C/670/13 Confirmation of Minutes Minutes of Meeting of the County Council held on 9th September 2013

In relation to minute number C/582/13, an error in the draft minutes whereby the totals for each Member’s expenses for attending conferences were misrepresented has now been rectified with the inclusion of the correct table of expenses.

C/671/13 Questions

C/672/13 Phone Booths on the Public Pavements

Question: Councillor M. Baker “To ask the Manager to confirm if it is legal for the telephone companies who own phone booths on the public pavement to festoon them with advertisements?”

Reply: “Telephone companies may advertise on their own structures. Any other person/body placing advertisements on these structures, without the owner’s permission, is in breach of the Litter Pollution Act.”

C/673/13 Letter Boxes on Public Pavements

Question: Councillor M. Baker “To ask the Manager to confirm if it is legal for An Post to adhere advertisements to letter boxes on the public pavement?”

Reply: “An Post may advertise on their own structures. Any other person/body placing advertisements on these structures, without the owner’s permission, is in breach of the Litter Pollution Act.”

C/674/13 Cooperative Housing

Question: Councillor V. Boyhan “To ask the Manager to examine land / sites under the control of the Council in order to establish if they are suitable for the building of co-operative housing subject to planning and finance, and to bring a report to Council?”

Reply: “The Council as Housing Authority and approver of funding streams such as the Capital Assistance Scheme (CAS) and Capital Advance and Lease Fund (CALF) cannot act as sponsor or partner for any proposed co-operative housing development.

There is currently no funding stream or arrangement in place for the Council to financially assist the proposal.

However, the Housing Department will support any such proposal and will consider any application from a group/co-operative/approved housing body for a site for the construction of housing for qualified housing applicants. However, it will be necessary for the interested qualified housing applicants to form a co-operative or housing body before the Council will consider disposal of a site or lands.

It will be the responsibility of the co-operative to source and obtain the necessary funding/financing, and also to obtain the required planning permission and building control/fire safety certificates.”

C/675/13 Gateway - Community Employment

2 Question: Councillor V. Boyhan “To ask the Manager to actively engage with community welfare services to facilitate the Gateway Back To Work Community Employment Scheme and to report on the areas where the Council could offer job placement as part of this scheme?”

Reply: “The Council has been and continues to be in contact with Community Welfare Services in relation to the introduction of the Gateway - Labour Activation Scheme. The Council has had discussions with the relevant trades unions with a view to the introduction of the scheme. In addition management has been actively pursuing areas across all services/departments to identify suitable positions/projects under the scheme with a view to having it commenced in Dún Laoghaire-Rathdown before the end of the current year.

In addition to this new scheme, the Council currently Sponsors 3 CE Schemes through the Community Section. There are approximately 127 Community Employment Learners working across the County supporting community activities and gaining valuable work experience. The Community Employment schemes offer Learners a wide range of experience in the following roles:  Caretakers  Childcare Workers  Administration Support  Youth Workers  Sports Assistants  Environmental Workers  Catering Assistants  Book Keepers  Tour Guides  Visual Arts Assistants

In the last Community Employment scheme review (July 2012 to July 2013), across the 3 schemes, there was an average progression rate of 62%. This is split evenly with an average of 31% of Learners progressing into employment and an additional 31% progressing into further education.”

C/676/13 Housing Needs Assessment - 2013

Question: Councillor V. Boyhan “To ask the Manager to provide a report on the Housing Needs Assessment commenced at the beginning of the year and to highlight significant changes since the last Housing Needs Assessment?”

Reply: “The 2013 Housing Needs Assessment for Dún Laoghaire-Rathdown was submitted to the DoECLG e Returns website on 17 June 2013 for inclusion in the national report. The national report is now being compiled with information having been received from all housing authorities. It is due to be published in the coming weeks. A full report will be presented to the members at that stage.”

C/677/13 Council's Register of Lands and Buildings - Progress Report

Question: Councillor V. Boyhan “To ask the Manager for a progress report on the updating and establishment of a central register of Council lands and buildings? (Ref: Local Government Audit Service)?”

3 Reply: “The Property Management Section is responsible for the Council’s acquisitions and disposals, as well as managing derelict sites, commercial and temporary lettings, and ground rents.

In conjunction with the Drawing Office, the Property Management Section is currently transferring information from the various property registers and property files onto an I.T. system, known as P.I.R. The P.I.R. system will provide a central, computerised, information system of all property/interests owned by Dún Laoghaire-Rathdown County Council.

There is however a large number of records, some going back over a hundred years, and the transfer of all these records will take some time to complete. The current focus of the project is on recording acquisitions. In this regard in excess of 60% of all acquisitions have now been recorded and digitised on the system.

Once completed the P.I.R. system will - record all property in which this Council has an interest - provide a uniform approach in the recording of property data. - provide property information that is accurate and up to date. - assist in the efficient and effective management of the Council’s property interests”

C/678/13 Dún Laoghaire-Rathdown Social Housing Data

Question: Councillor V. Boyhan “To ask the Manager to confirm how many applicants are on the Dún Laoghaire-Rathdown County Council's Social Housing Support List and a breakdown for each bed size in each area is as follows;

Reply: “As at 30th September 2013, there were 3660 applicants on the Social Housing Support List, broken down as follows;

Between 1st October 2012 and 30th September 2013, 220 Social Housing Support applicants (excluding transfers) have been housed as follows;

Dún Laoghaire-Rathdown County Council’s housing stock compromises of approximately 4200 properties.

