De Commissie geeft aan dat de Commissie ernstige twijfels heeft omtrent de verenigbaarheid van de ontwerpmaatregelen van OPTA, voor zover die betrekking hebben op de retailmarkten van UPC, Casema en Essent, met het Gemeenschapsrecht en met name met de in artikel 8 van de Kaderrichtlijn genoemde doelstellingen. De Commissie stelt hiertoe dat de door OPTA in de ontwerpmaatregelen onderscheiden retailomroepmarkten op grond van de ten tijde van haar brief beschikbare gegevens niet aan de drie criteria test voldoen en derhalve niet in aanmerking komen voor regelgeving ex-ante. Op 8 november 2005 heeft een bespreking plaatsgevonden tussen de Commissie en OPTA naar aanleiding van vorenbedoelde brief van de Commissie. OPTA heeft in deze bespreking aangegeven zich niet te kunnen verenigen met de stellingen van de Commissie. De Commissie heeft OPTA, omwille van de tijdsdruk aan de zijde van de Commissie om het Fase II onderzoek tijdig af te kunnen ronden, verzocht om uiterlijk 18 november 2005 schriftelijk aan te geven waarom OPTA zich niet kan vinden in de stellingen van de Commissie. OPTA is hiertoe graag bereid.

    De wereld van het digitale televisie kijken 4 april 2006 Versie 1.1 Samenstelling door Rudie Heinen, stagiair bij Moving Content De wereld van het digitale televisie kijken Inleiding De afgelopen tijd hebben zich allerlei ontwikkelingen voorgedaan in de wereld van de televisie. Het doel van dit rapport is dan ook het verschaffen van duidelijkheid omtrent ontwikkelingen als digitale televisie en enkele aanverwante zaken. Het rapport is samengesteld d.m.v. bronnenonderzoek. Tijdens het doen van dit onderzoek bleek dat vele toelichtingen en begrippen op het internet lijnrecht tegenover elkaar stonden. Om dit rapport toch overzichtelijk en vooral ook duidelijk te kunnen houden, moest in enkele gevallen gekozen worden voor de bron die het meest betrouwbaar leek te zijn. Hoewel het rapport is samengesteld met de grootst mogelijke zorg, bestaat er dus toch een (zeer) kleine kans dat bepaalde omschrijvingen binnen dit rapport onjuist/incompleet zijn. Daarnaast is het zo dat de ontwikkelingen op dit gebied momenteel razendsnel gaan, waardoor bepaalde informatie binnen dit rapport misschien alweer verouderd is wanneer deze wordt gepubliceerd. Toch ben ik er van overtuigd dat dit rapport voor velen zeker één en ander duidelijk zal maken en ik wens allen die in aanraking komen met dit rapport veel plezier bij het doornemen hiervan. Dit rapport is samengesteld in opdracht van Moving Content BV en bepaalde delen zijn geschreven voor de redactie binnen een bepaald project, waardoor sommige paragrafen die aan bod komen misschien minder te maken hebben met het algehele plaatje.
