Now the school is looking for a new coach and direction. Wake Forest fired Manning on Saturday after losing seasons in five of his six years with one NCAA tour- nament appearance. The move came more than six weeks after the Demon Deacons lost to Pittsburgh in the opening game of the Atlantic Coast Conference tournament, ending the season shortly before the coronavirus pandemic led to a shutdown of college and professional sports. Manning, a former No. 1 overall NBA draft pick, went 78-111 in Winston-Salem with a 30-80 mark in ACC regular-season games.     A’s News Clips, Wednesday, December 1, 2010 Power-hungry Oakland A's ready to wine, dine former Houston Astros slugger Lance Berkman By Joe Stiglich, Oakland Tribune A's officials were scheduled to have dinner Tuesday night in Houston with free agent Lance Berkman, two sources with knowledge of the situation confirmed to Bay Area News Group. Berkman, a switch-hitter who's slugged 327 homers over 12 seasons, is known to have been on the team's radar. Presumably, the A's view him as their designated hitter if they sign him. Berkman hit just .248 with 14 homers and 58 RBIs last season, which he began with the Houston Astros before being traded to the New York Yankees. But Berkman, who turns 35 in February, told Fox Sports last week that he's fully recovered from arthroscopic knee surgery that bothered him much of last season. He hit 25 homers as recently as 2009 for Houston. Adding power is the A's most pressing need. They would have a hole at DH if they decide not to tender a contract to Jack Cust, which is a strong possibility. The A's must decide by 9 p.m. Thursday (PT) whether to tender contracts to their 10 arbitration-eligible players, including Cust. Other logical non-tender candidates: outfielder Travis Buck, reliever Brad Ziegler and either of two third basemen -- Kevin Kouzmanoff or Edwin Encarnacion. It's believed the A's would consider signing Berkman to a one- or two-year deal, though the team doesn't comment on free- agent negotiations.

Thank you. A POSITIVIST, BASEBALL-CENTRIC CRITIQUE OF ORIGINALISM William D. Blake* INTRODUCTION The1 Constitution invests the Supreme Court with two related powers: discretion and finality. The Constitution contains open-textured language, which creates disputes on which the Court typically has the last say. As Justice Robert Jackson once humbly observed, “We are not final because we are infallible, but we are infallible only because we are final.”2 The baseball rulebook provides similar powers to umpires. Judgment calls are final; they cannot form the basis for appeal or protest.3 Even with the creation of instant replay, overturning an umpire’s call requires a finding of “clear and convincing evidence,” which provides a strong presumption that the call on the field was correct.4 Umpires, like judges, have considerable power in light of the irrevocability of their decisions. For example, the Official Baseball Rules (OBR) warns players and managers that they will be ejected from the game if they quarrel over an umpire’s strike zone.5 Finality is problematic if sports officials abuse their discretion. Consider a (perhaps apocryphal) story of a rookie pitcher who experienced unfair treatment from Hall of Fame umpire Bill Klem. On a two-strike count, the pitcher’s offering to Rogers Hornsby, another Hall of Famer, caught the corner of the plate.