At 30th September 2013, the Housing Department had 81 vacant dwellings, as follows:

C/679/13 Coffee Shops Etc Planned for the Central Library

Question: Councillor R. Humphreys “To ask the Manager to confirm that the Council will retain control of the ambience and character of any coffee shops etc planned for the Central Library?”

Reply: “The Council will retain control of the ambience and character of any coffee shops planned for the Central Library.”

C/680/13 Linear Park Greenway/Cycleway Along the Dodder

Question: Councillor R. Humphreys “To ask the Manager for her view on developing a Linear park Greenway / cycleway along the Dodder, possibly in conjunction with the City Council?”

Reply: “In 2012 South Dublin County Council took the role of lead agency in a project undertaken in conjunction with Dublin City Council and Dún Laoghaire-Rathdown County Council and supported by the National Transport Authority, to complete a Technical Feasibility Study of developing a high quality walking and cycling route along the River Dodder corridor between the River Liffey at Grand Canal Dock to its source at Bohernabreena in the Dublin Mountains which links to the Dublin Mountains Way (DMW) walking route. The DMW route was developed by the Dublin Mountain Partnership (DMP), of which DLRCC is a member, with the aim of improving the recreational experience of the Dublin Mountains. The Technical Feasibility Study was completed in August 2012.

During 2013 the National Transport Authority have funded the preliminary design of key sections of the Dodder Greenway route in each of the three local authority areas concerned.

A Steering Group has recently been established consisting of representatives nominated by the respective County Managers from South Dublin County Council, Dublin City Council and Dún Laoghaire-Rathdown County Council which will provide co-ordination and steering between the relevant local authorities. A further study has also been commissioned to explore the tourism potential of the route in order to make a bid for National Greenway funding towards the end of 2013.

The Dodder Greenway would provide an opportunity to get out of the city into the mountains in a healthy, green, activity focused manner. Taking the above into account and the potential greenways hold to encourage non-motorised travel for journeys between the home, schools, work and recreational areas along with associated social, health and economic benefits, Dún Laoghaire-Rathdown County Council continues to support such a proposal.”

C/681/13 Blue Line Project

Question: Councillor R. Humphreys “To ask the Manager for an update on the Blue line project?”

Reply: “It is a policy of the County Development Plan 2010-2016 “to facilitate the introduction of Bus Rapid Transit from the DART line to Sandyford / Dundrum Town Centre via UCD utilizing, where possible, the Eastern Bypass reservation.” Consultants were appointed to carry out a detailed assessment and prepare a Business Case for the project. This showed that it can be built at a relatively modest cost and that it offers excellent value for money. The Council, in association with UCD, St Vincent’s Hospital and the Sandyford Business Estates Association, undertook a promotion campaign to enlist public support for the project’s inclusion in the National Transport Authority “Greater Dublin Area Draft Transport Strategy 2011-2030.

The NTA Strategy published in 2011 envisages that those existing Quality Bus Corridors with high levels of passenger demand and dedicated bus lanes over much of their length, including the Stillorgan Road QBC, will migrate to facilitate Bus Rapid Transit (BRT) type services to the city centre. In relation to the proposed ‘BlueLine’ the Strategy states:

“A number of studies have been carried out in relation to provision of BRT type services on certain corridors, including the ’Blue Line’ proposal between Sandyford and St. Vincent’s Hospital. The potential for these proposals, and their integration into the wider bus priority network including BRT proposals in this Strategy, will be assessed by the Authority.”

In October 2012 a report prepared by the NTA entitled “Bus Rapid Transit (BRT) – Core Dublin Network” identified a core BRT network comprising mainly of two cross-city BRT corridors: (i) Blanchardstown to UCD; and (ii) Clongriffin to Tallaght based on a significant transport demand commensurate with a BRT system. This report did not make reference to the Blue Line

Further work carried out since the publication of that report confirmed the feasibility and likely usage of a BRT from Swords/Airport to City Centre.

The NTA is currently finalising its ‘Integrated Implementation Plan 2013-2018’ following a period of public consultation that ended on 4th September 2013. In the Implementation Plan it is proposed to progress the development of three BRT routes:  Swords / Airport to City Centre;  Blanchardstown to N11 (UCD); and

6  Clongriffin to Tallaght.

In its submission on the draft Implementation Plan Dun Laoghaire Rathdown County Council requested that consideration should be given to allowing for the future extension to Sandyford of the proposed BRT route from Blanchardstown to N11-UCD. Dun Laoghaire Rathdown County Council will continue to promote the ‘BlueLine’ for inclusion in an NTA infrastructure investment programme.”

Reply: “A list has been compiled of all questions and motions submitted by Councillors to Council and Area Committee meetings from June 2009 to October 2013. When calculating the figures for motions it was not possible, due to staff resources, to extract the number of re-entered motions. The figures for motions therefore include re-entered motions.

C/683/13 Additional Wheelchair Space

Question: Councillor H. Lewis “To ask the Manager to meet with the resident of (address withheld) to consider providing a small parcel beside (number withheld) with the intentions of making the front garden symmetrical and provide additional wheelchair space?”

Reply: “This unit was adapted previously for a similar need, a ramp was installed and the front door widened. The Housing Department at this time is not in a position to facilitate this request.”

C/684/13 Installation of Water Meters

Question: Councillor H. Lewis “To ask the Manager to specify the details of the work that Council staff have carried out to prepare for the installation of water meters across the County?”

Reply: “The Department of Environment, Community and Local Government instructed local authorities to do a pre-installation survey project which is an important preparatory element of the domestic water metering programme.

The elements of this project are: - Supervisory work; - Data cleaning (desktop identification of properties that have public water supply vs. those properties that have a private supply); - Surveying of the properties (identify and photograph the type (stopcock or boundary box)

9 and location (public or private) where each property connects to the public water supply).

