Pursuant to Section 27 -b of the General City Law. a legislative body may designate itself or another local administrative body to grant special permit uses as set forth in the zomng ordinance. A special permit use is defined as:

a particular land use which is permitted in the zoning ordinance or local law. subject to requirements imposed by such zoning ordinance and local law to assure that the proposed use is in harmonv with such zoning ordinance or local law and will not ~ - adversely affect the neighborhood if such requirements are met. (General City Law §27-b(l )).

If an applicant demonstrates compliance with the criteria set forth in the zoning ordinance for a particular special permit use, then the authorized board must approve the application. Juda

SUl3JECT: Miscelhneous Zoning Changes

Background: Periodically, changes to the zoning ordinance are proposed by staff when language is found in the ordinance that is incorrect, redundant, contradictory, and unnecessarv or when blatant omissions in the text are identified.

Issue: Staff has identified the following section of the Zoning Code where changes are reco=ended:

1) §331-13(C)(4)-Provisions Governing Lots-Delete the word NOT in this section to clarify what is meant by the Code.

PROPOSED: §331-13(C)(4) The lot is ft6C shown on a subdivision plat filed in Westchester Counrv Clerk's Office.

2) 331-80.1 E. Planned Waterfront Development Extension Zone- District Use and Bulk Standards. Add uses previously allowed within General Commercial Modified within the PWDE zone.

3) §331-126 Motor Vehicle Service and/ or Body Repair Facility-

Minimum Number of Parking Spaces: Five (5) for the first service bay and two (2) for every bay thereafter Minimum Number of Loading Spaces: 0

4) §331-126.1(C)(2) and (14) Off-Street bicycle parking facilities- A text change is needed in this section to allow the Development Commissioner to make a determination that the requisite bike rack may be placed at an alternate site in lieu of the subject site. ),

PROPOSED §331-126.1(C)(14): Notwithstanding the foregoing, under circumstances where it is determined by the Pla•lflisg Beltl'dCom:missioner of Development to be futile to require the construction of bicycle parking facilities on site, the Board may allow the placement of such required facilities at a specific off-site location.

PROPOSED§331-126.1(C)(2): A bicycle parking facility includes any structure or fixture constructed so as to enable a person to secure bicycles by locking the fume and one wheel of each bicycle therein. Inverted U­ frame racks that support the bicycle at two (2) or more points above and on either side of the bicycle's center of gravity are desired, except that the P~ BeMd; as p..n of sire pkm appmffiCommissioner of Development, may approve an alternate style of rack or enclosure that provides a comparable level of security and convenience. Racks shall be easily usable with both U -locks and cable locks. Racks shall support the bicycles in a stable upright position so that a bike, if bumped, will not fall or roll down.

5) §331-139.1Consultant Fees Occasionally, especially for larger more complex projects there is a need to hire an outside consultant or expert with specific knowledge to assist with review of an application, permit or certificate of occupancy. Currently, the City is only able to recover these costs during the preparation of an Environmental Impact Statement (EIS).

§331-139.1 Additional Fees (1) The City Council, the Pbnning Board and the Zoning Board of Appeals, in the review of any application brought pursuant to this chapter may refer such application presented to it to such planner, engineer, environmental expert, attorney or other consultant engaged by the City or to such City professional staff as such Board shall deem reasonably necessary to enable it to review such application as required by law. (a) Fees charged by such consultants shall be in accord with fees usually charged for such services in the metropolitan New York region and pursuant to a contractual agreement between the City and such consultant. /ill such fees shall be paid to tbe City upon submission of a City voucher, and the applicant shall reimburse the City for the costs of such consultant upon submission of a copy of the voucher or at the discretion of the reviewing board. 0}) Costs for services of professional staff shall be in accord with hourly tates based upon actual salary and benefits paid by the City. The applicant shall reimburse the City for the costs of professional staff services upon submission of an invoice or at the discretion of the reviewing board. (c) The payment of such costs by the applicant shall be required in addition to any and all other fees required by this or any other section of this chapter or any other City law, ordinance or regulation. (d) All charges for services shall be audited by the City, and applicant costs shall be limited to those that are reasonable in amount and are necessary for the City's review and action on the application in accordance with the law.

(2) Escrow accounts. At the time of submission of any application brought pursrumt to this chapter, the reviewing board may require the establishment of an escrow account, from which withdrawals shall be made to reimburse the City for the cost of consultant fees and professional staff services. The applicant shall then provide funds to the City for deposit into such account in an amount to be determined by the reviewing board based on its evaluation of the nature and complexity of the application. The applicant shall be provided with copies of any City voucher for consultant fees as they are submitted to the City and with City staff time records for services for which reimbursement is sought. When the baiance in such escrow account is reduced to 1/3 of its initial amount, the applicant shall deposit additional funds into such account to bring its baiance up ro the amount of the initial deposit. If such account is not replenished within 30 days after the applicant is notified, in writing, of the requirement for such additional deposit, the reviewing board may suspend its review of the application. A bnilding permit or certificate of occupancy or use shall not be issued unless all such applicants' costs have been reimbursed to the City. After all pertinent costs have been paid, the City shall refund to the applicant any funds remaining on deposit. All fees required pursrumt to this section shall be collected by the Clerk of the board having jurisdiction over the application.

6) §331-152(C) (4)Inclusion of Affordable Dwelling Units in Rental Housing­ Currently the Zoning Code notes tllitt affordable housing units which are proposed as rental housing shaH have restrictive covenants maintaining those affordable units for the life of the bnilding. To fw:ther encourage development, staff is reco=ending a change to the term for affordable rental units.

