1. TAXATION This construction/renovation contract is subject to the Moldovan Government Decision No. 246 of 08.04.2010 on the application of the zero rate of VAT on the supply of goods and services in the country and providing tax and customs exemptions for ongoing projects of technical and investment assistance covered under the international treaties to which the Republic of Moldova is part. As such, the US Government will not pay VAT on any invoices related to this construction contract. The contractor is required to coordinate with the US Embassy and with competent Moldova authorities in order to implement the procedures as required by the Moldovan Government in order to obtain the VAT TAX EXEMPTION that applies to this contract as detailed and specified in the referenced Moldovan regulations.

Contractor shall start the tax exemption within 7 days after award of this contract. Contractor is required to make all necessary coordination and to allow for time for approval of the VAT Tax Exception. A minimum of 3 months and a maximum of 5 months are estimated for processing all required documentation after its submission until the name of the Prime Contractor is published on the official Moldovan Government publication "Monitorul Oficial". The contractor should have the tax exemption process finalized before they start actual construction works and before they contract for any service related with this contract.

It is the contractor's responsibility to properly and adequately follow the requirements of the applicable Moldovan regulations in order implement of a tax free contract environment as it may be applicable for the prime contractor, subcontractors and suppliers. Per existing legislation the Moldovan Government will not register for VAT exemption any of the subcontractors, for any of the projects. The US Government SHALL NOT be responsible to pay any taxes for this contract resulting from a contractor's failure to implement the proper procedures or from not complying with the timelines or from not following any other requirements of the Moldovan regulations which guarantee tax exemption exclusively as detailed and in compliance with their regulations.

2. GENERAL DESCRIPTION OF PROJECT

2.1. Location of project

The project is located in the city of Taraclia, Moldova. See drawing below for location of Taraclia, approximately 150 kilometers south from Chisinau.

2.2. Legal and Technical Requirements

The project execution is based on the following principles:

- Strict compliance with US Contracting Regulations, including the requirements of the Department of Defense, the US Navy and Naval Facilities Engineering Command (NAVFAC).

- Strict compliance with Moldovan technical and legal regulations, with special emphasis on the specific technical regulations regarding the design, renovation and construction of hospital and other Health Care facilities in Moldova, including elevators for people with special needs (wheelchairs).

- Strict compliance with Moldovan Safety regulations, unless the US safety regulations (USACE EM 385-1-1) is more strict and not in conflict with the Moldovan safety regulations, in which case, the US safety regulations shall be applied.

- Compliance with technical and administrative requirements described in this document.

2.3. General Contract Description

This document is a Performance Technical Specifications (PTS) for a full Design-Build project. This PTS includes a description of the required finished work. This is a design-build contract. This means that the contractor is responsible to:

- Make necessary designs as required by this PTS for the different items of work

- Obtain NAVFAC’s acceptance of the designs and the approval of the beneficiary and all pertinent and competent Moldovan authorities, including the Ministry of Health and the of Taraclia.

- Obtain required formal technical approvals from competent and required Moldovan authorities, including the necessary expert review by third party company and/or “technical expertise” as required by Moldovan regulations for the scope of work included in this contract, which shall be paid by the contractor.

- Execute the construction/renovation works

- Obtain the acceptance of NAVFAC and the partial and final approvals by the competent and required Moldovan authorities and third party experts for the executed construction works.

Note: The contract includes third party and/or “technical expertise” review of all items of work which are required by Moldovan regulations. In case the Moldovan regulations do not allow for the contractor to be the client for this independent review, the contractor shall pay for the third party review and assign a different party as the client for this independent company, which could be the Municipality, a representative from the Ministry of Health, or other agency authorized by the Contracting Officer.

Note: The contractor needs to be familiar with the regulations of Moldova, in order to account for the different required permits, reviews and authorizations for renovations of health care facilities. Page 7 of 97 Version: 002

2.4. General Scope of Work – Structure of the Contract

This contract includes everything necessary to provide fully renovated medical areas in the 3rd floor of the Taraclia Hospital building, with the characteristics and limitations described in this document.

The work is divided into Base-Bid and 1 contract option, which will be awarded (or not) depending upon availability of funds, as well as other factors that the US Government will unilaterally consider. The contractor shall provide a separate price for the Base-Bid and the contract option, as required by the solicitation documents.

This means that there are two Contract Line Numbers (CLIN). CLIN0001 corresponds to the Base- Bid and CLIN0002 corresponds to Contract Option-1. The minimum part of the contract that will be awarded will be CLIN0001 and the US Government will unilaterally decide on the potential award of the CLIN0002.

In general terms, the works include the following items of work:

- CLIN0001 or Base-Bid: complete renovations, alterations, modifications and improvements to the South Wing of the 3rd floor.

- CLIN0002 or Contract Option-1: Renovations, alterations and improvements to the rest of areas of the 3rd floor.

2.5. Design Phase - General

The design shall be prepared in compliance with applicable construction codes, urban planning and construction practices in Moldova and in the Municipality of Tarcalia.

Some general requirements for the design are the following elements:

- Do not use the existing finishes of recently renovated areas in the hospital as model for this contract. The hospital has received several recent renovations. These renovations shall not be used as a model or example for the work included in this contract. For similar NAVFAC completed projects near Taraclia which can be used as examples, the contractor can visit the recently completed projects in Medgedia (Romania) or Odessa ().

- The use of gypsum boards to level the walls is not authorized.

- Complete new electrical installation from the electric meter in order to guarantee and certify that the electrical installations in the renovated areas fully comply with Moldovan regulations. This requires new electrical cable from the electric meter to the third floor, independent from the rest of the electrical system of the hospital building.

- Connect water to the water meter. There are available water pipes in the 3rd floor. However, their condition is unknown. For this reason, and to certify the water installation in the 3rd floor, the contractor shall design the water lines connected to the water meter. This requires providing new water lines from the water meter through the floors under the 3rd floor.

- Provide wall mounted sinks in all rooms. This includes replacing the existing sinks with new ones and installing additional ones in those rooms where there is no water sink. Provide with hot and cold water and single lever stainless steel faucet over minimum of 3 m² of ceramic wall tiles per sink.

- Prepare a new ventilation project for all the areas under the scope of work and execute it in order to have a renovated area in compliance with Moldovan ventilation requirements. The poor, or lack of, ventilation in the bathrooms is one of the main deficiencies of the areas to be renovated and consequently a separate study and project is required as part of this contract.

- Replace heating pipes and radiators, connected with piping in second and fourth floors. All piping connections shall be made outside the areas to be renovated, connecting the piping in the floors beneath and above providing new pipes sleeves to cross the floor and ceiling decks.

- Provide air conditioning by the use of heat pumps (capable of providing heat in the winter) in 4 rooms (to be determined by the Hospital Director after award of the contract)

- The entire area to be renovated shall be rated and certified for people with disabilities, unless specifically indicated otherwise in this document. The contractor shall provide stainless steel railing in the walls as described in this document. For example, there shall be no obstruction for a wheelchair to move freely between the renovated areas. This applies to very relevant elements such as bathrooms or door width.

- No renovation works shall be authorized without the corresponding design or sketch, certified by the corresponding and pertinent professional and accepted by the Contracting Officer Representative. Page 10 of 97 Version: 002

The contractor shall hire the services of a licensed architect to design all works with all items described in this document. For those items of work which do not require a formal Construction Permit or design, the licensed architect shall prepare and submit for acceptance the necessary drawings and/or sketches to formalize and explain to the beneficiary and to the Contracting Officer Representative the works that they are proposing to perform.

All works to be executed as required by Moldovan regulations, with the required foreman licensed in Moldova, technical supervision licensed in Moldova and architect.

As required by Moldovan regulations, for those elements that are required by Moldovan regulations, the contractor shall hire (and pay for) the services of a “Revision Entity - Expertise” authorized by the Government of Moldova to supervise and approve each phase of the design and the construction, including final commissioning and acceptance of the completed works. This company would report directly to the US Government representative and the beneficiary if required by the Moldovan regulations, but all their services shall be paid by the contractor.

The contractor’s final designs and sketches shall be signed, stamped and certified by a licensed architect in Moldova. The level of detail of the design (extent of specifications, number and size of drawings, calculations, …) shall be sufficient to verify the compliance with the requirements of this contract and as required by the regulations of Moldova and the Municipality of Taraclia and the different agencies involved in the process.

2.6. Construction Permit or Authorization – Construction Permit The contractor shall obtain formal written authorization from the competent Moldovan authority to perform the works included in the scope of work of this project.

