Turner Construction Company was chosen as the construction project manager.[13]Under UAE law, the Contractor and the Engineer of Record are jointly and severally liable for the performance of Burj Khalifa. Therefore, by adoption of SOM's design and by being appointed as Architect and Engineer of Record, Hyder Consulting is legally the Design Consultant for the tower. The case is before the Court on Strabala’s motion to dismiss the complaint pursuant to Federal Rule of Civil Procedure (“Rule”) 12(b)(6). For the reasons provided below, the Court grants the motion. Facts From March 2006 to February 2010, Gensler employed Strabala as Design Director, i.e., an architect. (Compl. ¶ 9.)
