IV-SEM MUSLIM LAW BY Dr. JAVED AHMED QURESHI DATE- 04-04-2020 MALIKI SCHOOL Maliki school is one of the four schools of fiqh or religious law within Sunni Islam. It is the second largest of the four schools, followed by about 25% Muslims, mostly in North Africa and West Africa. This school is not a sect, but a school of jurisprudence. Technically, there is no rivalry or competition between members of different madrasas, and indeed it would not be unusual for followers of all four to be found in randomly chosen American or European mosques. This school derives its name from its founder Imam Malik-bin-Anas. It originates almost to the same period as the Hanafi school but it flourished first in the city of Madina. Additionally, Malik was known to have used ray (personal opinion) and qiyas (analogy). This school is derives from the work of Imam Malik. It differs in different sources from the three other schools of rule which use it for derivation of regimes. All four schools use the Quran as the primary source, followed by Prophet Muhammad's transmitted as hadith (sayings), ijma (consensus of the scholars or Muslims) and Qiyas (analogy).In addition, the School of Maliki uses the practice of the people of Madina (Amal Ahl al-Madina) as a source. While the Hanafi school relies on Ijma (interpretations of jurists), the Maliki school originates from Sunna and Hadis. -

INTRODUCTION By the end of February 632 and at the age of sixty-three, the Prophet Muhammad believed that his days on earth were coming to an end.2 He announced to his followers that he would lead the hajj, the annual pilgrimage to Mecca, himself that year.3 On March 3, the Prophet delivered his farewell sermon near Mount Arafat.4 Among the limited number of topics he chose to include in his last public speech, he encouraged his followers to deal justly with one another and treat women well. 5 In the modem era, the rights of women under Islamic law have come under heightened scrutiny. Some commentators find the Prophet's farewell speech to be inconsistent with the way women are treated in some areas of the Muslim world. In Saudi Arabia, for example, women may neither drive nor vote. -

Foreign Policy Research Institute E-Notes A Catalyst for Ideas Distributed via Fax & Email and Posted at www.fpri.org September 2009 POLITICS, TERRORISM, AND THE SUNNI DIVIDE By Samuel Helfont This E-Note is based on Mr. Helfont’s forthcoming monograph, The Sunni Divide: Understanding Politics and Terrorism in the Arab Middle East, a product of FPRI’s Center on Terrorism, Counterterrorism, and Homeland Security. Wahhabism and the Muslim Brotherhood are two distinct forms of Sunni Islamism. They have separate histories and separate worldviews. In reality they are not even the same type of movement. Their origins were largely unrelated. Their historic missions have been completely different, as are their current goals and means of achieving those goals. Unfortunately, these differences too often are overshadowed by a false Sunni-Shia dichotomy that tends to lump all Sunni Islamists together. But learning the differences between Sunni Islamists is critical to understanding politics and terrorism in the Arab Middle East. One could even argue that the most important division shaping Arab politics is not between Sunnis and Shias but between the Wahhabis and the Brotherhood. Before delving into current issues, however, it is first necessary to define differences between Wahhabism and the Muslim Brotherhood. Wahhabism stems from the theological teachings of Muhammad ibn abd al-Wahhab, the eighteenth century reformer. Abd al- Wahhab was one of several “revivalist” thinkers to emerge from that century. The mission of these revivalists was to purify and thereby revitalize Islam. They carried the banner of reform but unlike modern reformers, they wanted to transform Islam on traditionally Islamic grounds. -

