GLOSSARY Affected – Means affected household by the Project, consisting of such Household persons, his or her spouse, minor sons, unmarried daughters, minor brothers or unmarried sister, father, mother and other members residing with him/her and dependent on him/her for their livelihood. Displaced – In the context of involuntary resettlement, displaced persons Person (DP) are those who are physically displaced (relocation, loss of residential land, or loss of shelter) and/or economically displaced (loss of land, assets, access to assets, income sources, or means of livelihoods) as a result of (i) involuntary acquisition of land, or (ii) involuntary restrictions on land use or on access to legally designated parks and protected areas. Compensation – Payment in cash or kind of the replacement value of the acquired property. Grievance – The committee established under the subproject to resolve Redressal the grievances. Committee Involuntary – Addresses social and economic impacts that are permanent Resettlement or temporary and are (i) caused by the acquisition of land and other fixed assets, (ii) by change in the use of land, or (iii) restrictions imposed on land as a result of a project. Land Acquisition – The process whereby land and properties are acquired for the purpose of the project construction by invoking the land acquisition act. Rehabilitation – The measures provided under the resettlement plan other than payment of the compensation of acquired property. Replacement – The method of valuing assets to replace the loss at market Cost value before the Project or dispossession, or its nearest equivalent, plus any transaction costs such as administrative charges, taxes, registration, and titling costs. Replacement cost is based on the market value before the Project or dispossession, whichever is higher. Resettlement – All the measures taken to mitigate all or any adverse impacts of the Project on the DPs property and/or livelihoods including compensation, relocation (where relevant), and rehabilitation

1. Introduction and Project Description 1. The hydropower potential of Himachal Pradesh (HP) is about 27,436 MW, which is about one-fourth of the total hydropower potential of India. The Government of Himachal Pradesh (GoHP), in its Hydropower Policy (2007), has fixed its targets to harness hydropower with the goal to become the "hydropower state" of the country. The State's hydropower policy includes the development of infrastructures such as road access and transmission interconnections to facilitate hydropower generation and its further evacuation to encourage investment from the State, central government, and private sectors. The majority of the hydropower generation projects are run-off- the river type. Implementation of the hydro policy will improve state financial health by earning revenue from supplying surplus power to the National Grid. In addition to developing its hydropower resources, HP has to build out its electric transmission infrastructure so that the additional power can be efficiently transmitted within the State and exported to the national grid. 2. For improvement/strengthening of existing infrastructures and addition of new infrastructure for effective power evacuation, the GoHP, through the Government of India (GoI), has requested the Asian Development Bank (ADB) for a Multi-Tranche Financing Facility (MFF) to provide financial assistance to the power sector investment program in the State. The investment program covers investments for transmission of clean energy to the National Grid of India by the construction of pooling substations and extra-high-voltage (EHV) transmission lines. To implement this, the GoHP has established Himachal Pradesh Power Transmission Corporation Limited (HPPTCL) vide HP Government notification no. MPP-A (1)-4/2006-Loose dated 11 September 2008, and HPPTCL was declared as the State Transmission Utility (STU) vide notification no. MPP-A (3)-1/2001-IV dated 10 June 2010. 3. The $350 million investments in the MFF to be supported by Asian Development Bank (ADB) will contribute to support the economic development in HP through expanded power supplies from clean energy sources and support a sustainable state electricity sector in the State. The Himachal Pradesh Clean Energy Transmission Investment Program (HPCETIP) is expected to produce the following outcomes: i. Increase in availability of clean energy downstream at polling stations for effective power evacuation in a financially sustainable manner. ii. Improvement of state finances and power sector financial viability from sales revenue earned from power exports. iii. Improve power sector governance. iv. Improve capacity in HP Power Transmission Corporation Limited (HPPTCL) for better planning, implementation, and management of power evacuation infrastructure, and energy efficiency through a better power management program. v. Improvement in standards of environmental and social safeguards in the sector. With ADB support, the proposed program will sustain the energy sector reform agenda and is expected to help to attract other long-term financiers to the state. 4. Tranche 3 sub-projects are located in Chamba, Kinnaur, Kullu, and Shimla districts of Himachal Pradesh extends from the Shivalik Hills in the south to the Great Himalayan ranges, including a slice of trans-himalayas in the north. The state falls between latitude 30'22" and 30'12" north and longitude 75'45" and 79'04” East. It is located between the Ravi River in the west and the Yamuna River in the east. Its greatest length is 355 Km from the north-western extremity of Chamba to the south-eastern tip of Kinnaur, and the maximum width is 270 Km from Kangra in Southwest to Kinnaur in the northeast. The altitude ranges from 450 to 6500 meters above mean sea level, which increases from West to East and