The contractor is required, as part of this contract, to prepare all documentation, designs, reports, information, drawings, coordination and approvals by experts or monitoring entities, and everything that may be necessary as required by Moldovan regulations, in order to obtain these Permits or Authorizations. The contractor is responsible to pay for any third party inspection or expertise that may be required by Moldovan regulations for the scope of work of this project. The contractor shall be familiar with these requirements in order to prepare their bids, regarding the obligatory administrative and technical procedures in Moldova for any renovation works in healthcare facilities.

The contract includes third party review of all items of work which are required as per Moldovan regulations. In case the Moldovan regulations do not allow for the contractor to be the client for this independent expert company, the contractor shall pay for the third party review and assign a different party as the client for this independent company, which could be the Contracting Officer Representative or other agency authorized by the Contracting Officer.

The contract requires not only the Construction Permit for the main renovation construction works, but other permits by different agencies, such as the electrical supply, gas, water, telephone or Internet provider that may be required by the scope of work of this contract. The contract includes all necessary coordination with all incumbent Moldovan agencies involved in the design, renovation and construction of Health Care facilities in Moldova. This includes paying for any official fee or tariff that these companies or agencies may have for the connection and for preparation of the necessary reports and technical studies.

No work shall be performed until the contractor sends to the Contracting Office Representative verifiable evidence that they have obtained all the necessary permits for each element of work included in this contract.

2.6 Measurements and Quantities

This contract complies with the US Contracting Regulations, and as such, measurements and quantities of materials and work are not provided, and if any are provided, the contractor shall be responsible to verify on site. The contractor needs to visit the job site in order to perform the necessary measurements and to observe the existing field conditions in order to prepare their cost proposal.

The US Government is not responsible for any mistake in the contractor’s measurements or assumptions of field conditions.

3. CLIN0001 - BASE-BID: GENERAL SCOPE OF WORK

Complete renovation of everything within the areas to be renovated. This includes new floors, wall surfaces, ceilings, electrical, doors, plumbing, plumbing appliances, heating, ventilation or fire alarm, in a slightly modified layout. This is a 100% DESIGN-BUILD contract and the contractor shall provide the corresponding technical projects or designs for each element of work.

The contract includes all necessary items of work in order for the renovated areas to be certified in compliance with latest Moldovan standards and regulations for healthcare facilities, with the additional features and elements described in this document.

In general the existing layout shall remain, with the exception of the internal idles, which are currently used for bathrooms, one treatment room and storage, and which shall be completely rearranged. Also, the bathrooms for the two small “VIP” rooms shall be completely demolished and remodeled in order to comply with Moldovan and international standards. The rest of the rooms, with windows to the exterior, shall remain with the same layout, although the beneficiary can decide to change its use after the renovation is completed.

This contract includes complete renovation in order to provide completely renovated areas. The use of gypsum boards to level the walls and to cover the imperfections is not authorized, but gypsum board can only be authorized for very small areas, not greater than 1 m², and shall be explicitly authorized by the Contracting Officer Representative.

3.2. DEMOLITIONS

The works include the complete demolition of everything within the areas to be renovated, including floor surfaces, partitions as necessary for the new layout, wall paint and covers and plaster as necessary to provide new leveled walls, doors, electrical installation, plumbing and plumbing fixtures, heating and ventilation systems or ceiling covers. It is estimated that most of the utility shaft partition walls will need to be demolished for the new required layout.

All utility connections shall be made outside the areas to be renovated. In most cases these shall be made in the 2nd floor and the 4th floor, although other connections shall be made in the basement or in other floors, as required by the scope of work. For example, the works include the demolition and replacement of the sewer lines from the third floor to the basement.

3.3. NEW LAYOUT

The general layout of the area shall remain as existing, with the following exceptions:

- The middle idle area shall be completely rearranged. Currently there are bathroom for patients, storage room, a treatment room and a bath room. All internal partitions shall be demolished and new layout shall be designed by the contractor’s architect, to provide:

o Male patient bathroom facilities, rated and certified for people on wheelchairs. Provided with: . 2 toilets . 1 urinal . 2 sinks . 1 hand drier

o Female patient bathroom facilities, rated and certified for people on wheelchairs. Provided with: . 2 toilets . 2 sinks . 1 hand drier

o Hospital staff changing room or locker room, provided with: . 1 toilet . 1 shower . 10 metal lockers anchored to the walls

o Shower area for patients, rated and certified for people on wheelchair o Any potential remaining area shall be used for storage.

- The two small bathrooms for the “VIP” rooms shall be demolished and completely redone in order to comply with Moldovan and international standards. For estimating purposes the contractor shall estimate that they will provide one larger bathroom with toilet, shower and wall mounted sink to be shared for both rooms.

- The doors shall be widened as necessary in order to provide the following minimum opening widths defined below. This requires redoing the partition walls of most of the utility shafts.

o Minimum 0.815 m for all doors except patient wards o Minimum of 1.20 m for all patient wards where technically possible.

- New partitions: The new layout will require new partition walls to be built. The contractor shall provide double-double gypsum board with noise insulation to optimize the strength/weight ratio.

3.4. FLOORING

All floors shall be replaced. The contractor shall remove existing flooring surfaces prior to installation of the new floor cover. Once the project is completed, all floors in South wing shall be exactly at the same elevation, to allow for easy movement of wheelchairs, stretchers, beds and other movable equipment on wheels. This means for example that the doors cannot be provided with a bottom threshold or bottom frame.

There shall be 2 types of floors: Homogeneous linoleum/vinyl (2 mm thickness), and grès porcelain.

All colors and models of flooring to be selected by the Hospital Director, in coordination with the finished colors of the floors in other sections of the hospital. Transition between different types of flooring shall be done with the product recommended by the manufacturer of the homogeneous linoleum.

Flooring: Grès Porcelain Flooring:

Provide homogeneous grès porcelain tiles for the bathroom, kitchens and dining room areas. Include matching wall base board from the same model as the tiles where ceramic wall tiles is not required. Install combination of 2 colors of tiles per room.

Grès Porcelain stoneware is a ceramic with a compact, hard, colored and non-porous body. The word “grès” means that the ceramic body of the tile is extremely vitrified, that is to say compact, hence the exceptional great resistance. The result is a lean clay body, little refractory, fired in a kiln (at 1200-1400 C°) until it reaches a non-porous vitrification and a complete water-proofing.

Porcelain floor tiles are made by materials featuring the lowest water absorption levels. This feature (that is also one of the two parameters on which the EN ISO standards classification is based) also results in the highest level of bending strength, that is to say, the maximum tension that the material, subject to an increasing bending action, can bear before breaking. Amongst the most significant features of grès porcelain stoneware there is also the high abrasion resistance, which means the resistance of the surface against the action related to the movement of bodies, surface or materials in contact with it.

The new porcelain grès tiles shall be high quality, provided with the following technical features:

- Water Absorption: Tested by ISO 10545 - 3 ≤ 0,5% - Deep abrasion resistance: Tested by ISO 10545 – 6: Max 175 mm3 - Frost resistance: Tested by ISO 10545 – 12: Tiles must not produce noticeable alteration to surface - Chemical resistance: Tested by ISO 10545 – 13: Tiles must not produce noticeable signs of chemical attack - Friction coefficient (slipperiness): Tested by ASTM C 1028 ≥ 0,60 - Size: Minimum 40x40 cm

All floors shall be perfectly leveled at the same elevation. In rooms with floor drains, all floors shall be sloped towards the new floor drain to be provided as part of this contract. Tile installation shall be done following manufacturer’s instructions and recommendations.

Flooring: Homogeneous Linoleum (or vinyl) for medical use:

Provide new 2 mm thickness homogeneous linoleum/vinyl for all areas except in the bathrooms. Provide combination of 3 colors per room. Flooring material to be installed by specialized experienced workers, over self-leveling grout to be perfectly leveled, and to be accepted by manufacturer representative.

