3. MINUTES OF THE ENVIRONMENTAL SERVICES COMMITTEE MEETING HELD ON 11 FEBRUARY 2015

It was proposed by Councillor J Palmer, seconded by Councillor N Anderson and agreed that the minutes of the Environmental Services Committee meeting held on 11 February 2015 and adopted by the Shadow Council at its meeting held on 25 February 2015 be confirmed and signed.

4. PRESENTATION BY THE DIRECTOR OF ENVIRONMENTAL SERVICES RE: REMIT OF THE NEW DIRECTORATE

Members were given a presentation in respect of the remit of the new directorate of Environmental Services. The following elements were included in the presentation:

 Technical Services – presented by the Acting Director of Technical & Environmental Services (CBC)  Operational Services – presented by the Operational Services Manager (CBC)  Environmental Health – presented by the Environmental Health Manager (CBC)

Several Members stated that they had been approached by community groups, charities etc in respect of charges being introduced for refuse collection. Councillor Palmer proposed that Officers should monitor the effects of refuse collection charges and table a report at a future meeting of the Committee.

AGREED: That Officers monitor the effects of refuse collection charges for community groups, charities etc and report back to the Committee at a future meeting.

5. REPORT FROM THE DIRECTOR OF ENVIRONMENTAL SERVICES

5.1. TERMS OF REFERENCE

5.3. CAR PARK AT BALLYNAHINCH STREET, HILLSBOROUGH – NEW LEASE ARRANGEMENTS

It was proposed by Councillor J Palmer, seconded by Councillor A Ewing and

AGREED: That approval be granted for the signing of the lease for the car park at Ballynahinch Street, Hillsborough, subject to the lease being reviewed by the Council’s legal representatives.

5.4. BINOVATION APP – PROPOSED PILOT PROJECT

AGREED: That approval be granted to implement the Binovation App for one year pilot.

5.5. CIVIC AMENITY SITE METAL CONTRACT ISSUES

The Director of Environmental Services advised that the current contract was due to expire on 31 March 2015 but that there was the option to extend the contract for up to one year if necessary.

AGREED: That retrospective approval be granted for the revised pricing arrangements for scrap metal for the continued period of the current contract as extended.

5.6. COMMERCIAL WASTE COLLECTION SERVICE

It was proposed by Councillor J Palmer, seconded by Councillor J Tinsley and

AGREED: That authority be delegated to the relevant Heads of Service to approve customer billing in advance, either on a quarterly or six-monthly basis.

5.7. NI AMENITY COUNCIL BEST KEPT COMPETITION / ADDITIONAL REPORT – ULSTER IN BLOOM

Members agreed to consider the entries for the NI Amenity Council Best Kept Competition together with entries for Ulster in Bloom, which had been listed in an additional report from the Director of Environmental Services.

AGREED: That approval be granted for the entries for the NI Amenity Council Best Kept Competition and the Ulster in Bloom competition, as listed in the report from the Director of Environmental Services, to be submitted.

5.8. CORPORATE HEALTH & SAFETY POLICY

It was proposed by Councillor B Hanvey, seconded by Councillor J Palmer and

AGREED: That approval be granted for adoption of the Health & Safety Policy for Lisburn & Castlereagh City Council.

5.9 ARRANGEMENTS FOR OUT-OF-HOURS COMMUNICATIONS AND RESPONSE

The Director of Environmental Services referred Members to correspondence received and advised that the Food Standards Agency and the Public Health Agency had asked for a response to be received by 13 March 2015.

It was proposed by Councillor N Anderson, seconded by Councillor A Givan and

AGREED: That approval be granted, in principle, to continue a shared arrangement with & North Council for the handling of food alerts, incidents and food poisoning outbreaks, and that a response be forwarded to the Food Standards Agency and the Public Health Agency by the deadline of 13 March 2015.

5.10 COUNCIL GARAGE AT PRINCE REGENT ROAD

It was proposed by Councillor J Palmer, seconded by Councillor J Tinsley and

AGREED: That approval be granted for the Chief Executive to sign the lease, subject to confirmation of a satisfactory legal review, and that a report be tabled at the Shadow Council meeting, recommending the signing of the lease under seal.