Lindley Cross 12 June 2009 Perspectives Behind Translating House of Flesh by Yusuf Idris Within the canon of great minds and talents that brought Egypt to a literary renaissance between 1880 and 1960, Yusuf Idris (1927-1991) is widely acknowledged as the master of the Egyptian short story. Employing a compact, terse style, charged with an energy that viscerally engages the senses as much as it does the imagination and intellect, he burst into the public eye with a prolific outpouring of work in the years directly following the 1952 Revolution. His stories from the beginning were confrontational and provocative, articulated from his firm commitment to political activism. Although his literary efforts had largely petered out by the 1970s, the uncompromising zeal and intensity he brought to his short stories left a groundbreaking impression on the history of modern Arabic fiction. Inside the Arabic literary tradition, the short story (al-qiṣṣah al-qaṣīrah, or al-uqṣuṣah) is in itself a genre that bears a political dimension, first and foremost due to its having been largely inspired by foreign models.1 Even in Europe and North America, it only achieved widespread acceptance as a literary form distinct from novels in the early nineteenth century. In the climate of French literary prestige and British colonialism encroaching upon Egypt’s identity, the choice whether to adopt or reject such forms was often indicative of a wider political view. Some intellectuals were convinced that the only way to save Egypt from cultural effacement was to re-appropriate the language and forms of the great classical masters like Abu Nawas and al- Mutanabbi and inject them into contemporary literature, warding off further corruption as a vaccine wards off disease. -
Islamic Civilization Experienced a Golden Age Under the Abbasid Dynasty, Which Ruled from the Mid 8Th Century Until the Mid 13Th Century
Included lands & peoples from parts of three continents (Europe, Africa, & Asia) Preserved, blended, & spread Greek, Roman, Indian, Persian & other civilizations. Enjoyed a prosperous golden age with advances in art, literature, mathematics, and science. Spread new learning to Christian Europe. A period of great prosperity or achievement, especially in the arts Islam began in the Arabian Peninsula in the early 7th century CE. It quickly spread throughout the Middle East before moving across North Africa, and into Spain and Sicily. By the 13th century, Islam had spread across India and Southeast Asia. The reasons for the success of Islam, and the expansion of its empire, can be attributed to the strength of the Arab armies, the use of a common language, and fair treatment of conquered peoples Arab armies were able to quickly conquer territory through the use of advanced tactics and the employment of horse and camel cavalry. Islamic rulers were very tolerant of conquered peoples, and welcomed conversion to the Islamic faith. All Muslims must learn Arabic, so they can read the Qur'an, the Islamic holy book. This common language helped to unite many different ethnic groups within the Islamic empire. It also made possible the easy exchange of knowledge and ideas. Islamic civilization experienced a golden age under the Abbasid Dynasty, which ruled from the mid 8th century until the mid 13th century. Part one of our research theorized three typologies shaping the challenges of similar conflicts in the Arab-African states of Egypt and Sudan. The typologies symbolized a Sufi culture perpetuating Muslims’ humanitarian relations; Secularist thought excluding the politics of faith; and Jihadist reactionaries manipulating symbolic representation of religion in the striving for power domains. Lacking in serenity the Sufi culture maintained for ages by popular prevalence, the Jihadist reactionaries sponsored a theocratic militancy that generated instability by excessive violence. Entrenched in non-democratic authoritative systems, the state failed in both countries to end peacefully the deepened tensions of the ongoing contradictions. Preserving the popular culture and supporting democratic governance, the Sufi/Secularist groups would probably continue to resist the theocratic dogma that evidently penetrated the region. Testimony of Omar Ricci Chairman Islamic Center of Southern California On “Confronting White Supremacy (Part I): The Consequences of Inaction” House Committee on Oversight and Reform May 15, 2019 Chairman Raskin, Ranking Member Roy and honorable members of the Oversight subcommittee on Civil Rights and Civil Liberties, my name is Omar Ricci, and I would like to thank the Committee for the opportunity to testify on the impact of white supremacy and white supremacist violence on American Muslims. I am here today to share my experiences as an American Muslim, the Chairperson of the Islamic Center of Southern California and as a law enforcement officer. I am not testifying in my capacity as an officer of the Los Angeles Police Department and the views shared in this testimony are mine alone. While I identify as a Muslim, my testimony today is rooted in an identity that is wholly American and a reflection of my concern as an American citizen. White supremacy is an evil that harms all Americans, regardless of race or religion, because it is one that is founded on a hateful and false sense of superiority. My hope is that my testimony can serve as a voice for all who have been scarred and impacted by the increase in white supremacist motivated attacks I am 50 years old, born in New York City to a Pakistani immigrant mother and a second generation Italian/Irish father. I moved to the great city of Los Angeles in 1972 and it has been home ever since. I attended Fairfax High School in a predominantly Jewish neighborhood, and graduated from California State University Northridge. -