The data cleaning has been completed and the supervisory work and surveying are ongoing. To date 39,500 properties (60%) of the calculated 65,500 have been surveyed.”

C/685/13 Pre-Burial Charges

Question: Councillor L. McCarthy “To ask the Manager to please consider giving citizens the option of including headstone charges with other pre-burial charges?”

Reply: “The Council will consider giving citizens the option of including headstone charges with other pre burial charges. However, it is the Funeral Directors who process the charges for purchase of burial rights and interment fees as part of their overall service to the bereaved family. This arrangement is common practice in all cemeteries as the Funeral Director is informing the family of interment and cremation services that are available in all Cemeteries in the greater Dublin Area.

The Council invoices the Funeral Directors on a monthly basis for all funerals that take place in Cemeteries under our control. For this reason we will need to discuss the issue with the Funeral Directors to see if they are willing to add the foundation fee onto the charges they administer already, or if they will agree to give the information regarding the charges for foundations, to the family at the time of arranging the funeral.”

C/686/13 Coastal Defence Strategy

Question: Councillor C. Smyth “To ask the Manager to report on the progress to date on Dún Laoghaire-Rathdown’s Coastal Defence specifically the two projects where funding was sought in 2011 and 2012, since the completion of the Coastal Defence Strategy Report by consultants Malachy Walsh & Partners in 2010/2011?”

Reply: “No funding has been received for the two projects for which DLR made submissions in 2011 and 2012.

1: Coastal Defence Strategy Study 2: Corbawn Lane Beach Access.

The following works were recommended to be undertaken by the Report and have been undertaken using DLR resources:  Signage has been erected informing the public of dangerous cliffs and possible falling debris along the coast.  The stone wall at Seafield that was starting to fall onto the beach has now been removed and replaced with a railing stepped back from the edge.”

C/687/13 Rehoming/Reclaiming a Horse

Question: Councillor C. Smyth “To ask the Manager to break down the costs involved for a person rehoming/reclaiming a horse that has been impounded by the Council and what were the costs prior to the changes by the Department of Agriculture, Food and the Marine?”

10 Reply: “In 2012 the Department of Agriculture, Food and the Marine informed local authorities that all costs for collection and storage of stray horses incurred by them must be borne by the owners of such horses before they are reclaimed. The Department will no longer reimburse local authorities any of the costs incurred prior to this, if the owner was not in a position to pay all costs the local authority could accept part payment and recoup the balance from the Department.

The costs involved are as follows; €90 Call Out fee plus € 1.90 per km. €15 per horse per night stabling costs €29.25 for microchipping of horse €30 for horse licence if owner has not got one €35 for horse passport if owner has not got one Any veterinary costs incurred

With regard to rehoming horses the Department have indicated that ideally 100% of all costs should be paid but if the new owner is not in a position to cover the full costs a fee of € 200 should apply.”

Proposed Disposal of Affordable Housing Units at Mimosa Hall and Levmoss Avenue, The Gallops, Dublin 18 acquired under Part V of the Planning & Development Act 2000, as amended, and the Housing (Miscellaneous Provisions) Act 2002, as amended, in accordance with the Rent to Buy Scheme

The following notice, copy of which had been circulated to the Members, was CONSIDERED:

15 Proposed disposal of Affordable Housing units at Mimosa Hall & Levmoss Avenue, The Gallops, Dublin 18, acquired under Part V of the Planning & Development Act 2000, as amended, and the Housing (Miscellaneous Provisions) Act 2002, as amended IN ACCORDANCE WITH THE RENT TO BUY SCHEME

In accordance with Part V of the Planning & Development Act 2000, as amended, the Council acquired 36 units at Mimosa Hall and Levmoss Avenue, The Gallops, Sandyford, Dublin 18 on the 22nd December 2009, comprising 11 x one bedroom, 23 x two bedroom and 2 x three bedroom apartments, from Viscount Securities Limited. These units are being offered for sale to eligible applicants in accordance with the terms of the Council’s Affordable Housing Scheme and to others at the open market price, with priority being given to affordable housing applicants and to first-time buyers.

These units are now also available for sale on a Rent to Buy basis whereby applicants who qualify for affordable housing are permitted to rent the property, initially, for a period of up to three years, at a fixed rent, under a letting agreement from the Council and will sign a Contract to purchase the property during the course of the three-year rental period. 80% of the rent paid will be deducted from the purchase price at the time of sale.

To date 24 properties have been sold to affordable applicants and 6 units have been occupied under the Rent to Buy Scheme.

It is now proposed to dispose of one property listed on the attached Schedule to an applicant who qualifies under the terms of the Affordable Housing Scheme and who meets the criteria for inclusion in the Rent to Buy Scheme. The property is being disposed of by way of Lease Agreement for a period of up to three years initially and a Contract which gives the option to purchase at any time during the lease period. A drawing showing the location of the unit and a schedule showing the fixed rent payable under the Lease and the sale price will be available at the meeting.

In order to comply with the requirements of Section 183 of the Local Government Act 2001, the consent of the Council is required for the issuing of a Lease Agreement and Contract for the disposal of this property. It is therefore recommended that the Council approve the following resolution:

The following report by the Manager was circulated to the Members and AGREED:

"DDP/205/13 Proposed Pay & Display Parking Control Scheme - 117A to 125A Braemor Road

The following report was CIRCULATED:

“In order to improve safety and to better regulate the flow of traffic in front of the shops at 117A to 125A Braemor Road, Traffic Section proposes to introduce a one-way system as shown on Drg. Ref. TT-043-03-2013. The work will include new footpaths, public lighting, road re-surfacing, and widening of the service road to provide 14 to 15 marked out car parking spaces.