5.11 LGR PROPERTY TRANSFER – ARMAGH CRAIGAVON COUNCIL TO LISBURN & CASTLEREAGH CITY COUNCIL

It was proposed by Councillor J Palmer, seconded by Councillor J Tinsley, and

AGREED: That approval be granted for the proposed arrangements for the transferring properties from Armagh Banbridge Craigavon Council to Lisburn & Castlereagh City Council.

5.12 OFF-STREET CAR PARKING

Following discussion relating to the possible benefits of the pilot scheme to retailers in the town centre and their customers, it was proposed by Councillor J Palmer, seconded by Councillor A Givan and

a) To note the report and the Terms of Reference of the Working Group b) That the Chief Executive or her nominated officer sign the Agency Agreement regarding parking enforcement c) That the pilot scheme of £1 per five hours be continued until more evidence in respect of cost-effectiveness was available and to review the scheme.

5.20 PROPOSED RESURFACING AND DRAINAGE WORKS TO AND ROAD HOUSEHOLD RECYCLING CENTRES (HRC)

The Director of Environmental Services advised that no issues relating to the HRC in the Cregagh Road had been identified during an inspection, therefore the site could transfer to with no site works to be carried out. She added that she would table a report listing the required works at the Carryduff HRC at a future meeting of the Committee.

6.1.1 MATERIALS RECOVERY FACILITY (MRF) CONTRACT

It was agreed to note the report in respect of the Materials Recovery Facility contract.

6.1.2 PROPOSED MEMORIAL PLAYGROUND – ERIN THOMPSON

The Director of Environmental Services advised that a further report, outlining further developments regarding the proposed memorial playground, would be tabled at a future meeting of the Committee.

It was agreed to note the report in respect of the proposed memorial playground.

6.1.3 PROVISION OF PROCUREMENT AND CONTACT LEGAL SERVICES TO ARC21

It was agreed to note the report in regarding provision of procurement and contract legal services to .

7 STAFF IN COMMITTEE

7.1 ENVIRONMENTAL SERVICES DIRECTORATE – HEADS OF SERVICE RESPONSIBILITIES

The Director of Environmental Services advised the Committee that following confirmation of the organisational design, some refinement had been necessary within the Directorate Service Units. . She added that there had been no changes in the overall remit of responsibilities, with the exception of petroleum licensing transferring to Environmental Health from Building Control.

AGREED: That approval be granted for the Environmental Services Directorate as set out in the report from the Director of Environmental Services.

7.2 ACTING UP POST

The Director of Environmental Services sought approval for one acting-up position in the Leisureplex, ie the phased retirement of the Plant Manager, to continue after 31 March 2015.

8 ANY OTHER BUSINESS

8.1 UPDATE ON COMMERCIAL WASTE (VAT) (Nno)

The Acting Assistant Director of Environmental Services (Technical Services) referred to previous Committee approval to accept commercial waste at amenity sites. Officers had been advised that the Council was not claiming VAT on commercial waste, therefore approval was now sought to remove the VAT element.

AGREED: That approval be granted to remove the VAT element from commercial waste charges at the Council’s amenity sites.

8.2 ELECTRICITY PROCUREMENT (SBD)

The Acting Director of Technical & Environmental Services (CBC) referred to approval granted at the previous meeting of the Committee for the Chair and the Director of Environmental Services to sign the contract for the procurement of electricity. He now sought retrospective approval to accept the tender for the procurement of electricity.

AGREED: That retrospective approval be granted to accept the tender from LCC for the procurement of electricity for Lisburn & Castlereagh City Council.

8.3 THANK YOU

As this was the last meeting of the Committee in the current year, the Chair thanked Members for their support and participation. He also thanked officers for their support and particularly the Members’ Services officer for producing accurate minutes. He also offered his best wishes for success to the Director of Environmental Services in her post. The Chair also wished Councillor B Hanvey, and Councillor T Mitchell every success as Chair and Vice-Chair of the Environmental Services Committee in the next year.

