STRUCTURAL INSTRUMENTS IN THE PROGRAM PERIOD 2014-2020 In the 2014-2014 programming period, the total financial envelope for the Republic of Croatia from the Structural Instruments is 10.676 billion euros. Of this, EUR 6.881 billion for investment in growth and development is available through OP Competitiveness and Cohesion and EUR 4.321 billion from the European Regional Development Fund and EUR 2.599 billion from the Cohesion Fund:

• Water Framework Directive 2000/60/EC • Directive 98/83/EC on the quality of water intended for human consumption achieving the prescribed water quality in terms of microbiological indicators on public water supply systems in 70 identified water supply zones by the end of 2018 • Directive 91/271/EEC concerning urban waste water treatment construction of drainage and wastewater treatment systems in 281 agglomerations with a load of more than 2,000 ES with completion of all works by the end of 2023 with transition deadlines by 2018 and 2020 depending on the size of the agglomeration and receiver sensitivity • Revised implementation plan for water utilitiy directives an integral part of the documentation of the EU accession negotiations in Chapter 27. Environment. Transitional periods have also entered into the Treaty of Accession of the Republic of Croatia to the European Union • Multi annual program of construction of municipal water facilities

8 PUBLIC PROCUREMENT PROBLEMS (1)

The biggest problem in the realization of EU projects is the procurement procedures. The new Law on Public Procurement tried to meet the Employers and shorten the procedure itself, but it should be noted that the implementation identified a number of problems that slow down this procedure:

 the preliminary consultation procedure did not produce the desired result: instead of tenderers seeking clarification of tender conditions or technical specifications for the purpose of market research and simpler implementation of the procurement procedure and obtaining better offers, professional complainants on behalf of potential tenderers seek only certain parts of the documentation to which they will file appeals;  Frequent filing of appeals about documentation (outside the deadline for appeals) of the procurement, which prolongs the bidding time. In some procurement procedures, new appeals to the tender dossier (TD) occur even after the State Commision (SC) Decision has been adopted and the amendments to the TD have been partially amended and the new deadline for submission of the bid has been determined, which further extends the bidding time.

 An appeal can be made by an economic entity, regardless of whether it has a legal interest (eg TD complaint - Appellant is a company registered for:  preparing meals, drinks and beverages for consumption elsewhere with or without service  production of perfumes and toiletries etc.)

 Public Procurement duration (from publication to execution of the award Decision): The average duration of the public procurement procedure for works is 9-10 months The average duration of the procurement process for services is 6-7 months

11 INCREASING OF PROJECT COSTS

12 PROBLEMS IN CONTRACTING AND IMPLEMENTATION

 Problems:

 Delayed award decision making due to increased bids  Delaying award decision making because of fear of financial corrections  Slow dynamics of work execution than planned (all projects)  Bankruptcy of contractors (Vukovar and Osijek projects),  Financial corrections as a result of ex-post control of the procurement process.

 PREPARATION OF STUDIES FOR FLOOD RISK MANAGEMENT PROJECTS (38 MIL HRK) – Preparation of basin-level studies for 12 river basins with significant flood risks, for the River in Croatia, and preparation of studies for the VEPAR Project

 MODERNIZATION OF LEFT-BANK SAVA DIKES FROM RAČINOVCI TO NOVA GRADIŠKA (369 MIL HRK) – The project on a 236 km section foresees emergency "no regret" measures to increase the safety of flood dikes and hinterland with the construction of hinterland berms with drains and service roads (155.0 km); development of 8 separate projects in total length of 17.5 km with the construction of a water tight curtain to protect against hydraulic collapse of foundation soil at critical sections; and the formation of 17 excavation sites to provide all the material required for the said works

 IMPROVEMENT OF NON-STRUCTURAL FLOOD RISK MANAGEMENT MEASURES IN CROATIA (VEPAR) 353 MIL HRK – The project is implemented in cooperation with DHMZ. It consists of the improvement of non-structural flood risk management measures in Croatia to achieve flood risk reduction and provide and systematize the missing data related to basins, watercourses, water regulation and protection structures; modernize and upgrade the network of hydrological gauging stations; develop or improve forecasting mathematical models; prepare or improve flood risk management studies; procure the equipment required for more efficient operational flood defence; educate and inform the public about flood risks.

FLOOD PROTECTION PROJECT (183 MIL HRK) – Foreseen works at the location where the retention reservoir is dammed; construction of railway protection facilities along the retention reservoir area; construction of a facility protecting fishpond on the Vitunjčica River; and the construction of the Ogulin retention reservoir dam with the associated facilities

 KARLOVAC-SISAK FLOOD PROTECTION PROJECT – It will provide the required flood protection to the town of Karlovac and other settlements along the Kupa River from Karlovac to Sisak which are frequently and heavily flooded. It will also improve the capacity and operation of the natural Kupčina retention reservoir with the construction of facilities at the Brodarci dam upstream of Karlovac and extend the natural flood storage area of Odransko polje. The project foresees the reconstruction of dikes and construction of other facilities of the flood protection system to improve the functionality of the system as a whole.

23 PROBLEMS IN CONTRACTING AND IMPLEMENTATION

 Problems:

 Complex projects and associated Tender Documents (TD);  procurement of specific goods; lengthy contracting procedure, including frequent appeals against TD filed to the State Commission for the Supervision of Public Procurement Procedures and appeals against the award decisions, eventually slowing down the contracting procedure
