Applications processed pursuant to the streamlined procedure

In this public notice, the Commission publishes a list of applications involving transfers of ownership and changes in the effective control of broadcasting undertakings as well as applications for amendments or extensions of deadlines not requiring a public process, which it has processed during the period 1 September 2007 to 31 October 2007 pursuant to its streamlined procedure.

1. The Commission has a streamlined procedure for its consideration of applications involving transfers of ownership and changes in the effective control of broadcasting undertakings as well as applications for amendments or extensions of deadlines not requiring a public process. Under this procedure, and on a case-by-case basis, the Commission may approve or deny such an application without first having issued a public notice provided that:

a) its examination of the application reveals the presence of no significant policy concern; and

b) the Commission is convinced that approval or denial would be consistent with its approvals or denials of previous applications.

2. Where these two conditions are met, the Commission is generally satisfied that a process initiated by a public notice is not required in the public interest, and would unnecessarily delay implementation of the transaction contemplated or of other proposals by the applicant.

3. In the appendices to this public notice, the Commission publishes a list of applications involving transfers of ownership and changes in the effective control of broadcasting undertakings (Appendix 1) as well as applications for amendments or extensions of deadlines (Appendix 2) not requiring a public process, which it has processed during the period 1 September 2007 to 31 October 2007 pursuant to its streamlined procedure.

Appendix 1 to Broadcasting Public Notice CRTC 2007-135

Broadcasting ownership applications not requiring a public process that have been processed by the Commission pursuant to the streamlined procedure during the period of 1 September to 31 October 2007

2. 6166954 Canada Inc. 2007-1105-3 APPROVED – Transfer of the ownership and 10 October 2007 effective control of 6166954 Canada Inc. through the acquisition by 6559603 Canada Inc. of the shares held by William R. Craig and family in 6166954 Canada Inc.

6559603 Canada Inc. is a corporation jointly owned by James Shavick and Joy MacPhail.

6166954 Canada Inc. is licensee of the Category 2 specialty programming undertaking OUTtv, and of the Category 1 specialty programming undertaking HARDtv.

3. Phillip Koneswaran, on 2007-1492-4 APPROVED – Corporate reorganization at the behalf of a corporation 30 October 2007 level of PolarMedia Corp. (PolarMedia), the to be incorporated. parent corporation of the licensee to be incorporated (Phillip Koneswaran (OBCI)) through Radika Koneswaran’s acquisition of additional shares in PolarMedia. This transaction increases Radika Koneswaran’s voting interest in PolarMedia to 86.29% but does not affect the effective control of Phillip Koneswaran (OBCI), which will continue to be exercised by Radika Koneswaran.

The Hindu Network – Category 2 specialty service, Broadcasting Decision CRTC 2006-144, 18 April 2006, authorized Phillip Koneswaran (OBCI) to operate a national Category 2 specialty programming undertaking. That undertaking is not yet in operation.

3. Ottawa Media Inc. 2007-1216-8 APPROVED – Change in the authorized contours of 10 September 2007 CKHK-FM Hawkesbury, Ontario authorized in English-language FM radio station in Hawkesbury, Broadcasting Decision CRTC 2007-204, 27 June 2007.

4. Carl Gilbert, on behalf 2007-1220-0 APPROVED – Extension to 21 December 2007 of of a corporation to be 10 September 2007 the time limit to submit an application for the use of incorporated another frequency and technical parameters acceptable to both the Commission and the Department of Industry for the new French-language commercial FM radio programming undertaking authorized in French-language FM radio station in Saguenay (zone La Baie), Broadcasting Decision CRTC 2007-95, 21 March 2007. This is the final extension to be granted by the Commission.

5. Canadian Broadcasting 2007-1231-6 APPROVED – Change in the authorized contours of Corporation 17 September 2007 the transmitter CBZC-FM Bon Accord, New Brunswick.

MediaNet Canada Ltd. 2007-1303-3 APPROVED – Extension to 21 September 2008 of 1 October 2007 the time limit to commence operation of the national ethnic Category 2 specialty programming undertaking authorized in RTV (Russian Television) – Category 2 specialty service, Broadcasting Decision CRTC 2004-420, 21 September 2004. This is the final extension to be granted by the Commission.

MediaNet Canada Ltd. 2007-1305-9 APPROVED – Extension to 18 November 2008 of 1 October 2007 the time limit to commence operation of the national ethnic Category 2 specialty programming undertaking authorized in JTV – Jewish Television – Category 2 specialty service, Broadcasting Decision CRTC 2004-497, 18 November 2004. This is the final extension to be granted by the Commission.

10. Newcap Inc. 2007-1132-6 APPROVED – Extension to 31 March 2008 of the 25 October 2007 time limit for Newcap Inc. to divest its 50% interest in Metro Radio Group Inc. (Metro), as directed in CFDR Halifax – Conversion to FM band, Broadcasting Decision CRTC 2007-106, 4 April 2007. Metro is licensee of CKUL-FM Halifax, Nova Scotia.
