SELF-DETERMINATION OUTSIDE THE COLONIAL CONTEXT: THE BIRTH OF BANGLADESH IN RETROSPECTt By VedP. Nanda* I. INTRODUCTION In the aftermath of the Indo-Pakistan War in December 1971, the independent nation-state of Bangladesh was born.' Within the next four months, more than fifty countries had formally recognized the new nation.2 As India's military intervention was primarily responsible for the success of the secessionist movement in what was then known as East Pakistan, and for the creation of a new political entity on the inter- national scene,3 many serious questions stemming from this historic event remain unresolved for the international lawyer. For example: (1) What is the continuing validity of Article 2 (4) of the United Nations Charter?4 (2) What is the current status of the doctrine of humanita- rian intervention in international law?5 (3) What action could the United Nations have taken to avert the Bangladesh crisis?6 (4) What measures are necessary to prevent such tragic occurrences in the fu- ture?7 and (5) What relationship exists between the principle of self- "- This paper is an adapted version of a chapter that will appear in Y. This response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum. Questions 1. Are Hindus a minority religion in Bangladesh? 2. How are religious minorities, notably Hindus, treated in Bangladesh? 3. Is the Awami League traditionally supported by the Hindus in Bangladesh? 4. Are Hindu supporters of the Awami League discriminated against and if so, by whom? 5. Are there parts of Bangladesh where Hindus enjoy more safety? 6. Is Bengali the language of Bangladeshis? RESPONSE 1. Are Hindus a minority religion in Bangladesh? Hindus constitute approximately 10 percent of the population in Bangladesh making them a religious minority. Sunni Muslims constitute around 88 percent of the population and Buddhists and Christians make up the remainder of the religious minorities. The Hindu minority in Bangladesh has progressively diminished since partition in 1947 from approximately 25 percent of the population to its current 10 percent (US Department of State 2006, International Religious Freedom Report for 2006 – Bangladesh, 15 September – Attachment 1). 2. How are religious minorities, notably Hindus, treated in Bangladesh? In general, minorities in Bangladesh have been consistently mistreated by the government and Islamist extremists. Specific discrimination against the Hindu minority intensified immediately following the 2001 national elections when the Bangladesh Nationalist Party (BNP) gained victory with its four-party coalition government, including two Islamic parties. -

Over the past decade, however, the opposition has been suppressed, leaving them unable to wage the strikes and protests typical of the country’s politics. Alongside their decline has been a resurgence of street movement beyond conventional political boundaries. These movements are unpredictable, coalesce around issues of injustice, and emerge in particular from urban students. This article examines the movements for reform to civil service quotas, and for improved road safety, seen primarily in Dhaka in 2018. Such movements pose two principal threats to the ruling party: first, they have the potential to undermine their legitimacy and create a moment of crisis on which the opposition could capitalise; second, they can exacerbate tensions between interest groups on whom the ruling party rely to maintain power. The state response of concessions and repression reflects these threats and the delicate balance of maintaining legitimacy while using coercion. With a rich history of political movements and a lack of alternative channels for political expression, responding to grievances that can motivate such movements will be an important challenge for the ruling party to maintain their grip on power. -

1 URGENT APPEAL - THE OBSERVATORY BGD 001 / 0517 / OBS 051 Arbitrary detention / Judicial harassment Bangladesh May 12, 2017 The Observatory for the Protection of Human Rights Defenders, a partnership of the World Organisation Against Torture (OMCT) and FIDH, requests your urgent intervention in the following situation in Bangladesh. Brief description of the information: The Observatory has been informed by reliable sources about the arbitrary detention of two journalists associated with the human rights non-governmental organisation (NGO) Odhikar, Messrs. Hasan Ali, a Kushtia District correspondent for Bangla Vision TV, and Aslam Ali, a staff reporter for Dainik Kushtia Dorpan. According to the information received, on May 9, 2017, Messrs. Hasan Ali and Aslam Ali were taken into custody after surrendering before the Court of Chief Judicial Magistrate at Kushtia District under Section 57(2) of the Information and Communication Technology Act 2006 (ICT ACT - amended in 2009 and 2013)1. At the time of publication of this Urgent Appeal, both remained detained in Kushtia District Jail. On March 30, 2017, Mr. Hasibur Rahman Riju, a police informer, filed a complaint at Kushtia Model Police Station against Messrs. Hasan Ali and Aslam Ali. He accused them of publishing an offensive post under the Facebook name ‘Sultan Eslam’ by using the cell phone of a worker at a tea stall at Thana Mor of Kushtia town. Mr. Hasibur Rahman Riju alleged that the post defamed him and violated Section 57(2) of ICT Act. On the same day, police Sub-Inspector Azizur Rahman arrested Messrs. Digital clocks high and bright enough for maximum visibility hung from office buildings, schools, and shops. Dhaka was one of twelve city corporations spread over fifty districts where they had been installed since early 2020. The clocks would go on until 17 March, the birth centennial of jatir pita, "The Father of the Nation", Sheikh Mujibur Rahman. They stopped at the precise mom- ent when all values—day, hour, minute, and second—turned zero. There it was, the moment of origin; of Mujib, for sure, but also of Bangladesh. A birth foretold, as it were. Birth (and death, too, as we shall see) has been a powerful motif in politics in Bangladesh in the second decade of the twenty-first century. Chronologies collided in felicitous ways; the country geared up for unforeseen pomp and circumstance. Bangabandhu (Friend of Bengal), an epithet once popularly mandated and decades later officially dictated, was the centre of the celebrations in a polity inching towards another significant temporal marker—the fiftieth year of its independence. 2020 was (officially) Mujib Borsho, the Mujib Year; 2021 marked the historic half century of Bangladesh that still considered itself young around its bigger, older, venerable neighbours. With international guests invited, shows, concerts, FOCUS and fireworks scheduled, and Mujib’s return to the newly liberated country re-staged in real time, the anniversary was to be a no-holds-barred performance.
