NEW FOREST NATIONAL PARK AUTHORITY MINUTES OF PLANNING DEVELOPMENT CONTROL COMMITTEE MEETING HELD ON TUESDAY 21 JUNE 2011 AT 09.30 HOURS IN THE MEETING ROOM, SOUTH EFFORD HOUSE, MILFORD ROAD, LYMINGTON Present: Members: Pat Wyeth (Chairman) Tony Gentle (Deputy Chairman) Clive Chatters Maureen Holding Ted Johnson Clive Maton Bob Morris Leo Randall Alan Rice John Sanger Officers: Steve Avery Director of Park Services Julia Mutlow Senior Solicitor and Monitoring Officer Rob Ainslie Development Control Manager Mark Funnell Senior Planning Officer Clare Ings Senior Planning Officer Rosalind Alderman Member Services Officer Vicki Gibbon Administration Assistant 87 Apologies for Absence 87.1 Apologies for absence were received from Peter Frost, Vicky Myers, Barry Rickman and Alan Weeks. 88 Declarations of Interest 88.1 Bob Morris declared a personal interest in Minute item 5, Report Items 1 and 2, as a member of Landford Parish Council. 88.2 John Sanger declared a personal interest in Minute item 5, Report Item 3, as the applicant was known to him. 88.3 Clive Chatters declared a prejudicial interest in Minute item 5, Report Item 7, as his employer owned land that would be affected by the application and he had been involved in discussions with colleagues as Planning Development Control Committee Meeting Minutes of meeting on 21 June 2011 to the relative merits of the proposals and the interpretation of the Habitats Regulations. He was not present for the debate and vote on that item. 88.4 Alan Rice declared a personal interest in Minute item 5, Report Item 7, as a member of the Lymington to Keyhaven Coastal Area Management Committee. 88.5 Members who were also members of New Forest District Council also declared a personal interest in Minute item 5, Report Item 7, as the planning Development Control Committee of the District Council would be considering a related application on the following day. 89 Minutes RESOLVED: That the minutes of the meeting held on 17 May 2011 be approved. 90 Chairman’s Announcements 90.1 The Chairman announced that it was Clive Chatters’ last meeting as a Committee member as he would shortly be standing down as an Authority member, and thanked him for all his input to the work of the Committee. 90.2 The Committee adjourned briefly for refreshments between 11.25 and 11.35 am and again between 12.00 pm and 1.00 pm. 91 Planning Applications for Committee decision (Paper NFNPA/PDCC 93/11) 91.1 Members gave detailed consideration to the individual planning applications contained within the report. RESOLVED: That the planning applications listed below be determined as shown in respect of each application and, in accordance with the Authority’s policies and procedures, formal notice of the decisions to be sent to the applicants forthwith. REPORT ITEM 1 Application No. 11/96148/FULL Full Application Installation of 5MW ground mounted solar photovoltaic Details panels; sub station; transformer/inverters - Land Of Home Farm Known As Big Field, Hamptworth Estate, Salisbury, SP5 2DS Declarations of Bob Morris (personal) interest Mr Guy Anderson, Hamptworth Estate Public Mr Graham Baker, New Forest Association participants Cllr. Sue Bennison, Bramshaw Parish Council Cllr. Bill Dunn, Redlynch Parish Council 2 Planning Development Control Committee Meeting Minutes of meeting on 21 June 2011 Members felt that this application was finely balanced, in Comment terms of both the need to source renewable energy and the high level of protection over the National Park’s landscape. It was noted that the Park had a limited capacity to absorb developments of this type and it was necessary to be aware of the cumulative impact of proposals on this scale. A proposal was made to refuse this application but was not carried; Members subsequently voted in favour of the officer’s recommendation. Planning consent granted subject to conditions. Decision 1. The development hereby permitted shall be begun Conditions before the expiration of three years from the date of this permission. Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. 2. No development shall take place until details of the photovoltaic collectors, location of CCTV cameras, substation infrastructure buildings, fencing, boundary treatment and access arrangements have been submitted to and approved by the New Forest National Park Authority. Reason: To ensure an acceptable appearance of the building in accordance with Policy DP1 of the New Forest National Park Core Strategy and Development Management Policies (DPD) (December 2010). 3. Within 25 years of the date of this permission or on the cessation of the use of the land for the generation of renewable energy, whichever is the sooner, the land shall be restored to a condition which has first been agreed by the New Forest National Park Authority. Reason: To protect the amenities of the area in accordance with Policy DP1 of the New Forest National Park Core Strategy and Development Management Policies (DPD) (December 2010). 