ITEMS FOR DECISION

1. SUB REGIONAL ANIMAL WELFARE ARRANGEMENTS

Members may be aware of the regional arrangements that have been in place in relation to Animal Welfare. The Animal Welfare function undertaken by Local Government in respect of non-farmed animals is fully funded by the Department of Agriculture (DARD). Historically the arrangements have been coordinated on a regional basis largely reflecting the previous Group arrangement along with Belfast City Council. The proposed continuance of this service is still on a regional basis however regard has been given to the financial restrictions associated with the function. Consequently, having been considered by all of the 11 new Councils, it is recommended that four sub regional management centers be progressed as opposed to the previous five that existed. These areas will be Northern, Southern, Western and Eastern (including Belfast). Fermanagh and District Council will act as the Northern Ireland lead council for the purposes of the Welfare of Animals Act (NI) 2011. As regional lead council, District Council will have a co-ordinating role with all councils and will be the agreed single point of contact with DARD and PSNI.

As outlined above the model for service delivery will include a four centre sub regional model linking to the regional lead council. The Eastern region will now include Belfast City Council (BCC) as it will join with the new council areas of Lisburn & Castlereagh City Council (L&CCC) and Ards & North Down Council (A&ND). DARD is progressing the Memorandum of Understanding for each of the Councils to consider and sign up to so as to formalise the sub regional service model arrangements. However it will not be possible to conclude the signing of the memorandums and secure local arrangements within the Eastern Region in advance of 1st April 2015. Consequently a short term agreement has been put in place with L&CCC, A&ND and BCC for the discharge of the Animal Welfare service until the Eastern Region agreement is confirmed and finalised with each of the council sin the Eastern Region. At this stage it is envisaged that the short term arrangement will be in place until 30th June 2015.

Once the Eastern Region agreement has been finalised a number of measures will be progressed in keeping with the overall regional arrangements:

 Fermanagh and will continue to act as the Northern Ireland lead council for the purposes of the Welfare of Animals Act (NI) 2011;  To ensure the effectiveness of the Animal Welfare Service and a collaborative regional approach to the function, a regional Project Board will be formed. Officer representatives will be required from each of the councils to sit on this Board, along with 4 sub-regional lead council animal welfare officer line managers, two representatives from DARD, PSNI and a number of other members;  A sub regional Animal Welfare Forum will be established;

 There will be two Memorandums of Understanding (MOU) with DARD. One between the Regional Lead Council and DARD, and the other between each sub regional Lead Council and DARD;  Enforcement will be in accordance with the overall enforcement policy of L&CCC. An agreed set of generic enforcement guidelines in relation to Animal Welfare will be finalised and appended to the Council’s enforcement policy;  A communications plan will be developed which will set out the plan which the regional Animal Welfare Project Board will use for communicating the overall work in relation to Animal Welfare;  A regional tender will be progressed by Fermanagh and Omagh District Council for the care and collection service of animals;  A Service level Agreement will be signed between BCC and the other Regional Lead Councils regarding legal services support to the Animal Welfare Service up to 31st March 2016 and then reviewed:  Each sub regional Lead Council will procure its own veterinary support for Animal Welfare cases.

Recommendation

It is recommended that Members approve the short term Animal Welfare Service arrangements as outlined for implementation with effect from 1st April 2015. It is also recommended that Members note that the overall harmonised Eastern Region arrangements will be finalised with Ards & North Down and Belfast City Council and confirmed with Members.

2. RIVERS AGENCY – PRESENTATION ON FLOOD MAPS OF NORTHERN IRELAND

Members will be aware that flooding has caused problems for a number of residents in recent years causing substantial damage to property and possessions.

With the Planning Service now based within the new Lisburn & Castlereagh City Council, the Council have new responsibilities for ensuring that applications for development are fully considered in the planning process. With this in mind, Rivers Agency staff have delivered a presentation on Flood Maps (Northern Ireland) to the last meeting of the Drainage Council for Northern Ireland. The interactive map- viewer enables users to access the latest flood hazard information available from Government and also highlights areas throughout Northern Ireland which are prone to flooding in order to enable potential adverse impacts to be identified and therefore assist with the planning process.

Rivers Agency has forwarded correspondence (Appendix 1 refers) offering a presentation to Council on the interactive map-viewer. The purpose of this report is to ascertain if Members would like to avail of this offer to enable suitable arrangements to be made.