PROPOSED: §331-152(C) (4) Each Residential Development Application for Rental Housing containing Moderate-Income Housing Units shall include a draft Declaration of Restrictive Covenants, which Declaration shall set forth and particula.rize the requirements set forth in Subsections C(l), through (3) above, and which shall be recorded against the propetty containing the Moderate-Income Housing Units prior to issuance of the first temporary or permanent certificate of occupancy for th.e Residential Development. Such Restrictive Covenants shall run for the life of the b>Iik!ifig ffi -..chich such Moderate Income Housing Units are loearech term to be determined bv the Commissioner of Development but at no time for a term limit not to be less than thi.rtv (30) years. The Declaration shall include rules and regulations for 111suring compliance with the Restrictive Covenants. The City's Department of Development and/ or one or more non-profit entities to be designated by the City Council shall administer and enforce such compliance program. The form and substance of such Declaration shall be subject to approval of the City's Corporation Counsel and Commissioner of Development

(2) A bicycle parking facility includes any structure or fixture constructed so as to enable a person to secure bicycles by locking the fll]ran1e and one wheel of each bicycle therein. Inverted U-frame racks that support the bicycle at two or more points above and on either side of the bicycle's center of gravity are desired, except that the [Planning Board, as part of site plan approval,] Commissioner of Develooment may approve an alternate style of rack or enclosure that provides a comparable level of secnrity and convenience. Racks shall be easily usable with both U-locks and cable locks. Racks shall support the bicycles in a stable upright position so that a bike, if bumped, will not fall or roll down.

(14) Notwithstanding the foregoing, under circumstances where it is determined by the [Planning Board] Commissioner of Development to be futile to require the construction of bicycle parking facilities on site, [the Board may allow] the Commissioner of Development in conjunction with the Commissioner of Public works may allow the placement of such required facilities at a specific off-site location. .L.Z

Section 5. Chapter 331-139, Consultant Fees, of the New Rochelle Zoning Code, is hereby amended by adding the following:

§ 331-139.1 Additional Fees

(1 ). (a) Fees charged bv such consultants shall be in accord with fees usuallv charged for such services in the metropolitan New York region and pursuant to a conlracmal agreement between the Citv and such consultant. All such fees shall be paid to the City upon submission of a Citv voucher. and the aPplicant shall reimburse the Citv for the costs of such consultant upon submission of a copv of the voucher or at the discretion of the reviewing board. (b) Costs for services of professional staff shall be in accord with hourlv .rates based upon actual salarv and benefits paid bv the Citv. The applicant shall reimburse the Citv for the costs of professional staff services upon submission of an invoice or at the discretion of the reviewing board. (c) The pavment of such costs bv the applicant shall be required in addition to anv and all other fees required bv this or anv other section of this chapter or anv other Citv law. ordinance or regulation. (d) All charges for services shall be audited bv the Citv, and applicant costs shall be limited to those that are reasonable in amount and are necessarv for the Citv's review and action on the application in accordance with the law.

(2). Escrow accounts. At the time of submission of anv application brought pursuant to this chapter, the revtewing board mav require the establishment of an escrow account. from which withdrawals shall be made to reimburse the Citv for the cost of consultant fees and professional staff services. The applicant shall then provide funds to the Citv for deposit into such account in an amount to be determined bv the reviewing board based on its evaluation of the nature and comnlexity of the application. The applicant shall be provided with copies of anv Citv voucher for consultant fees as thev are submitted to the Citv and with Citv staff time records for services for which reimbursement is sought. When the balance in such escrow account is reduced to l/3 of its initial amount. the applicant shall deposit additional funds into such account to bring its balance up to the amount of the initial deposit. If such account is not replenished within 30 davs after the applicant is notified. m writing. of the requirement for such additional denosit, the reviewing board mav suspend its review of the application. A building permit or certificate of occupancv or use shall not be issued unless all such applicants' costs have been reimbursed to the Citv. After all peninent costs have been paid, the Citv shall refund to the applicant any funds remaining on deposit. All fees required pursuant to this section shall be collected bv the Clerk of the board having jurisdiction over the application.

Section 6. Chapter 331-152, Requirements for Affordable Housing, of the New Rochelle Zoning Code, is hereby amended as follows:

§331-l52(C) Inclusion of Affordable Dwelling Units in Rental Housing.

(4) Each Residential Development Application for Rental Housing containing Moderate-Income Housing Units shall include a draft Declaration of Restrictive Covenants, which Declaration shall set forth and particularize the requirements set forth in Subsections C(l), through (3) above, and which shall be recorded against the property containing the Moderate-Income Housing Units prior to issuance of the first temporary or permanent certificate of occupancy for the Residential Development. Such Restrictive Covenants shall run for [the life of the building in which such Moderate Income Housing Units are located] a term to be determined bv the Commissioner of Development but at no time for a term limit not to be less than thirtv (30) vea:rs. The Declaration shall include rules and regulations for insuring compliance with the Restrictive. Covenants. The City's Department of Development and/or one or more non-profit entities to be designated by the City Council shall administer and enforce such compliance program. The form and substance of such Declaration shall be subject to approval of the City's Corporation Counsel and Commissioner of Development.

Section 7. Chapter 331-154, Downtown Density Bonus (DDB) Floating Overlay Zone, of the New Rochelle Zoning Code, is hereby amended as follows:

Background: The Quality Housing and Work Responsibility Act of 1998 (QHW'RA) requires all Public Housing Agencies (PHA) to prepare an Annual Plan which is to be submitted to the U.S. Department of Housing & Urban Development.

The _A,nnual Plan provides details of the City's immediate operations, program selection procedures and the PHA's strategy for handling operational concerns and the needs and concerns of Section 8 participants. In 2011, the City was rated as a "High Performing PHA" by HlJD based on the score earned in its Section 8 Management Assessment Program. As a result, the City is again qualified to submit a Streamlined "A,nnual Plan.

Issue: As part of the procedure in creating a plan, PHAs are required to hold a public hearing to give the public and Section 8 residents an oppornmity to comment on the Plan.

Recommendation: The Department of Development requests that the City Council schedule a Public Hearing for the second meeting in October on the 2013 Annual Plan and adopt legislation approving the Annual Plan at the same meeting.