4. No development shall take place until a scheme of landscaping of the site has been submitted to and approved in writing by the New Forest National Park Authority. This scheme shall include: (a) the existing trees and shrubs which have been agreed to be retained; 3 Planning Development Control Committee Meeting Minutes of meeting on 21 June 2011 (b) a specification for new planting (species, size, spacing and location); (c) areas for hard surfacing and the materials to be used (d) other means of enclosure; (e) location of trench for CCTV cable and depth/width of trench; and (f) a method and programme for its implementation and the means to provide for its future maintenance. Reason: To ensure that the development takes place in an appropriate way and to comply with Policy DP1 of the New Forest National Park Core Strategy and Development Management Policies (DPD) (December 2010). 5. All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner. Any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size or species, unless the Local Planning Authority gives written consent to any variation. Reason: To ensure the appearance and setting of the development is satisfactory and to comply with Policy DP1 of the New Forest National Park Core Strategy and Development Management Policies (DPD) (December 2010). 6. No development shall take place until a final plan for mitigation and compensation to include the measures set out in the GPM Ecology Report dated 19 April 2011 and the following: i. Delivery of measures for breeding waders within the quarry restoration to include protection of breeding area by use of ditch and provision of wader shingle nesting feature similarly protected by water (i.e. island or shingle bar) ii. The area of over-wintering stubbles to be provided to be increased to 12ha iii. Lifetime of the Conservation Management Plan Ecological Management Committee to cover the duration of the development and involve representation of the Authority at all times, all measures to be subject to the agreement of the Authority. 4 Planning Development Control Committee Meeting Minutes of meeting on 21 June 2011 Development shall only proceed in accordance with these approved details. Reason: To safeguard protected species in accordance with Policies DP1 and CP2 of the New Forest National Park Core Strategy and Development Management Policies (DPD) (December 2010). 7. No external lighting shall be installed on the site before details of such proposals have first been submitted to and approved by the New Forest National Park Authority. Reason: To protect the amenities of the area in accordance with Policies DP1 and CP6 of the New Forest National Park Core Strategy and Development Management Policies (DPD) (December 2010). 8. No development shall take place until a written scheme for a programme of archaeological investigation and/or recording has been submitted to and approved by the local planning authority in writing. The written scheme shall include: i. site investigation in accordance with the agreed scheme and programme. ii. proposals for post-investigation assessment and analysis of the results. iii. proposals for post-investigation analysis, submission of a publication report, preparation of site archive and deposition at a museum store approved by the Planning Authority. Reason: The development is located in an area of archaeological significance where the recording of archaeological remains should be carried out prior to the development taking place in accordance with Policy DP1 of the New Forest National Park Core Strategy and Development Management Policies (DPD) (December 2010) and PPS5 ‘Planning for the Historic Environment’. 9. The development hereby approved shall not take place until the arrangements to be taken for the protection of the trees and hedges on the site, in accordance with the submitted report by Wessex Woodland Management Limited March 2011, have been implemented. 5 Planning Development Control Committee Meeting Minutes of meeting on 21 June 2011 Reason: To safeguard trees and natural features which are important to the visual amenities of the area, in accordance with Policies DP1 and CP2 of the New Forest National Park Core Strategy and Development Management Policies (DPD) (December 2010). 10. Forestry operations within compartments BF2, BF3 and BF4 of the submitted plans and report (Wessex Woodland Management Limited March 2011) shall be carried out in accordance with management plans to be agreed by the National Park Authority until the site is decommissioned.
