LEGAL TERMS AND CONDITIONS FOR AENA S.M.E., S.A.’S “CRAZY FUN SUMMER” PROMOTION

ONE.- ORGANISING COMPANY

The company AENA S.M.E., S.A. (henceforth ‘AENA’), with registered office in Calle Peonias, 12, 28042, Madrid and identification number A86212420, plans to launch a promotion called “Crazy Fun Summer” and exclusively held at the following Airports. Josep Tarradellas Barcelona-El Prat (BCN), Adolfo Suárez Madrid-Barajas (MAD), Valencia (VLC), Málaga-Costa del Sol (AGP), Alicante-Elche (ALC), Gran Canaria (LPA), Tenerife Sur (TFS), Tenerife Norte (TFN), Menorca (MAH), Fuerteventura (FUE) and Lanzarote (ACE). This promotion is organised solely and exclusively by Aena.

TWO.- DURATION

The promotion will take place from 9 July 2019 to 31 August 2019.

Should it be necessary for this promotion to be postponed, changed or repeated owing to force majeure, participants shall be notified of that on the www.aena.es website, where the change will be given the same level of publicity as this promotion.

THREE.- PURPOSE

The purpose of this promotion is to encourage purchases during the above-mentioned promotional period in shops at Madrid, Barcelona, Valencia, Málaga, Alicante, Menorca, Gran Canaria, Tenerife Sur, Tenerife Norte, Lanzarote and Fuerteventura airports throughout the summer season, whose list of establishments is attached as Annexe 1 to these terms and conditions.

FOUR.- FREE OF CHARGE

This promotion will be free of charge, so that participation and prize winning shall not involve any increase in prices of the promotional products and services or any additional costs for consumers.

FIVE.- ELIGIBILITY

Any passenger over the age of 18 and with a boarding pass may take part, provided they meet the requirements set out in these legal terms and conditions.

AENA's employees, workers of the promotion’s affiliated airports and anyone who has directly or directly participated in the promotion's preparation are not allowed to not take part.

First-degree relatives of the above-mentioned groups, whether by blood or by marriage, are not allowed to take part either. Participation constitutes full and unconditional acceptance of these Legal Terms and Conditions, which participants shall have at their disposal for consulting in advance. All the requirements set out in this document must be met before a prize can be won.

SIX.- TERRITORIAL SCOPE

The territorial scope of the promotion shall include the following airports: Josep Tarradellas Barcelona-El Prat (BCN), Adolfo Suárez Madrid-Barajas (MAD), Valencia (VLC), Málaga-Costa del Sol (AGP), Alicante-Elche (ALC), Gran Canaria (LPA), Tenerife Sur (TFS), Tenerife Norte (TFN), Menorca (MAH), Fuerteventura (FUE) and Lanzarote (ACE)

SEVEN.- OPERATION

The following requirements must be met, in addition to the terms and conditions stated above, for the purposes of eligibility to take part in this promotion:

1. Passengers will have to find a “mupi” (advertising totem) in the shopping areas of the above-mentioned airports, next to the “Crazy Fun Summer” promotion booth.

There shall be two formats: an interactive format, which will be located in Madrid, Barcelona, Valencia, Málaga and Alicante airports; a physical format which will be located in Menorca, Gran Canaria, Tenerife Sur, Tenerife Norte, Lanzarote and Fuerteventura airports.

2. To play, users will have to slide the screen (for the interactive format) or the cubes (for the physical format).

Depending on the resulting cube combination, users may win discounts of €1 (for purchases of over €10), €2 (for purchases of over €10), €5 (for purchases of over €15) and €10 (for purchases of over €30) at participating shops and restaurants inside the promotion’s affiliate airports affiliated. Mupis will automatically print out the corresponding discounts.

Passengers who fail to win any prizes will be given pineapple- shape glasses containing a €1 discount for use in purchases of over €10.

Users at Josep Tarradellas Barcelona-El Prat (Terminal 1) and Adolfo Suárez Madrid-Barajas (Terminal 4) airports will also be able to access Virtual Reality. The Virtual Reality’s mechanics, which passengers will be explained before they take part, are as follows: Passengers will have 30 seconds to find and catch discounts that appear on the screen, by looking at their centre, through the campaign's crazy items. Users will collect more and more small discounts as they capture items, up to a maximum of €50, for use in purchases of over €100.

Once their screen time is up, users will be given the discounts they have won for their purchases.

Airport passengers will also be able to enter a prize draw for a weekend trip for two to Ibiza.

Any passenger who meets the requirements established in the legal conditions may participate in the draw for a trip to Ibiza for two people, regardless of their country of residence. The only limitation is the maximum prize amount of €4,000.”

Anyone wishing to take part in the prize draw will have to follow @enjoyaena and have a photo taken with the fun stickers put up by the airport and then upload a post on Instagram mentioning @enjoyaena with the hashtag #CrazyFunAirport.

AENA may request any other additional documents it deems fit to verify correct participation and compliance with the requirements set out in these legal terms and conditions, such as participants’ national identity card or passport for the purposes of verifying their identity.

Personal data provided by participants for the prize draw must be true. The participants’ Instagram profile has to be public.

Any participant who fails to meet all the requirements or provides false information shall be disqualified.

