Executive Summary Staff is requesting consent and signature of the Professional Services Agreement with Precision Engineering for a contract amount of $572,592.41 which requires approval by the Commission. This project will reconstruct the intersection of Cole Road and and widen Cole Road to five lanes between the intersection south to McGlochlin Street in Boise, approximately ½ mile. The design is scheduled to start on January 23, 2017. Staff recommends approval of the agreement.

Facts & Findings The Cole Road and Victory Road Intersection proposed improvements will be a 7 by 6 intersection. Cole Road south of the intersection of Cole Road and Victory Road is a two lane road with irrigation crossings and a bridge. The proposed roadway section will include two travel lanes northbound and southbound, median or two-way left turn lane, curb, gutter, bike lanes and sidewalk. The project will include the reconstruction and widening of Cole Road Bridge #1261.

Fiscal Implications There is $670,000 in the FY17 budget for the design of this project. The negotiated design costs including roadway design, intersection design, bridge design, geotechnical investigation, surveying, and contingencies amount to $572,592.41. A previous separate contract for surveying for $96,926.00 was executed so the survey could be completed before winter snow.

Policy Implications The project has been approved as part of the FY17 budget and the 2017-2021 Integrated Five Year Work Plan, adopted by the ACHD Commission on October 26, 2016.

ADA COUNTY HIGHWAY DISTRICT, a body politic and corporate of the State of Idaho, (hereinafter “ACHD”) and Precision Engineering LLC, 1935 N Belgrave Way, Eagle Idaho 83616 (hereinafter “Consultant”) hereby enters into this Agreement to perform the professional services required in connection with the professional services, as outlined in the attached Scope of Work (“Project”). AGREEMENT Consultant agrees to perform the professional services to complete the Scope of Work for an amount not to exceed $572,592.41. Any costs over and above this amount shall be the total responsibility of CONSULTANT. Consultant will perform any additional work as desired by ACHD by means of a written Supplemental Agreement signed by a person authorized by ACHD to execute such Supplemental Agreement in accordance with ACHD policy. Such authorization shall consist of written approval by either a person authorized by ACHD to give such approval or the Board of Commissioners; provided that the ACHD Board of Commissioners must approve any Supplemental Agreement that is in excess of thirty-five percent (35%) of the original Agreement amount. Such prior written authorization by ACHD shall be a condition precedent to any claim of Consultant for payment.

1. PROJECT: A. Consultant shall develop roadway plans for the Project. The plans shall include grading, paving, drainage, right-of-way details, and other information in accordance with the provisions contained within the attached Scope of Work. B. Consultant shall not be responsible for the performance failure of ACHD’s construction contractors. Consultant shall not be responsible for the means and methods used by ACHD’s construction contractors, including any subcontractor or other third-party traffic control and construction site security. 2. TIME OF COMMENCEMENT AND COMPLETION OF CONTRACT Consultant shall commence work under the terms and conditions of this Agreement within ten (10) calendar days from the date of receiving a "Notice to Proceed" from ACHD and

Consultant shall have the Scope of Work completed on or before February 28, 2018. This date is predicated on Consultant receiving the Notice to Proceed on January 18, 2017. Should Consultant fail to receive said Notice to Proceed on the date specified, the completion date shall be adjusted to allow for the difference between the proposed Notice to Proceed date and the actual date the Notice to Proceed is given. ACHD shall have the right to reduce the monies due to Consultant, commencing on the agreed completion date and continuing until all required work is complete, by a sum negotiated between the parties on a case-by-case basis. The Scope of Work shall be considered to be complete when all submittals required under Section 3106 of ACHD's Policy Manual are made, except for revisions arising from right-of-way acquisition. Time is of the essence of this Agreement. No waiver by either party of strict and timely performance of the other shall constitute a waiver of any subsequent breach or default. 3. DELAYS AND EXTENSIONS A. Extensions of time for completion may be granted by ACHD for the following reasons: (1) Delays in major portions of the work caused by excessive time required to process submittal; delays caused by ACHD or its other consultants/contractors; or additional work order, in writing, by ACHD. (2) Any delay caused by a Force Majeure Event. A “Force Majeure Event” means an event due to any cause or causes beyond the reasonable control of Consultant. (3) In the event of a delay as defined in item (1) or (2), the Consultant shall receive an equitable adjustment extending Consultant’s time for performance for such services sufficient to overcome the effects of the delay. B. Extensions of time will not be granted for the following reasons: (1) Underestimating complexity of the work by Consultant resulting in failure of Consultant to timely complete this Agreement under the terms and conditions provided herein; (2) Redoing portions of the project by Consultant that were inadequately performed by Consultant and subsequently rejected by ACHD. 4. TERMINATION A. ACHD may terminate or abandon this Agreement at any time, with or without cause, upon giving written notice of termination hereof as follows: (1) Evidence that actual progress is behind the progress indicated in the work schedule given to ACHD by Consultant. (2) Submission of substandard work by Consultant, its agent, sub-consultants or employees; (3) Material breach of any of the other terms and conditions of this Agreement by Consultant;