A petition signed by the majority of business owners and residents has requested the introduction of Pay Parking to control the use of these spaces. The scheme would operate Monday to Saturday from 08:00 to 19:00 at a rate of €1/hour for a maximum of 3 hours in any one stay. Residents Parking Permits and Visitors Permits would be available. At present the Council operates a grace period of 15 minutes (free parking) at the beginning or end of each stay.

All of the business owners and residents were written to with details of the scheme, a map and an information leaflet on Pay and Display parking. Comments were invited and one business owner telephoned to request that residents’ permits be limited to one per dwelling. This would involve a change to the Council’s Parking Control Bye-Laws that allow four residents permits per dwelling. This is not recommended as these upstairs apartments are small and unlikely to generate a demand for more than one permit per dwelling.

In accordance with Section 101 of the Road Traffic Act, 1961, Section 36 of the Road Traffic Act, 1994, Dún Laoghaire-Rathdown County Council Parking Control Bye-Laws, 2007 to 2011, and in accordance with the provisions of the Local Government Act, 2001, the proposed Pay & Display Parking Scheme for 117A to 125A Braemor Road is presented to the Area Committee for decision”.

The report was AGREED."

The introduction of pay parking control is a reserved function of the Council. In order to implement the proposed parking scheme for 117A to 125A Braemor Road the following resolution is required:

C/693/13 Local Travellers Accommodation Consultative Committee - Nomination of Members

The following report of the Manager, copy of which had been circulated to the Members, was CONSIDERED:

“Section 21 of the Housing (Traveller Accommodation) Act 1998 gave the local authority power to appoint a Committee to be known as the Local Traveller Accommodation Consultative Committee to advise on the provision and management of accommodation for travellers.

Section 22 of the Act states that the membership of the Committee shall comprise the following:- (a) members of the appointing authority (b) officials of the appointing authority (c) representatives of local travellers and traveller bodies and (d) where the Local Consultative Committee has been appointed by the Council, one member from each relevant housing authority (if any) within the administrative county concerned.

The making of an appointment under this section shall be a reserved function.

At the County Council meeting held on 9th March, 1998 the Council agreed that 3 Councillors would form part of the Local Consultative Committee.

In accordance with the guidelines the period of appointment of the Committee shall be at least 3 years except in the case of members of the authority who cease to be a member of a local authority and will not extend beyond the next round of local elections.

The current members of the Local Consultative Committee are:

Councillor T. Murphy appointed on 11th September 2010. Councillor G. Tallon appointed on 11th June 2012. Councillor D. Marren appointed on 2nd July 2013

Minute No. C/480/10 dated 5th July, 2010 appointed members to the Committee, however, there have since been staff changes in the County Council and among the representatives of local travellers and traveller bodies.

Accordingly it is recommended that the following resolution be passed by the Council:

It is hereby resolved to appoint the following persons to the Local Traveller Accommodation Consultative Committee:

C/694/13 Recommendation from Housing Strategic Policy Committee in relation to a small co- operative housing scheme.

The following report of the Manager, copy of which had been circulated to the Members, was CONSIDERED:

“The Housing Strategic Policy Committee at its meeting held on 17th June 2013 recommended the following matter to the Council:

“That the Council sponsor a small co-operative housing scheme whereby qualifying housing applicants, in conjunction with the Council, would build their own homes and that the Council would identify land within its ownership for such a scheme.”

Report: The Council as Housing Authority and approver of funding streams such as the Capital Assistance Scheme (CAS) and Capital Advance and Lease Fund (CALF) cannot act as sponsor or partner for any proposed co-operative housing development.

There is currently no funding stream or arrangement in place for the Council to financially assist the proposal.

However, the Housing Department will support any such proposal and will consider any application from a group/co-operative/approved housing body for a site for the construction of housing for qualified housing applicants. However, it will be necessary for the interested qualified housing applicants to form a co-operative or housing body before the Council will consider disposal of a site or lands.

It will be the responsibility of the co-operative to source and obtain the necessary funding/financing, and also to obtain the required planning permission and building control/fire safety certificates.

“That this Council agrees that the Manager would identify a suitable Council infill site for the purpose of building a small co-operative housing scheme and would help and oversee the building of these dwellings. Also that the Manager report on the proposal.”

“The Council as Housing Authority and approver of funding streams such as the Capital Assistance Scheme (CAS) and Capital Advance and Lease Fund (CALF) cannot act as sponsor or partner for any proposed co-operative housing development.

There is currently no funding stream or arrangement in place for the Council to financially assist the proposal.

However, the Housing Department will support any such proposal and will consider any application from a group/co-operative/approved housing body for a site for the construction of housing for qualified housing applicants. However, it will be necessary for the interested qualified housing applicants to form a co-operative or housing body before the Council will consider disposal of a site or lands.

It will be the responsibility of the co-operative to source and obtain the necessary funding/financing, and also to obtain the required planning permission and building control/fire safety certificates.”

C/695/13 Recommendation from Transportation Strategic Policy Committee in relation to Cyclist Right of Way at Junctions

The following report of the Manager, copy of which had been circulated to the Members, was CONSIDERED:

“Background: At the February 2012 full Council meeting, Councillor Dillon Byrne proposed:

“That this County Council recommend to the National Roads Authority, the National Transport agency, and the Roads Safety Authority to adopt the principle of permitting cyclists right of way at all junctions as practiced in the rest of Europe and that a comprehensive information and advertising campaign be undertaken before this change of policy is implemented.”