Background

The City is required by the U.S. Department of Housing and Urban Development (HUD) to prepare the Consolidated Plan, a five-year plan, which identifies the City's needs and investments in housing, homelessness, community development and economic development. The Plan describes the City's strategies for the use of federal Community Development Block Grant (CDBG) and HOME funds. The City is also requned to submit its 2013 funding application for these funds along with the Consolidated Plan.

The planning fum of Mullin & Lonergan worked with City staff to prepare these documents. i\dditionallv, an update to the City's Analysis of Impediments to Fair Housing Cboice (Al), last completed in 2008 1 was done at the same time.

Summary of the 2013-2017 Consolidated Plan

U.S. Census Bureau and HUD data sources were used in the preparation of the document, as well as input from Westchester-Putnam. Board of Realtors' database, municipal departments and several of the Citv's own planrung initiauves including the West End Need!- .4ssessment, infonnation from the Envisio1\!R community meetings, the Greel\TR Sustainability Plan 2010-2030 and the Sustainable Communities Initiative.

Public agencies and private non-profit organizations whose missions focus on the provision of affordable housing and human services to low-income persons were invited to participate in a series of focus group sessions held from January 23 through 25, 2012. An on-line "Housing and Community Development Needs Survey" was on the City's website and advertised for public input from February 10 through March 10, 2012. These opportunities were provided for area residents and stakeholders to impact the process in different ways.

A sampling of the BUD-required components included in the Consolidated Plan are:

• Strategy for addressing the needs of the homeless and special services populations • Specific long-term and short-term community development objectives for decent housing, a suitable living environment and expanded economic oppo:mmir:ies, principally for low-income and moderate-income persons • Housing needs assessment and inventory • Ivfinority and women's business outreach goals

Ana~vsis ofImpediments to Fair Housing Choice

The Analysis of ImpedimentJ to Fair HouJing Choice (AI) reviewed local regulations and adnunistracive policies, procedures and practices affecting the iocation, availability and accessibility of housing and assessed the conditions, both public and private, that affect fair housing choice. To prepare the Al, the consultant and staff reviewed the City's Zoning Code, Comprehensive Plan and housing and income data and researched the City's disabled and racial demographics to identify groups that may be subject to housing discrimination. Data was also used from the focus group meetings and questionnaires held for the Consolidated Plan, particularly from agencies that serve the special interests of the protected groups.

2013 Acdon Plan

The 2013 Action Plan describes the specific activities and goals that the City ";:ill undertake during the first year of the Consolidated Plan cycle. The proposed CDBG and HOlviE budgets contained in the Action Plan are attached for your review.

The 2013 CDBG budget is based on an estimated 5% reduction from the 2012 budget for a total of $1,250,417. The 2013 HOlviE budget is also estimated using a 5% reduction from the previous year for a total of $277,662.

Issue ll. public hearing was held on. February 14, 2012., designating the Department of Development as Lead Agency for the Consolidated Plan process. A second public hearing is required during the 30- day comment period which will extend from September 12 through October 12, 2012. Copies of the draft Consolidated Plan, 2013 Action Plan and .Analysis rrf ImpedimentJ to Fair Housing Choice will be available on the City's website and also at New Rochelle Public Library, the Department of Development and the City Clerk's Office. The three documents will be submitted to HlJD following City Council approval.

Recommendation

Staff recommends that City Council undertake the following actions:

a) at the September 12, 2012 Comntittee of the Whole meeting, set a elate for the Public Hearing to be held on October 9 , 2012 for public review of the 2013-2017 Consolidated Plan and 2013 Action Plan.

b) at the October 16, 2012 Regular Legislative Meeting, adopt the 2013-2017 ConJoiidated Plan and 2013 Action Plan and authorize it.' submission to HLTJ.

Subject: City Code Change - Parking Prohibited at Certain Times Washington Avenue

At the request of the City Manager, I evaluated parking regulations and traffic conditions on Washington Avenue to determine if parking could be provided on one side of 12 out of 15 blocks of Washington Avenue at all times. Currently, except between Fifth Street and Fourth Street, parking is prohibited on both sides of Washington Avenue on Mondays between 8:00a.m. and 12:00 p.m.

Washington Avenue is approximately 30 feet wide with parking provided on the north side of the street except for Mondays between the hours of 8:00a.m. and 12:00 p.m. and prohibited all times on the south side of the street except for the block from Fifth Street to Third Street. At this location parking is provided during certain hours. The proposed action would allow for parking on one side of Washington Avenue at all times except for a few locations. A figure showing existing on-street parking regulations is attached.

Since traffic flow can be accommodated with parking on one side of Washington Avenue I recommend that parking be allowed on one side of the street at all times on 12 out of 15 blocks of the street. This proposed action would change parking regulations on the south side of the street so that parking is provided Mondays from 8:00a.m. to 12:00 p.m except between Third and Fourth Street and opposite the Columbus Elementary School which is located from Fifth Street to Seventh Street. A figure showing this proposed parking regulation change is attached.

The foregoing requires the following City Code amendment. Once in effect, signage indicating the applicable regulations will be posted.

Subject: City Code Change- Parking Prohibited at All Times Glencar Avenue

After further review of the City Code. I determined that the legislation adopted May 29. 2012 was not in accordance with the intent of the proposed parking regulations on Glencar Avenue. The adopted legislation states that parking should be prohibited in those locations where parking should be provided. Regulatory parking signage currently provided on Glencar Avenue is in accordance with the intent of the legislation. That is parking is only provided on the east side of Glencar Avenue in front of 10 Glencar Avenue for a length of 160 feet and in front of 65 and 69 Glencar Avenue for a length of 160 feet. Furthermore. I found an error in the City Code which states that parking is prohibited on both sides of Glencar Avenue from Mayflower Avenue to 65 Glencar Avenue.

I therefore recommend that the City Code be amended to reflect the intent of the legislation and the regulatory signage currently on Glencar Avenue.

The foregoing requires the following City Code amendment. Once in effect. signage indicating the applicable regulations will be posted.

PROJECT DESCRIPTION: The Project was for the replacement of nine (9) rooftop HVAC units at the Police I Court Building.