Prior to giving notice of termination for cause set forth in paragraphs 1 and 2 above, ACHD shall notify Consultant in writing, of any such deficiencies or default in the performance of the terms and conditions of this Agreement by Consultant, and Consultant shall have ten (10) calendar days after receipt of such notice to correct or remedy such default or begin the corrective measures. Should Consultant fail to remedy its default or begin the corrective measures within said 10-day period, or for the reasons set forth above, ACHD shall have the option to immediately terminate this Agreement. Upon receipt of notice of termination by ACHD, Consultant shall immediately discontinue all work and services, unless directed otherwise, and shall transfer all documents pertaining to the work and services covered under the terms and conditions of this Agreement to ACHD. Upon receipt by ACHD of said documents, payment shall be made to Consultant for that work performed to date that has been approved by ACHD. Should any deficiencies or default occur by Consultant for the reasons set forth above, and result in any damages to ACHD, ACHD shall be entitled to proceed against Consultant for any damages it has sustained as a result of such breach by Consultant. B. Consultant may terminate the Agreement only for failure to pay or breach of the Agreement by ACHD after the entry of a court order or decision finding a breach. 5. NONAPPROPRIATION If ACHD is precluded from committing to make certain future payments due hereunder, this paragraph will apply. ACHD has appropriated the funds necessary to make all payments when due under the Agreement during ACHD’s initial fiscal period during the Agreement term. ACHD agrees that in each succeeding fiscal year during the term of this Agreement, ACHD will take all necessary steps to make a timely appropriation of funds in order to pay the payments due hereunder during that period, subject to the annual appropriations limitation imposed upon ACHD under state law. In the event that despite the best efforts of ACHD, ACHD determines that funds for any amounts under this Agreement will not be available or cannot be obtained during any succeeding fiscal period, ACHD may terminate this Agreement prior to the commencement of such succeeding fiscal period by giving written notice to CONTRACTOR/CONSULTANT/ VENDOR of such determination at least 60 days prior to the first day of such succeeding period for which an appropriation has not been made by ACHD. 6. DISPUTES Should any dispute arise as to the adequacy of performance, the occurrence of abnormal conditions affecting the work, or the enforcement or interpretation of any provision under this Agreement, such dispute shall be referred to the Director of Ada County Highway District, or his duly authorized representative(s), and a member of senior management of the Consultant for resolution. ACHD and Consultant shall attempt in good faith to settle by negotiation and compromise any dispute arising out of or relating to this Agreement, or the breach thereof (the “Dispute”). If a resolution of the Dispute cannot be mutually agreed upon than either party may file a civil action in Idaho state court to resolve the Dispute.

OWNERSHIP OF DOCUMENTS All material delivered by Consultant in conjunction with the preparation of the plans shall become the property of ACHD without any restrictions or limitations with respect to their further use thereof. All documents or materials prepared for ACHD shall not be distributed by Consultant, sub-consultants, their agents, representatives or employees to any third party without the express written consent of ACHD. Use of these documents on any other project, without written verification or adaptation by Consultant for the specific purpose intended, will be at ACHD's sole risk and shall be without liability or legal exposure to Consultant. ACHD shall indemnify and hold harmless Consultant from all claims, damages, losses, and expenses, including attorney's fees arising out of or resulting from the said use of such documents. 8. INDEMNITY Consultant agrees to indemnify, defend, and hold harmless ACHD for damages from any and all claims, demands, or actions as a result or consequence of any and all negligent acts, errors, or omissions by Consultant or Consultant's agents, employees, or sub-consultants arising from the performance of this Agreement. Consultant, sub-consultants, their agents or employees shall comply with the standards of ACHD in effect at the time ACHD accepts and approves the final plans; and/or the final payment is made by ACHD to Consultant under the terms and conditions of this Agreement. Consultant shall not be held liable for changes or revisions to the drawings or related documents following the acceptance by ACHD of such documents without Consultant’s knowledge and consent. Consultant does hereby further indemnify, save, and hold harmless ACHD, its agents, personal representatives and assigns, from any and all claims for wage payments, withholding, taxes, or other payments or benefits due to sub-consultants of Consultant. This provision shall not be construed to preclude any remedy that ACHD may have in law or equity. ACHD shall, subject to the limitations hereinafter set forth, indemnify, save harmless and defend regardless of outcome Consultant from expenses of and against suits, actions, claims or losses of every kind, nature and description, including costs, expenses and attorney fees caused by or arising out of any negligent acts by the ACHD or the ACHD’s officers, agents and employees while acting within the course and scope of their employment, which arise from or which are in any way connected to this Agreement. Any such indemnification hereunder by the ACHD is subject to the limitations of the Idaho Tort Claims Act (currently codified at chapter 9, title 6, Idaho Code). Such indemnification hereunder by the ACHD shall in no event cause the liability of the ACHD for any such negligent act to exceed the amount of loss, damages, or expenses of attorney fees attributable to such negligent act, and shall not apply to loss, damages, expenses, or attorney fees attributable to the negligence of Consultant. Consultant's period of liability shall remain in effect for as long as any applicable statute of limitations provided by Idaho law allows. The applicable statute of limitations shall not begin to accrue until the contractor’s warranty period of the constructed Project expires. Any construction contract that utilizes the Consultant's design work shall include both ACHD and the Consultant as additional insureds on the construction contractor's commercial general

