The MPAA Program Suppliers are claimants for and beneficiaries ofthe 1997 cable royalties at issue in this case. The court's decision in this case may affect the amount of 1997 cable television royalties to which they are entitled. MPAA has represented program supplier claimants in royalty distribution proceedings from the inception of the statutory license claims and distribution process and, therefore, maintains a strong interest in maintaining the integrity ofthe process. The court's decision in this case may affect the processes and procedures for claiming royalties and establishing entitlement thereto as well as the construction ofprovisions ofthe Copyright Act governing substantive and procedural aspects ofthe royalty distribution proceedings. GROUNDS FOR INTERVENTION MPAA and the MPAA Program Suppliers expect that some of issues to be raised by petitioners in this case will differ substantially from the issues raised in their above- captioned consolidated appeal (No. 02-1033) ofthe decision of the Librarian of Congress ' list of the MPAA-represented program suppliers is attached hereto as Exhibit 2. In a separate, concurrently-filed motion, movants have sought leave to defer submission of the disclosure statement required by Circuit Rule 26.1 pending submission of its Certificate of Counsel under Circuit Rule 28(a)(1) in No. 02-1033. now before this court. Intervention would allow MPAA and the MPAA Program Suppliers to respond as may be necessary and appropriate to such distinct issues.