Following a discussion the matter was referred to the Transportation Strategic Policy Committee (SPC).

The Transportation SPC at its meeting held on Thursday 12th September considered the following report of the Manager:

20 CYCLIST RIGHT OF WAY AT JUNCTIONS Introduction: Under Irish Law no one user has an absolute right of way. Even if you approach a junction and the lights are green this does not allow an absolute right of way and you are expected to proceed with caution and with due care and attention. Road users may have priority rather than a right of way and the issue becomes: Who is expected to yield their priority

Examples:  Vehicles on side roads would be expected to yield to vehicles on the main road.  Vehicles at a junction with a red light would be expected to yield to vehicles with a green light  Vehicles changing lane would be expected to yield to vehicles already in that lane

Improving facilities for cyclists involves improving their priority and this is done in a number of ways:  By providing cycle lanes to allow them to overtake static traffic  Advanced stop lines at junctions allow them to position themselves in a primary position and take priority through a junction  Early start or dedicated cycle signals can give them priority over other vehicles  Contra Flow cycle tracks allows priority in a direction that other vehicles are not allowed  Traffic signal by-passes reduce waiting time and improve priority

There are opportunities through legislation to further improve priority for cyclists by: allowing them to turn left on red signals or by putting more legal responsibility on drivers in the event of a collision e.g. in some countries you are assumed guilty if you are involved in a collision with a cyclist and the responsibility lies with the driver to prove their innocence.

Conclusion: It is recommended to the SPC that DLR:  Continues the policy of improving facilities and priority for cyclists  Continues to engage and support the NTA, NRA, DTTAS & RSA  Supports any advertising campaigns that inform road users of their current responsibilities.

The SPC did not agree with the motion and the report of the Manager was NOTED.

“A report was submitted for the information of the Members at the Dún Laoghaire Area Committee to approve the renaming of Phase 1 Rochestown House to Rochestown Lodge. However, during discussions it was felt there maybe confusion with the Hotel on Rochestown Ave with the same name. It is therefore advised that the name of Phase 1 Rochestown House be ‘Rochestown Terrace’.

The new name proposed is as follows:

‘Rochestown Terrace’ (Ardán Bhaile an Róistigh).

In addition, as the re-configuring of the 12 ground floor units has reduced the number of apartments in this block to 12, it is proposed to re-number the apartments in the block. The new numbering proposed is as follows:

Ground floor apartments 1 – 6 Rochestown Terrace (1 -6 Ardán Bhaile an Róistigh), Sallynoggin, Co. Dublin.

First floor apartments 7 – 12 Rochestown Terrace (7 - 12 Ardán Bhaile an Róistigh), Sallynoggin, Co. Dublin.

Work is currently under way on the re-development of the first phase of Rochestown House which involves the re-configuring of 12 ground floor bedsit units into 6 one-bed apartments, (the six upstairs units are already set out in one-bed units), changing the access from the southern to the northern elevation, and the carrying out of general refurbishment works throughout. These works include re-wiring, re-plumbing, external insulation, redecoration, installation of a new heating system and windows & doors, and replacing the existing kitchens and bathrooms. Following the development, this block will have 12 one-bedroom apartments. Following completion of this work it is intended to commence work on the refurbishment of the second phase.

The second phase of the development will retain the name Rochestown House and will be numbered 1 – 34. Appropriate signage will be erected.”

 Councillor B. Saul That this SPC initiate a complete review of Parks & Open Space Bye Laws

R. Shakespeare clarified that only Parks bye-laws exist and that there are none for Open Spaces. A review will form part of the Work Programme 2014.

 Councillor B. Saul To make a statement on the decision to allow a sports club close a public park and charge admission to an event?

R. Shakespeare advised that the closure was a measure to regulate the crowd and that the moderate charge was applied to cover the fencing costs. This is an event that has taken place each year over the last decade. Cllr. Devlin requested that elected members be advised of similar decisions made in respect of any future events as a large volume of calls was received.

 Tim Carey summarised the Dalkey Island Conservation Plan 2013-2023 for the committee, stating that its aim is to provide access for the public while preserving the island’s unique heritage. It is currently protected under EU and national legislation rather than bye-laws. A Steering Committee met several times and the plan also went before the two Area Committees. A period of non-statutory consultation took place in July and August, receiving 9 submissions in total. Regarding drilling licences granted for nearby waters, DLRCC has no powers of decision-making but the plan will manage and protect the island. This plan will be emailed to non-Councillor members.

 Dean Eaton made a presentation to the committee on the Council’s anti-litter and anti graffiti fund. The grant scheme is co-funded by the DoECLG and DLRCC, with €35,000 allocated in 2013. The projects undertaken seek to raise awareness about the problems of litter and graffiti among the public but with an emphasis in involving schools and young people. Projects include the Tidy Districts Competition, Green Dog Walkers, Down To Earth Theatre Company events and safe graffiti removal. This fund is separate from the Gum and Dog Fouling campaigns raised at previous meetings.

 Aiden Conroy presented an update on the busking issue raised at the June meeting. A report on findings carried out over 19 dates between June and August was circulated to the committee. The two main areas of relevance are Sandycove/Newtownsmith and the junction of Patrick St. and George’s St. Lower. Four complaints were made regarding noise nuisance during this time and retailers provided their views, which were chiefly positive. Complainants can contact Aiden at any time. Bye-Laws will not be considered at the current time.

Presentation on Draft Statutory Framework Homeless Action Plan 2014-2016 Tom McHugh invited Sorcha Donohoe, Dublin Region Homeless Executive to show a video presentation which provides an insight into the perspectives and experiences of formerly homeless households.