INSURANCE Consultant certifies it is an independent business, along with any sub-consultant retained and hired by Consultant, and shall acquire and maintain comprehensive general liability insurance, having a minimum limit of $100,000 per claim and $500,000 aggregate, and errors and omissions coverage having minimum limits of not less than $250,000. Consultant agrees to provide a certificate of insurance certifying to ACHD that such coverage is in force. Consultant further agrees to maintain and keep required Workers Compensation Insurance, Unemployment Insurance, and all other insurance required to be maintained under the laws of the State of Idaho. 10. INDEPENDENT CONTRACTOR Consultant is an independent contractor and is not an employee of ACHD. Consultant acknowledges that this Agreement is not an employment contract and that ACHD is only engaging Consultant to render the Professional Services described herein. 11. NOT AN EMPLOYMENT CONTRACT Consultant acknowledges that this Agreement is not an employment contract and that ACHD is only engaging Consultant to render the Professional Services described herein. 12. ACKNOWLEDGEMENT OF PROFESSIONAL SERVICE Consultant warrants that the Professional Services rendered under this Agreement require Consultant to have specialized skill and, or technical training. Consultant covenants that Consultant has the requisite specialized skill or, if Consultant gained Consultant’s ability to render such Professional Services through class or training, that Consultant has met all requirements in said class and, or training course(s), and, if required, Consultant is certified under applicable federal and, or state laws to perform said Professional Services. 13. GENERAL COMPLIANCE WITH LAWS Consultant shall at all times observe and comply with all Federal, State, and local laws and any and all codes, ordinances, and regulations affecting the work in any manner. Consultant agrees that any recourse to legal action pursuant to this Agreement shall be brought in the Fourth District Court of the State of Idaho situated in Boise, Idaho. 14. NONDISCRIMINATION A. Nondiscrimination: Consultant, with regard to the work performed by them during the term of this Agreement, shall not in any way discriminate against any employee or applicant for employment; subconsultant, subcontractor, or solicitations for subcontract including procurement of materials and equipment; or any other individual or firm providing or proposing services based on race, color, religion, sex, national origin, age or non-job related handicap, or prior military service or current military status.

Solicitations for Subcontracts, including Procurement of Materials and Equipment: In all solicitations, either by bidding or negotiation, made by Consultant for work or services performed under subcontract, including procurement of materials and equipment, each potential subconsultant, subcontractor, or supplier shall be made aware by Consultant of the obligations of this Agreement and to the Civil Rights requirements based on race, color, religion, sex, national origin, age or non-job related handicap, or prior military service or current military status. Federal Aid Projects: Civil Rights Attachment ____ attached hereto, is incorporated by reference, as it fully set forth herein. 15. ENDORSEMENT BY ENGINEER The Professional Engineer in direct charge of the design shall approve and endorse all plans, specifications, cost summaries, and reports with a professional seal, signature and date. In addition, the legal firm name and address shall be clearly stamped or lettered on the tracing of each sheet of the plans. Any licensing or approvals required by the State of Idaho shall be complied with by all Professional Engineers and Surveyors employed by Consultant. 16. MONTHLY PROGRESS REPORTS Consultant shall submit to ACHD, in conjunction with its payment request, progress reports of work done on the project with activity updates. This report shall be made not more often than once per month or every 4-week period. The report shall also include any and all pertinent information as to delays or lack of performance on the Project. Additional work, for which Consultant contemplates compensation and/or extensions of time, must be reported in such report with an attached explanation. (Extra work data must be submitted with the Progress Report, or it cannot be used for basis of subsequent extension of time or additional compensation by ACHD.) 17. ATTORNEY FEES In any suit, action or appeal therefrom to resolve the Dispute or to enforce or interpret the provisions of this Agreement, the prevailing party shall be entitled to recover from the non- prevailing party reasonable expenses including, but not limited to, reasonable attorney fees, account fees and other expert fees and costs. 18. PAYMENTS Payments properly submitted are due within thirty (30) days of the date of receipt of the Consultant’s invoice. SCOPE OF WORK Cole Road and Victory Road Intersection ACHD Project No. 317005 ACHD GIS No. IN205-97 December 21, 2016

Project Description This project is currently programmed for right-of-way in FY 2019 and construction in FY 2020.

