SYMPOSIUM ISLAM AND RELIGIOUS FREEDOM: THE EXPERIENCE OF RELIGIOUS MAJORITIES AND MINORITIES Brett G. Scharffs* INTRODUCTION One of the most interesting stories in the history of religious freedom is the journey of the Catholic Church, from being perhaps the most powerful institution on earth opposed to religious freedom in the eighteenth and into the nineteenth centuries, to being perhaps the most powerful institution on earth in defense of religious freedom from the middle of the twentieth century and into the early decades of the twenty-first century.1 Whereas in most countries today there is a very high correlation between dominant religious majorities and a low degree of religious freedom, regardless of whether the religious majority is Orthodox Christian, Muslim, Buddhist, Jewish, or Hindu, there is a striking exception: in countries with large Catholic majorities, limitations on religious freedom—measured both in terms of legal restrictions and social hostilities—tend to be low or very low.2 In an article in the Notre Dame Law Review celebrating the fiftieth anniversary of Dignitatis Humanae, I documented this remarkable anomaly and suggested that this was due to the Catholic Church’s journey toward finding within its own religious tradition the theological resources for identifying freedom of religion as a basic component of human dignity and thus a fundamental human right.3 In a subsequent article, Andrea Pin (whose article Is There a Place for Islam in the West? © 2018 Brett G. Prophesy, Public Theology, and Questions of Justice: Some Modest Reflections Barry Sullivan* I must confess that over the past few years I have been gravely disappointed with the white moderate. I have almost reached the regrettable conclusion that the Negro’s great stumbling block in his stride toward freedom is not the White Citizen’s Council-er or the Ku Klux Klanner, but the white moderate, who is more devoted to “order” than to justice; who prefers a negative peace which is the absence of tension to a positive peace which is the presence of justice . Lukewarm acceptance is much more bewildering than outright rejection.1 [T]he Church has always had the duty of scrutinizing the signs of the times and of interpreting them in the light of the Gospel. Thus, in language intelligible to each generation, she can respond to the perennial questions which men ask about this present life and the life to come, and about the relationship of the one to the other. -

Sanders All rights reserved 2 Abstract The French Revolution presented the Catholic Church with her greatest political crisis since the Reformation. The crises presented by the Revolution (including: the Civil Constitution of the Clergy, the death of the king, the Reign of Terror, war throughout Europe, and the imprisonment of the pope) also gave new urgency the theological problems of divine providence, the permission of evil, and the nature of predestination. However, even before the Revolution, such issues were at the heart of intra-Catholic theological debates. Beginning with the De Auxiliis controversy, and continuing with the growth of Jansenism and the Catholic Enlightenment, ideas of providence and predestination were hardly settled before the Revolution. But, such debates shed light on how theologians attempted to understand the Revolution. Two prominent Catholic thinkers in the wake of the Revolution were Joseph de Maistre and Félicité Lamennais. Both saw the Revolution as the natural result of theological errors and in keeping with divine providence. Maistre, a convinced Molinist, provides the most robust account of the Revolution as a felix culpa, an event that God permitted to happen in order to cleanse the Church of laxity and error, punish France for theological errors, and rid the world of Enlightenment philosophy. -

a Migrations of the Holy: Explaining Religious Change in Medieval and Early Modern Europe Alexandra Walsham University of Cambridge Cambridge, United Kingdom How do we conceptualize and explain religious change in medieval and early modern Europe without perpetuating distorting paradigms inherited from the very era of the past that is the subject of our study? How can we do justice to historical development over time without resorting to linear grand narratives that have their intellectual origins in the very movements that we seek to comprehend? In one way or another, this challenging question has inspired all my published work to date, which has focused on the ways in which early mod- ern society adapted to the religious revolutions that unfolded before it. My work has explored the ambiguities, anomalies, and ironies that accompany dramatic moments of ideological and cultural rupture. It has sought to bal- ance recognition of the decisive transformations wrought by the Protestant and Catholic Reformations with awareness of the complexities and contra- dictions that characterized their evolution and entrenchment in practice. It has been marked by a consuming interest in the currents of continuity that tempered, mediated, and even facilitated the upheavals of the early mod- ern era. One consequence of this preoccupation with analyzing how and why cultures are held in tension and suspension during critical phases of transition is that I have been very much less effective in acknowledging and accounting for religious change itself. This is my Achilles’ heel as a historian, and one that I share with a number of other historians of my generation. -

VATICAN II ON RELIGIOUS FREEDOM MSGR. JOHN P. KLEINZ * N 1948 the United Nations adopted a Universal Declaration of the Rights of Man. The World Council of Churches issued its Declaration on Religious Freedom at Amsterdam in 1948 and again definitively at New Delhi in 1961. Both proclaimed the individual person's human and civil right to form his own conscience according to his religious convictions and to determine his relationship to other churches. In 1965, at the end of the Second Vatican Council, another inter- national organization, the Roman Catholic Church, promulgated its own Declaration on Religious Freedom. Its Latin title, from the first three words, is Dignitatis Humanae Personae. Its subtitle already restricts its scope: "On the right of the person and of communities to social and civil freedom in matters religious." Its central thesis is: "It is an injustice done to the human persons, and to the order laid down for men by God, if a man is denied the free exercise of religion in society; saving a just public order." All three declarations propose essentially the same juridical prin- ciple. -