2. Project Components 5. Tranche 3 subprojects, with physical components, consist of 4 proposed new substations/pooling stations and 5 transmission lines. A. Construction of Substations: (i) 66/22 kV GIS substation at Nirmand (Bagipul) (ii) 132/220 kV GIS substation at Mazra (Distt.Chamba), (iii) 220 kV Pooling substation at Hatkoti and (iv) 220 kV Pooling substation at Barsaini. B. During the implementation of the subproject, few components has been included in the scope of works. The details are (i) Augmentation of existing 220/132 kV Kangoo Sub Station and stringing of 2nd circuit of 220 kV S/C line (3.2 Km) on D/C Towers from Dehar Power House of BBMB to Kangoo sub-station in Mandi district (ii) Construction of 2 No. AIS Bays in the existing 220/66kV Baddi substation and loop-in and loop-out (LILO) 2nd circuit of 220 kV Kunihar to Panchkula transmission line (2.5 Km) at Baddi sub-station in district Solan ((iii) Construction of 66/220 kV, 80/100 MVA transformer in 400/220 kV Gumma sub-station in district Shimla (iv) Creation of a joint control and operations center for transmission line assets in district Solan and Sirmaur (v) LILO of 132 kV D/C Kurthala-Bathri line (3.5 Km D/C) at Mazra sub-station in district Chamba. 7. The field-based due diligence was carried out for additional works with the objective to identify resettlement (permanent or temporary) impacts on titled/non-titled households, if any caused during the execution. The due diligence report is attached in Annexure 1 and the location of the proposed sites is provided in Annexure 2 to 8.

3. Purpose of the Report

8. The purpose of the semi-annual social monitoring report (SMR) is to analyze periodically over the total implementation period of the Project to comply with the approved safeguard documents. This report covers resettlement and social safeguard monitoring results to comply with the spirit of ADB policy to 'enhance stakeholders' trust 'in and ability to engage with ADB and thereby increase the development impact (of projects) in which disclosure of safeguard monitoring is a prominent aspect. This report covers the status of resettlement implementation and addressing all the issues related to social safeguards, with reference to the progress achieved and the status during the reporting period. This report outlines the monitoring implementation of social safeguard activities from January 2020 to June 2020 in accordance with the ADB’s Safeguard Policy Statement (SPS), 2009.

4. Social Safeguards Categorization

9. The sub-projects under Loan 3733-IND (Tranche-3) do not have any significant involuntary resettlement impacts, and the Project overall has been categorized as ‘B for involuntary resettlement (IR) and ‘B’1 for Indigenous People (IP) in accordance with the ADB’s SPS 2009, which applies to this Project.

As specified by the Scheduled Areas (Himachal Pradesh) Order, 1975 (Constitution Order 102) dated 21.11.1975. Whilst many STs no longer maintain their cultural traditions and have settled amongst the non-tribal populations, the STs are considered vulnerable APs and therefore Indigenous Peoples for the purposes of this RIPP.

10. Tranche-3 comprises of nine sub-projects (four Substations and five Transmission lines). The list of the sub-projects under HPCETIP (Loan 3733-IND) along with their scope, IR impact, the status of Resettlement and Indigenous Peoples Plan (RIPP) implementation, and physical progress is presented below in Table 1, and the status of additional works is presented in Table 2.