Recommendation

It is recommended that Members note the above and indicate if they would like to avail of the River Agency’s offer to deliver a presentation on the Flood Maps of Northern Ireland map-viewer.

ITEMS FOR NOTING

3. BEE SAFE

Members will be aware that both extant Councils run an annual event for Primary 7 children titled “Bee Safe”. The event is hosted by the Councils and with help from Home Accident Prevention (HAP) and funding provided by the Public Health Agency under the Health and Wellbeing Partnership.

The primary purpose of the event is to prepare children for their transition to secondary education. The event is due to take place week commencing 23 March 2015 covering the historic area. An additional report will be tabled next month to update Members on the success of the event.

Recommendation

It is recommended that Members note the above report.

4. DOG FOULING BLITZ

Members will be aware how emotive dog fouling can be and the impact this irresponsible act can have on a local community.

The Environmental Health Service Unit has publicised a Dog Fouling Blitz due to take part in April 2015 in a number of identified “hot spots” across the City Council area and is specifically targeting these areas during this initiative. Patrols will be increased, officers will reaffirm responsible behaviour and offer free poop-scoops and advice to persons “in charge” of a dog during the event.

Any observed persons failing to “scoop the poop” will receive a Fixed Penalty Notice during this zero tolerance initiative and failure to pay the Fixed Penalty Notice, will result in legal proceedings being instigated.

Recommendation

It is recommended that Members note the above report.

5. SERVICE DELIVERY

Members will be aware that from 1 April 2015 both extant Councils will no longer exist and that a single Environmental Health Service Unit will operate under Lisburn & Castlereagh City Council.

The purpose of this report is to advise Members that in the interim, the Environmental Health Service Unit will operate out of both Lagan Valley Island and Bradford Court. The final location will be dependent on a number of factors , some of which will be addressed as part of the accommodation review within the Estate’s Strategy presently being completed across the Council.

6. RELOCATION OF THE GARAGE FROM PRINCE REGENT ROAD

At the time of writing this report a draft lease has been received and reviewed. Comments have been prepared on behalf of the Council and returned to Solicitors.

It is very unlikely that an appropriate agreement will be in place in time to allow a move directly from the Garage at Prince Regent Road to Ryan Lane. Interim storage and working arrangements are being put in place to ensure service continuity and minimum disruption to residents. A verbal update will be given to Members at the meeting.

7. ADOPTION OF STREETS UNDER THE PRIVATE STREETS (NI) ORDER 1980 AS AMENDED BY THE PRIVATE STREETS (AMENDMENT) (NI) ORDER 1992

8. TENDER FOR THE PROVISION OF PARK RANGER/CARETAKING & OUT OF HOURS DOG WARDEN SERVICES

Members are advised that the contract for the provision of Park Ranger/Caretaking and Out of Hours Dog Wardens Services has been concluded. The successful tender submission was received from Hi-Tech Security Services, 54 Road Lisburn BT27 5BX.

The new contract arrangements are due to commence on 1st June 2015 and will cover the entire new Council area.

9. TREE WORKS WITHIN WALLACE PARK AND MOIRA DEMENSE

Members are advised of correspondence received from Translink regarding the felling of three trees adjacent to the train line within Wallace Park. The works commenced on 23rd March 2015 and are required as the result of a recent condition survey and will take approximately one week to complete. The site

works were subject to the necessary health & safety conditions being supplied by Translink to the relevant Council officers.

Members are also advised of works being carried out in Moira Demense. Following the recent incident in Lisburn where a falling tree led to a fatal road traffic incident, a survey of Council owned trees was carried out. Whilst the tree involved in the fatal incident was not within Council grounds, the incident reinforced the need to ensure the stability of trees in public accessible areas. As a result of the survey some trees were identified for felling in the interests of safety and this work has been initiated. .

10. CEMETERY COVER ARRANGEMENTS 2015

Attached as Appendix 2, for Members’ information, are details of the holiday arrangements for cemeteries for 2015.