The proposed project improvements consist of a total reconstruction of the Cole Road and Victory Road intersection and approximately 3,500 feet of road reconstruction on Cole Rd from Victory Road to McGlochlin Street. The anticipated improvements will consist of the following:

 Reconstruct the Cole Road and Victory Road intersection with six-lanes on Cole Road (two through lanes, one left turn lane and one right turn lane in each direction) and seven- lanes on Victory Road (two through lanes, dual left turn lanes and one right turn lane in each direction). The left and right turn lanes will extend for a length of approximately 300 feet, then taper to a five-lane sections in all four directions  Reconstruct Cole Road, south of Victory Road to McGlochin Street to a five-lane urban section including: two through lanes in each direction with a center turn lane, curb and gutter, sidewalk, and bike lanes  A pavement life-cycle cost analysis will not be conducted. This scope of work assumes that the intersection will be constructed with concrete pavement for a distance of approximately 300 feet from the intersection on each approach, matching the left- and right-turn lane lengths. From there, the roadway surface will be plant mix pavement.  A fully actuated traffic signal will be constructed at the intersection utilizing radar detection with protected/permitted left-turn phasing on the Cole Road approaches.  Install a PHB and school zone flashers on Cole Road near Diamond Street  Relocate existing emergency traffic signal at Boise Fire Station #17 as needed to accommodate the widening of Cole Road  Install corridor street lighting for the full extents of the project limits  Install fiber optic interconnect for the full extents of the project limits  Extend or replace existing Cole Road Bridge No. 282 over Five Mile Creek. The decision on whether the structure will be extended or replaced will be determined in preliminary design  Infiltration and/or retention facilities are anticipated to be designed to treat and dispose of storm flows generated by the project improvements  Existing irrigation will be perpetuated with pipe crossings replaced to meet current standards.

Ada County Highway District Precision Engineering Cole Road Victory Road Intersection December 21th, 2016 ACHD Project No. 317005 ACHD GIS No. IN205-97 Page 1 of 27 Cole Road and Victory Road Intersection Scope of Work A pre-scoping meeting was held on November 9th 2016 at ACHD to discuss the project expectations, level of effort and assumptions. The following outlines the items discussed:

 The traffic analysis will include verifying the future improvements at the intersection, which is anticipated to be a 7 lane by 6 lane intersection. As part of the analysis it will be determined if the dual left turns are warranted at construction year and if not what year they are warranted. The traffic analysis report will consist of a traffic memo verifying the recommendations developed in the ACHD 2012 CIP, Syringa Valley TIS (2014) and Southwest Boise Transportation Study (2009). A full-length traffic report will not be required.  The Concept Report will consist of a memo and multiple roll plots showing the alternative intersection designs. Showing advantages and disadvantages for each alternative including: estimated construction cost, ROW impacts, safety, pedestrian and bike facilities and others as determined.  Both Cole Road and Victory Road will remain open during construction. Traffic control phasing plans will be required in the plan set.  Coordination to occur between Maverick Developer and ACHD Development for the application of future Road Trust Funds, due to the relocation of the Maverick store from the northeast quadrant to the southeast quadrant of Cole Rd and Victory Rd intersection.  The proposed corridor speed limit (35 MPH on Cole Rd and 40 MPH on Victory Rd) to remain as is.  Consultant to scope approximately 30 utility potholes.  The project team’s initial vision includes shifting the intersection north to reduce impacts to right-of-way and will be determined at the design progress through 30%. Consultant to coordinate with Maverick through ACHD for ROW projections for the future Maverick site.  All permitting, assumed to be 404, to be completed by Consultant  Consultant to conduct floodplain analysis to be completed utilizing HEC-RAS  Public involvement will consist of 2 PIM's; after 30% and after 75%.  Consultant will create crash history displays and compile comments into a matrix from the PIM. The Consultant should include in the Scope of Work one-on-one meetings with individual property owners. The Consultant will also create displays with aerials showing the proposed improvements.

Precision Engineering, LLC, herein called the Consultant, will design the project and supply documentation in accordance with this scope of work, the current version of the ISPWC specifications with the current ISPWC updates as amended by ACHD adopted supplements, including the ACHD Supplemental Traffic Provisions.

Ada County Highway District Precision Engineering Cole Road Victory Road Intersection December 21th, 2016 ACHD Project No. 317005 ACHD GIS No. IN205-97 Page 2 of 27 Cole Road and Victory Road Intersection Scope of Work Precision will be responsible for Project Management, traffic analysis, and the design, preparation of plans, specifications, and estimate for traffic signal design including ITS components, PHB and emergency vehicle signal, street lighting, Cole Road and Victory Road intersection geometrics, all project signing and striping, advanced traffic control and traffic control phasing plans.