SUMMARY: This project was awarded to Duncan Industries Corporation at their low bid of$ 538,015.00 for the replacement of the nine (9) rooftop HVAC units at the Ponce /Court Building by Council Resolution No. 110 dated June 21, 2011.

This project had several unforeseen conditions arise due to the location and size of the new rooftop units with respect to the existing roof conditions. This required the additional work of removal and restoration of a portion of the roof and relocation of gas piping to supply power to the units. This work was unanticipated and was performed at an additional cost of$ 22,240.00.

This request is to amend Council Resolution No. 110 by the addition$ 22,240.00 to the award of the contract to Duncan Industries Corporation to a total amount equal to$ 560,255.00.

At the request of the West End Association (Service ID: 2012-7812), I evaluated geometric, parking and land-use conditions of Seventh Street north of Washington Avenue to determine if a 20 mph speed limit should be provided in front of and in the vicinity of Columbus Elementary SchooL By New York State law, speed limits less than 30 mph can be provided in front of schools which serve high school grades and below.

Fronting the Columbus Elementary School, Seventh Street has a horizontal curve and parking is provided on the west side of the street These conditions limit motorist's sight lines ahead. Hence it is safer to reduce the speed limit on Seventh Street in this area. A figure showing the location of the proposed reduced speed limit zone (area crosshatched) is attached.

It is recommended that the 2012 adopted budget be amended tor the following items:

1. CHIPS Funding The adopted New York State budget for FY 2012-13 allocated $960.222 in CHIPS funding to New Rochelle, an increase of $778 from the prior year. Our adopted budget estimated $900,000 for this program; consequently, an appropriation increase of $60,222 is required.

2. Fireworks Donation commitments totaling $78.600 have been received for the Fourth of July Fireworks celebration. A budget appropriation for fireworks expenses including overtime for both July 4'h and a portion of Memorial Day. offset by the anticipated donations. is required.

3. Deferred Retirement Costs The adopted FY 20 I I budget called for tbe deferral of 2011-12 retirement cost increases pursuant to New York State's Employer Contribution Stabilization Program. Botb the FY 2011 and FY 2012 budgets treated tbe deferred portion of retirement costs as an expense offset by the proceeds of the amortized Joan received from the State Retirement System. A subsequent promulgation by the State Comptroller requires that the amounts payable to the Retirement System in each of the ten years of the loan be shown as a reritement expense, not a debt service expense. This is simply a bookkeeping recategorization that has no bottom line impact. Audit adjustments were made for the FY 201 J portion of the deferral; a budget adjustment is needed for tbe FY 2012 portion.

4. Avalon Land Sale Payment The FY 2012 land sale installment payment due from Avalon is shown as revenue in the General Fund. Since the land was originally acquired through the issuance of debt, the City's auditors have advised us that the correct accounting treatment of this payment is to recognize the revenue in the Debt Service Fund and then transfer the proceeds to tbe General Fund. This has no bottom line impact: it is merely a bookkeeping recategorization. - 2 -

5. Code Inspection Services The BID has agreed to fund a part-time Buildings Bureau code inspector to enhance enforcement of building code regulations in the downtown area. This funding will be augmented by salary savings to expand efforts to other commercial areas. A total appropriation of $25,000 for this service is required.

6. Workers Compensation Fund Deficit As discussed during the recent presentation of the FY 2011 audit report, the Workers Compensation Internal Service Fund is in a deficit position while the Liability & Casualty Internal Service Fund has a fund surplus. To partially mitigate the deficit in the Workers Compensation Fund, user charges to departments were increased in FY 2012 and will be further increased in FY 2013. Additionally, as recommended by the auditors, excess funds in the Liability & Casualty Fund can be transferred to the Workers Compensation Fund. A budget amendment is needed for this transfer.

Recommendation: The above adjustments have no net impact on the budget; therefore, it is recommended that the 2012 budget be amended as per attached.

WHEREAS, the real estate tax levy in the City's 2012 fiscal year is approximately $50.589,008; and

\VHEREAS, the Council has not taken any action or adopted any local law which would require the effectiveness of this bond resolution to be subject to a permissive or mandatory referendum, now, therefore,

BE IT RESOLVED, by tl1e Council of the City of New Rochelle, County of Westchester, State.ofNew York, by affirmative vote of at least two-thirds of its members, as follows:

Section l. There are hereby authorized to be issued bonds of the City of New Rochelle, New York, in the aggregate principal amount of $800,000 pursuant to the Local Finance Lm.~/, to finance the payment of settled, compromised or entered tax certiorari claims or judgments resulting from court orders on proceedings brought pursuant to Article Seven of the Real Property Tax Law, paid or to be paid during the fiscal year ending December 31, 2012, at an estimated maximum cost of $800,000, which is a class objects or purposes.

Section 2. It is hereby determined that the payments of settled or compromised tax certiorari claims or judgments against the City paid or to be paid during the fiscal year of the City ending December 31, 2012 shall aggregate more than $1,600,000, an amount which exceeds one

percent of the portion of the real property tax levy of the City for said fiscal year levied for municipal purposes, and that, accordingly, the period of probable usefulness of such class of objects or purposes is ten (1 0) years pursuant to subdivision 33-a (b) of Section 11.00 of the Local Finance Law. Such bonds shall have a maximum maturity not to exceed ten (1 0) years, computed from the earlier of (a) the date of the first issue of such bonds or (b) the date of the first bond anticipation notes issued in anticipation of the issuance of such bonds. No proceeds of obligations authorized or issued under this bond resolution to finance the payment of claims or judgments settled or compromised against the City shall be expended unless the amount of any such claims or judgment has been finally determined as settled or compromised.

Section 3. The Council has determined and hereby states that (a) no money has heretofore been authorized to be applied to the payment of the costs of such class of objects or purposes; and (b) the Council plans to finance the costs of such class of objects or purposes from funds raised by the issuance of obligations authorized herein.

