ORDER 1. Title and commencement-(l) This order may be cited as the Harbour Boards Representation Order 1983. (2) This order shall come into force on the day after the date of its notification in the Gazette.

2. Interpretation-In this order- (a) References to the First Schedule to the Harbours Act 1950 are references to that Schedule as substituted by section 11 (l) of the Harbours Amendment Act (No. 2) 1971: (b) "The 1974 Order" means the Harbour Boards Representation Order 1974": (c) "The 1977 Order" means the Harbour Boards Representation Order 1977t: (d) "The 1980 Order" means the Harbour Boards Representation Order 198O:j:. 3. Lyttelton Harbour Board-(l) The representation on the Lyttelton Harbour Board of the County of Waimairi is hereby cancelled, and replaced by representation of the District of Waimairi.

(2) The First Schedule to the Harbours Act 1950 (as amended by clause 6 of the 1977 Order and clause 6 of the 1980 Order) is hereby amended by omitting from that part of the second column that relates to the Lyttelton Harbour Board the words "County ofWaimairi", and substituting the words "District of Waimairi".

4. Otago Harbour Board-(l) The representation on the Otago Harbour Board of the Otokia Riding of Silverpeaks County is hereby cancelled. (2) The Brighton and Taieri Ridings of Silverpeaks County shall be represented on the Otago Harbour Board. (3) The First Schedule to the Harbours Act 1950 (as amended by clause 8 of the 1977 Order and clause 8 of the 1980 Order) is hereby amended by omitting from that part of the second column that relates to the Otag<> Harbour Board the word "Otokia", and substituting the words "Brighton, Taieri".

5. Southland Harbour Board-(l) The representation on the Southland Harbour Board of the Borough of Riverton is hereby cancelled. (2) The First Schedule to the Harbours Act 1950 (as amended by clause 9 of the 1980 Order) is hereby amended by omitting from that part of the second column that relates to the Southland Harbour Board the words "and of the Borough of Riverton".

6. Timaru Harbour Board-(l) The representation on the Timaru Harbour Board of the Mount Peel- and Ridings of the Strathallan County is hereby cancelled. (2) The Rangitata, , Kakahu, and Milford Ridings of Strathallan County shall be represented on the Timaru Harbour Board. (3) The First Schedule to the Harbours Act 1950 (as amended by clause 2 (5) of the 1974 Order and clause 11 of the 1980 Order) is hereby amended by omitting from that part of the second column that relates to the Timaru Harbour Board the words "Mount Peel-Rangitata, Temuka,", and substituting the words "Rangitata, Waitohi, Kakahu, Milford,".

7. Continuance in office-Subject to sections 30 and 31 of the Harbours Act 1950, the representatives of constituent or combined districts holding office at the commencement of this order as members of any Harbour Board specified in any of clauses 3 to 6 of this order shall, unless they cease to hold office pursuant to any other enactment, continue to hold office until their successors elected at the next triennial election of members of Harbour Boards come into office.

8. Principal local authorities for cODlbined districts-Each local authority named in the third column of the Schedule to this order is hereby selected and appointed to be the principal local authority for the purposes of the election of the member or members of the Harbour Board who are to be elected by the electors of the combined district specified in the second column opposite the name of the local authority.

9. Revocations-Clauses 9 (2), 12, and 13 of and the Schedule to the 1980 Order are hereby revoked.

EXPLANATORY NOTE This note is not part of the order, but is intended to indicate its general effect. This order makes various amendments to the First Schedule to the Harbours Act 1950 which sets out the persons eligible to elect the members of harbour boards. The order also specifies the principal local authorities for those situations where the electors of all or part of different districts are to elect the same member or members. Clause J relates to the Lyttelton Harbour Board and is a minor change following the conversion of Waimairi County into Waimairi District. Clause 4 relates to the Otago Harbour Board. The effect of the clause is to disfranchise the electors of the former Otokia Riding of Silverpeaks County. and to enfranchise the electors of the Brighton and Taieri Ridings of that County. The Otokia Riding has been abolished and its area included within the Brighton and Taieri Ridings. Clawe 5 relates to the Southland Harbour Board and omits reference to the Riverton Borough following the amalgamation of that Borough with Wallace County. Clawe 6 relates to the Timaru Harbour Board. The effect of the clause is to disfranchise the electors of the former Mount Peel-Rangitata and Temuka Ridings of Strathallan County and to enfranchise the electors of the Rangitata, Waitohi, Kakahu, and Milford Ridings of that County. The Mount Peel-Rangitata and Temuka Ridings have been abolished and their areas included in other ridings whose electors are electors of the Timaru Harbour Board. Clawe 7 provides for the continuation in office of existing elected members until the next triennial election. Clawe 8 specifies the principal local authorities for the purposes of any election of a member of a board by the electors of more than one district. The changes from the present Schedule result from the changes described above, and the changes made by section 7 of the Harbours Amendment Act 1983 in relation to the election of members of the Hawke's Bay and Wellington Harbour Boards. Clawe 9 makes consequential revocations.
