Parliamentary Paper No. 196, Session 2018‐2021 i Useful information Role of the Committee The Scrutiny of Acts and Regulations Committee is an all‐party Joint House Committee, which examines all Bills and subordinate legislation (regulations) introduced or tabled in the Parliament. The Committee does not make any comments on the policy merits of the legislation. The Committee’s terms of reference contain principles of scrutiny that enable it to operate in the best traditions of non‐partisan legislative scrutiny. These traditions have developed since the first Australian scrutiny of Bills committee of the Australian Senate commenced scrutiny of Bills in 1982. They are precedents and traditions followed by all Australian scrutiny committees. Non‐policy scrutiny within its terms of reference allows the Committee to alert the Parliament to the use of certain legislative practices and allows the Parliament to consider whether these practices are necessary, appropriate or desirable in all the circumstances. The Charter of Human Rights and Responsibilities Act 2006 provides that the Committee must consider any Bill introduced into Parliament and report to the Parliament whether the Bill is incompatible with human rights. Interpretive use of Parliamentary Committee reports Section 35 (b)(iv) of the Interpretation of Legislation Act 1984 provides – In the interpretation of a provision of an Act or subordinate instrument consideration may be given to any matter or document that is relevant including, but not limited to, reports of Parliamentary Committees. When may human rights be limited Section 7 of the Charter provides – Human rights – what they are and when they may be limited – (2) A human right may be subject under law only to such reasonable limits as can be demonstrably justified in a free and democratic society based on human dignity, equality and freedom, and taking into account all relevant factors including— (a) the nature of the right; and (b) the importance of the purpose of the limitation; and (c) the nature and extent of the limitation; and (d) the relationship between the limitation and its purpose; and (e) any less restrictive means reasonably available to achieve the purpose that the limitation seeks to achieve Glossary and Symbols ‘Assembly’ refers to the Legislative Assembly of the Victorian Parliament ‘Charter’ refers to the Victorian Charter of Human Rights and Responsibilities Act 2006 ‘Council’ refers to the Legislative Council of the Victorian Parliament ‘DPP’ refers to the Director of Public Prosecutions for the State of Victoria ‘human rights’ refers to the rights set out in Part 2 of the Charter ‘IBAC’ refers to the Independent Broad‐based Anti‐corruption Commission ‘PCA’ refers to the Parliamentary Committees Act 2003 ‘penalty units’ refers to the penalty unit fixed from time to time in accordance with the Monetary Units Act 2004 and published in the government gazette (as at 1 July 2020 one penalty unit equals $165.22) ‘Statement of Compatibility’ refers to a statement made by a member introducing a Bill in either the Council or the Assembly as to whether the provisions in a Bill are compatible with Charter rights ‘VCAT’ refers to the Victorian Civil and Administrative Tribunal [ ] denotes clause numbers in a Bill ii Alert Digest No. 3 of 2021 Industrial Relations Legislation Amendment Bill 2021 Member Hon Tim Pallas MP Introduction Date 17 February 2021 Portfolio Industrial Relations Second Reading Date 18 February 2021 Summary The Bill amends various Acts to improve the operation of existing legislative schemes. Note the Second Reading Speech: ‐ ‘This Bill makes a number of amendments to current Acts of Parliament. The proposed amendments fit into four categories. Firstly, some amendments improve the operation of existing legislative schemes. Secondly, some amendments update references in the specified Acts to other Acts of Parliament. Thirdly, some amendments result from the passage of the Wage Theft Act 2020 by acknowledging the new role of Wage Inspectorate Victoria as a statutory body. Lastly are amendments that implement recommendations of the Victoria Inquiry into Labour Hire and Insecure Work.’ The Bill: ‐ Amends the Child Employment Act 2003 to transfer functions to the Wage Inspectorate Victoria;1 Amends the Construction Industry Long Service Leave Act 1997 (CILSL Act) to allow for information sharing with the Portable Long Service Benefits Authority; Amends the Equal Opportunity Act 2010 (EO Act) in relation to contract workers to clarify that certain protections in the Act extend to contract workers; Amends the Inquiries Act 2014 to provide labour hire workers with the same protections against detrimental actions if they participate in a Royal Commission; Amends the Labour Hire Licensing Act 2018 (LHL Act) to allow for the waiving of fees, retain and deposit monies and amend descriptions of the three tier licence fee system; Amends the Long Service Benefits Portability Act 2018 (LSBP Act) to allow for regulations to be made with respect to entitlements under the Long Service Leave Act 2018; Amends the Long Service Leave Act 2018 (LSL Act) to clarify the operation of various offences, the use of common law contracts and employers’ obligations and transfer functions to the Wage Inspectorate Victoria; Makes miscellaneous amendments to the Owner Drivers and Forestry Contractors Act 2005 to clarify provisions with respect to the provision of information. 1 Note the Second Reading Speech:‐ ‘…the Wage Inspectorate Victoria

    2018 Victorian State Election Analysis May 2019 spence-consulting.com Spence Consulting 2 2018 Victorian State Election Analysis Commentary and analysis by Gavin Mahoney. Now that the dust has settled on the 2018 State election let’s have a look a look at the outcome from a Local Government perspective. The previous 58th Parliament consisted of 22 members of the 88 seat Legislative Assembly who were former Councillors, and in the 40 seat Legislative Council there were 9 former Councillors. With a record number of Councillors standing at the 2018 state election a greater municipal presence within the state legislature seemed possible. Figures show that 43 existing Councillors contested both houses and 31 former Councillors also tried their hand, a record 74 candidates in total. So, what was the wash up for current and former councillors? We bid farewell to former (Councillors) members of Parliament who chose to retire at the election, Christine Fyffe (Liberal, Evelyn), Judith Graley (ALP, Narre Warren South) and Geoff Howard (ALP, Buninyong). Jane Garrett (former Yarra Councillor) successfully moved from the Lower House (Brunswick) to the Upper House (Eastern Victorian Region), replacing Daniel Mulino another former Councillor, who won ALP preselection for the newly created and safe Federal seat of Fraser. Daniel should add to the Local Government stocks within the National Parliament after the 18 May Federal Election. Peter Crisp (National, Mildura) was defeated being replaced by Mildura Councillor Ali Cupper, who stood as an Independent. Andrew Katos (Liberal, Baron South) who initially won the seat from another former Councillor in Michael Crutchfield, lost to another former Councillor and previous ALP Federal Member for Corangamite, Darren Cheeseman.
