Reported – The Access Officer presented the report and advised that the Southern Snowdonia Access Forum vacancy was for a member to represent equine interests.

Public Speaking Mr. Geraint Lewis, the agent, addressed the Planning and Access Committee and asked Members to consider the following:- - Gwynedd Highways Authority have no objections. - the flood consequence assessment has been approved. - there were no overlooking issues. - the setting and layout has been amended as a result of the appeal decision. - any increase in traffic and noise would be for a very short time during the building phase. - the ransom strip was bought by a 3rd party to ensure there was no further development on the site. - the developer has received enquiries from prospective purchasers. - 2 of the 4 dwellings will be subject to a Section 106 Agreement to secure affordability and local needs. - the developer intends to connect to the mains sewerage system. Assessment:

Site

The site is located within a relatively open patch of ground within the south western section of the Plas Tan y Bwlch (Plas) grounds, where the forestry section has a small nursery area.

The land is located c. 150m to the east of Porth Gwyn, Grade II listed building and former lodge to Plas and c. 250m to the south west of the main Plas Buildings which is a Grade II* listed building and is accessed by a gravelled track from the western road access to Plas.

The site, which does not form part of the formal Plas gardens, is relatively flat and well screened by mature trees.

The Authority’s tree nursery provides a stock of young trees and hedges for many of the Authority’s internal and external projects and schemes, in addition trees and hedges are grown to sell on to other organisations and to the general public at Plas.

While the site is within the grounds of Plas it lies outside the formal gardens, SSSI, SAC and ancient woodland but does lie within the Historic Park and Garden designation.

Background to proposal

The existing nursery at Plas has reduced in size of the last few years, however due to the Authority’s involvement in a number of new projects and the requirement to reduce costs and increase income it is proposed to widen the scope of the existing nursery to enable the propagation of more trees and shrubs from seed. This, in addition, should provide plants of known providence thus reducing the risk of bringing diseases into the area.

The Authority has also set up a trainee position within the forestry section through the SMS Edern Project. The project will provide funding for one trainee every year for a three-year period, it is this project which is funding the installation of the proposed polytunnel.

Proposal

The total site is shown covering an area of 30m x 8m and involves the levelling of the site including an element of cut and fill and the laying down of a hardcore surface.

The polytunnel is shown as having a width of 6m, length of 20 with a maximum height of 2.83m. The polytunnel frame will be constructed of steel 50mm tubing which will be covered in a polythene cover.

Policy Considerations and Consultation responses

Strategic Policy A

The proposal will enable the Authority to grow additional plants for use in internal and external projects that benefit the natural environment of the National Park and to provide an additional income stream.

The establishment of the polytunnel will also form part of project to provide training to local people in relation to arboriculture skills.

Development Policy 1,2 and 6

It is considered that the nature, scale and form of the development is compatible with the capacity and character of the site.

The site is located within a secluded part of the grounds which is not open to public and is well screened from the A487 by mature trees and therefore will not be unduly prominent in the landscape.

The materials proposed for the works are considered acceptable for the site.

Strategic Policy D

The Authority’s ecologist, who has visited the site, does not have any objections to the proposal taking into consideration its scale and does not consider that it would have an adverse impact on the adjacent nature designations.

As a precaution it is advised that an ecologist checks the ground for otters prior to the commencement of works.

No comments have been received from Natural Resources Wales at point of writing, any comments received will be reported verbally to committee.

Strategic Policy Ff

The site is well screened and located some distance from the Plas and its associated buildings and that of Porth Gwyn, and therefore the proposal would not be considered to have any adverse impact on the setting of the listed building.

This section of Plas grounds, while designated as Historic Park and Gardens, does not form part of the formal Plas gardens but has been used by the Authority for a number of years as a tree nursery. There is no change in the existing use of the land and the structure that can easily be removed should the nursery use cease.

Cadw have provided comments and they do not raise any objections taking into consideration the scale of the proposal and the fact that due to land topography the site is well screened.

No comments have been received from Maentwrog Community Council.

Trunk Road Authority does not issue a direction in relation to the proposal.

No other comments have been received as a result of publicity and consultation.