Section 4. Subject to the terms and conditions of this bond resolution and the Local Finance Law, and pursuant to the subdivisions of Sections 21.00, 30.00, 50.00 and 56.00 to 60.00, inclusive, of the Local Finance Law, the power to authorize bond anticipation notes in anticipation of the issuance of the bonds authorized by this bond resolution and the renewal of such bond anticipation notes and the power to prescribe the terms, form and contents of such bonds and such bond anticipation notes, including renewals thereof, including the power to issue bonds with substantially level or declining debt service, and the power to issue, sell and deliver such bonds .and such bond anticipation notes, including renewals thereof, is hereby delegated to the Commissioner of Finance, as chief fiscal officer of the City. The Commissioner of Finance is hereby authorized to execute on behalf of the City all bonds issued pursuant to this bond resolution and all bond anticipation notes, including renewals thereof, issued in anticipation of the issuance of such bonds, and the City Clerk is hereby authorized to affix the seal of the City of all such bonds and all such bond anticipation notes, including renewals thereof, and to attest such seaL Such bonds, if, as and when issued shall be authenticated by the countersignature of a fiscal agent of the City or by the appropriate designated officer of the City pursuant to Section 70.00 of the Local Finance Law. The Commissioner of Finance is hereby authorized to contract with a fiscal agent for the City in connection with the issuance of the obligations authorized hereby, or, at the option of the Commissioner of Finance, may elect to act as fiscal agent. In the absence of the Commissioner of Finance, the Deputy Commissioner of Finance is hereby authorized to exercise the powers delegated to the Commissioner of Finance by this Resolution.

Section 5. The City Clerk of the City shall cause this bond resolution to be published together with a notice in substantially the form prescribed by Section 81.00 of the Local Finance Law in The Journal News, a newspaper having a general circulation in the City, which is hereby designated the official newspaper of the City for this purpose. The validity ofthe bonds authorized by this resolution and of bond anticipation notes issued in anticipation of the sale of such bonds may be contested only if such obligations are authorized for an object or purpose for which the City is not authorized to expend money, or if the provisions of law which should be complied with at the date of the publication of this bond resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty (20) days after the date of such publication, of if such obligations are authorized in violation of the provisions of the Constitution of the State. Section 6. The faith and credit of the City are hereby and shall be irrevocably pledged for the punctual payment of the principal of and interest on all obligations authorized and issued pursuant to this bond resolution, as the same shall become due.

Section 7. The City intends to issue the obligations authorized by this bond resolution to finance the cost of the aforesaid class of objects or purposes. The proceeds of the bonds and any bond anticipation notes issued in anticipation of the sale of bonds may be applied to reimburse expenditures or commitments made for such purpose on or after the date of adoption of this bond resolution. The City expects to expend general funds or other available moneys for the aforesaid class of objects or purposes which are expected to be reimbursed from the proceeds of such obligations.

Section 8. It is hereby determined by the Council that the aforesaid class of objects or purposes will not have a significant effect on the environment.

Section 9. The City hereby covenants for the benefits of holders of obligations authorized herein to enter into agreements with or for the benefit of certain purchasers of the obligations authorized hereby to enable them to comply with Rule 15c2-12 of the Securities Exchange Act of 1934, as amended (the "Rule"), by providing to a nationally recognized municipal securities information repository, if and when required by the Rule: (i) at least annually, current financial information concerning the City, including mmual audited financial statements and pertinent operating information, and (ii) notice of any material events as set forth in the Rule, unless an exemption from such requirement exists as provided in the Rule.

Section 10. The Commissioner of Finance and Corporation Counsel, acting jointly, are hereby authorized to make settlement of tax certiorari proceedings brought against the City.

Section II. Attached is Notice of Obligational Authority (NOA) for Local Workforce Investment Area (LWIA)- Westchester (Balance of)/Putnam Counties for the amount of $29,517.48. This NOA identifies funding awarded to your LWIA under the Department's Hurricane Irene and Tropical Storm Lee disaster National Emergency Grant (NEG). This represents 100% ($27 ,331.00) of the total award amount for the New Rochelle Parks project and an additional 8% ($2, 186.48) for LWIA administrative costs.

The grant funds can only be used towards the costs incurred to provide adequate supervision and monitoring of the temporary workers, hired, paid and deployed by the temporary agencies to perform tasks that are disaster related, such as clean-up, demolition, repair and renovation related to public facilities, structures and lands. The grant funds may also be used to provide transportation to such workers, to purchase disaster related supplies and personal safety equipment.

Supervisory positions funded through this NOA are responsible for capturing the time worked of temporary staffing agency workers who are performing grant related duties lor your projects. A timesheet will be provided separately from this letter, and further instructions for submission will be provided by Business Services staff.

Available funds may be used to provide humanitarian assistance, clean-up, demolition, repair and renovation related to public facilities, structures and lands. Up-to eight percent (8%) of your total expenditures may be charged to administration. All charges against this program must be reported monthly to PeopleSoft to Program 186. LWIA administrative costs should be charged to the administrative account (516000). Participant wages should be charged against the wages account (516100). Re: Reallocation of Public Assistance Funds: Mitigation and Grant-Writing Activities

The Federal Emergency Management Agency (FEMA) Public Assistance Program provides supplemental reimbursement for the repair or restoration of the infrastructures and facilities to pre-disaster condition after the declaration of a major disaster by the President. The City of New Rochelle most recently participated in this program as a result of damages caused by Hurricane Irene in August of 20 11.

The City with the assistance of State Emergency Management Office (SEMO), and FEMA representatives identified over $200,000 in costs related to the response, and recovery, including overtime of emergency personnel, equipment costs, contractual services, and administrative costs. The City will receive 75% of this amount from the federal government and 25% from the state. It is requested that $75,000 of the public assistance reimbursement be reallocated to facilitate mitigation and grant-writing activities.

• $50,000- Mitigation o Flood mitigation activities including catch basin cleaning and line repair improvements.

