Here are my thoughts on the regulation. Other than the issue that we've discussed on the water sampling, I think this regulation is within the framework of SB 390 and is a step forward for the regulation of oil & gas drilling. Below are NCL's specific comments. 1. Section 9 - If a well has been hydraulically fractured, long-term sampling should be required even if operations do not last long, or the well does not produce hydrocarbons. The concern here is the injection of fracturing fluid, even if the operation was not as successful as the operator had hoped. Also, we feel that the law requires water quality monitoring and this regulation envisions specific instances where this will not occur. While we understand the argument that no other state requires this, Nevada should have a higher standard as water is more scarce here than in other states. 2. Section 11 - Although not specifically outlined in the legislation, we feel that a 300 foot setback is not far enough. Also, the provision allowing for an exception to this rule is problematic. 3. Section 12 - Although it is often the standard in other states, we don't see a compelling reason why trade secrets should be protected, especially when an operator is injecting fluids on public lands near groundwater sources. Our concerns with fracking in Nevada are extensive and very serious. Thinking of exchanging our limited water supply for natural gas/oil is absurd. You live in this state, you care about the people of Nevada. Please consider the failures and repercussions of those who have taken up this practice. Polluted ground water, environmental contamination, methane release, earthquake dangers, unwanted spills, just to name a few. If you are seriously considering this oil extraction that comes with such detrimental side effects, then you, as a governor, are failing. You are failing your good natured, fellow citizens. My kids are fifth generation Nevadans and our family has an extensive history in this amazing state. We care so deeply and need to consider the affects that our children will face. Please, please, please reconsider following the mistakes of your fellow politicians. Nevada is too precious and too fragile. Sacrificing the well being of the people, let alone sacrificing the scarce and valued resource,the resource of life, Our water, Our livelihood. Fracking in Nevada is absolutely unacceptable. Please look past the dollar signs, get past the pressures of big oil companies, help move this beautiful Nevada into the 21st century.