Conclusion:

Taking into the consideration the scale of the proposal and its siting in a secluded and well screened part of Plas grounds it is considered that the development can be considered acceptable.

The scale of the development is considered commensurate with the need identified for the polytunnel on a site already used by the forestry section as a tree nursery.

Due to the distance from the listed buildings and the fact that the site is well screened it’s considered that the proposal will not have any adverse impact on their setting.

While location in a section of designated Historic Park and Gardens the site lies outside the formal Plas gardens where a tree nursery has existed for a number of years.

No ecological concerns have been identified and it has been concluded that the proposal will not have any adverse impact on the ecology of the site or any adjacent nature designations.

It is therefore the proposal conforms to the relevant policies contained in the Eryri Local Development Plan and is considered acceptable.

Applicant: Description: Andrew & Elena Pryce Demolish existing dwelling and construction c/o George+Tomos Penseiri@Architects of replacement dwelling, relocate vehicular Ty Cambrian access, formation of new driveway and 12 Heol Penrallt parking area and associated landscaping. Machynlleth Powys SY20 8AL

Site: Two storey cottage located in the north east corner of the site. External walls of the original dwelling are whitewashed or painted stone, with slate hanging at first floor level on the southern gable. A stone built lean-to extension is situated on the southern gable and more modern extensions along the rear (western) elevation which protrudes past the northern gable.

The dwelling is orientated so that the front elevation faces away from the road. It appears that the dwelling was built, or adapted in the past, as two cottages (one-up-one-down). Despite the alterations and additions that have occurred over the years it retains its historic form, scale and setting.

Proposal: The proposal involves the demolition of the existing cottage and the construction of a replacement dwelling. The replacement dwelling would be located much in the same position as the existing property but would be re- orientated to face the road.

It is also proposed to relocate the existing vehicular access, form a new driveway and parking area as well as landscaping works within the garden which will include retaining walls.

Responses from third parties: Comments have been received from the Meirionnydd Branch of The Campaign for the Protection of Rural Wales citing the following concerns:  This part of the Dyfi Valley is an area of special character and beauty and can easily be destroyed with insensitive development.  The cottage is highly visible from the A470 and proposal would be inappropriate in their opinion.  The character of the old cottage should be retained as much as possible by renovating the existing dwelling.

Relevant Planning Policies – Eryri Local Development Plan: Policy No. Policy SP A National Park Purposes and Sustainable Development SP Ff Historic Environment DP 1 General Development Principles DP 6 Sustainable Design and Materials DP 16 Replacement of Existing Dwellings

Background: Members will recall that an application for alterations and extensions to the existing dwelling came before the Committee in December 2017. It was officers opinion at that time that the proposal would destroy the inherent character of the traditional building and was considered overdevelopment of the original dwelling. Following discussions with the applicant and their agents, the application was subsequently withdrawn with the intention of submitting a further application for a replacement dwelling.

Pre-application advice was sought for a replacement dwelling. Officers advised that the design, materials and size were acceptable in principle. There would however be a need to submit a structural survey and any other information to provide that it is not possible to repair, extend or improve the existing dwelling in an appropriate manner.

Assessment: The dwelling is included on the Authority’s list of traditional buildings and whilst not achieving the ‘special’ status of Listed Buildings, traditional buildings still require protection from inappropriate change. In accordance with Development Policy 16 the demolition and subsequent replacement of a traditional building which can be repaired, extended or improved in an appropriate manner will not normally be permitted. The use of the phrase ‘will not normally be permitted’ indicates that there can be exceptions; however, there is a need to provide substantive justification for the demolition and subsequent replacement of the traditional dwelling.

To be consistent with other applications the Authority must be satisfied that the building is substandard and the remedial work required to bring this dwelling up to modern habitable standards would render renovation financially unsustainable compared to the cost of a replacement dwelling.

