INTRODUCTION OF PAGES The Speaker informed the Assembly that Allen Mark, Karyin Qiu and Jillian Smart from F.H. Collins Secondary School; and Näntsäna Murphy, Nathaniel Curtis, Clodagh Berg, Hannah Bjork-Andison and Marika Kitchen from Vanier Catholic Secondary School, would be serving as Pages during the 2014 Spring Sitting. Ms. Qiu and Ms. Berg were introduced and welcomed to the House.

SPEAKER’S STATEMENT Changes to the Order Paper – Withdrawal of motions Prior to proceeding with the Daily Routine, the Speaker made the following statement regarding changes made to the Order Paper. “The following motions have been removed from the Order Paper as they are outdated: Motions No. 16, 98 and 481, standing in the name of the Member for Vuntut Gwitchin; Motions No. 90, 200, 218, 555 and 561, standing in the name of the Member for Takhini-Kopper King; Motions No. 345 and 427, standing in the name for the Member for Mayo-Tatchun; Motions No. 93, 535 and 575, standing in the name of the Leader of the Third Party; Motion No. 515, standing in the name of the Member for Pelly-Nisutlin; and Motion No. 536, standing in the name of the Member for Copperbelt South. QUESTION OF PRIVILEGE Ms. Stick, Official Opposition House Leader, rose on a Question of Privilege, regarding a response made by the Hon. Mr. Cathers, Minister of Community Services, during Question Period on Wednesday, April 2, 2014. Prior to receiving the Question of Privilege, the Speaker made the following statement: “This is the first question of privilege that has been raised during the 33rd Legislative Assembly. The Chair believes it would be beneficial for all members to understand these rules and procedures. Once the Official Opposition House Leader has concluded her statement, the Chair will ask for statements from other members, if other members wish to speak to the question of privilege. The House will then proceed with other business. Standing Order 7(3) says that, in dealing with a question of privilege, ‘the Speaker may allow such debate as is necessary to assist in the determination of whether there appears to be a prima facie case of breach of privilege and whether the matter is being raised at the earliest opportunity.’ I would therefore ask all members who speak to the question of privilege to keep their statements brief and concise. It is important to keep in mind that the Chair does not decide whether a breach of privilege has or has not occurred — that is a matter for the House to decide. The question for the Chair is whether there appears on the face of it to be a breach of privilege. If the Chair determines that there appears to have been a breach of the House’s privileges, Standing Order 7(4) says that ‘any member may either immediately propose a motion or, not later than at the conclusion of the next sitting day, give notice of a motion calling upon the Assembly to take action thereon or referring the same to a Committee of the Assembly.’ Members must realize that a debate on a question of privilege is a serious matter. If the Chair rules that a prima facie breach of privilege has taken place and if the motion designed to deal with the alleged breach calls upon the Assembly to take action, the debate on that motion would take precedence over all other matters under Orders of the Day until the question of privilege has been resolved.” The Speaker then heard the Question of Privilege and took it under advisement.

GOVERNMENT HOUSE LEADER’S REPORT Length of Sitting The Hon. Mr. Cathers, Government House Leader, rose pursuant to Standing Order 75(4), to inform the House that the House Leaders had met for the purpose of achieving an agreement on the maximum number of sitting days for the current Sitting. Further, pursuant to Standing Order 75(4), the Hon. Mr. Cathers informed the House that the House Leaders had - 462 -

agreed that the current Sitting should be a maximum of 30 sitting days, with the 30th sitting day being Thursday, May 15, 2014. QUESTION OF PRIVILEGE Speaker’s Ruling Prior to proceeding with Orders of the Day, the Speaker gave the following ruling pertaining to a Question of Privilege raised by Ms. Stick, Official Opposition House Leader, regarding a response made by the Hon. Mr. Cathers, Minister of Community Services, during Question Period on Wednesday, April 2, 2014. “Before ruling on the question of privilege, the Chair will address some procedural matters. Standing Order 7(4) says that the Speaker must rule on (a) where there appears on the face of it, to be a case of breach of privilege, and (b) whether the matter has been raised at the earliest opportunity. In order to rule on the question of privilege, we must consider the nature of parliamentary privilege. The classic definition of parliamentary privilege is found in Erskine May’s Treatise on the Law, Privileges, Proceedings and Usage of Parliament. It says — on page 75 of the 23rd edition, for those of you who have a copy — ‘Parliamentary privilege is the sum of the peculiar rights enjoyed by each House collectively … and by members of each House individually, without which they could not discharge their functions, and which exceed those possessed by other bodies or individuals. Thus privilege, though part of the law of the land, is to a certain extent an exemption from the general law.’ These ‘peculiar rights’ exist so that the House and its members can perform their constitutionally mandated duties without obstruction or interference from other persons or groups. In raising the question of privilege, the Official Opposition House Leader referred to a comment made by the Minister of Community Services during Question Period on April 2. The Chair will not repeat the words that led to the question of privilege which the Official Opposition House Leader characterized as ‘disrespectful and inappropriate for this House.’ The Official Opposition House Leader requested that the minister apologize for what he said. Procedurally, the Official Opposition House Leader cited Standing Order 19(i). Standing Order 19(i) says, ‘A member shall be called to order by the Speaker if that member … uses abusive or insulting language, including sexist or violent language, in a context likely to create disorder …’ In responding to the question of privilege, the Minister of Community Services said, ‘This would appear to be something raised appropriately through a point of order …’. The Chair has reviewed the Blues of April 2 and has considered the interventions of the Official Opposition House Leader and the Minister of Community Services. Having done so, the Chair believes there is no prima facie question of privilege in this case. The issue raised by the Official Opposition House Leader is whether the words spoken by the Minister of Community Services were, or were not, unparliamentary. Matters of unparliamentary language are properly dealt with as points of order, not questions of privilege. - 465 -

Points of order regarding unparliamentary language or other matters must be raised at the time the alleged offence occurs. In ruling that there is no prima facie question of privilege, the Chair takes no position as to whether the words spoken by the minister were, or were not, parliamentary, nor does the Chair take a position on whether an apology is owed. The Chair’s only ruling is that the issue raised by the Official Opposition House Leader does not qualify as a matter of privilege. The Chair will, however, take this opportunity to remind members of two things. First, Standing Order 6(6) says, ‘When a member is speaking, no member shall interrupt, except to raise a point of order or a question of privilege.’ Second, proceedings will be more orderly if members refrain from personalizing their comments during Question Period and debate.” The House then proceeded to Orders of the Day.

SPEAKER’S RULING Motion not in order The Speaker made the following ruling. “Earlier today, the Government House Leader identified Motion No. 667 and Motion No. 671 as the items to be debated under government private members’ business tomorrow. After the Speaker left the Chair, the Opposition House Leaders approached the Chair outside of the House. The Opposition House Leaders questioned whether it was in order for the House to debate these motions. The Opposition House Leaders argued that it would not be in order to do so, as the actions requested in the motions had already been taken. The Chair then discussed the matter with the Government House Leader and the Member for Vuntut Gwitchin. The Chair’s decision is that it would not be in order to debate Motion No. 667, as the action requested in that Motion has, indeed, already been taken. Therefore Motion No. 667 will be removed from the Order Paper and will not be debated tomorrow. - 516 -

However, debate on Motion No. 671 can proceed, as it appears to the Chair that the motion could encompass actions beyond those that have already been taken to achieve the goal articulated in the motion.”
