Pursuant to Governor Baker’s March 12, 2020 Order Suspending Certain Provisions of the Open Meeting Law, G.L. c. 30A, §18, and the Governor’s March 15, 2020 Order imposing strict limitation on the number of people that may gather in one place, this meeting of the Town of Chelmsford Board of Selectmen will be conducted via remote participation to the greatest extent possible. Specific information and the general guidelines for remote participation by members of the public and/or parties with a right and/or requirement to attend this meeting can be found on the Town’s website, at www.chelmsfordma.gov For this meeting, members of the public who wish to watch the meeting may do so by accessing the Chelmsford Telemedia website www.chelmsfordtv.org

No in-person attendance of members of the public will be permitted, but every effort will be made to ensure that the public can adequately access the proceedings in real time, via technological means. In the event that we are unable to do so, despite best efforts, we will post on the Town’s website an audio or video recording, transcript, or other comprehensive record of proceedings as soon as possible after the meeting.

Articles to be included on the Warrant must be submitted in duplicate to the Office of the Town Manager at 50 Billerica Road prior to 4:00 p.m. on Monday, August 3, 2020. NOTICE OF VOTE

NOTICE OF ASSIGNMENT OF ITS RIGHT TO FIRST REFUSAL / G.L. ch. 61A, §14 24 Misty Meadows Lane, Chelmsford, Massachusetts (the “Premises”)

Reference is made to the notice of intent to sell dated May 11, 2020 provided pursuant to Massachusetts General Laws Chapter 61A, Section 14 pertaining to the following parcel of land in Chelmsford, Massachusetts:

The Premises shown as Assessors Map #81-321-1, consisting of approximately 41.16 acres of land and more particular described in a deed recorded in the Middlesex North Registry of Deeds at Book 1542, Page 283.

Please be advised that at a duly posted and convened meeting of the Chelmsford Board of Selectmen on ______, 2020, a majority of the Select Board voted to ASSIGN THE OPTION TO PURCHASE the Premises to the Chelmsford Water District (the “Water District”) as provided by M.G.L. Chapter 61A, Section 14. The Water District is a political subdivision of the Commonwealth of Massachusetts within the meaning of G.L. ch. 61A, §14 and has address of 20 Watershed Lane, Chelmsford, Massachusetts 01824. As a condition of this assignment, the Water District shall conserve at least 70% of the Premises in a use consistent with Chapter 61A, or no less a percentage conserved than proposed by the developer whose offer gave rise to right of first refusal, whichever is greater, but may be permitted to undertake a limited development on the balance of the Premises. All land other than land that is to be developed shall be bound by a permanent deed restriction that meets the requirements of chapter 184. This notice of assignment is provided for purposes of recording with the Middlesex North District Registry of Deeds.

About CCAT: Chelmsford Climate Action Team was formed in January 2020, by Chelmsford residents to promote climate legislation, and activities. We draw inspiration from climate groups in nearby towns like Lowell, Westford, Natick and Lexington, and we look to communities across the country and the globe. Currently we work with the Chelmsford Library and the town’s Sustainability Manager to help our town meet the State’s plan to meet Net Zero Emissions by 2050.

Legislation: In addition to education and advocacy we meet with our state legislators in efforts to learn more about climate legislation and how our state government works. We’ve spoken with Senator Barrett, Tammy Gouveia, Jim Arciero and Rep. Tom Golden. Recently we held a Zoom meeting with Rep Jim Arciero and Rep Joan Meschino to learn more about the State’s Roadmap bill (filed by Rep Meschino) that is currently in the House Ways and Means committee. Members of the Westford Climate Action Group joined us.

Education and Advocacy: We have been working with the Chelmsford Library since the Spring of 2019, to hold monthly "Climate Conversations." We’ve brought in speakers to talk about wind energy, heat pumps, climate legislation, regenerative agriculture, Green Municipal Aggregation, Our Climate Change and more. We have produced three videos with CTM; they are available to view on CTM’s Community Channel.

Upcoming: On Thursday, August 13, 2020, Dianne Sterratt-Steimel will show her documentary, "Troubled Waters: Fighting Pollution in the Merrimack River.” “Troubled Waters” highlights the problems affecting the Merrimack-- a source of water as well as recreation, and the habitat for many wildlife species. Team Action Climate

Chelmsford

Our Team: We are Chelmsford residents who met through the MA chapter of Elders Climate Action. We share a commitment to promoting climate legislation, advocacy and education to prevent the harmful effects of climate change and protect our planet. Founding members are: Kathy Cryan-Hicks, who worked as Assistant Director at the Chelmsford Library before retirement, Tom Amiro, member of the town’s Energy Committee and Bern Kosicki who retired from Lincoln Labs and is a member of the Sierra Club and the Union of Concerned Scientists. In spite of Covid-19, we have grown a mailing list of over 50 residents, many of whom attend our monthly Zoom programs.

