LICENSE RULES AND REGULATIONS

1. All entertainment shall be so conducted that no noise shall be plainly audible, under any circumstances, at a distance of one hundred fifty 150') feet from the licensed premises. All shall face the licensed premises and not the street.

2. The licensed premises shall be subject to inspection by the police of the Town of Bourne and duly authorized agents of the Licensing Board.

3. The entertainment and dancing by performers must be confined to a specific space provided for the purpose.

4. The type and hours of entertainment shall be subject to change by the Licensing Board at any time after notice to the licensee.

5. No employee and/or entertainer shall solicit, induce or request a patron to purchase any alcoholic or non-alcoholic beverage for them or any other person. Nothing shall prohibit the above activity in connection with any contract, which such person may have with a patron to whom they are related by blood or marriage.

6. The licensing Board reserves the right to change or add to the foregoing terms and conditions after notice to the licensee.

7. Attire and conduct of employees, entertainers, and other persons:

a. It is forbidden to employ or permit any person in or on the licensed premises while such person is unclothed or in such attire as to expose to view any portion of the areola of the female breast or any portion of the pubic hair, cleft of the buttocks, or genitals.

b. Mingling between employees and patrons is forbidden except by owners and managers in of their duties and waitresses and waiters involved in the of food and beverages.

c. It is forbidden to encourage or permit any person in or on the licensed premises to touch, caress, or fondle the breasts, buttocks, or genitals of any other person.

d. It is forbidden to employ or permit any person to wear or use any device or covering exposed to view that simulates the breasts, buttocks, pubic hair, or genitals or any portions thereof.

e. It is forbidden to employ or permit any person in or on the licensed premises

1. sexual intercourse, masturbation, sodomy, flagellation, or sexual acts prohibited by law; or

2. touching, caressing, or fondling of the breasts, buttocks, or genitals of oneself or of another.

8. Vectual Displays - It is forbidden to employ or permit any person in or on the licensed premises to show motion picture , -type cassettes, still pictures, or other photographic reproductions depicting any of the acts, or any simulation of any of the acts, prohibited in Rule 7 of these Rules and Regulations.

9. Severability - If any of the provisions of these Rules and Regulations or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions of such Rules and Regulations, or the application of such other provisions, which can be given effect without the invalid provision or application thereof, and for this purpose the provisions of these Rules and Regulations are severable.

10. Other Laws - Notwithstanding any of the foregoing Rules and Regulations, no person duly licensed by the Licensing Board for the Town of Bourne under G.L. c. 138, sections 1, 12, or 23 shall employ, use the services of, or permit upon his licensed premises any employee, entertainer, or other person who by his or her attire or conduct violates any General Laws, Special Act, or Bylaw of the Town of Bourne.

11. All licenses shall be kept in an accessible place on the premises available at all times to the proper authorities.

12. Any police complaints and/or reports, presently on file, shall continue in force until disposed of by this Board.

13. All areas where dancers perform shall be separated by an area of at least three (3) feet in width between any stage or platform and areas where drinks are served and consumed.

14. This license is subject to suspension, revocation, or forfeiture for breach of any of its conditions, or regulations of which the license has notice, or any law of the Commonwealth.
