ORDER No. 34/RPT Dated-17/06/2021 O R D E R No. 34/RPT Dated-17/06/2021 WHEREAS,a large number of commercial places/ shops have come up in Kolkata which are popularly known as Cyber Café and a large number of people visit those to use the facilities available in such places including Internet access and E-mail facility; AND WHEREAS, there is reasonable apprehension that Criminals /Antisocial /Antinational elements may use these facilities to mislead the security/ investigating agencies, create panic in the public, endanger the security of VVIPs and Government Institutions, help in the anti-national activities thus directly affecting the security of the State; AND WHEREAS, I, SoumenMitra , Commissioner of Police, Kolkata being an Executive Magistrate for the Metropolitan area of Kolkata as well as in the district of South 24 Parganas (within the limits of the suburbs of Kolkata falling under Kolkata Police jurisdiction) as appointed and specially empowered by the State Govt. under the Notification No. 228- P.S. Cell/HR/O/3P-13/05(Pt.-II) dated 08/02/2021 read with the Notification No. 226- P.S. Cell/HR/O/3P-13/05(Pt.-II) dated 08.02.2021 and the Notification No. 229-P.S.Cell/HR/O/3P-13/05 (Pt.-II) dated 08.02.2021 read with the Notification No. 227-P.S.Cell/H.R./O/3P-13/05 (Pt.-II) dated 08.02.2021to act under the sub-section (1) of Section 144 of the Code of Criminal Procedure, 1973 (Act 2 of 1974 ), am of the opinion thatit is necessary to take speedy measures in this regard to prevent danger to human life or safety, to thwart/ prevent terrorist activities which may affect the security of the state and disturbance of public order and tranquility; Now, therefore, in exercise of the power conferred by Sub Section (I) of Section 144 of the Code of Criminal procedure, 1973(Act2 of 1974) read with the Sub Section (3) of the said Section, I, SoumenMitra , Commissioner of Police, Kolkata being an Executive Magistrate for the Metropolitan area of Kolkata as well as in the district of South 24 Parganas(within the limits of the suburbs of Kolkata falling under Kolkata Police jurisdiction) do hereby order: - a) Prohibiting the use of Cyber Café by a person whose identity has not been established by the owner of the Café. b) Maintaining a register to identify the visitor/user. c) Making an entry in the handwriting of the visitor/user mentioning name, address, telephone number and the details of identity proof. The visitor/user shall also sign the register kept for this purpose. d) Establishing identity of the visitor/user through Identity Card issued by Govt., Electoral Photo Identity Card (EPIC), Ration Card, Driving License,Passport and AADHAR Card (any one of them). e) Preserving activity server log in main server and its record should be preserved for at least six months. f) Informing any activity of suspicious nature of a visitor bythe owner of Cyber Café tothe local Police Station. And g) Maintaining record about the specific computer used by the person. The above mentioned clauses are meant for strict compliance by the owners of such Cyber Cafes in the Metropolitan area of Kolkata and its Suburbs. As the notice cannot be served individually upon all concerned, the order is hereby passed ex-parte under sub section 2 of section 144 of Cr.P.C. 1973. It shall be published for the information of public through Press, the Kolkata Police Gazette and by affixing copies on the Notice Boards of the offices of All Divisional Deputy Commissioners of Police, all Police Stations concerned and the offices of the Kolkata Municipal Corporation; This order shall come into force for a period of 60 (Sixty) days with effect from 19.06.2021 to 17.08.2021or until further order . Any person contravening this order shall be punishable under the extant applicable laws. Given under my hand and seal this day, the17 th June, 2021. O R D E R No. 35/RPT Dated-17/06/2021 WHEREAS, it is reasonably apprehended that terrorist/anti-social elements in the guise of tenants/paying guests/domestic helps etc. may seek hideouts in the residential areas of the Police Stations as specified in the Schedule-I appended to this order, and there is every likelihood of breach of the peace and disturbance of public tranquility and also there is an apprehension leading to grave danger to human life and safety and injury to public property on that account; AND WHEREAS, it is necessary that some checks should be put on landlords/ tenants so that terrorist/anti-social elements in the guise of tenants/paying guests/domestic helps etc. may not cause disturbance of public tranquility and damage public property etc. or hatch up any planning for the same and that immediate action is necessary to thwart any possibility of the same; Now, therefore, I, Soumen Mitra , Commissioner of Police, Kolkata being an Executive Magistrate for the Metropolitan area of Kolkata as well as in the district of South 24 Parganas (within the limits of the suburbs of Kolkata falling under Kolkata police jurisdiction) as appointed and specially empowered by the State Govt. under the Notification No. 228- P.S. Cell/HR/O/3P-13/05(Pt.-II) dated 08/02/2021 read with the Notification No. 226-P.S. Cell/HR/O/3P-13/05(Pt.-II) dated 08.02.2021 and the Notification No. 229-P.S.Cell/HR/O/3P-13/05 (Pt.-II) dated 08.02.2021 read with the Notification No. 227- P.S.Cell/H.R./O/3P-13/05 (Pt.-II) dated 08.02.2021 to act under the sub-section (1) of Section 144 of the Code of Criminal Procedure, 1973 (Act 2 of 1974); do hereby order that no landlord/owner/person whose house property falls under the jurisdiction of area of Police Stations specified in the Schedule-I appended to this order, shall let/sublet/rent out/give licence for the use of any accommodation to any person unless and until he/she has furnished the particulars of the said tenant(s)/occupier(s) etc. as the case may be, as per the proforma in Schedule-II, II(A), II(B) to the Officer-in-charge of the Police Station concerned. All persons who intend to take accommodation on rent etc. shall inform in writing in this regard to the Officer-in-Charge of the Police Station concerned in whose jurisdiction the premises fall. The persons dealing in property business shall also inform in writing to the Officer-in-Charge of the Police Station concerned in whose jurisdiction the premises fall about the particulars of the tenants/occupiers etc; As the notice cannot be served individually on all concerned, the order is hereby passed exparte under sub-section (2) of section 144 of the Code of the Criminal Procedure, 1973. It shall be published for information of public through Press, the Kolkata Police Gazette and by affixing copies on Notice Boards of the offices of All Divisional Deputy Commissioners of Police, all Police Stations concerned and the offices of the Kolkata Municipal Corporation. This order shall come into force on and from 19.06.2021 and shall be effective for a period of 60 (sixty) days up to 17.08.2021 (both days inclusive) or until further order.