Future Projects: We want to help continue the work that has already been done to prepare our community to “weather" the effects of climate change. We hope to build a consensus among town leaders and residents that climate change is an emergency, like so many communities across the world already recognize. We envision projects like a Climate Fair, an EV afternoon and a campaign to “opt up” to 100% green energy in the Chelmsford Choice plan. Working with Chelmsford’s Sustainability Manager we hope to create our own "Chelmsford Roadmap" to reduce emissions to Net Zero by 2050, along with the rest of the state.

Values and Vision Committee Board of Selectmen July 27, 2020

1 Overview

• The Board of Selectmen formed the Values and Vision Committee to establish common vision and values for the Town of Chelmsford. • The expectation is that the Vision and Values statements established will be the guiding principles for our citizens, the local business community, and the municipal operations of the Town. • The Vision and Values set the framework for culture, goals and objectives throughout the Town.

VISION: The town Vision statement will articulate our quest or future path for the town. It will define what we aspire to become, create and achieve.

VALUES: The town Values statement will articulate the core principles or standards by which we do business. They define what we believe in, what we know to be right, and how we want to be known by others.

2 What was the process?

• The Board of Selectmen formed the Committee with representatives from the Board of Selectmen, town management, and residents. • The Committee conducted a public survey, two public input sessions, and working sessions to form the Vision and Values statements.

3 Vision and Values

VISION: The Town of Chelmsford will be a livable, inclusive, diverse, welcoming, multigenerational community. Mindful of our historic past, we are adaptive and responsive to our dynamic environment. Our residents enjoy excellence in education, access to open space, and a vibrant, sustainable quality of life.

Per the Board's request at our July 13 meeting, I am providing an update on the Local Initiative Project (LIP) being brought forward by the Hanover Company. Included with this memo is a timeline which Evan Belansky has proposed, as well as the Board's current LIP policy and the application required by the Massachusetts Department of Housing and Community Development.

On Monday, July 20, I met with the Town Manager and Director of Community Development to review the LIP and Comprehensive Permit processes.

As part of the LIP approval process, a public meeting is required. Prior to that meeting, the developer must submit all relevant items, as specified in the policy. It should be noted that most of the information requested by the BOS policy is included on the DHCD application. In order to reduce duplication, I would suggest that we ask the developer to submit the DHCD application for the Board's review, with the understanding that some sections cannot be completed until all approvals are granted.

It was suggested that the Board focus on this project at a high level, including how it fits with existing strategic goals, such as those identified in Chelmsford's Housing Production Plan and Master Plan. The 'nuts and bolts' are typically under the purview of the Zoning Board of Appeals, which has the final authority to issue a Comprehensive Permit.

In the near term, the developer has requested a meeting to discuss sewer and water issues. I will report the outcome of those discussions following that meeting.

Otherwise, I will continue to monitor and report on the progress of this project. When all documents, etc. have been submitted, a public meeting can be scheduled, and deliberations conducted for granting LIP approval.

7 LOCAL INITIATIVE PROGRAM

7‐1 PROMOTE AND DEVELOP LOW AND MODERATE INCOME HOUSING It shall be the policy of the Town of Chelmsford to pursue and promote the development of low and moderate income housing pursuant to current applicable federal and state regulations. Further, the Board of Selectmen (Board) shall actively encourage the development of low and moderate income housing through the Local Initiative Program (LIP) pursuant to the Comprehensive Permit Law, M.G.L. Chapter 40B, ss. 20‐23. Chapter 40B requires that municipalities provide low and moderate income housing equal to10% of the community’s housing stock. Low and moderate income housing units developed through the Local Initiative Program that meet applicable regulatory requirements are eligible for inclusion on the Subsidized Housing Inventory and count toward Chelmsford’s 10% requirement.

7‐2 SUBMITTAL REQUIREMENTS Any developer seeking to obtain the Board’s LIP endorsement shall submit the information described below. Application materials shall be filed not less than two weeks prior to the anticipated meeting of the Board. The actual date of the meeting will be determined by the Board. Supplemental materials and materials showing any changes to the project shall be provided not less than 7 days prior to the Board meeting in order to facilitate distribution to Board members and municipal staff.