6. Sub-projects implementation (Land Acquisition, Resettlement, and Rehabilitation) A. Scope and status of land acquisition and implementation of resettlement activities a) Sub-Stations covered under Tranche-3 11. During the initial assessment, it was noticed that out of four substations, and one will be built on the government land at Hatkoti and the remaining three on private land. The total land required for the said works was 3.76 ha. There were some typographical errors in the calculation. For the construction of 220 kV Pooling substation at Barsaini, total 5 bighas 10 biswa2 of land was required. As per land conversion, this will be 0.4046 ha instead of 0.96 ha. Thus 3.3246 ha of land was required for four substations. During implementation, 0.92-ha land has been transferred from Himachal Pradesh Power Corporation Limited (HPPCL) to HPPTCL for construction of a substation at Hatkoti (Govt land) instead of 0.8 ha, which was decided during the preliminary stage. INR 91.6 million amount has been transferred to HPPCL (Receipt of the payment is attached in Annexure 9). The details of the land requirement are provided in Table 3. 12. Land for three substations has been acquired from private landowners. By the end of the reporting period, 2.19 ha of land has been acquired from 22 AHs, an amount of INR 34.85 million has been paid as land cost/ compensation. 0.21 ha of land belonging to 2 AHs is yet to be acquired; however, the negotiations have been already completed. The work in said land has not yet commenced. This is to confirm that no households have lost 10% or more of their landholding. i. S-1: Substation at Nirmand (Bagipul) 13. The substation has been constructed on private land, and a total of 0.6 ha of land belonging to two AHs has been acquired. An amount of INR 5 million has been paid as compensation. The compensation of land was paid prior to the start of civil works. The details of compensation are provided in Annexure 10. ii. S-2: Substation at Majra 14. The substation has been constructed on private land. 1.4 ha of land belonging to 20 AHs has been envisaged. By the end of the reporting period, 1.19 ha of land has been acquired from 18 AHs, and an INR 10.85 million had been paid as compensation. The details of compensation are provided in Annexure 11. All the documents related to the payment of AHs are available with PIU. An

acquisition of 0.21-ha land from 2 AHs is in progress. Negotiation and consent of 2 AHs have already been obtained, but the acquisition could not be completed due to shareholders' unavailability. No works have been executed in the land which is still not acquired. The details of the land yet to be acquired is provided in Table 4. iii. S-4: Substation at Hatkoti 15. The substation has been constructed on the Government land, and a total of 0.92 ha of land has been transferred to HPPTCL. INR 91.6 million amount has been transferred through real-time gross settlement (RTGS) in favour of HPPCL. iv. S-: Substation at Barsaini 16. The substation has been constructed on private land. A total of 0.4046 ha of land belonging to two AHs has been acquired. An amount of INR 19 million has been paid as compensation.The compensation of land was paid prior to the start of civil works. The details of compensation are provided in Annexure 12. 17. The details of the substations and compensation disbursed for AHs for the land acquired for substations are provided in Table 5.

b) Transmission Line under Tranche-3 18. Tranche- 3 requires the construction of the transmission line 134.833 km in length and 469 towers after the inclusion of additional works(T-6 132kV LILO of Kurthala Bathri at Mazra). The proposed Kurthala Bathri lines at Mazra envisage will have both permanent and temporary impacts. The land required for the construction of 28 towers, out of which 25 towers are located on govt/forest land and 3 towers on privately owned land. Total land required for tower footing is 0.7167 hectare, out of which 0.0758 hectare is private land while 0.6409 hectare is government land. Approximately, 10 households will be affected by loss of small parcels of land for tower footings. Additionally, an estimated 21 non –fruit trees will also be impacted,out of which 6 belongs to 1 AH and 15 trees comes under government land ). Out of 469 towers, 202 towers are located on private land, and the remaining 267 towers are located on Government/ forest land. By the end of the reporting period, land for 85 towers belonging to 217 AHs is available with HPPTCL, and INR 36.03 million has been paid to concerned landowners as land compensation. Out of 85 towers, full payment has been disbursed for 74 towers, while partial payment has been made for 11 towers as shareholders of the lands were not available. The details of tower acquisition status in the transmission line presented in Table 6 and Annexure 13 and compensation status are presented in Table 7. i. T-1: Transmission line from Nirmand to Kotla 19. The transmission line from Nirmand to Kotla (23 km in length) requires the construction of 74 towers. Out of which, 54 towers are located on government-owned land and 20 towers on privately owned land. By the end of the reporting, one tower has been acquired belonging to one AH. An amount of INR 1.03 million has been paid for the land. The details of compensation are provided in Annexure 14. ii. T-2: Transmission line from Pooling substation at Barsaini to Pooling substation at Charor 20. The transmission line from the Pooling substation at Barsaini to Pooling substation at Charor (37.320 km in length) requires the construction of 144 towers. Out of which 80 towers are located on government-owned land, 62 on privately owned land, and 2 towers on government as well as private land. By the end of the reporting, one tower has been acquired belonging to one AH. An amount of INR 1.69 million has been paid for the land. The details of compensation are provided in Annexure 15. iii. T-3: Transmission line from Majra to Karian 21. The transmission line from Majra to Karian (17.45 km in length) requires the construction of 52 towers, out of which 25 towers are located on government-owned land, and 27 towers are on privately owned land. By the end of the reporting, 24 towers have been acquired belonging to 44 AHs. Out of 24, full compensation has been paid for 22 towers, while for two towers, partial payment has been made, as the shareholders of the land were not available. An amount of INR 10.92 million has been paid as compensation for land. The details of compensation are provided in Annexure 16. iv. T-4: Transmission line from Bajoli Holi HEP to Lahal 22. The transmission line from Bajoli Holi HEP to Lahal (18.34 km in length) requires the construction of 59 towers, out of which 30 towers are located on government-owned land, and 28 towers are on privately owned land and 1 tower in the existing office complex of Hydro project executing by GMR contractor. The NoC of GMR has already been obtained and available with PIU. By the end of the reporting, 27 towers have been acquired belonging to 63 AHs. Out of which, 23 towers have been full compensated while partial payment has been made with respect to 4 towers, as the shareholders of the land were not available. An amount of INR 8.38 million has been paid as compensation for land. The details of compensation are provided in Annexure 17.

v. T-5: Transmission line from Lahal to Chamera 23. The transmission line from Lahal to Chamera (35.315 km in length) requires the construction of 112 towers. Out of which, 52 towers are located in government-owned land and 60 towers on privately owned land. By the end of the reporting period, land for 32 towers has been acquired belonging to 108 AHs. Out of 32 towers, the full payment has been made for 27 towers, while partial payment has been issued for 5 towers. An amount of INR 13.98 million has been paid as compensation for land. The details of compensation are provided in Annexure 18. vi. T-6 132kV LILO of Kurthala Bathri at Mazra 24. Transmission line 132kV LILO of Kurthala Bathri at Mazra (3.5 km in length) requires the construction of 28 towers. Out of which, 25 towers are located in government-owned land and 3 towers on privately owned land. No land acquisition has been so far initiated.

h) Impact on Scheduled Tribe/Indigenous Peoples due to Subprojects 30. Presently no works have been executed in designated/notified tribal area; hence no impacts on ST/Indigenous Peoples has occurred during the reporting period. 7. Institutional Arrangements 31. HPPTCL is the executing agency (EA) of the state government and is responsible for the overall execution of the projects under HPCEIP, supervising the implementation of the resettlement plans and ensuring compliance with the loan covenants. The Project Management Unit (PMU) is headed by the Managing Director (MD) and supported by two Directors (Director Planning/Contracts and Director Projects). Besides, that HPPTCL has one General Manager (Projects), three Deputy General Manager (Projects), and eight PIUs (Gumma, Bhabanagar, Rohroo, Sarabai-I, Sarabai-II, Chambi, Chamba, Lahal), which are headed by the Senior Managers. 32. The environment and social cell (ESC) at the corporate level monitors the policy and implementation related social and environmental impacts of all projects of HPPTCL. The ESC at present comprises of an officer of the rank of Deputy Manager, who is supported by the Social and R&R consultant and are responsible for day to day functioning of ESC. The order copy of the ESC committee is attached in Annexure-20. Currently, in the absence of a Social and R&R consultant in the ESC, Deputy Manager at PMU assists PIUs in social and R&R aspects of the projects in compliance with ADB's Safeguard Policy Statement, 2009. 33. The Social Safeguard Consultant was available for one year from February 2018 to March 2019. Also, the Sr. Manager (Projects) retired in February 2019. Sr. Manager (Consultant) was holding a charge of Environment and Social, Consultant for a period of March-2019 to October 2019. A Deputy Manager at PMU Level has been assigned as an additional responsibility for safeguard related issues under Tranche 3. The HPPTCL also has a designated Land Acquisition Officer, who is responsible for coordination with the local revenue office, district administration, and acquisition of land and payment of compensation. The status of staffing for land acquisition is provided in Table 9. Grievances Redress Mechanism 34. HPPTCL has constituted the grievance redress committee (GRC) vide no- HPPTCL/ADB-F-33/2016- 10446-50 dated 27/03/2017 at PMU and PIU levels. The initial grievances are being received at PIUs, and fifteen days have been allotted to redress the grievances; if the grievances could not be addressed at the PIU level or AP is not satisfied with the resolution of the grievances, the same shall be forwarded to GRC at Head office level. During the reporting period, no grievance has been received. The composition of the GRC at PMU and PIU is presented in Table 10 and Table 11, and an order copy is provided in Annexure 21.

