Apesar da especialidade que a leva a ser comparada com a tipografia parisiense, a cidade de Angoulême ainda usava as prensas de madeira, às quais o idioma deve a expressão "fazer a prensa gemer", agora sem aplicação. A tipografia atrasada ainda empregava as almofadas de couro esfregadas na tinta, que um dos impressores batia nos caracteres tipográficos. A plataforma móvel em que se dispõe a forma cheia de letras, sobre a qual se aplica a folha de papel, ainda era de pedra e justificava seu nome de mármore. As devoradoras prensas mecânicas de hoje de tal modo jogaram no esquecimento esse mecanismo, ao qual devemos, apesar de suas imperfeições, os belos livros dos Elzevier, dos Plantin, dos Alde e dos Didot, que convém mencionar os velhos instrumentos a que Jérôme- Nicolas Séchard dedicava supersticiosa afeição; pois eles desempenham um papel nesta grande pequena história.” (BALZAC, Honoré, 1836, p. 7) 7 7 RESUMO Este trabalho examina a possibilidade de constituição do gênero revista web para dispositivos móveis a partir dos projetos de design dos três maiores semanários informativos do país: Veja, Época e Istoé. Em busca de um padrão de disposição de elementos e acesso às informações capaz de ser reconhecido como modelo e também de entender a delicada relação dialética proporcionada entre a forma e o conteúdo, recorremos a reflexões com base nas contribuições de Alexander e Cheptulin. Fazemos uma revisão nas mais recentes tentativas de estudos ao redor do mundo que intentam perceber como se dá o encontro entre o projeto de revista para dispositivos móveis e os webleitores, levando em consideração questões como a mobilidade, as tecnologias disponíveis, percepções de marketing e também a própria herança do design editorial impresso influenciando nas características da web, tais como as encontradas nos agregadores de conteúdo dispostos em sistema de curadoria eletrônica ou no gênero notícia, historicamente presente na sociedade há milênios e de quem emprestamos o pensamento de Marcuschi. As características da convergência midiática, lembradas por Jenkins, também são revisitadas e associadas às discussões sobre um produto nativamente analógico que encontra seu referente no digital móvel. Buscamos levantar todo esse questionamento, nas três publicações já mencionadas, ao longo de 2 anos (2014-2015) e também na primeira edição de 2016. Nossa base metodológica teve como grande contribuição o modelo de Bravo-Waechter adaptado para a percepção dos elementos do webjornalismo nessas publicações, com base na contribuição de Palacios. O resultado frustra de maneira direta a tentativa de levantamento de um padrão, revelando produtos com características completamente distintas. No entanto, o apêndice apresenta duas aplicações realizadas nos anos finais do doutoramento (2015-2017): em sala de aula, nascem dois produtos que exemplificam essa transição do impresso ao digital e apontam um caminho que pode servir como alternativa à falta de padrão. Convergência. 7 8 ABSTRACT This paper examines the possibility of incorporating the revised web genre for mobile devices from the design projects of the country's three largest magazines: Veja, Época and Istoé. In search of a pattern of elemental disposition and access to information capable of being recognized as a model and also of understanding the delicate dialectic relationship between form and content, we have recourse to reflections based on the contributions of Alexander and Cheptulin. We review the latest studies around the world that try to understand how the mobile magazine project meets mobile readers, taking into consideration issues such as mobility, available technologies, marketing perceptions, and The very inheritance of printed editorial design influencing the characteristics of the web, such as those found in content aggregators arranged in electronic curatorial system or in the news genre, historically present in society for millennia and from whom we borrow the thought of Marcuschi. The characteristics of media convergence, as recalled by Jenkins, are also revisited and associated with discussions about a natively analog product that finds its referent in mobile digital. We tried to raise all this questioning, in the three publications already mentioned, over two years (2014-2015) and also in the first edition of 2016. Our methodological basis had as great contribution the Bravo- Waechter model adapted to the perception of the elements of the Webjournalism in these publications, based on the contribution of Palacios. The result directly frustrates the attempt to raise a standard, revealing products with completely different characteristics. However, the appendix presents two applications made in the final years of the PhD (2015-2017): in the classroom, two products are born that exemplify this transition from print to digital and point out a path that can serve as an alternative to the lack of standard. CONCLUSIÓN .................................................................. 10 El Consejo de la Comisión Nacional de los Mercados y la Competencia (CNMC), en Pleno, en su reunión de 21 de mayo de 2014, ha aprobado el presente informe, relativo a la modificación introducida en el art. 32 del Proyecto de Ley por el que se modifica el Texto Refundido de la Ley de Propiedad Intelectual, aprobado por Real Decreto Legislativo 1/1996, de 12 de abril, y la Ley 1/2000, de 7 de enero, de Enjuiciamiento Civil, en el que se analizan las implicaciones de la misma desde el punto de vista de la competencia efectiva en los mercados y la regulación económica eficiente. Este informe se aprueba a iniciativa propia, en ejercicio de las competencias de la CNMC, en aplicación del artículo 5.1 de la Ley 3/2013, de 4 de junio, de creación de la Comisión Nacional de los Mercados y la Competencia. I. ANTECEDENTES I.1 Marco general La existencia de una normativa de protección de la propiedad intelectual se justificaría en la necesidad de crear un sistema de incentivos que favorezca dinámicamente, en mayor medida que el mercado, la actividad creadora de obras artísticas, literarias y científicas. Es un postulado comúnmente asumido que el Derecho de la competencia y el Derecho de la propiedad intelectual persiguen el idéntico objetivo de promover tanto la competencia como la innovación, además de la consecución del bienestar y la asignación eficiente de los recursos.