Civil Survey Consultants, Inc (CSC), herein called the Subconsultant, is currently completing the Survey tasks under Section 3.0 and has previously been granted NTP on 11/16/16, this was done in an effort to minimize potential delays due to weather. This SOW covers the remaining tasks necessary for completion of the project.

In addition to the approved Survey task, CSC will be responsible for 404 permitting, hydraulic analysis, preparing the SWPPP and ROW development and for the design, preparation of plans, specifications, and estimate for all roadway geometrics outside the limits of the concrete intersection, and all storm drain and gravity irrigation components of the project.

Elite Edge Engineers herein called the Subconsultant, will lead the bridge design components of the project. This includes the design, preparation of plans, specifications, and estimate, and the completion of any required permits for a precast concrete stiff leg structure to replace or extend the existing structure of the same type located on Cole Rd over Five Mile Creek, approximately two thousand five hundred (2500) feet south of the intersection of Cole Rd and Victory Rd. The new structure will extend past the new sidewalk on each side and will require pedestrian rails at the top of the wingwalls. Construction phasing will be implemented to maintain access during construction due to heavy traffic volumes.

Terracon herein called the Subconsultant, will lead all geotechnical components of the project as outlined under Section 4.2.

TAG Historic Research herein called the Subconsultant, will lead all cultural research components of the project as outlined under Section 4.6.

Coordination of Scope of Work The Scope of Work and Professional Services Agreement are essential parts of the project, and a requirement occurring in one is as binding as though occurring in all. They are intended to be complementary and to describe and provide for a complete package.

The roadway widths adopted by ACHD and identified on the Master Street Map shall serve as the basis for beginning evaluation. If the proposed width or other standard is less than ACHD standards, it must be documented, justified, and approved by ACHD.

This was done in an effort to minimize potential delays due to weather; and as such is not included in this scope of work.

Consultant will develop the existing surface 3D model. The surface will be developed utilizing the survey points and break lines provided by survey Subconsultant.

Products and Deliverables  Develop the existing 3D surface model 4.0 30% DESIGN The minimum information required on a 30% design review plans shall show existing facilities/features (including utilities) and location and general design features of planned facilities including existing and proposed right of way. This includes but is not limited to line and grade and other related items that will affect project design. These plans should be 30% complete at minimum.

4.1 Concept Intersection and Roadway Design Design conceptual intersection and roadway geometry, lane configuration, bridge location and traffic signal pole locations for the proposed improvements. Consultant will prepare roll plots of the concept design with typical sections showing lane widths for approval by ACHD. Consultant will prepare three (3) intersection alternatives for Cole Road and Victory Road: one centered on the section line, one shifted north retaining the southern right-of-way line to avoid impacts to

One (1) horizontal alignment alternative for Cole Road south of Victory Road will be prepared, to be widened symmetric about the existing centerline, minor shifting may be required to minimize ROW impacts, extent to be determined as the design progresses. Roll plots will identify concept level right-of-way impacts, utility impacts, and other design constraints associated with each alternative. Consultant will attend a review meeting with ACHD to discuss the alignment alternatives and make minor modifications to incorporate review comments.

4.2 Geotechnical Investigation The geotechnical engineering services for this project will be performed by Terracon (Subconsultant) and will include explorations for the proposed intersection reconstruction, roadway reconstruction and widening south of Victory Road, replacement of Cole Road Bridge 282 crossing Five Mile Creek, and stormwater management improvements. A Geotechnical Engineering Report will be prepared summarizing the results of our field explorations, laboratory testing, and engineering analysis, and provide recommendation for design of the pavement sections, bridge replacement, and preliminary stormwater management improvements.

We understand the project proposes to reconstruct the Cole/Victory Roads intersection with 7 lanes on the Victory Road leg of the intersection and 6 lanes on the Cole Road leg of the intersection. It is anticipated that Portland Cement Concrete Pavement (PCCP) will be used to reconstruct the Cole/Victory Roads intersection. In addition, Cole Road will be widened to 5 lanes south of the Victory Road intersection improvements to just north of the intersection with McGlochlin Street. It is anticipated that flexible pavement sections will be used for the intersection transitions to existing asphalt pavement and the widened roadway segment south of the intersection. The new structure at Cole Road Bridge 282 is anticipated to be a stiff leg bridge.