Following the presentation from Ms. Donohoe, Mr. McHugh advised Members that a new Homeless Action Plan for Framework for the Dublin Region, for the period 2014 too 2016 has been drafted.

He advised that he is a member of the Regional Homeless Consultative Forum, and this body has considered the plan in considerable detail, and the inputs of all partners and agencies included in the forum have been included in the plan. He advised that he fully endorses and recommends the draft plan, which sets out challenging objective and targets to deal with the homeless issue.

Mr. McHugh stated in the absence of a quorum the meeting would adjourn and in order to progress the matter, he undertook to circulate the draft plan to all Members of the SPC and invite feedback or comments for inclusion

The Chairperson agreed that the draft plan be circulated and adjourned the meeting due to the absence of a quorum.

2. Business submitted by Director of Services (a) Traffic Modelling in the Urban Environment - Case Studies - Blackrock LAP and Sandyford Business Park (Presentation by Joe Seymour, Regional Director and Shane Dunny, Principal Consultant Aecom)

Mr. Joe Seymour, Regional Director, Aecom, gave a brief overview of the role of the Company and outlined the various projects they were involved with.

Mr. Dunny presented an overview of urban traffic modelling and briefed the meeting on the traffic models carried out by Aecom for DLRCC, i.e Sandyford Area model to include ESB Link Road, Leopardstown Roundabout and the Blackrock Local Area Plan.

The report was NOTED.

(c) Public Bike Hire Scheme Study Dan Brennan, Consultant with Aecom provided an update on the Public Bike Hire Scheme Feasibility Study for Dun Laoghaire and outlined the result of the Market Research and Demand Analysis carried out to date.

28 Following some questions and clarification on the extent of the scheme, the report was NOTED.

(b) Parking Bye-Laws in Dún Laoghaire-Rathdown County Council area [specifically the introduction of new locations to the scheme] "The attached ‘Guidelines for the Implementation of Pay and Display Parking Control Schemes’ are taken from Appendix IV of the Dún Laoghaire-Rathdown County Council Parking Control Bye-Laws, 2007 to 2011. The Guidelines set out the rationale for Pay and Display parking controls and the procedure for their implementation.

Before allocating scarce resources to the design and implementation of a Pay and Display scheme in a residential area the Council requires a signed petition from the Residents Association or from a representative number of residents, indicating that there is majority support for the introduction of Pay and Display parking controls.

In recent years the Council’s deteriorating financial position has meant that consideration has to be given by the Council to the financial cost of introducing a scheme, such as the cost of meters, signage, lining, and continued enforcement and maintenance costs.

The Transportation SPC meeting on 12th September 2012 considered a number of locations requesting Pay and Display and agreed that all future schemes in residential areas must allow for all day parking to provide a revenue stream to finance the introduction and ongoing costs of the scheme."

Mr. Jim Hayes, Senior Engineer, Traffic Section presented the above report to the Members.

Councillors asked that the report be amended to delete the reference to Pay & Display schemes that facilitate all day parking being introduced to provide a revenue stream. It was intended that schemes were to allow for all day parking for the use of commuters or those working in the area that needed to use their car as a means of transport, as maximum three hour stay is of no value when it is not being utilised.

The costs associated with Pay and Display schemes should be brought to Councillors when reports on the introduction of schemes are being presented to meetings for approval.

(d) Dublin Agglomeration Environmental Noise Action Plan (December 2013 – November 2018) Gerry Flaherty, Senior Executive Engineer, made a presentation on the Final Noise Action Plan for the Dublin Agglomeration.

(e) Road Safety Annual Evaluation Report 2012 Seamus Storan, Executive Engineer, presented the 2012 Road Safety Annual Evaluation report to the members. A PowerPoint presentation including reference to the 4 ‘E’s, Engineering, Education, Enforcement and Evaluation delivered was, noting key figures and trends in road casualties and injuries. An overview of infrastructural works delivered by DLR including DLR’s involvement in key road safety campaigns and initiatives with schools, the RSA and An Garda Siochana was outlined. DLR’s proposed schedule for the Casualty Reduction winter programme was circulated at the meeting, to include the DLR / AXA Road Safe Show to take place on Monday 14th and Tuesday 15th October 2013.

Reply: “A number of workshop type meetings have taken place between Transportation engineers and the planners preparing the Draft Dun Laoghaire Local Area Plan. This exchange of information and ideas is being used to work up a pre-Draft version of the Plan that will be circulated to individual departments for comment prior to finalising the Draft Plan for public consultation. At that stage the Planning Department will organise public information sessions and briefings for Councillors at which Transportation will be represented.”

(b) Councillor Marie Baker “That this Transportation SPC amends the Council’s road lining policy to allow the use of single yellow lines in residential areas so as relieve the pressure on residents of all day parking by commuters.”

The majority of requests for single yellow lines are from residential estates where commuter parking is causing a nuisance by blocking driveways, destroying grass verges, littering etc. or could restrict access for emergency services. The residents believe that a single yellow line for some period during the day will remove commuter parkers while keeping the estate free for residents at other times with no financial cost to them (no permits required etc).

There are a number of issues with this:  Providing single yellow lines for a period during the day can also negatively affect residents i.e. no visitors or residents can park during the period while the restrictions are in place.  Single yellow lines require enforcement. The Gardaí do not have sufficient resources to police, on a large scale, single yellow lines in residential areas where it is safe to park. The Council provides a Traffic Warden Service in Pay and Display areas where the revenue pays for enforcement and other Council services. There would be a cost in extending the warden service to non revenue generating areas either through the direct cost of employing additional wardens or through reduced enforcement and therefore reduced revenue in existing Pay and Display areas.  Everyone has a right to park on the public road where it is safe to do so. Allowing cars to park in areas close to public transport may provide users with access to public transport where they may otherwise have to take their car into a town.  The County Development Plan limits the number of car parking spaces that may be provided in non-residential developments, in order to encourage the use of public transport, cycling and walking. Some employees in the county have no workplace parking but have journeys to work that cannot reasonably be undertaken by non- car modes.

