Instructions TALBOT COUNTY 2021 HMCRP UPDATE MITIGATION ACTION ITEMS STATUS UPDATE Instructions Please complete the fillable sections for each of the twenty-four mitigation actions progress report forms, contained herein, that your department, agency, or organization was listed as a responsible entity. SP&D is requesting updates on a total of 24 action item projects. Each of the contained forms includes pertinent project information as well as the following items we are seeking feedback on: (1) Your Contact Name, (2) Your Contact Phone & Email, (3) Project Status, including anticipated completion date, and (4) Answers to the following four questions: 1. What was accomplished for this project during this reporting period (2017-2021)? 2. What obstacles, problems, or delays did the project encounter? 3. If incomplete, is the project still relevant? Should the project be changed or revised? 4. Other Comments For your convenience, a table has been included below directing you to those mitigation actions that your department, agency, or organization was listed as a responsible entity. Please do not be overwhelmed by the total number of forms, on average each entity will complete 4 mitigation progress report forms based on the table below. Although owners are not required to bring the existing building into compliance, elevation is the best way to reduce vulnerability. There are many other things owners can do to reduce future flood damage: • Use flood resistant material, for example tile, closed-cell wall insulation, and polyvinyl wall coverings. • Raise air conditioning equipment, heat pump, furnace, hot water heater, and other appliances on platforms. • Install electrical outlets higher above the floor. • Move ductwork out of crawlspaces. • Retrofit crawlspaces with flood openings. • Fill in below-grade crawlspaces/utility space. • Raise windowsills and entryways above Base Flood Elevation (BFE) for stores located in floodplains. According to the Institute for Business and Home Safety, an estimated 25 percent of businesses do not reopen following a major disaster. You can protect your business by identifying the risks associated with natural and man-made disasters, and by creating a plan for action should a disaster strike. By keeping those plans updated, you can help ensure the survival of your business. However, an evacuation destination listing for flood events has not been created. The listing below would not be utilized for flood events considering several of the facilities are in the Hurricane evacuation zones and/or the Special Flood Hazard Area (SFHA).     Maryland’s Lower Choptank River Cultural Resource Inventory by Ralph E. Eshelman and Carl W. Scheffel, Jr. “So long as the tides shall ebb and flow in Choptank River.” From Philemon Downes will, Hillsboro, circa 1796 U.S. Geological Survey Quadrangle 7.5 Minute Topographic maps covering the Lower Choptank River (below Caroline County) include: Cambridge (1988), Church Creek (1982), East New Market (1988), Oxford (1988), Preston (1988), Sharp Island (1974R), Tilghman (1988), and Trappe (1988). Introduction The Choptank River is Maryland’s longest river of the Eastern Shore. The Choptank River was ranked as one of four Category One rivers (rivers and related corridors which possess a composite resource value with greater than State signific ance) by the Maryland Rivers Study Wild and Scenic Rivers Program in 1985. It has been stated that “no river in the Chesapeake region has done more to shape the character and society of the Eastern Shore than the Choptank.” It has been called “the noblest watercourse on the Eastern Shore.” Name origin: “Chaptanck” is probably a composition of Algonquian words meaning “it flows back strongly,” referring to the river’s tidal changes1 Geological Change and Flooded Valleys The Choptank River is the largest tributary of the Chesapeake Bay on the eastern shore and is therefore part of the largest estuary in North America. This Bay and all its tributaries were once non-tidal fresh water rivers and streams during the last ice age (15,000 years ago) when sea level was over 300 feet below present. As climate warmed and glaciers melted northward sea level rose, and the Choptank valley and Susquehanna valley became flooded.

Booth IMPOSITION OF CIVIL PENALTIES – ORIGINAL JURISDICTION OVER ADJUDICATION OF PENALTIES IN THE MARYLAND COURTS – JURISDICTION OF BOARD OF APPEALS ESTABLISHED BY CHARTER COUNTY. Talbot County had no authority to confer subject matter jurisdiction upon its Board of Appeals to consider an administrative appeal of civil penalties assessed by the Talbot County Chief Code Compliance Officer. The Maryland General Assembly has not vested boards of appeal established by charter counties with authority to review or consider civil penalties assessed by a code enforcement officer for violations of a county code. Under the applicable Maryland laws, the authority to adjudicate civil penalties arising from violations of a local code enacted by a charter county is within the original jurisdiction of the courts. Because this case originated in the Talbot County Board of Appeals, which did not have jurisdiction over the matter that was the subject of the administrative appeal, the Court of Appeals vacated the judgment and remanded the case to the Board of Appeals with instructions that its decision be vacated and that the assessments be dismissed.
