John Echeverria Vermont Law School October 12, 2014 Introduction and Overview This paper presents case studies of the judicial electoral process and its implications for environmental legal protections in four states: Montana, North Carolina, Washington, and Wisconsin. Academics and other researchers have documented the growing partisan competition and increasingly high levels of expenditures in state judicial elections.1 Prior research has also documented the efforts by various special interests to influence the ideological complexion of the state courts by supporting or opposing specific candidates for judicial office.2 This paper builds upon this prior work by attempting to determine whether successful efforts to change the personnel sitting on specific state courts have, in fact, influenced subsequent rulings by these courts in environmental cases, as intended by certain advocates. VanDyke appeals the First Judicial District Court’s grant of summary judgment to the Plaintiffs and Appellees, declaring VanDyke ineligible to seek election to the position of Justice of the Montana Supreme Court in the 2014 general election and directing the Montana Secretary of State to strike his name from the ballot. The only issue on appeal is whether VanDyke’s decision to take inactive status with the State Bar of Montana while he practiced law in other states disqualifies him from meeting the constitutional requirement of admission to the practice of law in Montana for five years prior to the election. KLEMENHAGEN, LLC: IS IT TIME TO REVISE MONTANA'S DRAM SHOP ACT? Ross Sharkey* I. INTRODUCTION Nearly every week, readers of Montana newspapers are reminded of the State's drunk-driving epidemic. Whether the given news article details sentencing of a repeat DUI offender,' describes the Legislature's most re- cent proposals to reform drunk-driving laws, 2 or chronicles the effects of a drunk-driving fatality, 3 the message remains the same: Montana has a prob- lem with drinking and driving. Indeed, 103 of the State's 229 traffic fatali- ties in 2008 were alcohol related.4 Of those fatalities, 91 involved a driver with a blood alcohol content (BAC) over the .08 grams-per-deciliter legal limit.5 * Thanks to Professor Stacey Gordon for her helpful comments and to my wife Lyndsey for her suggestions and support.

BOB KEENAN, SD 5, BIGFORK, opened the hearing on SB 241, Good faith protection for court-appointed psychologists. SEN. KEENAN stated that SB 241 would make it a requirement that before an individual could file a complaint with the Board of Psychologists against a psychologist that had developed a parenting plan, they would have to go to the District Court and get permission to do so. He went on to say that only one percent of the numerous cases filed had resulted in a finding of probable cause. Proponents' Testimony: Dr. Charles Kelly, President, Montana Psychological Association, explained to the Committee what a parenting plan was and how a psychologist was appointed to do one.