Ada County Highway District Precision Engineering Cole Road Victory Road Intersection December 21th, 2016 ACHD Project No. 317005 ACHD GIS No. IN205-97 Page 10 of 27 Cole Road and Victory Road Intersection Scope of Work Field Exploration In general, the field exploration will consist of soil borings for pavement section and bridge foundation design, initial feasibility infiltration rate tests, and piezometer installation. The subsurface exploration will consist of the following items:

 As part of two previous ACHD projects, Terracon drilled a boring on Cole Road approximately 350 to 400 feet north of Victory Road and another boring on Cole Road approximately 250 feet north of McGlochlin Street. Data from these previous borings will be used for development of the pavement sections for the current project. Borings will be drilled to provide additional subsurface information for the project. One boring will be drilled to a depth of about 5 feet below the existing ground surface on the east, west, and south legs of the Cole/Victory Roads intersection (total of 3 borings). Two additional borings will be drilled to a depth of about 5 feet in the segment of Cole Road south of the intersection improvements.  On boring will be drilled on each side of the Cole Road Bridge 282 to a depth of 30 to 40 feet below the existing ground surface or to auger refusal, whichever is encountered first. These borings will be used for analysis of the bridge foundations and associated embankments.  Two borings will be drilled to a depth of approximately 17½ feet below the existing ground surface for installation of piezometers to allow measurement of groundwater levels at their locations. Each piezometer will be protected with a locking cap and a flush-mounted cover. We assume one piezometer location will be north of the Cole Road Bridge and one south of the bridge. For this project, groundwater measurements from piezometers will occur monthly during the irrigation season, from mid-April until the end of October 2017. We assume CSC staff will obtain these groundwater measurements and provide the results to the project team.  Two borings will be drilled near the piezometer borings to a maximum depth of about 10 feet below the existing ground surface for initial feasibility infiltration rate tests. These tests will be performed within 5-inch diameter solid pipe placed in the boreholes. A bentonite seal will be placed within the annular space around the outside of the pipe. The project team will assist in determining the preliminary locations and the depth of the percolation tests. Based on Section 8000 and 8200 of the ACHD Policy manual, these feasibility tests will not meet ACHD’s requirements for evaluation of design level infiltration rates. After conceptual development of the stormwater management improvements is complete and the actual facility types, locations, and depths are known, tests that are appropriate for the planned improvements and that are in accordance with the methods described in Appendix C of Section 8200 of the ACHD Policy Manual should be performed. Subconsultant will prepare a supplemental scope of work and cost estimate for performing these tests once known.

A ‘no-fee’ permit will be obtained from ACHD prior to working in the right-of-way. A traffic control subcontractor will provide traffic control during drilling, piezometer installation, initial infiltration rate testing, as necessary. All borings will be backfilled in accordance with Idaho

Borings drilled through existing asphalt will be patched with cold-mix asphalt.

Appropriate utility clearance will be requested from Digline prior to the exploration. Our services do not include determining the locations of underground utilities beyond contacting a “one-call” locate service, Digline. If there are other utilities not located by Digline, a utility locate specialty contractor will need to be obtained to locate these utilities. A supplemental scope of work and cost estimate will be prepared for this service. We are not responsible for damage to unmarked utilities.

Borings will be logged by a field engineer/geologist and samples will be obtained as the drilling progresses. Preliminary boring locations will be recorded using a recreational grade handheld GPS. We will also mark the boring locations so that the project surveyor can record the locations and elevations of the borings after drilling. The field services described above will be completed during a single mobilization.

Accessing the boring locations outside the existing paved area will cause disturbance to the existing ground surface and vegetation, particularly borings within existing landscaped areas. Restoration of this disturbance, beyond backfilling the bore holes, is not included in our scope of services.

Laboratory Testing Laboratory testing will be conducted on representative samples of soil and rock obtained from the field exploration, and may include: moisture content, gradation, Atterberg limits, consolidation, moisture/density relationship, and R-value. The actual tests performed will depend on the soil conditions encountered.

Geotechnical Engineering Analysis and Report Field and lab data from the field explorations will be reduced and analyzed for reporting purposes. Geotechnical information from projects performed by Subconsultant north and south of this project will also be reviewed and incorporated as appropriate. Subconsultant will develop geotechnical engineering conclusions and recommendations for the proposed bridge foundations and associated embankments. Subconsultant will also design the flexible and rigid pavement section using ACHD design procedures for the proposed reconstruction. This scope of services assumes ACHD will provide Subconsultant with design traffic information in the form of a Traffic Index (TI) for use in design of the flexible pavement section and rigid ESALs for design of the PCCP intersection.

Subconsultant will prepare a draft Geotechnical Engineering Report for review by ACHD. The report will include; boring logs, laboratory test results, initial feasibility infiltration test results, and geotechnical recommendations for the bridge and pavements for this project.

After all reviews of the draft report are complete, we will discuss comments generated from the reviews with ACHD. We will incorporate these comments, as appropriate, and submit a final

We will prepare a comment response sheet to document actions taken on comments received. This scope of work does not include additional revisions to the report or review iterations.