7‐2.1 Plans 7‐2.1.1 Site Plan(s) showing all existing and proposed structures, driveways, parking areas, landscape areas, and site amenities, such as courtyards or play areas. Plans shall show the distance of proposed structures to property lines and shall depict buildings on abutting properties.

7‐2.1.2 Architectural plans consisting of building elevations and floor plans. Architectural plans shall note the length, width, and height of all structures. Building height shall be shown in two measurements: as defined in the Chelmsford Zoning Bylaw and as measured to the highest point of the roof.

7‐2.2 Project Narrative: The Developer shall provide a Project Narrative describing the proposed project, including the proposed affordability component. The Narrative shall describe the affordable and market rate unit components in sufficient detail to establish unit quantity, type, placement within the project, and proposed pricing. The Board shall normally require a higher percentage of affordable units than is required by statute and developers are encouraged to propose the maximum feasible percentage. The Narrative shall also clearly describe the existing conditions of the land, the proposed project, number of units, gross density, effective density (the density when land unsuitable or unavailable for development such as wetlands, floodplains, or land encumbered by easement is subtracted from the overall acreage), and distance of structures on abutting properties to the property and to proposed structures.

7‐2.3 Community Outreach/Notification to Abutters: A design process that includes public involvement early in the process will assist in garnering community support, thereby saving developers significant time and expense. The Board shall not consider any proposal under this Policy without evidence that the Developer has actively solicited input from all project abutters in a timely and sufficient manner.

7‐2.4 Exceptions/Waivers: The developer shall submit to the Board of Selectmen a list of waivers required to develop the project. The list shall indicate what is required under local regulation.

7‐2.5 Narrative of Need/Benefit to the Community: The Development Team shall provide a narrative on how the project will benefit the community and its consistency with the Town’s Planned Production Plan. Conformance with DHCD’s LIP Guidelines shall also be clearly stated.

7‐2.6 List of Abutters: The Developer shall provide a list of abutters and abutters to abutters within 300 feet of the property, said list to be prepared by the Assessors Office. The Developer shall notify all parties on the list by regular mail not less than 7 days in advance of the Board’s initial Public Hearing LIP review meeting.

7‐2.7 Project Budget/Pro Forma: The Developer shall submit a project budget/pro forma detailing anticipated expenses and revenues of the project.

7‐2.8 Fee: A certified or cashier’s check in the amount of $50 per unit with a minimum of $1,000 shall accompany the Developer’s initial application for LIP endorsement. This fee is intended to defray the cost of staff review associated with LIP endorsement requests and is in addition to any other fees that may be charged by the Town or other agencies.

7‐3 STAFF INPUT Prior to filing with the Board, the Developer shall initiate discussions with relevant municipal departments in order to identify and address potential issues. Municipal departments must include the Community Development Department, Fire Department, Police Department, DPW – Sewer Division, DPW – Engineering Division, Conservation Commission, and Board of Health. The Developer is also encouraged to contact the relevant water district.

7‐4 CHELMSFORD HOUSING AUTHORITY INPUT The Developer shall review the Project’s affordable component with the Chelmsford Housing Authority. The review shall include a determination of pricing of the affordable units, affordable unit location, and the type of housing proposed. The Chelmsford Housing Authority shall provide its comments and recommendations to the Board relative to the affordable housing proposed.

7‐5 ADDITIONAL REQUIREMENTS The Board reserves the right to require the Developer to provide additional information to assist the Board in making a decision.

7‐6 BOARD OF SELECTMEN ACTION The Board may grant, grant with conditions, or deny its endorsement of any LIP under consideration.

Affirmative Fair Housing Marketing Plan:

Please submit your Affirmative Fair Housing Marketing Plan (AFHMP), prepared in accordance with Section III of the 40B Guidelines, and a description of the lottery process that will be used for this project. This shall describe:

Article II Wildlife Feeding

§ 11‐30. Definitions. As used in this and subsequent sections,

Wildlife shall mean any undomesticated and unrestrained animal or fowl, including but not limited to bears, coyotes, deer, foxes, raccoons, skunks and other animals or fowl causing public safety threats or nuisances.