9. Consultation with Stakeholders and Disclosure 35. Public consultation for the additional subprojects was carried by different modes instead gathering people, due to Government’s imposed restrictions/requuirements to maintain social (physical) distancing, during lockdown or unlocking process after novel virus Covid-19 (pandemic) outbreak. Such consultations were mostly carried out by telephonically, one to one meeting and in group of very few people. Entitlement for affected households was also discusses in details. Public have ensured their support to the department for provide more electricity facilities to the villagers. Details of consultation carried out presented in Annexure 22. The ADB-approved safeguards documents have been disclosed on HPPTCL website in line with ADB’s SPS 2009 requirements. The translation of safeguard document in local language is in process. During the reporting period, informal consultations were carried out with the stakeholders. 10. Capacity Building Initiatives 36. For proper and smooth implementation of RP implementation and safeguards compliance as per ADB requirement, the capacity building of all the stakeholders involved in implementation work is very important. The philosophy behind this initiative is to develop a better understanding of the problem and to enhance productivity and efficiency. During the reporting period, a training program organized by the ADB’s on Safeguard requirements was attended by the 18 participants, including both officers and management of HPPTCL responsible for the implementation of safeguards. 11. 12. Next Steps: 38. For the construction of Mazra Substation, 1.4 ha of land belonging to 20 AHs were required. By the end of the reporting period, 1.19 ha of land acquired from 18 AHs and acquisition of 0.21 ha of land from 2 AHs is under progress. Negotiation and consent of 2 AHs have already been obtained, but the acquisition is still not completed due to the unavailability of shareholders. PIU contacted the shareholders of the land, and assurance has been given for the availability of all shareholders at the earliest. If the issues are delayed, the amount will be deposited with the District Court.

13. Conclusion: 39. All affected persons are compensated and paid resettlement assistance prior to the start of civil works in accordance with the agreed RP. Upto this reporting period, INR 34.85 million has been paid to 22 AHs for acquired land for construction of substations, 217 AHs has been compensated INR 36.03 million for acquired land for construction of 85 towers. 33 AHs has been paid amount INR 1.58 million for loss of trees. No vulnerable AHs were impacted during the reporting period. 40. No vulnerable AHs were impacted during the reporting period. 41. Land selection for the substation and towers will be in non-sliding zones and excavation and other construction activities will be carried out in scientific way. All the compensation has been paid prior to commencement of civil works

Annexure 1: Result of due diligence visit of additional works proposed under tranche -3 A due diligence visit was undertaken to all the sites to (i) assess whether the sub-project causes any resettlement impacts (temporary/permanent, partial/full) impacts on structures, trees, crops, and livelihoods non-titled affected persons (APs) (ii) To collect evidence (documents, photographs,) to understand/ identify resettlement impacts if any and (iii) To organize public consultation along the project sites to discuss the resettlement impacts. Due diligence/ field visits (conducted by a team including PIU & PMU, local body, Patwari, etc.) to assess involuntary impacts. A detailed assessment has been conducted for the entire route of the proposed alignments, and data collection from secondary sources has been done to support the field survey findings.

During the due diligence visit, it has been confirmed that most of the works will be undertaken in the existing premises of HPSEBL/ HPPTCL. Impacts were envisaged only during laying LILO of 132 kV D/C Kurthala-Bathri line (3.5 Kms double circuits) at Mazra sub-station in Chamba District. The proposed lines envisage will both permanent and temporary impacts. The land required for the construction of LILO of 132 kV D/C Kurthala-Bathri line of length 3.5 km requires the construction of 28 towers, out of which 25 towers are located on govt. /forest land and 3 towers on privately owned land. Out of 3, 1 is totally in private land while 2 is private and govt also.

The total land required for tower footing is 0.7167 hectare, out of which 0.0758 hectare is private land while 0.6409 hectare is government land. Approximately 10 households will be affected by loss of small parcels of land for tower footings.(Ref Table 1). Land for each tower to be placed on private land will be acquired through negotiation and compensated as per the agreed negotiated amount. Additionally, an estimated 21 trees non –fruit trees, and 15 nos-govt ), will be affected in the right of way. Out of 21 trees, 6 non-fruit trees are under private ownership and remaining are comes under government land. As per survey ,there will be no impacts on standing crops and structures, if any impacts are envisaged, assistance will be paid as per the agreed entitlement.