A Building Condition Survey was submitted in support of the application and detailed costings for the works were requested in order for officers to consider the matter in full. The information submitted states that the building is generally in poor condition and requires work to renew or replace all elements of the existing building with the exception of the main walls. It is estimated that altering and extending the existing property would cost approx. £68,000 more compared with the cost of erecting a new dwelling in its place. Independent advice was sought from a Chartered Building Surveyor who confirmed that the costings submitted are realistic. It is accepted therefore that the work required to bring this dwelling up to modern habitable standards would render renovation financially unsustainable. Officers are therefore satisfied that the applicant has provided substantive justification for the demolition and subsequent replacement of the traditional dwelling and this proposal can be considered as an exception to Development Policy 16.

In order to comply with Development Policy 16 the replacement dwelling must also be of an improved design and complement the landscape setting. The design was discussed at the pre-application stage and whilst it is a more modern design it is considered to be an improvement to the existing dwelling which has been unsympathetically extended in the past. The design and use of materials are also considered sympathetic to their surroundings. Whilst there have been concerns that the property would be highly visible from the A470, it is considered that the proposal would not be unduly prominent in the landscape when seen traveling along the A470, which is some 475 metres to the east of the site.

It is also a requirement of Development Policy 16 that the size of the replacement dwelling is normally no more than 50% greater in total floor area than the original dwelling. Again, the use of the word ‘normally’ indicates that there can be exceptions. It is proposed to increase the floor area 55% over and above the existing dwelling. A dwelling of this size would not be out of character or scale with existing dwellings in the vicinity. It is considered therefore that there would be no conflict with the requirements of Development Policy 16 with regards to size.

Conclusion: The demolition of a traditional building and the subsequent replacement with a new dwelling would not normally be permitted; however, policy does allow for exceptions. In this instance it has been demonstrated that the work required to bring the existing property up to modern habitable standards and to provide adequate space as a family home would render the development unviable compared with the cost of a replacement dwelling. Irrespective of any financial disadvantage the applicant could face, it has also been demonstrated (through the previous application and discussions with the agents prior to the submission of the current application) that the existing dwelling could not be extended or improved in an appropriate manner without destroying the inherent character of this traditional building.

Whilst it is unfortunate that a traditional dwelling would be lost, it is considered that a replacement dwelling would be preferable than trying to extend and alter the traditional building in an unsympathetic manner.

There is no conflict with the policies identified above and no objections have been received; the application is therefore one that should be supported.

RECOMMENDATION: To GRANT permission subject to the following conditions:

1. The development hereby permitted shall be commenced before the expiration of five years from the date of this decision. 2. The development hereby permitted shall be carried out in accordance with the following approved plans: Drawing no. L 01 (Block Plan and Location Plan) Drawing no. PL 01, Rev. A dated 07/06/18 (Site Plan) Drawing no. PL 02 (Floor Plan) Drawing no. PL 03, Rev. A dated 07/06/18 (Elevations) 3. The roof of the dwellinghouse shall be covered with blue-grey slates from the Blaenau area, or slates with equivalent colour, texture and weathering characteristics details of which shall be provided and approved in writing by the Local Planning Authority. 4. Prior to any stonework commencing on the site, a trial stonework panel including pointing not less than 2.00 m² shall be constructed. No building operations in stone shall be carried out on the site unless and until the trial panel has been inspected and approved by means of a formal application to the Local Planning Authority. The stonework of the dwellinghouse shall be built in accordance with the approved sample. 5. The retaining walls necessitated by the development hereby permitted shall be constructed externally of local natural stone to match those of the existing stone walls in the vicinity. 6. The finish of the timber cladding to the dwelling shall be approved by the local planning authority by means of a formal application. Any painting or staining shall be undertaken in accordance with the approved details not later than three months from completion of the development. 7. The type and colour of the render to the external walls of the dwelling shall be approved by the local planning authority by means of a formal application. 8. The access shall be laid out and constructed strictly in accordance with the submitted plan. 9. Within 1 month of the access hereby permitted being first brought into use, the existing access servicing the site shall be permanently closed and the highway boundary reinstated in accordance with the details to be agreed in writing with the local planning authority. 10. TITLE Installation of a replacement septic tank, 1 Prince Llewelyn Terrace, Dolwyddelan (NP4/16/404)

PURPOSE For Information

For Information:

1. Planning permission was granted in 2017 for the installation of a replacement septic tank on land at 1 Prince Llewelyn Terrace, Dolwyddelan.