The provision of single yellow lines should be reserved for areas of high commercial activity (such as town centres) where parking during the day would impede traffic flows

31 but can be allowed at night to facilitate businesses and road users. High traffic flows make the single yellow line essentially self-enforcing, as any parking would cause traffic congestion.

If parking within an area has grown to such an extent that regulation is required then the appropriate course of action is to install Pay and Display Parking.”

It was AGREED that the above item would be placed on a future Transportation SPC Agenda for discussion.

“A Pay and Display Parking Scheme was recently implemented along this section of roadway. The area will continue to be monitored outside of the normal operating hours of the Pay and Display scheme to ensure that no vehicles are found to be parked for the purposes of advertising in contravention of the Roads Act 1993.”

“That the Manager gives a detailed outline as to what process one would take to register a complaint about anti-social behaviour against a tenant who is on the Rent Allowance Scheme (RAS) and what powers, if any does the Council have in relation to this type of case. Please state how many such cases have been received by this Council since January 2010.”

“All tenancies under the Rental Accommodation Scheme, whether Tenant only or Availability Agreement, are governed by the Residential Tenancies Act 2004, which sets out basic tenancy obligations for both landlords and tenants, including an obligation that tenants will not engage in, or allow anti social behaviour in the property or the vicinity of it. The tenancy is governed under Section 34 of the Act and the responsibility for dealing with breaches of tenancy agreements including that of anti-social behaviour, lies with the Landlord of the property. The landlord can terminate the Residential Tenancy Agreement if the tenant is in breach of any of its obligations to the landlord. Similarly the Housing Authority can require the landlord to

36 terminate the Residential Tenancy Agreement if the tenant breaches his/her obligations to the Housing Authority.

Those wishing to register a complaint about anti-social behaviour against a RAS tenant should either contact the Landlord/Management Agent of the RAS property directly with their complaint or they can forward them in writing or verbally to the RAS Section of the Council, who would then forward the complaint to the Landlord/Managing Agent to deal with.

The RAS Section of the Council will offer support to the landlord in dealing with matters and will follow up on any complaints referred on to ensure they have carried out the instructions from the Council and their action is noted on the tenant’s file. It is the responsibility of the Landlord to issue any written warnings, including Notice to Quit, in accordance with the relevant sections of the aforementioned legislation.

It is only a very small minority of RAS tenants who are involved in anti-social behaviour. Since January 2010 there have been 30 RAS tenants against whom complaints in relation to anti- social behaviour have been received.

Social housing applicants who accept an offer of RAS accommodation and existing RAS tenants approved for transfer and who have accepted an offer of alternative accommodation, go through the Council’s anti-social background checks prior to being finally approved for allocation to the accommodation.”

However, this is dependent on the enactment of enabling legislation.

The Department is to initiate discussions with the Council and the Harbour Company to determine the most suitable method of transfer to local authority control. No discussions have taken place to date. Once these discussions have taken place and information is available on the likely basis of the transfer and contents of the legislations a report will be brought to the Council.”

“That this Council recognises the need for flexibility in dealing with local parking solutions in the County and calls on Council management to provide for flexibility to the greatest possible extent, to work with local councillors on these issues, and to dispense with the designation of residential parking areas as parking revenue generators in order that sensible solutions can be implemented to deal with residents’ legitimate concerns about the amenity of their areas.”

“In general there are 4 methods employed by the Transportation Department to control and restrict parking on the Public Roads.

Double Yellow Lines indicate that parking is not permitted at any time. The regulations allow for stopping on Double Yellow Lines for up to 30 minutes to facilitate loading/unloading. Double Yellow Lines are provided where parking would cause a hazard e.g. on a bend with no visibility or where there is not sufficient width to accommodate parking and maintain traffic flows. In the provision of pay and display schemes double yellow lines are often provided opposite parking bays where there is not sufficient width to allow parking on both sides of the road and maintain traffic flows.

Single Yellow Lines indicate that parking is not permitted during the hours specified on the accompanying time plates. The regulations allow for stopping on Single Yellow Lines for up to 30 minutes to facilitate loading/unloading during the time parking is not permitted. The provision of single yellow lines should be reserved for areas of high commercial activity (such as town centres) where parking during the day would impede traffic flows but can be allowed at night to facilitate businesses and road users. High traffic flows make the single yellow line essentially self-enforcing, as any parking would cause traffic congestion.

Clearway: No stopping or parking allowed during the specified hours. Sallyglen Road and Dundrum by-pass are examples of where a clearway has been provided to prohibit unsafe parking or stopping of cars at any time of the day.

Pay and Display parking regulates an area by designating where it is safe to park. It provides parking for all road users at all times of the day in the designated bays. During the times specified on the accompanying time plates there is a charge to park in the bays. Pay and Display Schemes are monitored by the Traffic Wardens on behalf of the Council. If parking within an area has grown to such an extent that regulation is required then the appropriate course of action is to install Pay and Display Parking.