The surfaces to which apply the homogeneous linoleum shall be perfectly leveled, and provided with high quality solid homogeneous linoleum (2 mm thickness of wear thickness). Linoleum material shall have the minimum technical characteristics listed below:

- Officially rated in manufacturer’s catalog as certified for use in medical and laboratory facilities. - Description (EN 649): Homogeneous single layered vinyl flooring - Reaction to fire: Bfl-s1 - Electrical behavior - body voltage (EN 1815) – kV: < 2 - Thermal resistance (EN 12667) - m² K/W: Approx. 0.01 - Thermal conductivity: As needed. - Bacteria resistance (EN ISO 846 Part C): Does not favor growth - Total thickness (EN 428): 2 mm - Wear layer thickness (EN 429): 2 mm - Total weight (EN 430): >2.95 kg/m2 - Abrasion group - volume loss (EN 660 – 2) – Group: T - Abrasion group - volume loss (EN 660 – 2) – mm3: ≤ 2.0 - Classification - industrial (EN 685) – Class: 43

Install following manufacturer’s instructions for a perfectly leveled finished surface. Installed over self-leveling layer, using welded joints, and installed over the lower portion of the walls, as indicated in the model shown in one of the pictures included in this paragraph. The material used for the floor shall be extended up to 10 cm along the walls, without any joints separating the floor and the wall portions. Linoleum shall be provided in rolls and not in tiles.

Definition of homogeneous linoleum: The linoleum or single layered vinyl flooring shall have a minimum thickness of the wear layer of 2 millimeters and a total thickness of 2 millimeters. This means that all the material of the linoleum flooring is wear layer. A linoleum flooring with less than 2 millimeters of wear surface and made up of several layers is not acceptable.

3.5. WALLS

All walls in the areas to be renovated shall be repaired and provided with new finishes with the following rule or basis of design:

- Where there are ceramic floor tiles, the contractor shall provide ceramic wall tiles from floor to ceiling - In one room, to be selected by the Hospital Director after award, the contractor shall provide homogeneous vinyl from floor to the ceiling. - In all the hallway spaces and in one additional room (nurse room), the contractor shall provide homogeneous vinyl from the floor up to 1.8 meters high and the rest plastered and painted. - In the other rooms, the contractor shall provide plastered and paint finish.

The contractor shall perfectly level all the walls using cement base mortar. The use of gypsum boards to level the walls is not authorized, but gypsum board (double-double) is only authorized for the new wall partitions. Additionally, the walls will be damaged by the installation of recessed utilities, such as electrical or water lines. The use of gypsum board covering for the walls IS NOT authorized.

It is estimated that the contractor shall remove all paint and a relevant portion of the plaster on all walls to remain before applying the leveling plaster in which to apply the required finish layer (paint, tiles or homogeneous linoleum)

Homogeneous vinyl/linoleum wall covering (1.8 meters)

All work to be done in compliance with medical standards for hospitals. To be provided where the existing floor is vinyl.

Material: Homogeneous vinyl product

General features: Impervious surface with PU-Shield, hygienic and watertight, manufactured from watertight and extremely hardwearing high-quality vinyl. The homogeneous construction makes it durable against mechanical damage and allows easy repair. Rated by manufacturer for use in healthcare environments.

Plaster and Paint

Where the wall surfaces shall be plastered and paint, the contractor shall use the necessary leveling layers (required among other reasons for covering all the utilities under the wall surfaces) and provide a minimum of 3 coats of paint.

The contractor shall use an antibacterial and antifungal paint, certified by the manufacturer for use in medical facilities. Use lime based paint (limewash – whitewash) or any other officially certified by the manufacturer to be used in medical facilities requiring antifungal and antibacterial features.

Ceramic Wall Tiles

Where there are currently ceramic wall tiles, and surrounding all wall mounted sinks, the contractor shall provide ceramic tile covering (designed for walls) with water resistant joints, glued onto the surface of the wall. Provide with stainless steel or aluminum corner guards embedded in the wall tiles at all corners. Provide colors, to be selected by beneficiary among ample selection to be provided by the contractor, but in coordination with the colors used in the Surgery Department.

Size of ceramic tiles shall be minimum 20x30 cm. Bigger tiles are authorized. Smaller tiles are not authorized.

3.6. CEILINGS

All ceiling surfaces shall be new.

The contractor shall estimate that there shall be 2 types of ceilings:

- In bathrooms: Metal suspended ceiling

- In all other areas: Hospital rated acoustic suspended ceiling.

The contract includes in general terms for all the ceilings in the areas under the scope of work:

- Removal of any suspended ceiling surfaces (metal, gypsum,…) until the ceiling deck is exposed. - Cleaning the exposed deck structure - Painting all ceiling deck structure areas to be covered under the new suspended ceiling with antifungal and antibacterial certified paint. - Installing the new required suspended ceiling.

The use of gypsum board covering for the ceilings IS NOT authorized.

Suspended Acoustical Ceiling: Use Mineral tiles 600/600/33mm on a metal sub-frame coated with a durable anti-bacterial finish.

3.7. DOORS AND SIGNS

The contractor shall provide the doors wider than they currently are.

o Minimum 0.815 m for all doors except patient wards o Minimum of 1.20 m for all patient wards where technically possible.

This requires demolishing the utility shafts to make them smaller, so that the door openings can be made wider.

There shall be 4 type of doors:

- 2 automatic sliding door at the main entrances

- All pedestrian doors connecting with the hallway: All doors connecting with the hallway shall have the same finishes and quality, although they shall have different width.

- All doors for the utility shafts shall have the same finishes, although lower quality than the pedestrian doors.

- All other remaining doors: The contractor shall use PVC doors similar to the ones recently installed in the hospital building.

Main entrance doors – Automatic sliding doors:

There shall be two new entrance doors: Both shall be facing the entrance lobby, although only one of the existing ones is in that location.

- Doors shall be automatic sliding doors - Door to be certified to be used in medical areas - Provided with see through glazing of minimum 8 mm transparent glazing - Provided with locked open - locker closed – auto – card reader switch

Door connecting with the hallway (pedestrian):

The contractor shall provide and install high quality hospital rated and certified doors, with the required width for the intended use. These doors shall be provided with the following features:

- CE certificate for hospital use - All doors to be provided with same finishes / esthetics - Door leaf: Solid hardwood (minimum 16 kg/m²) or GRP (glass reinforced polyester) - Door Frame: Metal. All doors to be installed over metal frame. The use of wood frames or trims is not authorized. - Without bottom thresholds. The floors shall be continuing from one room to the adjacent one, to allow for movement of equipment on wheels and for ventilation. - Doors and frames to be provided by the same manufacturer and shall be standard catalog product for medical or healthcare use. - Heavy duty stainless steel hinges, stainless steel knob and lockset. Minimum 3 hinges per door. - Door stops - Stainless steel kick plate and protection against impacts by wheelchairs (Armor Plate or kick plate or mop plate together with the stretcher plate) - Provide 50% of number of doors with a see though glazing with minimum 8 mm thickness. Dimension of the see-through window to be coordinated with the Hospital Director.

The number of these doors is unknown, as it depends on the layout of the internal areas to be designed by the contractor’s architect. As a minimum there will be 20 units, plus the ones required to access the new areas to be designed in the idles to be redesigned by the contractor.

Door connecting with the hallway (utility shafts):

There are several large doors to access the utility shafts from the hallway and from other areas included in the scope of work of the contract. All these doors shall be removed and the access to the utility shafts to be redesigned by the contractor. For estimating purposes, the contractor shall estimate:

- Access doors with similar width as the existing ones - The similar esthetics as the new hallway pedestrian doors - Without see through window and without kick plates - With bottom frame, similar to a window. - With bottom frame at least 40 cm from the finished floor elevation.

All other doors: Doors inside the rooms, or connecting between rooms, not connected with hallway or entrance lobby. The contractor shall use PVC doors similar to the ones recently installed by the hospital Administration in other areas renovated within the last 5 years.

3.8. WINDOWS AND WINDOW BLINDS

The beneficiary has recently replaced the windows of all the areas under the scope of work and consequently their replacement is not part of this contract. This contract includes:

- Removing the existing windows and their sills and reinstalling them over the new wall surfaces.

- Providing internal window blinds for 50% of the windows in the areas under the scope of work. Window blinds shall be vertical panel type, manually adjustable, as the ones shown in the pictures below. Window blinds to be certified to be used in medical facilities. Coordinate color, model and where to install with Director of Hospital.

3.9. ELECTRICAL

The project includes the complete design and installation of a completely new electrical system starting at bus bar immediately after the electrical meter in the ground floor (see picture included in this paragraph). This is required in order for the contractor to certify that the entire electrical installation of the renovated areas shall be in strict compliance with Moldovan regulations.

The work includes:

- Complete removal of existing electrical installation, including all cables from the electric meter. None of the existing electrical installation shall be reutilized.