11. REFUSE COLLECTION POST 1 APRIL 2015

Members will be aware that due to the boundary changes resulting from the Local Government Reform process, not only are the extant Council areas forming a significant part of the new Lisburn & Castlereagh City Council (L&CCC), but there is also a series of household transfers taking place on 1st April 2015 from Armagh, Banbridge and Craigavon (ABC). As a result, it will ultimately be necessary to redesign the Council’s refuse collection routes to accommodate these changes and to maximise collection efficiency.

Notwithstanding the above, the current collection processes will continue in their present guise absorbing the transferring in properties from ABC until the necessary changes can be implemented. This will reduce the potential for disruption to the Council’s refuse service and facilitate a graduated lead-in period for the new refuse collection routes once the re-routing process has been completed.

13. UPDATE ON REPLACEMENT OF LISBURN CITY COUNCIL AND CASTLEREAGH BOROUGH COUNCIL SIGNAGE

Members will be aware that at a number of locations across the extant council areas there were signs depicting the point of entry into the areas previously known as Lisburn City Council and Castlereagh Borough Council areas. An overall facility and area rebranding audit will be completed in due course however in preparation for vesting day the main point of entry signs to the new L&CCC area have been updated to reflect the new Council name. This work is planned for completion for 1st April 2015.

Appendix 4 shows the detail of the signage in the area previously known as Lisburn City Council. A further update will be given at the meeting in respect of the signage in the area previously known as Castlereagh Borough Council.

14. CORRESPONDENCE FROM NORTHERN IRELAND ENVIRONMENT AGENCY (NIEA) Attached as Appendix 5 for Members’ information is a copy of correspondence received from NIEA. Chris Mills, Director of Resource Efficiency NIEA, recently met with the 11 new council Chief Executives (CEOs) to discuss the options for improving the co-operation and working relationship of NIEA with the new Councils with respect to waste management and regulation. As Members will appreciate waste management is one of the key financial drivers for the Council and any means to reduce costs and increase efficiencies is to be welcomed. Chris Mills makes reference to the ‘Mills Report’, published in 2013, which concluded that there have been systematic failures in the management and regulation of the Northern Ireland Waste sector, including significant criminal infiltration. It has been recognised that the ramifications of this have impacted on

all agencies including Local Authorities who are the major producer of municipal waste.

NIEA is working on a holistic approach to the control and monitoring of municipal waste which includes:  Effective waste management regulation;  Best Practice contract procurement;  Effective application of Duty of Care;  High quality data reporting and auditing, and  The recovery and disposal of waste across all jurisdictions.

Other actions relating to enhanced liaison and partnership working between Central and Local Government are set out in the DOE’s Operational Plan for managing and regulating waste in Northern Ireland (NI). There was considerable support for exploring opportunities for sharing resources on joint actions such as data sharing and joint inspections and for the creation of nominated contracts to help facilitate day to day working across the whole sector of Government.

At the meeting with the CEOs there was an appetite to go beyond compliance and to start to build a resource efficient NI. It was both appreciated and recognised that this will take some time to achieve however the purpose of this update is to advise Members that the Council can work with NIEA in this regard. NIEA is keen to engage with the Council at an early stage in their considerations and has proposed that this is initially achieved through the nominated three CEOs. The CEO of L&CCC has replied to NIEA and confirmed that this initial approach is to be welcomed. Members will be kept apprised of further developments in this overall area.

The ‘Most Improved’ title went jointly to and and the ‘Roses in Towns’ award winner is Lisburn C winners are: and Castlereagh Borough Council in recognition of efforts to support biodivers Riverside Bed & Breakfast - Cushendall, Edenvilla Park & Secret Garden - Portadown and the Crawfordsburn Inn fo plant/floral presentations.

Wallace Elder from ‘Ahoghill in Bloom’ is the winner of the Ulsterbus Tours Community Champion Award in recognitio positive difference he has made to his local area by embracing the ‘Ulster in Bloom’ ethos. Wallace was nominated by Borough Council.

Winner of the Tourism NI ‘Giro d’Italia’ Award is Loughgall (Co Armagh) for demonstrating the best support for the ‘G theme.

The Best Station title was scooped by Train Station and the Community Rail Halt Award went to Brighter Whi for their work at Whitehead Train Station.

Speaking at the awards ceremony in Malone House, Belfast, Angela Coffey, Translink Board Member, said:
