think it is wrong to put a monetary value on democracy and elections.