- Connect a new feeder or circuit immediate after the electric meter, with the necessary electrical protections and provide a new electric panel for all areas under the scope of work of this project. This new main panel to be recessed within a wall or in one of the utility shafts, similarly to the rest of the electrical installation.

- Design of the new electrical system and pertinent and required approvals by competent Moldovan licensed engineer and authorities. The contractor shall use the services of a licensed engineer in Moldova to prepare the drawing and calculations. Copy of the designs shall be provided to the Contracting Officer Representative. All electrical cables shall be installed under conduit and the conduits shall be recessed on the walls and over the new ceilings surfaces, so that no electrical conduit is visible within the areas to be renovated. All electrical appliances (boxes, panels, lighting fixtures, receptacles, switches) shall be recessed within the walls.

- The contractor shall execute the works that may be necessary in order for the electrical installation in the other areas of the building not to be affected by the complete replacement of the electrical installation of areas of the second floor. Any electrical system or installation which is currently powered, but which could be affected by the renovation works, shall continue to have electrical power after the renovation works. For example, if there is a wall receptacle in the staircase or in the North wing of the 3rd floor, connected to an electric panel located in the areas to be renovated of the South wing of the third floor. This construction contract includes the removal of such electric panel, and therefore the electrical receptacle will lose power. Then, this contract also includes the connection of the electrical circuits supplying power to such receptacles to a new circuit breaker to be installed in one of the new electrical panels to be installed recessed within the walls of the renovated areas. Anything in the building that currently has electric power, shall remain with electric power after the completion of this project.

- All electrical equipment shall be CE certified (European Community certified)

- Provide new electrical grounding systems as required by Moldovan regulations. Provide copy of the grounding resistance tests to the Contracting Officer Representative.

- Electrical protection: All circuits shall be protected against short circuits and against indirect contacts with differential protection of maximum allowed current 30 mA.

- Receptacles and special outlets: The contractor shall provide the same number of receptacles as there are in the areas to be renovated, plus 40 additional electrical receptacles in the areas to be renovated, to be installed as recommended by the contractor’s design team in coordination with the Hospital Director.

- Illumination: Provide LED technology lighting. The contractor shall include LED technology lighting in their project. Minimum power for each individual lighting fixture shall be 8 watts. Lighting fixtures shall be recessed within the new suspended ceiling.

The contractor shall provide a lighting design for the renovated areas, showing the illumination design pattern for each room in compliance with EN 12464-1. In each room, the design shall include the number and location of specific LED lighting fixtures, to show that they meet the minimum lighting levels required by standard EN 12464-1. These designs are normally done by the manufacturer of the proposed lighting fixtures. For the final inspection and acceptance the contractor shall provide the services of a certified third party inspection company with a lighting meter to test the illumination levels. This test shall be done in presence of the beneficiary representative.

Models: All models shall be selected by the contractor’s designer, to meet the requirements specified herein.

- All internal areas in the building annex shall be provided with suspended acoustic ceiling, and therefore the contractor shall provide recessed lighting fixtures.

- As a minimum, one of every 10 internal lighting fixtures shall be provided with autonomous battery to operate for a minimum of 30 minutes in case of power failure.

- Provide the necessary special appliances as required by Moldovan regulations, such as emergency lights, exit signs, etc

- Ultraviolet (UV) lighting fixtures: Provide a total of 15 large format UV lighting fixtures, at the location to be indicated by the Hospital Director. UV lighting fixtures to be similar (but not the same) as the one described in the picture included in this paragraph. UV lighting fixture to be hard wired (with cable not visible) and certified for hospital use.

The contractor’s designer shall include all required electrical connections for all electrical equipment to be incorporated by this contract, as well as for other electrical equipment to be installed by the beneficiary after completion of our contract.

Other electrical loads and equipment included in this contract includes, but would not be limited to electric loads such as:

3.10. TELEPHONE / INTERNET / COMMUNICATIONS

The contractor shall provide 4 outlets for telephone and internet connection. If the connector is not the same for both, the contractor shall provide 4 telephone and 4 internet connectors.

Location for the 4 (or 8) wall receptacles for telephone and Internet shall be indicated by the beneficiary. The contractor is responsible to provide all necessary installations in order to provide perfectly operational signal to the wall outlets from the nearest available point (or points) of connection with the service provider. This includes conduits, cables, cabinets, boxes, switches and everything else that may be necessary in compliance with Moldovan regulations and with the particular technical requirements of the service provider (telephone and Internet). The contractor is responsible to pay for any official connecting fee that may be applicable. The contractor is not responsible to sign the contract with the service provider, but they are responsible to coordinate with the beneficiary.

3.11. FIRE ALARM

Provide Fire Alarm system as required by Moldovan Regulations for this type of public facility. Provide with required smoke detectors, pull stations, horns and strobe lights.

All cables and boxes shall be recessed within the walls if allowed by Moldovan regulations.

3.12. SINKS

The contractor shall provide new sinks in all rooms. This includes the rooms where there is currently a sink and those that do not have one. Once this project is completed, there shall be a wall mounted sink in each room.

The contractor shall provide wall mounted sinks, without any contact with the floor, and with similar size as the one shown in the picture below.

All exposed drainage piping, including the p-trap or syphon, shall be made of stainless steel.

The work includes the installation of approximately 3 m² of new ceramic wall tiles around each one of the new sinks, except in the bathroom areas where the ceramic tiles shall be continuous on the walls.

Each sink shall be provided with a single lever control for hot and cold water. Each sink to be provided with cold and hot water.

The contractor shall provide mirrors and special lighting on half of the sinks, total of 4, to be installed where indicated by the beneficiary.

3.13. WALL RAILING

The entire area under the scope of work shall be designed by people on wheelchairs. Additionally, the contract includes providing wall railing to serve as physical protection, but also as walking aid. For this reason, the contractor shall design, provide, install and test a total of 30 linear meters of wall railing along the walls of the areas to be renovated, mainly along the hallways, but also inside some rooms.

The contractor shall coordinate with the Hospital Director and the Contracting Officer Representative the exact location of the 30 linear meters.

The handrails shall be installed to assist the movement of people with limited mobility. The railing shall be capable of supporting 100 kg of vertical or horizontal force at any given point without any visual deflection.

The exact location of the handrails will be determined by the beneficiary after the project is awarded, but for estimating purposes the contractor shall include 30 linear meters of new metal handrails, in sections of average length of 2.0 meters.

Basis of design:

- Stainless steel or PVC covered aluminum - Standard catalog product, rated by manufacturer for hospital use.

These 30 meters of railing is independent and in addition to the special railing that will need to be provided in the bathroom area to be designed and built in compliance with regulations for people with limited mobility.

3.14. HEATING SYSTEM

The contractor shall replace the closed circuit hot water system in the areas under the scope of work with a new one, in compliance with Moldovan regulations. This includes:

- Removal of existing piping and radiators.

- Connection with heating pipes in 2nd and 4th floors.

- New piping, valves and radiators.

- All pipe penetration through the ceiling and floor decks, but also through any wall, shallbe provided with the corresponding pipe sleeve.

- Provide bi-metal aluminum radiators. Size and location shall be the same as existing, except where the layout of the room changes. The sum of the area of the existing radiators shall be the same as for the new radiators.

- Provide individual regulating valve in each radiator.

- Provide individual filter for each radiator.

- Piping to be installed recessed within the walls to the maximum extent technically possible.

3.15. VENTILATION

The inadequacy or lack of ventilation in the center idle and in the “VIP” room bathroom is one of the main deficiencies of the areas to be renovated. This project includes work in excess of Moldovan regulations. It includes:

- Cleaning the existing ventilation shafts or ducts

- Providing new forced ventilation from the rooms without windows, to the exterior of the building.

The contractor shall provide ventilation to all areas, but especially to those without exterior windows. The basis of design is the compliance with Moldovan regulations for ventilation of public buildings used as medical facilities.

Cleaning the existing ventilation ducts: The contractor shall hire the services of a specialized company to clean the ventilation ducts from all rooms under the scope of work connected with these ventilation systems. The works includes:

- Cleaning the ducts

- Performing a video inspection and providing a copy of this visual inspection to the Contracting Officer Representative.

- Replacing the wall grilles with new stainless steel manually regulated grilles

Forced ventilation for rooms without windows: The contractor shall provide forced ventilation as follows:

- Individual duct for each room. Sharing the same air duct for two rooms is not acceptable, and the contractor shall provide two separate and independent air ducts, to avoid contamination of one room with air coming from another room.

- Cleanable. The contractor shall provide all air ducts with inspection and cleaning ducts.

- Each exhaust fan (one per room) to have a minimum of 2 speeds.

- Each exhaust fan shall be designed to remove at maximum speed the volume of air in each room in a maximum of 4 minutes

- The exterior opening to outside of the building to be provided with self-closing louver and bird screen.

3.16. SEWER LINES

The contractor shall replace all sewer lines in the areas under the scope of work of the contract from the 4th floor to the basement.

This will include:

- Removing the existing sewer lines

- Providing new sewer lines in the same location, but using the pertinent pipe sleeves

- Connecting all sewer and drainage lines from the second and ground floor to the new sewer lines. This requires many piping connection and extensive works in areas outside of the scope of work of the renovation works.

- Make final connection of sewer line to nearest PVC pipe in the basement.

3.17. HEAT PUMPS

The contractor shall provide air conditioning by the use of heat pumps (capable of providing heat in the winter) in 4 rooms, to be determined by the Hospital Director after award of the contract.

The contract includes a new centralized heating system with radiators, as described in a previous paragraph. However, in addition to this source of heating, the contractor shall also provide heat pumps to provide heat in the winter or cold air in the summer. Heating by the use of electric resistance is not authorized. The contractor shall provide cooling and heating system using split- type inverter technology heat pump units. Provide heat pumps with exterior units protected from the view and snow to the maximum extent technically possible.

It is required to provide a minimum of 2 internal units for each external units. It is not authorized to provide one exterior unit for each interior unit. This means that if for example there would be 4 interior A/C units (wall or ceiling mounted), there shall be a maximum of 2 exterior units.

The contractor shall hire the services of a specialized company or engineer to design the new air conditioning system. For estimating purposes, the contractor can estimate a system with the following technical parameters:

- Heat pump system using inverter technology with variable refrigerant flow. Capable of providing hot and cold air and maintaining 21 degrees in hottest summer conditions.

- The compressor units shall be installed over a new structural support wall in the back of the building or on a concrete pad. It is not authorized to install one compressor (exterior unit) for each condenser (internal unit). They shall be provided with metal roofing to protect them from inclement weather, even if the units are rated for exterior installation.

- Ceiling mounted or wall mounted internal units.

- Individual temperature control for each room

- Drainage from the condensate to be connected with the exterior ground

3.18. WATER HEATERS

The contractor shall replace all water heaters with new ones as necessary to provide hot water to all faucets in all rooms of the areas to be renovated. It is not authorized to install one water heater per room, but as a minimum a water heater shall serve two rooms.

3.19. FIRE HOSES

The contractor shall replace the existing fire hose cabinets with new ones, provided with new hoses and valves, as required by Moldovan regulations.

3.20.3. Locker Rooms

The contractor shall design a locker room in the idle areas to be completely demolished. The contractor’s architect shall propose the size, location and shape. The contractor shall provide in this particular room:

3.20.4. Showers

The contractor designer shall provide a minimum of 2 showers:

- One for people on wheelchair, with sufficient space for assistants to help the person to use the shower.

4. CLIN0002 – CONTRACT OPTION-1: GENERAL SCOPE OF WORK

The work included in the Base-Bid of this contract is clearly described in paragraph 3 and all its subparagraphs and it includes the complete renovation of the South Wing of the 3rd floor of the Taraclia Hospital. Contract Option-1, or CLIN0002, includes the renovation of the remaining areas of the 3rd floor, including all areas not included in the Base-Bid, with the exception of the staircases and elevators. These areas were recently renovated, to much lower standards than those included in the Base- Bid of this contract. This contract does not include removing any of the renovation works done by the beneficiary in the North wing area of the 3rd floor, unless otherwise indicated, but it only includes additional requirements as outlines herein: The work included and described in this paragraph (and its subparagraphs) shall be performed if, and only if, contract option-1 is awarded to the successful offeror by the Contracting Officer. The US Government will unilaterally decide whether to award or not this portion of the contract based on availability of funds, as well as other factors.

4.1. AREAS UNDER THE SCOPE OF WORK OF THE CONTRACT OPTION-1 OR CLIN0001

4.2. THE SCOPE OF WORK OF THE CONTRACT OPTION-1 OR CLIN0001

In general, the contract includes:

- Two new entrance doors: The contractor shall provide an install two automatic sliding doors similar to the ones described under the Base-Bid. The entrance lobby to the 4th floor shall have 4 automatic sliding doors once the works are completed. Each door shall have its corresponding door sign engraved on it.

- Providing hallways with same flooring as the hallways in the Base-Bid (homogeneous linoleum). The contractor shall provide homogenous linoleum or vinyl with same technical features and requirements as the ones described for the Base-Bid. In addition to the actual installation of the homogeneous linoleum over self-leveling grout by specialized workers, the contractor shall:

o Remove, modify as necessary, and reinstall all doors connecting with the hallway. This is to account for the necessary elevation of the finished floor surface, which may affect the normal operation of the existing doors. Most of these doors were recently installed by the beneficairy, and this contract does not include replacing these doors, but making the necessary modifications and alternations for the doors to operate properly with the new floor surface.

o Provide metal thresholds between the new homogeneous linoleum and the existing flooring in the rooms to remain.

- Providing ceiling on hallway as the ceiling in the hallways in the Base-Bid. Similarly to the Base-Bid, the contractor shall remove all ceiling cover, clean the ceiling surfaces, paint with hospital rated paint and provide new acoustic medical rated suspended ceiling.

- Replacing hallway lighting. Similarly to the Base-Bid, the contractor shall provide new lighting fixtures on the new suspended ceiling. However, it is not required to replace the entire electrical installation, but only the lighting fixtures, reutilizing as much as technically possible the existing electrical installation. The number and distribution of the LED lighting fixtures shall be determined with the same parameters as in the base-Bid.

5. Omissions from the Project Specifications

The design shall be based upon the requirements described in the previous pages. If any installation is not specified in this section, but it is required for the formal acceptance of the renovated, improved or rebuilt areas and/or works, the contractor shall consider this installation to be part of the contract, and they shall use commercial grade materials and equipment in compliance with Moldova Code and common construction practice.

Additional Requirements

The work shall meet all requirements of this Request For Proposal (RFP) package. Drawings to be as required in this RFP and with sufficient detail to communicate the design to the US Government, Moldova authorities, final beneficiary, contractor’s staff and sub-contractors. Material selection, specifications and installation to be as described in these technical specifications and in strict compliance with Moldova regulations. The Performance Technical Specification (PTS) are a guideline for the design package. If an item in the project design is included in these technical specifications, the requirements of the PTS and applicable local codes shall govern. If an item in the project design is NOT included in the ESR/PTS, the requirements of applicable local codes shall govern.

Provide the Final work as a complete and usable facility including technical details, items of work, permits or fees that are not explicitly described in this RFP, but which are necessary to provide a fully operational hospital area shall be considered part of this contract.

The beneficiary (Municipality of Taraclia and Hospital staff) will participate in the development of the design and construction, and their expertise and deep knowledge of the requirements shall be considered during the design stage. However, they shall be limited by the requirements of these technical specifications.

The Monitoring Entity shall participate, review and approve the design. They shall take responsibility over the design documents. Nevertheless, the Monitoring Entity shall not have any authority to add, delete or modify work in this project, and shall only provide their recommendations to guarantee strict compliance with applicable regulations on Moldova. If they recommend a different and more expensive technical alternative to some technical alternative outlined in this document, but the one provided in this document does not violate Moldova regulations, the contractor only has a contractual obligation to follow the technical alternative outlined in this document.

6. PROCEDURE AND GENERAL CONTRACT REQUIREMENTS AND GUIDELINES

6.1. Principles

This construction contract is based on 3 principles:

- Strict compliance with US Contracting Regulations, including the requirements of the Department of Defense, the US Navy and Naval Facilities Engineering Command (NAVFAC).

- Strict compliance with Moldovan technical and legal regulations, with special emphasis on the specific Moldovan technical regulations regarding Health Care facilities.

- Strict compliance with Moldovan Safety regulations unless the US regulations is more strict and not in conflict with the local safety regulations, in which case, the US Safety regulations shall be applied.

Construction shall be in accordance with sound construction practices, and shall conform to the latest revision/edition of the codes, criteria, and standards in effect at the time of submission of the bids, except as otherwise indicated by this Request for Proposal. Construction shall also comply with applicable codes, ordinances and regulations of Moldova governing life/safety, fire protection, building construction, and electrical systems in effect during this contract, except where specifically stated herein. Any material installed that does not meet the requirements of this Technical Specification and/or applicable Moldovan codes, ordinances and regulations will be removed and reinstalled at Contractor’s expense.

6.2. Prohibited Items

Use of the following items in this construction project is prohibited:

- Use of aluminum for electrical conductors. - Embedding aluminum conduit in concrete. - Use of fluorescent light ballasts and other products containing PCB's. - Use of incandescent lighting - Use of urea-formaldehyde foam insulation products. - Use of any paint/coatings having a lead content of over 0.06 percent by weight of non- volatile content. The use of ozone depleting chemicals is prohibited. The use of zinc- chromate is prohibited. - The use of materials containing asbestos is prohibited.

6.3. Start of Construction

The Project Manager (PM) or Contracting Officer Representative shall authorize the start of construction. This authorization to start will not be given until the contractor:

- Provides written evidence that they comply with all legal requirements in Moldova in order to perform the works described in these PTS.

- Provides copy of the required permits or authorizations from the competent Moldovan authority authorizing the execution of the works

- Provides technical information and technical projects for the designs, including proposed materials and equipment to be used for the project. Only materials and equipment previously accepted by the Contracting Officer Representative shall be brought to the site.

- The Contracting Officer Representative accepts their Accident Prevention Plan. See the guidelines for preparation of the APP attached to the solicitation package.

- The Contracting Officer Representative accepts their Quality Control Plan. See Annex 1.

- The Contracting Officer Representative accept their Construction Schedule

- Construction Sign is placed on site (see pertinent paragraph for the Construction Sign)

6.4. Responsibility for New Materials

All materials delivered to the construction site shall remain in the ownership and responsibility of Contractor. Contractor will be responsible to safeguard the procession and condition of the material until US Government takes procession of the finalized project. Any materials or equipment stolen or disappeared from the job site before final acceptance is the responsibility of the contractor.

Material that is not intended to become part of the project shall not be delivered, placed, retained nor stored on the project site.

6.5. Design

The design phase has different phases, which will require the contractor to provide, submit and process different documents, drawings, permits and/or calculations for approval or acceptance of all parties involved in the design process. The US Government representative shall not approve the design, but they shall “accept” the design. It is the contractor’s designing team responsibility to “approve” the design once “accepted” by the US Government representative. The contractor shall follow the required steps in Moldova for this type of design.

The Performance Technical Specification (PTS) are a guideline for the design package.

- If an item in the project design is included in the PTS, the requirements of the PTS and applicable local Moldovan and international codes shall govern.

- If an item in the project design is NOT included in the PTS, the requirements of applicable local Moldovan and international codes shall govern.

Provide the Final work as a complete and usable facility including technical details, items of work, permits or fees that are not explicitly described in this RFP, but which are necessary to provide a fully operational and finished facility shall be considered part of this contract. The contractor shall hire the necessary and required licensed architects/engineers to prepare the necessary design in accordance with the scope of work of this contract, and with the technical and quality requirements described in this document. The contractor shall perform the work in strict compliance with the construction codes and regulations of Moldova. The contractor is responsible to provide a copy of a Construction Picture#41. Simplified flow Permit issued by the corresponding local authority, and those diagram for design permits that are required for the utility connections. The acceptance process. contractor is responsible to prepare any required documentation (CO = Contracting Officer) and/or designs that will be required in order to obtain these permits. No work shall be executed until the corresponding construction permit is issued by the competent authority, and a copy provided to the COR.

For those items required by the Scope of Work, which are not specified herein, the contractor shall follow the applicable Moldovan Codes and Regulations

6.6. Design-Build Procedure

A design-build contract means that the contractor is responsible not only to perform the works described in this document, but to prepare all necessary designs and technical projects.

The contractor shall be responsible, and it shall be part of their contract, to perform all works included in their designs. All designs shall include the items of work included in this document, as well as those items of work not included in this document, but required by Moldovan regulations in order to have perfectly operational and functional facilities.

This document includes conceptual sketches, which shall be used as part of the basis of design of this contract. However, it is the contractor’s responsibility as part of this contract to prepare the new conceptual designs, final design and full technical projects.

This contract includes the preparation of the required designs, technical projects, geotechnical reports, surveys, permits, certifications as well as any required coordination with local authorities. The contract also includes processing and paying for any potential fees that may be required in order to obtain the required Construction Permits.

The contractor is responsible to verify site conditions and to prepare all necessary inspections and reports before preparing the design and technical projects. The contractor shall visit and inspect the work site prior to submission of their offer to the US Government. The contractor may consult with the Municipality of Tarcalia if any information of the site conditions is necessary, in coordination with the representative and Project Manager from the United States Office of Defense Cooperation in Chisinau: Mr. Trestianu [email protected], or Mr. Alexandr Cerchez [email protected] who are also be responsible to coordinate the site visits.

Once the final design is prepared, it shall be accepted by the COR before the contractor sends it to the local authorities to obtain the corresponding Construction Permit. The accepted final design will be incorporated into the contract.

- Conceptual/Initial design (or 35% design): The contractor shall start with this phase immediately after contract award. The contractor shall provide a conceptual, initial or 35% design showing the general layout of all work included in the contract, which shall include the minimum required spaces and some of their finishes and contents. The 35% design shall include the proposed materials and finishes, and it shall describe the proposed design in minimum detail to verify that the next phases of the design shall comply with the minimum requirements of this contract, including the Moldova regulations. The 35% Concept Design is intended to assure all lay-out requirements are clearly met before proceeding with the rest of the design. The contractor designing team shall coordinate with the beneficiary representatives and the Monitoring Entity before submitting the 35% design to the US Government representative for acceptance. The US Government representative shall review the concept design submission for compliance to these Technical Requirements and to verify acceptance by the beneficiary and the local authorities, and with the RFP package. The Contracting Officer representative will provide written comments to the contractor.

- Final Certified Design: Once the final design has been approved by local authorities, the contractor shall submit a copy properly approved, signed and certified by the “Revision Entity” and by the architect and different engineers that may have participated in the design, as required by Moldova Code and regulations. The Final Certified design shall be provided to the US Government representative together with the formal authorization or construction permits from the competent local Moldova authorities. The design phase shall not be considered to be complete, and therefore payment for the design shall not be authorized, until the contractor provides a copy of the required construction permits, authorizing the contractor to perform all the works included and detailed in the design.

6.7. Construction/Design Schedule and Contractual Milestones

Perform all work within 700 calendar days after contract award. Provide a bar chart with a minimum of 50 activities. Indicate planned start and completion dates for design and construction.

In addition to the contractual requirement to complete all construction works within the 700 calendar days after award of the contract, the contractor shall comply with the following required milestones. Failure to comply with these milestones will be objective basis for invoice retention or further contractual action by the Contracting Officer.

Tax exemption information: Coordinate with the US Embassy representative within 14 days after contract award date

6.8. Construction Schedule (bar chart is authorized)

Perform all work within 700 calendar days after contract award. Within 45 days after contract award, the contractor shall provide a construction schedule including a minimum of 50 activities, and clearly defining the different phases.

6.9. SAFETY: Accident Prevention Plan

SAFETY SHALL BE THE FIRST PRIORITY OF THE CONTRACTOR. SAFETY OF THE WORKERS AND PERSONNEL AT THE SITE SHALL TAKE PRECEDENCE OVER ANY OTHER FACTOR.

The contractor shall use the format or guidelines included in the solicitation package to prepare the Safety Plan or Accident Prevention Plan

Within the timeframe allowed for the final design submission, the Contractor will prepare and submit an Accident Prevention Plan as required and outlined by the US Army Corps of Engineers Safety Manual (EM-385-1-1), describing procedures they plan to perform to ensure the safety of the workers, the staff of the facilities, the general public, and the equipment on the job site. The Plan shall clearly define the measurement that the contractor will implement to guarantee that nobody will be exposed to any hazards as a result of this construction contract.

Additionally, the safety plan must address types of personal protective equipment to be used by personnel, types and frequencies of safety inspections, hazard analysis plan to prevent safety incidents, and training utilized to familiarize employees with safety policies and practices. The contractor shall comply with the US Army Corps of Engineers Safety Manual EM385-1-1 wherever the requirements of this manual are more stringent and not in conflict with the requirements of the Moldovan Safety Law.

No work shall start at the job site until the Accident Prevention Plan is received and accepted by the COR.

Execution of this construction contract requires compliance with Moldovan and United States Army Corps of Engineers Safety regulations. In addition to the Accident Prevention Plan which needs to be prepared as outlined in EM385-1-1, the contractor is responsible to prepare all necessary safety documentation, studies, reports, books, design or logs, which may be required by Moldovan regulations/legislation.

- Safety of the people shall be the highest priority of the contractor.

- The contractor shall comply with the Safety Manual of the US Army Corps of Engineers (EM-385-1-1), wherever this US manual has more stringent safety requirements than those required by Moldovan Code and these requirements are not in conflict with local safety regulations. - In accordance with previous safety paragraphs, the contractor shall provide an accepted copy of their Accident Prevention Plan before any work is authorized to start.

- The contractor is responsible for the safety of the contractor’s employees, subcontractors, visitors and the general public, as they could be affected by this construction project. Contractor shall provide proper fences or barricades to separate the construction areas from the rest of areas of the installation.

- The contractor is responsible to comply with Moldovan Safety Code. All costs of compliance with safety and with Moldovan safety regulations are the responsibility of the contractor. Any costs related with safety inspections, safety monitoring, or anything else required to comply with the Safety regulations shall be the responsibility of the contractor.

- Within the context of his responsibilities, the contractor shall take the necessary actions to protect the safety and health of the employees, including the prevention of occupational risks, information and training measures, and measures for the organization of the health and safety at work and its necessary means as required by Moldovan Code. The following general prevention principles shall be taken into account for the adoption and implementation of the measures provided above:

a. avoiding risks;

b. evaluating the risks which cannot be avoided;

c. combating the risks at the source;

d. adapting the work to the individual, in particular as regards the design of the workplace and the choice of work and production equipment and methods, with a view, in particular, to alleviating monotonous and repetitive work, and its effects on health;

e. adapting to technical progress;

f. replacing the dangerous by the non-dangerous;

g. prevention planning;

h. giving collective protective measures priority over individual protective measures;

i. giving appropriate instructions to the employees.

An employer shall insure all employees against occupational accident and disease risks, under the terms of Moldovan law. The contractor shall verify that all employees of the prime contractor or any subcontractor employed in this project meet the legal requirements of Moldovan Law.

The contractor shall organize the employee training in the field of health and safety at work. This training must be provided to new employees, those changing the workplace or type of work and those resuming their activity after a break longer than 6 months. In all such cases, the training shall take place before the actual beginning of the activity. The contractor shall be responsible for the facilities related to the provision of first aid in case of occupational accidents, for fire prevention and the evacuation of the employees in special situations and imminent danger. The contractor shall be responsible for a safe and hygienic work environment both on the project site and at off-site locations where work is done in conjunction with this project.

- The contractor shall be responsible for the protection of all grounds, vegetation and improvements that exist and are to remain after the project is complete; with-in the project work areas, adjacent to the project work areas and along the common route of access to the site, outside of the work areas. The Contractor shall be responsible to have any damage caused by Contractor’s employees, equipment or sub-contractors repaired and restored to pre-damage condition, as approved by the PM or Contracting Officer Representative (COR), at no cost to the Government.

- The Contractor shall comply with all applicable safety regulations of Moldova, including all required record keeping.

- The Contractor shall provide and maintain in working order during the entire construction period, such fire protective equipment and devices as required by applicable safety standards and as deemed necessary and suitable for any possible class or type of fires. Extinguishers shall be non-freeze type of not less than ten pound (5KG) capacity each.

- Provide protection against rain, wind, or heat so as to maintain all work, materials, apparatus, and fixtures, incorporated in the work or stored on the site, free from injury or damage. At the end of the day’s work, cover all new work and existing installations likely to be damaged as a result of the construction activities (i.e. roofing work).

- Contractor shall acquaint themselves with the location of utilities, which may be encountered or be affected by work, and shall be responsible for damage caused by neglect to provide proper precautions or protection. If needed, the contractor shall contact any local authorities or utility companies to locate any utility service, (and pay for their services if needed).

- Provide, erect and maintain all required barricades, of sufficient size and strength necessary for protection of material storage, as well as to prevent accidents to the public and the workmen at the job site.

- Report all injuries to any person and damage to any property not belonging to the contractor immediately to the COR (Contracting Officer Representative). Compensation to any third party affected by the construction activities (such as damage to private property) shall be the exclusive responsibility of the contractor.

- Contractor shall have a minimum of 5 new hard hats available at the job site for the official visitors.

6.10. Coordination

All coordination with the beneficiary shall be the responsibility of the contractor. The Contracting Officer shall be notified of any disputes between agencies or approvals that will affect Contract duration or Contract Price.

The contractor shall include into their bid the fact that the hospital will continue its operation during the performance of the works. If the Contract Option-1 is awarded, the works will be performed in two phases, each phase corresponding to each CLIN. If the contract option is not awarded, the works will be performed in one single phase. However, the hospital shall remain operational and the contractor shall provide the necessary dust protection to avoid any dust from entering into operational areas of the hospital.

The contractor is responsible to move the furniture from the areas to be renovated to a location to be provided by the beneficiary, within the Municipality of Taraclia. The contractor is not responsible in case something is damaged or broken during the transportation. If something is too delicate or fragile, the beneficiary shall move it themselves or assume responsibility in case it is damaged by the contractor. Once the works are completed, the contractor is responsible to make everything back to its original location. The contractor is not responsible for cleaning equipment or furniture to be moved.

All works shall be closely coordinated with the beneficiary.

6.11. Responsibility and Ownership of Removed Materials

All refuse or salvaged materials are the property of the beneficiary (Hospital Administration), and therefore they shall be moved to a location within the plot of land of the hospital facility. Prior to moving them to the location to be indicated by the beneficiary, they shall be properly cleaned. The contractor shall not be held responsible in case something is damaged or broken during its removal or transportation. This applies to elements such as the old doors, piping of lighting fixtures.

Those elements that are not requested by the beneficiary shall become the property of the Contractor and shall be disposed of, off-site, in accordance with applicable Moldovan regulations. The Contracting Officer Representative may ask for receipts of proper disposal of debris, or excess materials.

6.12. Special Site Conditions

Confine all operations, equipment, apparatus and storage of materials, to the immediate area of work to the greatest possible extent. Contractor shall ascertain, observe and comply with all rules and regulations in effect on the project site, including, but not limited to parking and traffic regulations, use of walks, security restrictions or hours of allowable ingress and egress.

6.13. Language

All communication and correspondence between the contractor and the Government personnel shall be in English. It shall be the responsibility of the Contractor to prepare proposals, invoices, shop drawings and submittals, quality control reports, computations, and all correspondence pertaining to this contract, in the English language; but the Contractor may, for his own record purposes, prepare them in the local language. All correspondence to and from the Contracting Officer shall be in the English language. In case of dispute or claim, the English version will govern.

Immediately after award, the contractor shall appoint an English speaking representative, with cellular phone and e-mail address. The Contracting Officer Representative reserves the unilateral right to disapprove this person if it is found that his English language capacity is not sufficient to perform the duties required for such position.

For the visits of the Contracting Officer, the PM or their authorized representative to the job site, the contractor shall provide somebody capable of representing the construction company who can communicate in English language or the contractor shall provide a translator to translate from English to local languages.

6.14. Submittals – Technical Information

The contractor shall provide technical information on all materials and equipment to be incorporated to the job site. This information must be sent to and accepted by the COR before they are purchased by the contractor. Any material or equipment utilized at the job site that is not approved by the representative of the Contracting Officer and that if found not to comply with the requirements of this contract (or Moldovan Legislation) shall be removed at no cost to the US Government.

6.15. Deliverable

The contractor shall provide for acceptance to the COR, as a minimum the deliverables listed in the tables below. For all technical deliverables/submittals, the contractor’s quality control representative shall certify that each proposed product meets the technical requirements listed on this Performance Technical Specifications.

6.16. Pictures

The contractor shall send weekly and representative digital pictures of their construction by e-mail once construction starts, showing construction progress. These pictures shall be used to monitor the contractor’s performance and to validate the progress monthly invoices. The US Government will not process payments unless the contractor provides complete and verifiable evidence of the work performed.

Failure to provide updated pictures will impact the ability of the Contracting Officer to validate and therefore to pay for the invoices.

6.17. Certifications, Licenses, Permits, Fees, etc. The contractor shall be legally capable of performing construction and design works in Moldova, as required by Moldovan regulations. The contractor shall possess the necessary licenses and authorizations in order to be able to perform the design and construction activities described in this document in strict compliance with Moldovan legislation.

All workers employed or performing any works for this construction project shall be legally capable of performing such works in Moldova. This includes work permits for any worker who is not a legal resident in Moldova.

The Contractor shall be responsible for determining, processing, requesting and paying all fees associated with, and obtaining any required permits for this project including, but not necessarily limited to permits for on-site and off-site hauling, demolition/disposal, construction activity, utilities, communications, etc. The contractor is responsible for acquiring any required certifications (licensing). Coordinate all permit requirements with the COR. Submit all completed permit application material, and associated back-up material, required to operate facilities, to the Contracting Officer for approval prior to agency submission. Contractor shall be responsible for complying with environmental laws, regulations and requirements. The Contracting Officer Representative may require at any time evidence of proper construction licensing of the contractor.

Coordinate all permit requirements with the competent local authorities or with the COR as required. Submit all completed permit application material, and associated back-up material, required to operate facilities, to the Contracting Officer for approval prior to agency submission. Contractor shall be responsible for complying with environmental laws, regulations and requirements.

6.18. Quality Control Plan

Within the timeframe allowed for the submission of documentation before starting the works, the Contractor will prepare and submit a Quality Control Plan describing personnel, procedures, tests and installation techniques that he plans to perform to ensure the quality required by these Technical Requirements and his design is obtained.

The Quality Control Plan shall include the name and qualifications of the person responsible for the quality of the works

In Annex 1, it is included a guideline to prepare this Plan.

6.19. Construction Sign

Immediately after award the contractor shall prepare and install on site a construction sign with the following characteristics and information on it:

- Wood / plasticized sign with minimum dimensions 2.5 meters wide by 1.5 meter high

- Letters and logos prepared by an specialized company and designed for outdoor installation

- Flags of Moldova and the United States of America

6.20. Payment

Payment shall be performed as required by US Administrative Requirements. See Contract Clauses pertinent to Payment procedures.

** NO ADVANCE PAYMENT IS AUTHORIZED **

Payment shall be performed following the principle of payment for completed work. Payment shall be phased as detailed herein:

- Design shall not exceed 6% of the construction price for each element of work for which the design is done.

- Partial monthly payments as agreed with the COR, and in accordance with the Schedule of Prices as described in section 6.21.

- Maximum of 80% (cumulative) is authorized until the final inspection is completed and all potential deficiencies are corrected. No payment over 80% is authorized until all work included in the contract is completed.

- Final invoice (100%) shall be paid once final inspection is completed and all potential defects identified in the final inspection are properly corrected.

Together with each invoice, the contractor shall provide:

- Official invoice

- Cost breakdown to justify the amounts for which the contractor is requesting payment

- Filled Contractor’s Safety Self Evaluation Form

- Invoice Statement: With this text signed by a responsible person from the company (ideally the one that signed the contract):

I hereby certify, to the best of my knowledge and belief, that:

(1) The amounts requested are only for performance in accordance with the specifications, terms, and conditions of the contract;

(2) All payments due to subcontractors and suppliers from previous payments received under the contract have been made, and timely payments will be made from the proceeds of the payment covered by this certification, in accordance with subcontract agreements and legal requirements of the Republic of Moldova;

(3) This request for progress payments does not include any amounts which the prime contractor intends to withhold or retain from a subcontractor or supplier in accordance with the terms and conditions of the subcontract; and

(4) This certification is not to be construed as final acceptance of a subcontractor’s performance.

Progress payment shall only be authorized if COR verifies on site the amount of work performed, or if the contractor proves with sufficient pictures and documentation that the work was actually performed as required by the contract. COR will disallow from the requested amount those portions of the invoice that the contractor does not prove that they were performed as required by the contract.

6.21. Schedule of Prices

In order to process the invoices, the contractor shall submit a Schedule of Prices to the COR for acceptance. This document shall include the main elements of the construction contract, and in the invoices the Contracting Officer Representative and Project Manager of the contractor shall agree on the percentages executed for each of the line items.

Only elements that are tangible and incorporated into the finished project shall be authorized. The value of all items shall be properly distributed. Front-in loading the Schedule of Prices is not authorized.

No invoice shall be processed until the Schedule of Prices is accepted by the Contracting Officer Representative.

6.22. Utilities

The contractor shall estimate that they will need to provide all required utilities for the construction phase of the project.

They shall provide a temporary connection to the general electrical utility network with an electric meter or they will need to provide generators. The contractor is responsible to provide or pay for their energy consumption, including heating.

The contractor cannot use any utilities from the hospital complex.

The contractor is responsible to provide their own sanitation facilities for the workers.

6.23. Damages/Impact to Existing Facilities

The contractor is responsible to repair any damage or impact caused by their construction activities to any premises. This includes potential damages such as:

- Damages to the roads

- Damages or disturbances to any soils around the job site.

- Damages to any hospital complex building

- Damages to any utility infrastructure, such as electrical cables, water lines or communications cables.

6.24. Cleaning

Contractor shall keep premises free of accumulations of surplus materials and rubbish caused by their operations. Combustible rubbish shall be removed from the premises each day. Burning of rubbish on premises is not permitted. In addition, the Contractor shall perform final cleaning to remove all foreign matter, spots, soil and construction dust, so as to put the project in a complete and finished condition ready for acceptance and use intended.

All waste areas and storage areas will be cleaned up to the COR’s satisfaction. All excess materials will be removed from the site and the Contractor will leave the premises free of debris and excess waste materials. Any garbage of debris to stay at the job site for more than one day will be stored in proper approved containers, properly separated from general public. Stockpiling debris and garbage directly on the ground is not acceptable, but the contractor shall provide adequate metal containers.

6.25. Spare Parts and Materials

The contractor will provide spare parts for all new materials to be incorporated to the job site. They shall provide a total of:

- 1 lamp of each type utilized for this project,

- 5 m² or 5% of each type of flooring or ceramic tile utilized

- 20 liters of each type of paint to be used,

- other typical materials that were used in this construction project that may be used for the user of the facility for maintenance purposes

6.26. Warranty and Training

The completed works shall have the warranty periods required by Moldovan regulations, which under no circumstance shall be less than one year general warranty and 10 years for any water infiltration (i.e. for the showers to be provided). The contractor shall provide the warranty letter to the competent Moldovan authorities with a copy to the Contracting Officer Representative and to the US Embassy representative. The start date for the warranty is the day when all works are accepted by the US Government, not when the different tasks are completed.

The contractor shall notify the US Government representative at least two months in advance of the proposed final inspection date.

As part of this contract, the contractor shall provide formal training to the beneficiary representatives as part of the turn-over procedure. Prior to turning over the keys of the new facilities, the contractor shall provide not less than 8 hours (1 working day) of formal maintenance training of the facility. The contractor shall provide the services of specialized personnel for the maintenance of the heat pumps. The beneficiary shall sign the attendance sheet rooster after each day of formal training.

6.27. Close-Out Procedure

In order to close the project, the following is necessary:

The contractor shall follow this procedure in order to close-out the contract:

1) Work completed at the construction site. Contractor shall notify the Contracting Officer at least with 60 days advance noticed of when the project will be ready for final inspection.

2) COR receives Acceptance Act signed by all required Moldovan Government agencies, as stated in the Law. This document should be available during the final inspection. Acceptance Act to be signed by the competent local authorities and the end user.

3) Contracting Officer to receive copies of documents to certify that of the warranty letter, a copy of the folder with all construction documents, the spare parts lists signed by the beneficiary, training attendance sheets, the as-built drawings, and other related documentation. In total, the contractor shall provide 2 books, packages or boxes containing all technical, maintenance and administrative documentation of the contract. One box to remain in Taraclia and the other to be sent to the US Embassy in Chisinau.

4) Final Inspection by COR and beneficiary representatives.

5) If any defects are identified during final inspection, the contractor to show evidence of proper correction.

6) Once all defects (if any) are corrected, contractor to submit and COR to process final invoice.

7) Contracting Officer to send official Beneficial Occupancy Date Letter.

Annex 1: Guideline to Prepare the Quality Control Plan

Immediately after award, the contractor shall prepare a Quality Control Plan following the guideline and format provided in this Annex 1. This is in addition to any quality control plan or documentation that may be required by Moldovan regulations for this type of construction activity. The Plan shall be accepted by the Contracting Officer before works are authorized to start at the job site.