Feeding shall mean the act of ground feeding, placing, exposing, depositing, distributing, or scattering, directly or indirectly, of any grain, shelled, shucked, or unshucked corn, seeds, wheat, bread or bakery products, salt, meat or parts, fish or parts, honey, molasses, or any other feed or nutritive substances, in any manner or form, so as to constitute for such wildlife a lure, attraction, or enticement to, on, or over any such areas where such feed items have been place, exposed, deposited, distributed, or scattered.

Designated enforcement authority shall mean Chelmsford Animal Control Officers, Police Officers, and agents of the Board of Health; and State Environmental Police Officers, and other enforcement officers of the Division of Law Enforcement, and by the Deputy Environmental Police Officers.

§ 11‐31. Prohibited activity.

No person shall feed any wildlife at any place within the Town of Chelmsford. Whenever the Chelmsford

Animal Control Officer or any designated enforcement authority determines a person has violated the provisions of this Section, such person shall be notified pursuant to Section 11‐33. Further violations in the same location, either by act of commission or omission, may constitute prima facia evidence that such violation was with the knowledge or consent of the person previously found in violation of this provision.

§ 11‐32 Exceptions.

A. Nothing in this By‐Law shall be construed to limit the feeding of domesticated waterfowl or other

animals, as defined by the Division of Fisheries and Wildlife, by a farmer as defined in M.G.L.

Chapter 128 § 1A on property owned or leased by him, or the feeding of waterfowl or any other

birds by propagators licensed under M.G.L. Chapter 131 § 23 when such waterfowl or other birds

are confined in such a manner as may be required pursuant to said Section 23 and any rules and

regulations issued under authority thereof; or the feeding by any person or his agents, invitees or

licensees or waterfowl lawfully kept as a pet by such person.

B. Regardless of this By‐Law, the Director of the Division of Fisheries and Wildlife or his agent or

designee may authorize the emergency feeding of waterfowl and other birds when, in his opinion,

such action is necessary to alleviate undue losses and suffering of such birds due to unusual weather

conditions and other circumstances. The Director may authorize such action by such means as he

deems necessary and expedient, but such means shall include the immediate notification to the

Select Board thereof by first class mail.

C. Any individual, company or corporation that is duly licensed by the Commonwealth of

Massachusetts or entitled under law to possess wildlife of any kind.

D. Any action that is officially sanctioned by the Commonwealth of Massachusetts that would require

feeding, baiting, or luring of wildlife (i.e., capturing and tagging wildlife for scientific projects and

study).

E. Any individual, company, or corporation that is engaged in lawful agricultural pursuits, including but

not limited to growing crops, crop‐bearing plants or raising livestock.

F. This section shall not be interpreted so as to prohibit bird feeders, squirrel feeders, or bat houses.

However, if a feeder is determined to be the cause of a public safety threat or nuisance, the

Chelmsford Animal Control Officer may order the feeder(s) and seed debris to be removed within 48

.

G. This section shall not be interpreted so as to prohibit the feeding of pets, provided that if food

intended for pets is determined to be the source of wildlife feeding, the landowner or person

responsible for the premises will be required to take steps to render such pet food inaccessible to

wildlife, including the requirement that the pet food be removed. If any wildlife gains access to pet

food, the condition allowing access must be corrected or the pet food removed within 48 hours.

H. This section shall not be interpreted so as to prohibit the storage of refuse, food product, pet food,

or other material or nutritive substance on any premises in a manner which does not constitute a

lure, attraction or enticement of wildlife on property within the Town of Chelmsford, provided that

if such storage is determined to be the source of a wildlife feeding problem, the landowner or

person responsible for the premises will be required to take steps to render such storage area

inaccessible to wildlife and the area near the storage be kept free from such debris. If any wildlife

gains access to a storage area, the condition allowing access must be corrected or the stored

material removed within 48 hours.

§ 11‐33 Penalties.

Any violation of this section may be enforced by the Animal Control Officer or any designated enforcement authority through non‐criminal disposition, pursuant to Massachusetts General Laws Chapter 40, Section 21D, in accordance with the following schedule of fines:

First offense: Written warning

Second offense: $25 fine

Third offense: $50 fine

Each subsequent offense: $100 fine

Due to favorable energy commodity markets, the Town is procuring electricity and natural gas supply for municipal buildings. The baseline electricity supply conforms to the State-regulated National Grid default supply. If the Town were to opt for a greener electricity supply, the additional cost could increase from a range as low as $8,000 for National Wind renewable energy certificate to as high as $300,000 for the more expensive New renewable energy certificates. Given the Town’s budgetary constraints, I am seeking your guidance prior to the scheduled August 19th bid opening.
