Ghias Abstract Defining Shariʿa: The Politics of Islamic Judicial Review by Shoaib A. Ghias Doctor of Philosophy in Jurisprudence and Social Policy University of California, Berkeley Professor Malcolm M. Feeley, Chair Since the Islamic resurgence of the 1970s, many Muslim postcolonial countries have established and empowered constitutional courts to declare laws conflicting with shariʿa as unconstitutional. The central question explored in this dissertation is whether and to what extent constitutional doctrine developed in shariʿa review is contingent on the ruling regime or represents lasting trends in interpretations of shariʿa. Using the case of Pakistan, this dissertation contends that the long-term discursive trends in shariʿa are determined in the religio-political space and only reflected in state law through the interaction of shariʿa politics, regime politics, and judicial politics. The research is based on materials gathered during fieldwork in Pakistan and datasets of Federal Shariat Court and Supreme Court cases and judges. In particular, the dissertation offers a political-institutional framework to study shariʿa review in a British postcolonial court system through exploring the role of professional and scholar judges, the discretion of the chief justice, the system of judicial appointments and tenure, and the political structure of appeal that combine to make courts agents of the political regime. -

M "s/.-Oj Uni^ 0 2 t'S 2C06 THESIS 1 ABSTRACT The sad demise of Prophet Muhammad (SAW) (571- 622AD) created a vacuum in the Muslim Ummah. However, this vacuum was filled by the able guided and pious Khulafa {Khulafa-i-Rashidin) who ruled Ummah one after another. Except the first Khalifah, all the subsequent three Khulafa were unfortunately martyred either by their co-religionists or by antagonists. Though the assassination of Hazrat Umar (RA) did not create any sort of havoc in the Ummah, but the assassination of Hazrat Uthman (RA) caused a severe damage to the unity of Muslim Ummah. This was further aggravated by the internal dissentions caused by the assassination of the third Khalifah during the period of the fourth Khalifah, leading to some bloodshed of the Muslims in two bloody wars of Camel and Si/fin; Hazrat All's assassination was actually a result of that internal strife of the Muslims, dividing the Muslim community into two warring camps. Hazrat Hasan's abdication of the Khilafah tried to bridge the gulf but temporarily, and the situation became explosive once again when Hazrat Muawiyah (RA) nominated his son Yazid as his successor whose candidature was questioned and opposed by a group of people especially by Hazrat Husain (RA) on the ground that he was not fit for the Khilafah. -

Yet the still image remains the default object of inquiry in most studies of devotional visuality. Taking movement rather than stasis as the prerequisite for engagement, many popular decorative items and technologies that share the status of “moving images” evoke the affective experience of pilgrimage. In what follows, close analysis of a repertoire of one such image technology, the lenticular print, formed through its circulation in Pakistan, provides insights into the kind of engagement expected from images whose efficacy is governed by their mobility. -

THE ZIKR OF HUZOOR MUFTI-E-AZAM HIND Radiallahu Ta’ala Anh Huzoor Mufti-e-Azam Hind Hazrat Imam Mustafa Raza Khan Qadri (Radiallahu Ta'ala Anh) had reached such an exalted level of spiritualism that his heart was in constant remembrance of Allah Ta’ala. As with the very special and chosen servants of Allah Ta’ala he used to engross himself in the remembrance and worship of Allah Ta’ala to such an extent that the parts of his body would sometimes split up and individually make the Zikr of the Name of Allah Ta’ala. Hereunder is a glimpse into the illuminated heart and Zikr of Huzoor Mufti-e-Azam Hind (Radiallahu Ta'ala Anh). Once, whilst Huzoor Mufti-e-Azam Hind (Radiallahu Ta'ala Anh) was on a journey by train to Calcutta, there was a Saadhu in the same couch as Hazrat. The Saadhu would suddenly jump up and look around carefully as if he had heard something. The Saadhu got up from his seat and walked to Huzoor Mufti-e-Azam Hind (Radiallahu Ta'ala Anh) and said, “O Holy Man! What kind of sound is this which is causing my heart to yearn so much?” Huzoor Mufti-e-Azam Hind (Radiallahu Ta'ala Anh) called the Saadhu to sit close to him and said, “The Name of the One whom I worship has become part of my heartbeat and since this name has come into my heart, my heartbeats have become so loud and powerful that I hear it and those ears which are meant to hear it also hear it.
