SHRI SANJAY HARIBHAU JADHAV: SHRI RAJAN VICHARE: Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state: (a) whether the Government has noticed that the kidney racket cases have increased in the country; (b) if so, the details thereof indicating the cases registered, operators arrested, prosecution initiated and conviction made in this regard during each of the last three years and the current year, State/UT-wise including Maharashtra; and (c) whether the Government has investigated the role being played by the doctors, if so, the details thereof along with the corrective steps taken/being taken by the Government in this regard? ANSWER THE MINISTER OF STATE IN THE MINISTRY OF HEALTH AND FAMILY WELFARE (SMT. ANUPRIYA PATEL) (a) Few instances of illegal retrieval/transplantation of kidney have come to the notice of the Ministry of Health and Family Welfare. (b) to (c): Health is a State subject and steps for prevention and control of any such racket are required to be taken by the State Governments. Whenever a complaint comes/is brought to the notice of Department of Health and Family Welfare, the same is forwarded to States concerned and the Ministry of Home Affairs for action. Details of such cases are, however not maintained centrally. The Government of India has already enacted Transplantation of Human Organs and Tissues Act, 1994 (as amended in 2011). This Act has provisions for imprisonment upto ten years and fine upto Rs. 1.00 crore for commercial dealings in human organs. However, the enforcement of provisions of the Act is within the remit of the respective State Government..
