C 232/32EN Official Journal of the European Union 10.9.2008 Notification by the Hungarian Government under Directive 94/22/EC of the European Parliament and of the Council on the conditions for granting and using authorisations for the prospection, exploration and production of hydrocarbons (1) (Text with EEA relevance) (2008/C 232/09) 1. The Hungarian Office for Mining and Geology is launching an invitation to tender under Section 26/A(6)-(7) of Act No XLVIII of 1993 on mining (a bányászatról szóló 1993. évi XLVIII. törvény) and Section 12/B(2) of Government Decree 203/1998 (XII. 19.) implementing it (a bányászati törvény végrehajtásáról szóló 203/1998. (XII. 19.) Korm. rendelet) for the cancelled mining rights listed in point 2 below. Upon obtaining the mining rights (i.e. on entry into force of the decision designating the new rights holder), the holder of the mining rights will be authorised to conduct their operations in compliance with the provi- sions of the legislation governing this sector. Under the applicable law, the party awarded the mining rights must seek approval of a technical operational plan from the Mining Department before commencing operations. No actual operations may be carried out without an approved technical operational plan. Persons submitting applications must be able to prove that they purchased a copy of the detailed tender dossier from the Hungarian Office for Mining and Geology (available only at the Office in person). The tender dossier may be purchased at the presidential secretariat of the Hungarian Office for Mining and Geology (H-1145 Budapest, Columbus u. 17-23.) for HUF 25 000. The Hungarian Office for Mining and Geology bears no responsibility for any obligations or claims arising in connection with the mining rights other than as laid down in point 2 below and in the tender dossier. Applications for the mining rights of hydrocarbon mineral resources must be submitted by post to the presi- dential secretariat of the Hungarian Office for Mining and Geology (H-1145 Budapest, Columbus u. 17-23.) in triplicate, within 90 days of publication of this invitation to tender in the Official Journal of the European Union. Applications posted after the time limit will not be considered. All applications will be evaluated at the same time, within 30 days of the submission deadline. The Mining Supervisory Authority will issue a decision designating the successful tenderer and the new holder of the rights to the mining site. Information regarding the successful tenderer will be published on the website of the Hungarian Office for Mining and Geology (www.mbfh.hu). Main evaluation criteria: — the price offered to the State for acquisition of the mining site, — the financial suitability of the tenderer as demonstrated by the supporting documents. Applicants must provide assurance in the tender that they will comply with the obligations arising from the mining rights, particularly as regards landscaping and environmental and nature protection. 2.
