NSW Legislative Council Election 2007

Summary

This paper summarises the results of the 2007 election for 21 members to serve in the New South Wales Legislative Council. The 2007 election was the second to be conducted under a new electoral system introduced in the wake of the 1999 ‘table cloth’ ballot paper election.

The new system retained the existing ballot paper format, where voters could choose to vote ‘below the line’ for candidates or ‘above the line’ for parties using the Group Voting Square option. However, the new electoral system abandoned the tickets of preferences that had previously been imputed for any ballot paper marked using the group voting square. Between group preferences controlled by party tickets were abolished.

To have a group voting square, parties now needed to run full tickets of at least 15 candidates, and a single ‘1’ in a group voting square now only implied preferences for the candidates in that group. Voters were given a new voting option to indicate preferences for parties using the group voting squares. Preferences were implied for all the candidates in the first chosen group, then the second chosen group, and so on. The new system abolished party control over preferences and meant the only preferences in the system were those filled in by voters themselves.

This publication consists of five sections.

Section 1 contains the overall state-wide count and details of the distribution of preferences. Section 2 lists the Legislative Council results for each electoral district, and also provides a summary of vote by region. Section 3 provides more detail on the vote for each party by electoral district, with ordered tables of vote received in each electorate. Section 4 consists of summary tables comparing the vote for selected parties by electorate between the Legislative Assembly and Legislative Council. Section 5 provides some analysis by electorate of the incidence of ‘above the line’ voting.

While all calculations and analysis of preference flows are based on the results provided by the NSW Electoral Office, all calculations remain the responsibility of the author.

The 1999 election saw 264 candidates and 80 groups nominate for election. Following the introduction of the new electoral system for the 2003 election, the number of candidates rose to 284, but the number of groups on the ballot paper fell to a more manageable 15. In 2007 there was an increase to 19 groups, the extra groups lifting the number of candidates to 333.

As with the 2003 election, preferences played no part in the final result of the election. Under the old group ticket voting rules that applied until 1999, preferences flowed strongly between groups on the ballot paper as more than 90% of votes had been cast using the group voting option. Under the new system which abolished preferences between parties except for those filled in by voters themselves, 80-90% of preferences from minor parties exhausted after the exclusion of the final candidate. There were no exclusions that saw group votes of the Labor, Liberal/National, Greens or Christian Democrats distributed, so it is not possible to assess whether the more active encouragement of voters to distribute preferences had any effect on voter behaviour.

The filling of the first 17 vacancies was entirely determined by the number of full quotas achieved by each party or group. The final four vacancies went to the four parties with the highest vote tallies after the election of the candidates with full quotas. Despite a process that required the distribution of preferences from more than 300 excluded candidates, the order in which the final candidates were elected was exactly as could have been determined from the initial tally of first preference votes.

Two candidates received no votes, Mile Klindo (Group D) and Luke Williams (Group F). Two other candidates received only a single vote, Tricia Clayton (Group H) and Chris Ripoll (Group M). A total of 96 candidates received less than 10 votes, 167 less than 20 votes, 244 less than 50 votes, and 274 candidates received less than 100 votes. Only 20 of the 333 candidates received more than 1,000 votes, the eighteen lead candidates of the groups that had a group voting square on the ballot paper, plus Dawn Fraser at the top of the Ungrouped column and Ian Macdonald who appeared second on the Labor ticket. Group D did not register a Group Second Preference and therefore did not have a group voting square. Group D polled only 456 votes, its lead candidate Nick Beams polling 338 votes. Only 11 candidates received more than 1,000 votes ‘below the line’. These were John Della Bosca (Labor) 8935, Lee Rhiannon (Greens) 8510, Charlie Lynn (Liberal) 7463, Fred Nile (Christian Democrat) 5053, Dawn Fraser (Ungrouped) 4460, Arthur Chesterfield-Evans (Australian Democrat) 2835, Roy Smith (Shooters Party) 1976, Janey Woodger (Australians Against Further Immigration) 1511, Patrice Newell (Group F) 1492, Nell Brown (Group A) 1310 and Ian Macdonald (Labor) 1083.

Counts 1-17 After the tallying of first preference votes and the determination of a quota at Count 1, the next 16 counts dealt with the surplus to quota votes of the lead candidates on the Labor, Liberal/National and Green tickets. This process elected 16 members, eight from the Labor group, seven from the Liberal/National group and one Green. By count 17, 651 votes had leaked out of the Labor ticket, 810 from the Liberal/National ticket and 403 from the Greens ticket. Major beneficiaries were the Australian Democrats (518), Christian Democrats (382) and Group F Climate Change Coalition 166.

Counts 18-312

At the end of Count 17, no candidate remained with more than a quota in their own right. The group total for the 20 remaining Green candidates was more than the quota, but the total of votes with the highest remaining Green candidate John Kaye fell just short of a quota. Kaye would not be elected until Count 312 when the second last Green candidate Wendy White was excluded, her preferences finally putting Kaye over a quota.

Count 18 was the first count where a candidate was excluded. It was count 100 before the first candidate with 10 votes was excluded, Count 151 before the first candidate with 20 votes was excluded, Count 221 before the first candidate with 50 votes was excluded, and it was Count 261 before the exclusion of the first candidate with 100 votes. The below-the-line votes for the final Group D candidate Nick Beams were excluded at Count 304 when 326 of his 410 votes exhausted.

At Count 312, the Green’s Wendy White was excluded, preferences finally putting the second Green candidate John Kaye over the quota (Elected 17). The following table shows the totals at the end of Count 312. The quotas for the 17 candidates already elected have been excluded.

Count 313 distributed John Kaye’s tiny surplus. Count 314 excluded Labor’s Rob Allen, Count 315 the Liberal Party’s Sarah Lawrence, and Count 316 Labor’s Tony Keating. At the end of Count 316, 18 candidates remained in the count. No Green or Group D candidates remained, Dawn Fraser was the last Ungrouped candidate, and one candidate remained from each of the other 17 other groups on the ballot paper. All preference distributions beyond this point will include votes cast using the Group Voting Square option.

Count 329 elected Fred Nile but the distribution of his small surplus was deferred. Count 330 then excluded Arthur Chesterfield-Evans (Australian Democrats). However, with three vacancies to be filled and only three candidates remaining in the count, preferences did not need to be distributed. The remaining four candidates were declared elected in descending the order of their final tally of votes.

Summary of Counts 317-330

As explained in the description of the counts provided on the preceding pages, the last candidate from each party group was excluded between Counts 317 and 330. The consequence of the voting system introduced after the 1999 election is that the number of preferences flowing between groups has fallen dramatically at the 2003 and 2007 elections. Table 1.5 summarises the overall flow of preferences between Count 317 and Count 330. In total, 83.44% of all votes exhausted during these counts, with no single party receiving more the 5% of preferences distributed.

This is a dramatic reversal of pre-2003 elections, where the old group ticket voting method resulted in preferences flows of 80-90%. (See NSW Parliamentary Library Research Service Background Papers, “NSW Legislative Council Election 1995” (1996/2)” and “NSW Legislative Council Election 1999” (2000/2).)

As predicted, the new voting system clearly favoured parties with the highest surplus to full quota votes after the initial election of over-quota candidates. (See Library Background Paper “Prospects for the 2003 Legislative Council Election” (2003/3)) The order of the parties at Count 316 was the same as when ordered by surplus quota at Count 1. Between Count 316 and Count 330, the only change to order that occurred was that Labor’s Mick Veitch pass the Shooters Party’s Roy Smith.

Unlike the 1995 and 1999 elections, preferences played almost no part in determining the result of the election. As had occurred in 2003, around 80-90% of preferences exhausted at the exclusion of each candidate. The election of the final four vacancies was determined essentially by the number of primary votes received by each party, not by the distribution of preferences.

The data in Table 1.6 below shows that the incidence of ticket voting in 2007 and 2003 was essentially the same as in 1999. The decline in the number of votes distributed as preferences came about entirely due to the change in the way group ticket votes were implied as votes for candidates on the ballot paper, not because of a change in the way people voted.

The one caveat on this observation is that the top six polling parties never had a candidate excluded who at that point held the balance of the group ticket votes. When other parties were excluded, only 10-20% of voters had directed preferences. The top six parties all distributed how-to-vote material recommending preferences, so it may be that a higher proportion of Labor, Liberal/National, Green Christian Democrat, Shooters Party and Australian Democrat voters would have used the new voting option.

There was little difference between the incidence of ticket voting in 2007 and its incidence at previous election.

It is not known how many people in 2007 used the ‘above the line’ preference option introduced before the 2003 election. Given the high rate of exhausted preferences, it seems unlikely that its use could have been above 20% for any of the parties that were excluded during the count. It may have been higher for the six highest polling parties, but it is impossible to know as no remaining lead candidate of these groups has their preferences distributed.

Group second preferences are lodged by parties so that if the disqualification of a candidate causes a group to have less than a full list of 15 candidates, a second group can be specified to receive the flow of preferences from the first group. This requirement is a consequence of the constitution requiring 15 preferences for a formal vote. Group D did not have a group ticket voting square and so was not required to lodge a group second preference.

As no candidate was disqualified in 2007, none of the above flows of preferences were required.