EIGHT.- COMMUNICATION WITH WINNER AND DELIVERY OF THE PRIZE

The winner of the prize who have met the requirement set out in these terms and conditions will be delivered their prize (discount vouchers of €1, €2, €5, €10 and a space Virtual Reality access prize for receiving discounts of up to €50) at the AENA booth in the airport they have taken part in, on prior verification by an AENA steward of the prize won.

Under no circumstances may the prize forming the subject matter of this promotion be changed, altered or offset at the winner’s request, nor may it be redeemed for cash.

The winner who turn down their prize shall not be entitled to any indemnity or compensation. The marketing and/or sale of the prize or rights to the prize are strictly prohibited.

Participants’ claims will be handled by AENA whose decision will be absolute and final

The winner of the prize draw for a trip to Ibiza will be announced on 1 September 2019.

The winner will be awarded prize that are personal and non- transferable. Failure to comply with this rule will lead to the participant’s disqualification from the prize draw.

The winner will be chosen, along with 10 runners up, who will be chosen at random from a prize draw from among all those who have taken part correctly.

Aena will contact winner in private on Instagram. The message will explain the steps required for confirming and receiving prize. The winner must send their name, surname(s), ID number, telephone number and email address by private message to the profile stated, within 72 hours as from the date of publication of the announcement of the winner.

Prize-winner who fail to send the necessary documents for confirming their interest in receiving the prize within deadline stated above will be deemed to have declined the prize.

Whereas winner may turn down prize, under no circumstances may the prize be exchanged for another prize or their cash value.

In the event of renunciation, the prize will pass to a runner up.

NINE.- GENERAL CONDITIONS

Aena reserves the right to cancel, suspend and/or modify the Promotion, completely or in part, in the case of fraud, technical defects, or any other factor outside Aena’s reasonable control that impedes the integrity or correct operation of the prize draw, in Aena's opinion.

Additionally, Aena reserves the right to disqualify any person who knowingly manipulates the participation process or the operation of the prize draw or acts in violation of the present Legal Terms in a detrimental or unsportsmanlike manner. Any attempt to deliberately impede the legitimate operation of the Promotion may constitute a violation of criminal and civil law, and should such a violation occur, Aena shall reserve the right to claim damages from any person as far as the law permits. Failure by the Organiser to take legal action shall not imply any waiver of its right to take whatever legal action may be available to it. TEN.- LEGITIMATE RESPONSIBILITY

Aena shall not be liable for any problems caused by changes to the prize draw or problems of any other nature that are not attributable to Aena or which fall outside its control: (1) incorrect or inaccurate information, whether caused by participants or third parties; (2) unauthorised human intervention at any time during the promotion; (3) technical or human errors unrelated to Aena that may occur in the management of the promotion; (4) any harm or loss to persons or assets that may be caused directly or indirectly, in full or in part, by the participation of candidates in the prize draw or by the receipt of the prize or its proper or improper use.

TEN A.- DISPUTES

All issues relating to the construction, validity, interpretation and performance of these Legal Terms and Conditions, or the rights and obligations of the participants and Aena in relation to the Promotion, shall be subject to the law and courts of Spain, without any other conflict-of-law rule applying (whether from Spain or any other jurisdiction), which may lead to the application of laws from any other jurisdiction other than that of Spain.

TEN B.- RIGHTS TO IMAGERY

The winner of the prize forming the subject matter of this promotion shall authorise the organising company to copy, use and disseminate their name, surname and image, in any advertising and/or promotional activity whatsoever relating to this promotion, in any medium (including but not limited to, use through the Internet and Internet for mobile telephones) without such activities conferring any right to remuneration or benefit apart from the delivery of the prize won under these terms and conditions.

The authorisation includes all rights to public reproduction, alteration, distribution and communication of the recordings or images captured, without any limitations in time or territory.

TEN C.- DATA PROTECTION

AENA S.M.E., S.A., informs you, under the provisions established in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and Spanish Framework Act 15/1999 of 13 December on Personal Data Protection, that the data of the participants as well as the winner, shall be automatically processed for the purposes of enabling the allocation and use of the prize forming the subject matter of the “Crazy Fun Summer” promotion.

The participants hereby state and guarantee that all the personal data they have provided Aena are accurate and correspond to their identity.

In addition, participants will be able to authorise the processing of their data (email address) commercial emails can be sent on AENA services at a national level, by ticking the box to that effect when registering. You may revoke at any time the consent you have given for receiving emails, by emailing to the following email: [email protected].

Communications sent to winner by AENA, as the data controller, shall provide full information, under the Data-Protection Policy that features on the webpage www.aena.es, on the processing of the data of the participation and, where appropriate, the winner.

You may exercise at all times your rights of access, rectification, deletion and challenging, portability and limitation of the processing, as listed in the GDPR (EU) 2016/679, by emailing your request to [email protected] with the subject Data Protection.

If you are have not obtained satisfaction in exercising your rights or in the way you exercised them, you can lodge a claim before the Supervisory Authority. For more information go to www.agpd.es.

TEN D.- ACCEPTANCE OF THE TERMS AND CONDITIONS

Participants, merely by participating in this promotion, accept its terms and conditions, as set out before the Madrid-based civil-law notary, Don Luis Máiz Cal, as well as in Aena, and likewise accept Aena’s judgment when it comes to resolving any issue that may arise from this promotion.