• $25,000 - Grant Writing o Funds will be used to apply for projects to mitigate hazards, and promote agency goals including grant writing activities for the Youth Bureau in support of youth development programming.

Re: New York State & Local Retirement System Regulation 315.4 -Reporting for Elected/ Appointed Officials

On August 12, 2009, Regulation 315.4 went into effect. It defines the process of reporting retirement service credit for elected/appointed officials. According to the regulation, elected officials who are members of the Retirement System must adopt a standard work day resolution, specify the term of office for their position, and submit a log of work activities and actual time worked for 3 consecutive months.

Based on the time logs received, elected officials who are members in the NYS and Local Retirement System work 30 or more hours a week. Thus, the standard work day using a 5-day week is 6-8 hours per day as indicated below:

• Mayor 8 hours per day • City Council Members 6 hours per day

Per the City Charter, Article Ill Section 5, Term of Office of Council members. The term of Council members shall be 4 years, starting the first day of January after their election.

In accordance with 315 .4, the City Council must adopt a standard work day resolution. The resolution must be posted for 30 days on the official city website. A certified copy of the resolution and an affidavit of posting must be filed by the City Clerk with the Office of the State Comptroller within 45 days of adoption of the resolution. The New Rochelle Fire Department respectfully requests pennission to accept the 20 I I SAFER Grant awarded by the Department of Homeland Security. No matching funds are required from the City and the grant will pay all salary and benefits of the six new hires for two years.

The grant will benefit the city and its residents in the following ways:

1. We will get younger members. 2. We expect to lose five or six members over the 2 yr period through attrition. 3. There is the potential to reduce overtime. 4. There would be no requirement to return revenue for past salaries in the event of layoffs. 5. Based on Fire Dept management recommendations, this would allow the dept to maintain safe manning levels.

We were awarded the grant on August I 8, 2012 and have thirty days from then to accept it and ninety days from that date to hire the six new fire fighters. Section 2. Chapter 316 of the Code of the City of New Rochelle, is hereby amend6d as follows:

§ J 16-1. Legislative findings.

It is hereby declared and found that the towing and 'booting of vehicles in the City of New Rochelle involves matter affecting the public interest and that certain improper practices related thereto should be subject to regulation for the purpose of protecting and safeguarding the public health, safety and welfare and to prevent and protect the public from fraud, abuses and unnecessary mconvemence.

Section 3. Chapter 316-2, Definitions. of the Code of the City of New Rochelle, is hereby amended as follows:

§ 316-2. Definitions.

As used in this chapter, the following terms shall have the meanings indicated·. BOOT To clamp, affix or lock a booting device onto the wheel of a motor vel'..icle to prevent the wheel .from rotating, thereby immobilizing the vehicle.

HOOKUP Each and every step and action to be taken to totally secure and engage the vehicle to be towed to a tow tru~k has been completely a...'1d fmallytaken so as to allow the operator of the tow truck to immediately remove and tow the vehicle in conformity with efficient and safe operating procedures.

Any individual, firm, association, joint venture, parmership, group, corporation, any other legal entity or combination of entities which provide the service of moving a motor vehicle by another vehicle for hire or the storage of vehicles after towing, or the service of booting and shall include, without limitation, owuers of towing trucks, their agents and employees.

PRNATELY OWN"ED REAL PROPERTY Real property owned by any individual, firm, association, joint ventnre, partnership, group corporation or any legal entity or combination of entities whatsoever, and shall include, without limitation, shopping centers, parking lots, apartment houses and land used for commercial purposes,

TOWING The moving of a motor vehicle by another vehicle for hire.

TOWING TRUCK A vehicle which:

A. Is towing or transporting; or

B. Is equipped with crane, winch or other device designed to raise a vehicle or the front or rear end thereof.

§ 316-3. Removal of vehicles.

A. Wbere the operator of a towing truck removes an unattended motor vehicle from privately owned real property under the direction of the owner or an individual acting on behalf of the owuer of such property, said operator, before removing said vehicle, shall notify the Poiice Department of the City of New Rochelle of the impending removal of the vehicle and provide to the Police Department the street address and telephone number of the premises where any person whose vehicle is removed may recover the same. In no event shall the operator of a towing truck require the owuer of a vehicle to retrieve such towed vehicle from a location that is not within the limits of the City of New Rochelle.

B. Whenever the operator of a towing truck removes an unattended motor vehicle from privately owned real property, all charges imposed for both towing and storage shall not exceed those authorized by the County of Westchester.

C. Whenever the operator of a towing truck removes an unattended motor vehicle from privately owned real property to the site said operator maintains for such impounded vehicles, said operator shall provide at such site, on a twenty-four-hour-a-day basis, an individual authorized to release the impounded vehicle upon the payment of the authorized towing and storage charges. Upon release, the operator shall provide the owuer of the impounded vehicle with a legible, numbered and signed receipt of payment.

D. Whenever a tow truck operator is about to remove an improperly parked vehicle from privately owned real property but has not yet hooked up or engaged said vehicle to a towing truck, said operator shall immediately release custody and control of the vehicle to the owner or such other person authorized to operate the same without charging any fee whatsoever, provided only that said vehicle is immediately removed fiom the property.

E. In the event that a tow truck operator is about to remove an improperly parked vehicle from privately owned real property and has hooked up and engaged said vehicle to a towing truck but has not removed the vehicle from the property, said operator shall immediately release custody and control of the vehicle to the owner or such other person authorized to operate the same for the payment of a fee of $15, and further provided that said vehicle is immediately removed from the property.

§ 316-3.1. Booting ofvehicles.

A. An operator may boot an improperly parked vehicle on privately owned real property instead of towing it therefrom, but the fee for such booting shall not exceed $45 plus tax, provided that, upon payment of such fee and the removal of the booting device, said vehicle is immediately removed from the property by the owner or operator thereof.

B. Whenever a person engaged in the booting of vehicles affixes a boot to an unoccupied [unattended] motor vehicle on privately owned real property under the direction of the owner or an individual acting on behalf of the owner of such property, said operator shall notify the New Rochelle Police Department immediately.