Design Review Subconsultant will review the portions of the 75% Design Submittal that relate to the performed geotechnical services. Comments of this review will be presented in a letter.

Meetings Subconsultant will attend the kickoff meeting. Our budget does not include attending other project meetings.

Products and Deliverables  Draft and final Geotechnical Engineering Report including boring logs with latitude and longitude, and location plan, results of laboratory tests, initial feasibility infiltration rates, recommendations for flexible and rigid pavement materials and thicknesses using ACHD design procedures and ISPWC specifications, and geotechnical foundation design recommendations for Cole Road Bridge 282 replacement.  A supplemental scope of work and cost estimate for infiltration testing will be prepared for use in final design of stormwater management improvements.  Letter with comments from Subconsultant’s review of the 75% Design Submittal.

ACHD Responsibilities  Supply traffic index (TI) for the flexible pavement design and rigid ESALs for PCCP design of the intersection.  Waive fee for the Temporary Highway Use Permit.  Obtain property access permission from landowners, if required.

Assumptions  The proposed field explorations include a total of 5 roadway soil borings, 2 bridge foundation borings, 2 piezometer borings, and 2 initial feasibility infiltration rate test borings.  Borings will be accessible with a truck-mounted drill rig.  Drilling will be performed during the daylight hours of 9:00 am to 3:00 pm.  After completion of drilling, the boring locations will be surveyed by others on the project team.  ITD Materials Phase Report formats will not be required for this project.  Property access permission, if required, will be obtained by ACHD.  A supplemental scope and cost estimate will be required for design level stormwater management improvements.  The scope of services does not include the abandonment of the piezometers.  The intersection will be PCCP and remaining pavement will be flexible pavement.

Rehabilitation of existing pavements is not being considered for this project.  Life-cycle cost analyses are not required for this project.

4.3 Hydraulic/Stormwater Design All project designs must comply with the Clean Water Act, NPDES requirements and the currently approved ACHD Section 8000 Stormwater policy and Section 8200 Stormwater Design Manual. All projects should use the GSI Guidance Manual to determine the feasibility of GSI for the project area.

Alternative 2 is a contingency item and will not be performed unless authorized by ACHD.  A HEC RAS model will be prepared for the bridge crossing on Five Mile Creek to determine the impact lengthening the structure will have on the floodplain/floodway and establish solutions if a “Net Rise” occurs.  Two meetings will be required with the City of Boise.  A Flood Plain Development Permit and a No-Rise Certification will be required by the City of Boise.

4.5 Traffic Intersection Traffic Verification As directed at the pre-scoping meeting, we will verify the recommendations provided in the ACHD 2012 CIP, Syringa Valley TIS (2014) and Southwest Boise Transportation Study (2009). Consultant (L2 Data Collection) will obtain AM and PM peak-hour turning movement counts over a two (2) day period at the Cole Road and Victory Road intersection. ACHD to provide the 24-hour counts at the intersection. Consultant will utilize the forecasted average daily traffic (ADT) on Cole Road and Victory Road for the 2020 construction year and 2040 planning year provided in the Syringa Valley TIS. The 2035 build-out data provided in the report will be projected to year 2040.

The average control delay, Level of Service (LOS) and intersection capacity will be determined for the existing traffic and the analysis years using HCS 2010. Consultant will prepare a draft memo summarizing the analysis and results, meet with ACHD to discuss the draft findings, address review comments and prepare final traffic memo.

Illuminance Analysis Consultant will determine the required light pole locations within the project limits to achieve the design illuminance level using AGI32. The design illuminance level will be based on ACHD and City of Boise Standards and AASHTO guidelines. This task also includes determining the lighting circuitry and calculating voltage drops for the roadway lighting. Consultant will provide a roll plot of the illuminance level contours overlaid on the proposed improvements and aerial background, including the illumination calculations. Consultant will meet with ACHD and City of Boise to discuss findings.

4.6 Environmental Evaluation Cultural Resources: The cultural resources documentation to support the Construction General Permit (CGP) for this project will be performed by TAG Historic Research (Subconsultant).

Step 1 – Determine if there will be ground-disturbance. The screening process is initiated if ground-disturbance will occur with the project. If ground disturbance occurs, TAG Historical Research and Consulting (TAG) will undertake Steps 2 and 3 as outlined in the EPA in Appendix E –Historic Property Screen Process from the CGP.

Step 2 – Identify prior surveys or evaluations conducted on the site.

This step consists of a literature review at Idaho State Historic Preservation (SHPO) offices to identify previous investigations in the project area and, if needed, additional research in the records of the Ada County Assessor records to determine construction dates for properties in the project area. If properties over 50 years of age are identified during the county records search, a reconnaissance-level survey will be undertaken to identify potentially eligible NRHP properties. No documentation of historic properties will occur with this step.