JERUSALEM PROPHETS AND PROGENITORS IN THE EARLY SHI'ATRADITION* Uri Rubin INTRODUCTION As is well known, the Shi 'I belief that 'Ali' should have been Muhammad's succes- sor was based on the principle of hereditary Califate, or rather Imamate. 'Ali's father, Abu Talib, and Muhammad's father, 'Abdallah, were brothers, so that Muhammad and 'Ali were first cousins. Since the Prophet himself left no sons, the Shi 'a regarded' All as his only rightful successor.' Several Shi 'I traditions proclaim 'All's family relationship (qariiba) to Muhammad as the basis for his hereditary rights. For the sake of brevity we shall only point out some of the earliest.A number of these early Shi T traditions center around the "brothering", i.e. the mu'akhiih which took place after the hijra; this was an agreement by which each emigrant was paired with one of the Ansar and the two, who thus became brothers, were supposed to inherit each other (see Qur'an, IV, 33? 'All, as an exception, was paired not with one of the Ansar but with the Prophet himself." A certain verse in the Qur'an (VIII, 72) was interpreted as stating that the practice of mu iikhiin was confined only to the Muhajinin and the Ansar, to the exclusion of those believers who had stayed back in Mecca after the hijra. They re- tained the old practice of inheritance according to blood-relationship." Through the window on the left, the sultan’s lions peer out. In the adjoining cage, the Jews of Fez. When the photograph was taken in 1912, the Jews were sheltering in the sultan’s menagerie from a murderous riot on the eve of the establishment of the French protectorate of Morocco. The implication is clear: the Jews’ place is with the sultan’s beasts. It was the Jews’ job to feed the lions. In times of trouble, what place of refuge could be more natural than the sultan’s menagerie? The lions have long gone, and so have the Jews. Almost all the Jewish communities of the Middle East and North Africa have been driven to extinction: most went to Israel, where half the Jews or their descendants come from Muslim lands. A lethal cocktail of state-sanctioned persecution and mob violence, modulated to the peaks of Arab-Israeli tension, has caused the Jewish population to dwindle from one million in 1948 to 4,500 in one generation. It was an ethnic cleansing, says Weinstock, not even rivalled by Nazi Germany in 1939. Such a calamity cannot be explained by the Jews’ failure to integrate. They were indigenous, having for the most part settled in the Middle East and North Africa over 2,000 years ago – one thousand years before the advent of Islam. -

Islam and Women’s Literature in Europe Reading Leila Aboulela and Ingy Mubiayi Renata Pepicelli Contrary to the perception that Islam is against women and against the European way of life, some Muslim women based in Europe write novels and short stories in which Islam is described as instrument of empowerment in the life of their female characters. No more or not only an element of oppression, religion is portrayed as an element of a new identity for Muslim women who live in Europe. The Translator1 and Minaret2 by Leila Aboulela (Sudan/United Kingdom) and “Concorso”3 by Ingy Mubiayi (Egypt/Italy) are three works that demonstrate how the re-positioning of religion functions in women’s lives and struggles. I will first analyze the two novels written in English by Aboulela, followed by the short story written in Italian by Mubiayi. In The Translator (1999), Aboulela tells the story of Sammar, a young Sudanese woman who follewed her husband, a promising medical student, to Scotland. After her husband dies in a car accident, Sammar is alone in this foreign country. In Aberdeen she spends several painful and lonely years, far from her home and son who, after the terrible accident, lives in Khartoum with her aunt/mother-in-low. During this time, religion, day by day, becomes her only relief. Suddenly she finds work as an Arabic to English translator for an Islamic scholar, Rae, at a Scottish University, and she falls in love with him. Though her love is reciprocated, they have a problem. Rae is not Muslim, and for Sammar, Islam shapes and affects all aspects of life.