C. Whenever an operator affixes a boot to an unoccupied [unattended] motor vehicle on private property, said operator shall affix a four-inch by seven-inch orange sticker to the driver's side window. Said sticker shall warn the driver that a boot is affixed to the vehicle and moving the vehicle could result in damage to the vehicle. The sticker shall include the name, and address of the operator, as well as a telephone number the driver can call to arrange for the removal of the boot.

D. In the event that an operator boots an unoccupied [unattended] motor vehicle on privately owned real property, the operator or an attendant must remove the boot from the vehicle within 15 minutes after being contacted by the vehicle's owner or operator.

E. Whenever an operator has begun the process of booting an improperly parked vehicle on private property but has not yet locked the boot onto the vehicle, and the owner or operator of the vehicle offers to remove the vehicle from private property, said operator shall remove the boot from the improperly parked vehicle at no charge to the vehicle's owner or operator.

F. No motor vehicle shall be booted bv a person licensed pursuant to this section unless such licensee has been authorized to boot such motor vehicle pursuant to a written contract between such licensee and the owner. lessee, managing agent or other person in control of the propertv on which such motor vehicle is parked. Such contract shall also provide that such owner. lessee. managing agent or other person in control of the propertv shall be liable for anv violation bv such licensee or his or her emolovee or agents of anv of the provisions of this section or of anv rules oromule:ated pursuant to this section.

G. An owner. lessee. managing agent or other person in control of oropertv who has entered into a written contract with a person licensed pursuant to this section authorizing such licensee to boot motor vehicles parked on such propertv shall be liable for anv violation bv such licensee or such licensee's employees or agents of the provisions of this section. or of anv rules promulgate pursuant to this section.

H. No motor vehicle mav be booted if: (!) such vehicle is occupied bv anv person or live animal; (2) such vehicle is parked on the roadwav side of a vehicle stopped. standing or parked at the curb: (3) such vehicle is parked in a fire lane. or in front of or immediately adiacent to a fire hvdrant. fire connection or bnilding emergencv exit; (4) such vehicle is an ambulance. correction vehicle. police vehicle. fire vehicle. civil defense ememencv vehicle. emergencv ambulance service vehicle. environmental emergencv response vehicle. sanitation patrol vehicle. hazardous materials emergencv vehicle. ordnance disposal vehicle of the armed forces of the United States; (5) such vehicle bears a special vehicle identification issued in accordance with the provisions of section 1203-a of the vehicle and traffic law. or "MD" New York registration plates; and (6) such vehicle is parked in a space reserved for vehicles displaying a handicap permit.

I. No release or waiver of anv kind purporting to limit or avoid liability for damages to a vehicle that has been booted shall be valid. In addition. anv person who booted a vehicle. or other person authorized to accent pavment of anv charges for such booting, shall provide a signed receipt to the individual paving the booting charges at the time such charges are paid. Such receipt shall state the name, business address. business telephone number and license number of the person who has booted such vehicle as such information appears on the license to engage in booting. and such receipt shall also include a telephone number for the office within the Police DePartment responsible for receiving complaints with respect to booting.

J. No charge shall be imposed for the booting of a vehicle when anv person has committed a violation of this section. or anv rules promulgated pursuant to this section with respect to such vehicle, and any such unlawful charge shall be reimbursed bv anv nerson liable for a violation of this section.

K. The owner or person in control of a vehicle which has been booted bv a licensee or such licensee's emplovee or ag;ent shall be permitted to pav anv charge for booting at the location where such vehicle was booted and the licensee. or other person authorized to accept pavment. shall accept such pavment in person bv credit card in accordance with generallv accepted business practices.

L. Anv vehicle which has been booted pursuant to this section must be returned to the owner or person in control of such vehicle within 24 hours of booting or such vehicle shall be towed bv the operator in accordance with Section 316-3 herein.

§ 316-4. W aming and informational signs.

A. No owner of private property shall remove, permit the removal or booting of or cause to be removed or booted any motor vehicle from property owned by him unless there is erected and maintained upon such property, at the entrances and [or] exits to such property, a sign containing a warning that parking thereon is restricted to authorized persons only, that unauthorized parking or trespassing is prohibited and that the vehicles of trespassers or unauthorized persons will be towed away or booted, and containing the further statement setting forth the address and telephone number where any person whose vehicle is removed may make inquiry to regain his vehicle. Such signs shall be not less than 12 inches by 18 inches in size, and lettering thereon shall be not less than one inch in size. Included on such sign shall be the fee amount authorized by the County of Westchester and the fee amount authorized by the City of New Rochelle pursuant to§ 316-3E of the Code of the City of New Rochelle for hookup but not removal, and the fee amount authorized by the City of New Rochelle pursuant to § 316-3.1 of the Code of the City of New Rochelle for booting.

B. All information on the above-required signs must be filed with the New Rochelle Police Department. The owner shall inform the Police Department, in writing, of any changes to the contents of such sign within 10 days of such change. The filing fee shall be as set forth in Chapter 13 3, Fees, for each filing.

§316-5. License required: exceptions.

No person shall conduct towing: or booting as defined herein on private property without first having obtained a license as hereinafter provided. AU licenses shall be issued for a one (1) vear period.

§316-6. License applicant requirements.

A. The name and address of the applicant. specifving, in the case of a partnership or an unincorporated association. each partner or member thereof, and in the case of a corporation, the name and address of each officer. director and stockholder thereof.

B. The date of birth and citizenship of the applicant and each member thereof, if an unincorporated association. and of each officer, director and stockholder. if a corporation.

C. The address of anv and all depots. garages or bodv shops. whether located inside or outside the City. that will be used bv the applicant in connection with his towing business.

D. A statement as to whether the anplicant or anv partner. member. officer or director has. within the last five years, ever been convicted of a crime and, if so. the date. crime charged and sentence imposed.