The ‘Guidelines for the Implementation of Pay and Display Parking Control Schemes’ are set out in Appendix IV of the Dun Laoghaire Rathdown County Council Parking Control Bye-Laws, 2007 to 2011. The Guidelines set out the rationale for Pay and Display parking controls and the procedure for their implementation. In section 2 the main reasons for implementing Pay and Display parking controls in residential areas include the following: - To improve the prospects of residents accessing parking at or near their homes, - To discourage extraneous parking in residential areas which has a detrimental impact on

40 the quality of life of residents

The Transportation SPC meeting on 12th September 2012 considered a number of locations requesting Pay and Display and agreed that all future schemes in residential areas must allow for all day parking.”

“That this Council welcomes the announcement by the Minister of State for Housing and Planning Jan O’ Sullivan of a € 32 million funding boost for Local Authorities that will provide new social housing homes for housing applicants.

In view of this, the Manager would prepare a report for discussion at this Council meeting outlining the amount of extra funding allocated to Dún Laoghaire-Rathdown County Council, how this funding will be used and to outline the housing projects ready to commence.”

“In July 2013, through Circular 21/2013 Local Authorities were invited to submit proposals to purchase new, permanent social housing units. Dún Laoghaire-Rathdown County Council submitted a proposal to purchase 11 units.

In August 2013 the Minister of State for Housing and Planning Jan O’Sullivan TD announced that €32m was made available for this purpose.

Of the €32m Dún Laoghaire-Rathdown County Council was allocated €949,046, which covered the purchase of 5 units.

Arrangements are currently ongoing to complete these acquisitions and to ensure that funding is drawn down.”

Item No. 34: Funding of Social Housing It was proposed by Councillor J. Bailey and seconded by Councillor M. Bailey:

“That the Manager advise the Council on what applications have been made to the Minister of Environment and Local Government for funding of social housing in our area.”

The following report of the Manager, copy of which had been circulated to the Members, was CONSIDERED:

“Dún Laoghaire-Rathdown are constantly in touch with the Department of the Environment, Community and Local Government to maximise support for Social Housing projects. The Housing Department has managed to secure funding for major renovation works at Rochestown House, Sallynoggin. Phase 1 of which is currently on site. It is anticipated that funding will be advanced for phase 2, to enable works to commence in 2014.

In relation to Disabled Person extensions and bathroom alterations, the Council has been given an allocation of €80,000 in 2013, additional funding was sought and the allocation was increased to €402,803, most of which has been drawn down.

€306,981 was initially provided for energy upgrade works, and following a request for additional funding, the allocation was doubled. As a result, a large energy improvement programme is under way and it is hoped that approximately 600 units will receive cavity and attic insulation this year, which should improve the energy efficiency of our existing housing stock .

The Department has also been advised in relation to outstanding commitments in relation to Part V. In July, the Council was advised that funding would be provided for the acquisition of 3 units to be acquired in accordance with agreements entered into under Part V.

Every opportunity is availed of by the Council to seek and draw down funding.”

C/722/13 Mutual Transfers Between Council Tenants

The following motion was MOVED by Councillor D. O’Callaghan WITHOUT DISCUSSION:

“That the Council discusses Dún Laoghaire-Rathdown’s policy regarding mutual transfers between Council tenants.”

The following report of the Manager, copy of which had been circulated to the Members, was NOTED:

“In accordance with the Allocations Scheme, adopted by the Council on the 13th June 2011:

“Mutual transfers will be allowed between tenants with similar properties and in cases where a transfer achieves a better use of accommodation. The Council can consider applications for mutual transfer from tenants of dwellings of different sizes in certain circumstances.”

Every consideration is given to facilitating mutual transfers, having regard to making best use of accommodation. In addition if the proposed transfer meets other requirements for example medical where one tenant for instance requires downstairs accommodation, or if one tenant will no longer be overcrowded, the transfer is generally approved. An application may not be approved on estate management or rent arrears grounds or where the accommodation is too large or indeed too small for the tenants as it is Council policy “where housing need changes the applicant will be offered accommodation appropriate to his/her existing housing needs”.

The Council also operates a Downsizing Scheme under the Allocations Scheme whereby priority will be given to tenants seeking to downsize their accommodation.”

C/723/13 Report of this Council's Work on the Weirs of the Dodder

The following motion was MOVED by Councillor J. Dillon Byrne WITHOUT DISCUSSION:

44 “That this Council requests the Manager to present a report of this Council’s work on the Weirs of the Dodder to enable salmon and sea trout to spawn up river and lamprey eels.”

The following report of the Manager, copy of which had been circulated to the Members, was NOTED:

“A preliminary meeting between Inland Fisheries Ireland, Office of Public Works, ARUP Consultant engineers, and the relevant Local Authorities was held on the Dodder in July of this year.

Fish passes on 7-8 weirs are ultimately required. Four of these are partially in Dún Laoghaire- Rathdown area; the Upper Smurfit weir, Dropping Well weir, Orwell Weir and the weir upstream of the Packhorse Bridge. The proposed solution for the Orwell Weir is on the Dublin City Council side using an existing millrace.

Funding issues for the preliminary design and recommendation of solutions are being investigated. The Council will be kept up to date with any progress.

Any proposal will probably involve the Part 8 Planning procedure.”

C/724/13 Pupil Teacher Ratio

The following motion, in the name of Councillor N. Richmond, was WITHDRAWN:

“That this Council calls on the Minister for Education and Skills not to further increase the pupil teacher ratio for minority faith fee paying secondary schools in the context of this year's budget.”

C/725/13 Success of Community Events

The following motion was MOVED by Councillor C. Devlin, WITHOUT DISCUSSION:

“That this Council congratulates and thanks all the staff, both direct and indirect, who helped organise and run the various community events held throughout the County over the course of the summer months. They were very successful and reflected well upon this Council.”