If no historic resources are identified, TAG will complete a memo report summarizing all cultural resource work, including the literature review and reconnaissance-level survey. This memo report will satisfy the requirements as listed in EPA–Appendix E.

Step 3 - If historic resources potentially eligible to the NRHP are located during Step 2, TAG will draft a memo report providing a list of potentially eligible sites within the project area and evaluate the project effects on the identified resources.

Threatened & Endangered Species Consultant will prepare and submit a letter to the US Fish and Wildlife Service requesting their determination of whether there are Endangered Species or Critical Habitat in the project area.

If further work is required following consultation with SHPO, the additional work will be scoped at that time.  An intensive-level survey which includes formal documentation of historic resources would be completed as additional services to this scope of work.  Archaeological and Historic Resources Survey Report (AHSR) prepared according to the standards of the Idaho SHPO as revised December 2015. The AHSR identifies field methods survey results, and provides recommendations of project effects. After client and SHPO review, the AHSR will be revised if needed and completed as additional services to this scope of work.

4.7 30% Design Submittal This task includes performing an internal review of all deliverables and preparing the submittal documents. The Consultant will deliver one paper and one PDF copy.

5.1 75% Roadway Design The minimum information required on 75% design review plans shall show existing facilities / features and location and general design features of planned improvements.

5.2 75% Hydraulic / Stormwater Design The Subconsultant will determine preliminary sizes and show and label locations for all drainage facilities (pipes, culverts, inlets, manholes, and water quality treatment and disposal facilities) on plan and profile sheets.

5.3 75% Gravity Irrigation The Consultant will layout and verify the size of the irrigations structures. The minimum information required on the preliminary design review plans shall be complete enough to show location and general design features of all existing and proposed irrigation facilities.

The SWPPP will consist of preliminary narrative and Sediment and Erosion Control plan sheets displaying temporary erosion control measures.

5.5 75% Structure Design The Subconsultant will prepare the 75% structure layout, situation and layout, preliminary design of the deck, abutments, footings and wing walls, and details for the bridge over the Five Mile Creek.

5.6 75% Traffic Signal & PHB Design The Consultant will design the initial layout of the traffic signals at Cole and Victory intersection, PHB at Diamond St with school zone flashers, and relocate existing emergency vehicle signal plans will be drafted showing new signal poles, mast arms, and luminaires as necessary for the proposed improvements.

5.7 75% Lighting and Interconnect Design The Consultant will design the street lighting within the project limits. Pole placement to be based on illuminance calculation prepared in Task 4.5. Consultant will design the interconnect improvements to perpetuate the existing system and coordinate with ACHD Congestion Management on cable sizes for possible upgrades.

5.8 75% Signing and Pavement Markings The Consultant will develop signing and pavement markings in accordance with MUTCD, current ACHD standards and applicable state and local laws and ordinances.

5.9 75% Temporary Traffic Control The Consultant will develop the advanced temporary traffic control plan. It is anticipated Cole Road and Victory Road will remain open during construction and a detour plan will not be developed in the scope of work. Temporary Phasing plans will be prepared with 95%.

5.10 75% Right-of-Way The Subconsultant will develop right-of-way requirements using alignment geometry developed for 75% design that defines the limits of additional right-of-way requirements. Permanent and temporary easements will be identified, when possible. Proposed ROW and easements will be shown on plan and profile sheets.

5.11 75% Utility Coordination The Consultant shall include the existing facilities on the plans

The intent of this task is not to identify all utility locations, the Contractor will still be responsible for locating all utilities during construction. Potholing will be accomplished with a vacuum truck to minimize field impacts. This scope includes up to 30 potholes. Utility locations will be marked in the field by Digline and pothole locations will be based on the Digline locates. Consultant will coordinate pothole requirements and locations with ACHD. Consultant will be available to provide additional potholing as Additional Services.

5.13 75% Quantities And Construction Cost Estimate The Consultant will tabulate quantities and prepare the 75% construction cost estimate for the project entered into B2W per ACHD User Guide. The ISPWC bid item description and number format and ACHD’s Standard Special Provisions (SSPs) and Special Provisions (SPs) item description and number format will be followed. If a viable item number/description cannot be found, the Consultant will prepare a Special Provision Request or Modification Form and submit to the ACHD Project Manager for approval. The cost estimates will be based on a combination of the most current bid averages report available on ACHD’s website and engineering judgment.

5.14 75% Design Submittal This task includes performing an internal review of all deliverables and preparing the submittal documents. Deliverable shall be in PDF format.

Precision Engineers Scope of Services and Cost Proposal

L2 Data Collection (L2DC) is pleased to submit this proposal to provide traffic data collection services in Boise, ID beginning on date(s) and time(s) still to be determined:
