He seeks an order of certiorari to quash the Secretary of States refusal to exercise the Royal Prerogative of Mercy (“RPM”) to remit the 20 year sentence imposed upon him following his conviction on 6 April 2011 for the attempted murder of a part-time soldier in 1981. Background [2] On 13 June 1981 the applicant, as a member of the Provisional IRA (“the IRA”), took part in an ambush near Ballygawley. Mr Brush, a member of the Ulster Defence Regiment, was shot and injured. Mr Brush returned fire and the applicant was also shot and was admitted to hospital on the same day where he was kept under guard. On 27 June 1981 the applicant escaped from hospital and went “on the run.” He was not, however, charged with the shooting until 2007. [3] During the 1980s, while on-the-run, the applicant was involved in purchasing weapons for the IRA. On 30 August 1988 he was arrested as he crossed the Dutch/German border in a motor vehicle. Following a routine vehicle check, two AK47 rifles were found in the applicant’s car. He was charged in Germany with involvement in a series of bomb and gun attacks committed on behalf of the IRA.

A member of the public who witnessed the offence pointed the applicant out to an army patrol. Following his arrest and caught red-handed with the murder weapon, the applicant pleaded guilty at Belfast City Commission on 11 February 1975. He was sentenced to life imprisonment. The only possible motive for this murder was the victim’s religion. After approximately 16 years he was released from prison on licence in July 1990. The applicant’s evidence is that after his release, he consciously decided to “move away from violence” and paramilitary activity. That he went to university and became heavily involved in youth and community work, including cross-community work. In short, that he left his past life behind him. [2] However, the murder of Mr McIlroy was not the only murder committed by the applicant. On 30 September 1973 he murdered Eileen Doherty at Annadale Embankment, Belfast. The factual background to that murder included the use of a hijacked taxi which was later found and from which palm prints were taken. Years later and in 2009, improvements in technology and the work of the Historical Enquiries Team, led to the electronic matching of the prints to the applicant.

This report presents a gap analysis of current measures used for the prevention of violent extremism and radicalisation across European countries. It provides an overview of the vari- ous risk factors linked to radicalisation and analyses whether these have been ad-dressed in current prevention tools. The respective gaps between radicalisation and violent extremism and its prevention are presented. Areas of counter-radicalisation are still underdeveloped in Europe. Prevention measures tar- geting online-radicalisation, vulnerable groups and prison populations exist but only on a small scale. In contrast, it has been identified that prevention tools significantly target the social, moral and cultural development of young populations. The risk factors mentioned in the report are not recognised as single triggers of radicalisa- tion and are to some extent interlinked with one another. Counter-radicalisation and measures to curtail violent extremism should increase the development of tools and initia- tives that target all pathways to radicalisation. The report is the second of a sequence of three reports that together will produce policy recommendations for the prevention of radicalisation in Europe.