2. During the consideration of the application it was discovered that a non-native invasive plant, namely Japanese knotweed (JKW), was present on the proposed site of the replacement septic tank. Conditions were placed on the approval to ensure the management and eradication of the plant. Condition 4 stipulated that the JKW should be eradicated prior to work commencing on the installation of the septic tank.

3. Due to the nature of the plant the eradication of JKW as part of a development proposal can be complex and difficult to achieve without lengthy and costly treatment.

4. The applicant felt aggrieved that no work could commence on the installation of the septic tank until such time as the JKW was fully eradicated from the site. Due to the veracity of the plant it can take three to five years to fully eradicate the plant. As this would have delayed the installation of the septic tank the applicant appealed against condition 4.

5. In determining the appeal the Planning Inspector concluded that whilst the eradication of the JKW from the site is necessary it was unreasonable to stipulate that the JKW be fully eradicated prior to work commencing on the septic tank.

6. The Inspector re-worded the condition to ensure that the JKW management and eradication plan, required by condition 3 included a programme of works to ensure the timing of the works for the replacement septic tank is accounted for within a JKW treatment and eradication programme.

7. The outcome of the appeal is considered to be a reasonable compromise in that the applicant can install the septic tank at an appropriate time whilst still having the commitment to manage and eradicate the JKW.

8. The appeal decision has given clarity with regards to imposing conditions in the management and eradication of JKW.

The Authority are exploring the possibility of initiating ‘direct action’ under Section 219, to attempt to secure the demolition of the hotel.

PURPOSE To report for information on discussions and issues raised at meetings in June 2018 Northern and Southern Snowdonia Access Forums

1. BACKGROUND

1.1 There are two Access Forums in two Snowdonia National Park - one for Northern Snowdonia and one for Southern Snowdonia.

1.2 The Access Forums are statutory (with a term of three years) appointed under the CROW Act 2000 (Section 94.4) to advise the Authority on improvements in access in the area in order to facilitate recreation and enjoyment in the outdoors. The meetings are held every quarter - in March, June, September and late November / early December.

1.3 Representatives from the Authority are nominated for both Forums.

2. June 2018 meetings

2.1 Matters discussed in both Forums

2.1.1 Letter of response from W.G was received following the joint LAF Chairs’ letter expressing their concern in relation to the SNP grant reductions.

2.2 Matters discussed at the Northern Forum only (4/6/18)

2.2.1 Some discussions were had about the installation of the new Cwm Idwal bridge.

2.2.2 Discussion regarding the NRW Forestry holdings and the Public Rights of Way issues within them. 2.2.3 A CROW Act restriction has been applied for by the Power Company – to exclude the right of access for a period of 4 months for work to be completed within the area designated. 2.2.4 Update on the current state work on the Dolwyddelan- Unclassifed road. 2.2.5 Agreed to have a joint sub group (SNP South & North and Arfon Dwyfor LAF) approach to the new Gwynedd Council Rights of Way Improvement Plan consultation. Hopefully this may be in September.

2.3 Matters discussed at the Southern Forum only (11/6/2018) 2.3.1 The co-option of a new member to represent the equine sector on the SLAF has now formally been approved by the Authority. 2.3.2 Letter of response was received from Gwynedd Council –Highways regarding the potential linkage from Aberdovey Outward Bound centre to Bryn Llestair (Picnic Island). This was not favourable however, members felt that this required further action and discussion. 2.3.3 The Forum approved the formal application as presented by the NRW for another 5 year restriction on the area known as Traws Ranges – for the protection of the public due to remnants from the old firing ranges. 2.3.4 Members were updated on the equine access on the Mawddach Trail and after consultations with the NRW about additional access provision at the adjacent Coed y Garth. 2.3.5 There was an update on the Dolgoch Woodland CROW gating issue. This will now go ahead following discussion with the Dolgoch Trustees. 2.3.6 There was a request from the equine sector for the SNP to produce a bridleway guide similar to the one produced by Ceredigion Council for the National Park. PR would look into this. 2.3.7 General discussion was had on the progress in Cwm Maethlon (Happy Valley) and the unclassified road with the off roading fraternity and their contribution to the improvement.
