This is an action in which it is claimed that a successful song, My Sweet Lord, listing George Harrison as the composer, is plagiarized from an earlier successful song, He’s So Fine, composed by Ronald Mack, recorded by a singing group called the “Chiffons,” the copyright of which is owned by plaintiff, Bright Tunes Music Corp. He’s So Fine, recorded in 1962, is a catchy tune consisting essentially of four repetitions of a very short basic musical phrase, “sol-mi-re,” (hereinafter motif A),1 altered as necessary to fit the words, followed by four repetitions of another short basic musical phrase, “sol-la-do-la-do,” (hereinafter motif B).2 While neither motif is novel, the four repetitions of A, followed by four repetitions of B, is a highly unique pattern.3 In addition, in the second use of the motif B series, there is a grace note inserted making the phrase go “sol-la-do-la-re-do.”4 My Sweet Lord, recorded first in 1970, also uses the same motif A (modified to suit the words) four times, followed by motif B, repeated three times, not four. In place of He’s So Fine’s fourth repetition of motif B, My Sweet Lord has a transitional passage of musical attractiveness of the same approximate length, with the identical grace note in the identical second repetition.5 The harmonies of both songs are identical.6 *179 George Harrison, a former member of The Beatles, was aware of He’s So Fine.

First Dance, Father/Daughter Dance, Mother/Son Dance etc) FOUR WEEKS in advance prior to your event so that we can confirm that the band will be able to perform the song(s) and that we are able to locate sheet music. In some cases where sheet music is not available or an arrangement for the full band is need- ed, this gives us the time needed to properly prepare the music and learn the material. Clients are not obligated to send in a list of general song requests. Many of our clients ask that the band just react to whatever their guests are responding to on the dance floor. Our clients that do provide us with song requests do so in varying degrees. Most clients give us a handful of songs they want played and avoided. Recently, we’ve noticed in increase in cli- ents customizing what the band plays and doesn’t play with very specific detail. If you de- sire the highest degree of control (allowing the band to only play within the margin of songs requested), we ask for a minimum of 100 requests. We want you to keep in mind that the band is quite good at reading the room and choosing songs that best connect with your guests. The more specific/selective you are, know that there is greater chance of losing certain song medleys, mashups, or newly released material the band has.

    Billy Preston Billy Preston was a soul singer and pianist who, in addition to having a successful solo career, collaborated with some of the greatest names in the music industry, including the Beatles, the Rolling Stones, Little Richard, Ray Charles, George Harrison, Eric Clapton, Bob Dylan, Sam Cooke, Sammy Davis Jr., Sly Stone, Aretha Franklin, the Jackson 5, Quincy Jones, and the Red Hot Chili Peppers. Often called “the Fifth Beatle,” this former child prodigy left one of the most profound and prolific legacies in music. William Everett Preston was born in Houston, Texas in 1946. He began playing piano at age three, and by ten he had joined the band of gospel great Mahalia Jackson. At age twelve he appeared in the 1958 film St. Louis Blues, portraying blues composer W.C. Handy as a young man. In the 1960s Preston performed with Little Richard and Ray Charles, and became a regular singer and pianist on the ABC television series Shindig. Preston went on to a successful career as a session musician, including lending his talents to the Beatle’s Let It Be album. That collaboration led to his signing to the Beatles’ Apple label, and in 1969 his solo effort, produced by George Harrison, was released. The album That's the Way God Planned It and the single of the same name met with limited success, but in 1972 he released an instrumental funk single, "Outa-Space," that reached #2 in the U.S. and won the Grammy award for Best Pop Instrumental Performance. Over the next two years, Preston enjoyed more number one hits including "Will It Go Round In Circles" and "Nothing From Nothing." He was the first guest musical artist on the premier episode of the popular TV show Saturday Night Live.

    2002 - Tom Tom Club's Christmas Stocking Stuffers Interview with ex-Talking Head and Tom Tom Club's Chris FrantzDec. 15, 2002 Just in time for the holiday season ex-Talking Heads turned Tom Tom Club alumni Chris Frantz and Tina Weymouth are filling their fan's Christmas stockings with two new downloadable holiday chestnuts from their website, http://www.tomtomclub.net . Both Chris and Tina, along with David Byrne and Jerry Harrison were inducted into the Rock and Roll Hall of Fame earlier this year, and while their work with the Talking Heads is what they may be best known for, the wedded couple have also, for the last twenty years, been busy making their own brand of uninhibited party music with their band Tom Tom Club. Surprisingly, its their own music with the Tom Tom Club, and not the Talking Heads, that has permeated itself into so many different styles of music over the past two decades, as their 1983 hit "Genius of Love" is the most sampled song of all time, with artists such as 2PAC, Ziggy Marley, the X-ecutioners and Mariah Carey either sampling bits or recreating the entire song. Livewire's Tony Bonyata caught up with Chris to talk about the Heads, the impact of Tom Tom Club, as well as their delightful new stocking stuffers. Livewire: I understand that you're giving your fans a couple of early Christmas presents on your web site this season. Chris: Yeah, we are. The first one, which is already posted on the homepage of our site, tomtomclub.com, is a very traditional, beautiful and kind of chilled-out French carol called "Il Est Ne," which is French for "He Is Born." It's very traditional, and I'm sure you'll recognize it when you hear the melody.

For their new 40:42 EP released Thursday, the Grammy-winning band commissioned acclaimed jazz saxophonist Sam Gendel and the Connecticut rock quintet Goose to both create their own reinterpretations of the Father of the Bride album track. One twist though: Vampire Weekend gave Gendel and Goose the directive to turn their one minute and thirty-nine second long song into two twenty minute and twenty-one second versions (hence the title 40:42 ). In addition to fans being able to hear the two unique interpretations, Gendel and Goose both came with their own visuals. While Gendel's jazzy take comes with some improvisational animation, Goose chose to film themselves performing an intimate, up-close take on the song.