E. Wbether or not the applicant has ever been denied a license for a tow truck, towing business or booting business bv anv g:overomental agencv or aufboritv or whether or not the applicant has ever been charged with chasing or whether or not anv such license ever issued to the applicant has been suspended or revoked and. if so. the date, the location and the circumstances thereof.

F. A list of all valid licenses held by the anplicant which authorize him to conduct a towing or booting business.

G. Whether this is an initial application or a renewaL

H. Proof of insurance in accordance with Citv requirements. I. Anv other relevant information which the Police Connnissioner mav require.

§ 316-[ 5] 2. Penalties for offenses.

Notwithstanding any other penalty provision of the Code of the City of New Rochelle, a violation of any provision of this chapter shall be punishable by a mandatory minimum fine for the first violation thereof of $50, and by a mandatory minimnm fine of $100 for a second or subsequent offense, with the maximum fine in each and every instance which may be imposed not to exceed $250.

§316-8. License fees.

A minimal fee of $750 shall be paid for each license issued hereunder.

§316-9. Issuance of license.

Upon receint of a properly completed application and pavment of the requisite fee. the Police Connnissioner shall issue a license to the applicant unless he determines:

A That the applicant is unfit and is incapable of properlv conducting a towing or booting business within the Citv of New Rochelle or does not conform to the provisions of this chapter: or

B. That the applicant's garage, depot or auto repair shop used in connection with the towing business is in violation of anv state or Citv law or regulation. including but not limited to zoning. building or fire law ordinances or regulations in the municipality in which it is located: or

C. That the aPnlicant has made a materiallv false statement or misrepresentation in his application.

6316-10. TransferabilitY oflicense.

A license issued hereunder shall not be transferred or assigned to another person or vehicle. exceDt as provided below.

§316-11. Snsoension. revocation or refusal to renew license: hearing; appeals.

A. Anv license issued hereunder mav be suspended. revoked or refused to be renewed bv the Police Connnissioner or his designee after a hearing. upon flve davs' notice. if the licensee thereof shall violate any provision of this chapter. anv rule or regulation adopted hereunder or anv ordinance of the Citv or is charged with the violation of anv vehicle and traffic law. ordinance or regulation of the State of New York or Citv of New Rochelle.

B. A request for a hearing to reinstate a license or to contest a suspension. revocation or refusal to renew must be made. in writing, to the Police Connnissioner and be sent bv registered or certified mail or gjven in person within I 0 davs after the suspension. revocation or refusal to renew. A hearin£ will be held within 21 days after receipt of the '· I ,, ''_b

licensee's request before the Police Commissioner or his designee and a decision rendered within three days. The licensee's license will remain suspended. revoked or expired until a decision is rendered bv the Police Commissioner or his desimee.

C. Anv licensee whose license has either been suspended. revoked or refused to be renewed pursuant to this chanter mav appeal said suspension. revocation or refusal to renew to the Police CommissioneL within 30 davs of the date thereof. bv attaching a copv of the suspension or revocation.

§316-12. Enforcement This chapter shall be enforced bv the Police Department

In consideration of this nomination and at my request, City Historian Barbara Davis completed research of existing records documenting previous Council resolutions for naming within this complex to insure accuracy with no apparent conflicts detected. § 281-67. Basic criteria for consideration.

The City Council may consider a formal application for consideration and approval to designate an honorary name for City and park facilities upon the following basic criteria:

A. The person honored must have been a resident of New Rochelle for at least l 0 years.

B. If the person is deceased, he or she must have been deceased for a minimum period of 12 months.

C. The person would have to have had a significant association with the park, site or facility; or contributed significantly to the City as a whole; or achieved significant recognition historically on the City level; or donated or contributed a significant amount for the acquisition and/or development of the park, site or facility; or provided direct and significant volunteer services benefiting the public as a local or community leader.

D. If the park, site or facility has been previously named for someone else, the application for renaming shall be sent to the City's Historic and Landmarks Review Board for an advisory opinion to the City Council.

E. A formal application must be made to the City Manager's office detailing the following:

(I) The full name of the person to be honored:

(2) The date of birth and the date of death, if applicable, of the person to be honored;

(3) The history of residence of the person to be honored;

(4) A brief biography of the person being honored, including all other data relevant to the commemorative naming;

(5) Details of how the person contributed to the acquisition or development ofthe park. site or facility or how the person to be honored enhanced the City; and

(6) Letters of support from City organizations or petitions signed by City residents demonstrating significant support for the proposed naming.

Dick Caswell was born in Watertown, N.Y. On May 28, 1931. He moved to St. Louis, Missouri when he was a young man. He played baseball for the University of St. Louis. After college he entered the armed forces. Dick moved to New Rochelle 1n 1956 and has been a resident ever since.

Dick has been a player, coach and general manager of the New Rochelle Robins since 1956. In that time the Robins have won close to 2,200 games. The Robins have played in national and international tournaments finishing as a runner-up to Japan in an international tournament.

Dick Caswell and the Robins are known locally, nationally and internationally. New Rochelle honored the Robins over the years with several proclamations. In 2007 the New Rochelle Hall of Fame honored the Robins as Team of the Year. Close to 100 players have gone on to professional baseball that came through the Robins system.

Dick has brought honor and fame to the City of New Rochelle being honored 'Nith a plaque from the Commissioner of baseball Bowie Kuhn.

In conclusion Dick has done this with money from his own pocket, which would run at least $250,000 or more. Dick put his money where his mouth is. The last of a dying breed to bring honor to New Rochelle. The process to compile a storefront business registry was started with the assistance of college interns. The interns were supplied with a list of data currently obtained by city departments. See below.

Some 14 different storefront business areas citywide were mapped using information obtained fi·om the Comprehensive Plan, Zoning Map, and general knowledge. A questionnaire was created to obtain business name, owner contact, and type of business/licenses, refuse collection and liabiiity insurance information. See attached.

The interns were given ID' s from the City and began to gather information on approximately 160 storefront businesses in the downtown and section ofNew Rochelle. The students found that some business representatives readily supplied the information while others did not.
