This is an application to vary a small part of the main hotel. Currently the Spa is situated on two floors, ground and lower ground. The hotel wishes to move the spa reception to the lower ground to integrate with the rest of the spa, and to replace the ground floor with a hotel bar named "Wigmore & Cavendish." The first two attached plans de-mark the area to be varied on the existing licensing plans, by indicating it with a green box. Plan 16-111-LP001 shows the public licensed area of the ground floor to be varied edged in red. And likewise plan 16-111-LP002 shows the same for the Lower Ground. Both plans contain building detail on the legend. And authorities will note that this is split by room so that it is easy to refer to an area of the plan and check on the corresponding legend what the works will be. In addition, this variation seeks to ensure that each area is properly integrated into the Premises Licence. The applicants seek the same regulated hours and activities for "Wigmore and Cavendish" as for "Artesian Bar." The spa reception has previously been licensed to permit patrons waiting for a treatment to enjoy a glass of champagne (or similar). The applicants would seek to licence the new spa reception in the same way. This application also seeks to address some house- keeping issues in relation to the Premises Licence. Condition 24 refers to the old 1964 Act s.77 and should now be deleted. The application seeks to delete condition 26 as the entrance to the new hotel bar is not through the main body of the hotel. However this should be replaced with a condition as follows; "The Wigmore and Cavendish shall provide a registered SIA door supervisor after 21:00hrs on any night that it is open to members of the public." Condition 35 shall be amended to update the capacity of the Wigmore & Cavendish. The new location will not impact the existing fire exits. The toilet in the basement is proposed to be removed and instead to be relocated in ground floor. The basement has been used only for occasional events so toilet doesn't seem to be necessary. Also there are usually 1-2 staffs working at the premises and it is not practical to supervise basement area. This will leave the basement toilet as an unsupervised space that can increase the risk of crime, disorder and anti-social behaviors as well as reduce public safety. We have many female customers that don't feel convenient or safe to use the toilet in the basement. The other important reason is that the basement toilet will have harmful effect on the level of hygiene and contamination in the basement. Furthermore, on practical level it is proved that there is hardly a cost-effective way to provide the required foul drainage for the basement toilet. Due to above-mentioned reasons we decide to relocate the toilet to ground floor where we can offer a good size female/disabled toilet for public use in a safer, cleaner and more accessible location. The average age of attendees is forty-fifty years and, as a good-natured mature crowd, there is never any trouble. Tickets will only be sold in advance, not on the night, and people will be given an id ink stamp in case they need to pop outside for a cigarette (although there tend to be very few smokers in the dance community). The event will end at 1.00am and the bar will close at 12.30am, having opened at 8.45pm. The drinks will all be served in plastic containers only. Burj Alarab Arabesque, 13C Crawford Street, W1 (Marylebone High Street / not in cumulative impact area) – The Applicant’s Representative confirmed at the hearing that his client wished to convert the café into a restaurant offering food of a Middle Eastern theme to customers who were predominantly tourists. The Applicant wished to amend the terminal hour for the majority of the year for late night refreshment and the opening hours to 01:00 and 01:30 respectively (03:00 and 03:30 had originally been applied for). During the month of Ramadan, late night refreshment was applied for until 05:00 and the proposed closing time was 06:00 with 03:00 being mentioned during the hearing by the Applicant’s Representative as a possible compromise if Members were not minded to grant the full hours. Alcohol was not being applied for.

The Sub-Committee received representations from a number of residents who were concerned about the late terminal hour in this residential area both during Ramadan and during the other eleven months of the year. The point was made that the proposed hours were considerably later than other premises in the area were operating to. The local resident’s representative and Environmental Health referred to concerns about odour smells (the Applicant’s Representative disputed that this was caused by the premises and stated that a new extractor had been fitted).

The Sub-Committee granted Core Hours (Monday to Thursday until 23:30 and Friday and Saturday until midnight) throughout the year, taking into account the residential nature of the area and the potential for disturbance late at night. The use of the outside tables and chairs was permitted until 23:00 as applied for.

Rose Café, 57 Praed Street, W2 (Hyde Park Ward / not in cumulative impact area) – The Applicant had been granted Core Hours at a Sub-Committee hearing in March 2014. The Applicant was seeking an extension for the hours of late night refreshment and the opening hours until 03:00 Monday to Sunday in June, July, December and the month of Ramadan and until 02:00 Monday to Saturday and 01:00 on Sundays for the rest of the year. Environmental Health and local residents referred to the reasons why Core Hours had been granted rather than the later hours applied for in 2014, including the residential nature of the area. There had been complaints in the past when the premises had been open after midnight. The Sub-Committee decided to refuse the application. Tommi’s Burger Joint, 37 Berwick Street, W1 (West End Ward / West End Cumulative Impact Area) – This was an application for a new premises licence for Core Hours in respect of late night refreshment and on and off-sales of alcohol. The proposed hours were thirty minutes beyond Core Hours. The Applicant had agreed the Council’s model restaurant condition and off-sales would be by delivery only as part of a pre-ordered meal. A local resident at the hearing stated that providing there was no music heard outside the premises, there were no tables and chairs outside and the establishment was not drink led, he would not have concerns. He was of the view that if tables and chairs were permitted at this premises, it would create a cluster of premises using outside areas in the locality which would add to public nuisance. The Sub-Committee noted that the application did not involve tables and chairs. There was no presumption against restaurant premises. There was a proposed capacity of 20. The Sub-Committee granted the application for the hours applied for. The Applicant advised that the delivery company was given strict instructions on not causing nuisance to residents, including waiting for the delivery inside the restaurant. The Sub-Committee emphasised that the delivery company would be expected to use their best endeavours to minimise any potential for nuisance.

Lobos Meat & Tapas, Basement and Ground Floor, 48 Frith Street, W1 (West End Ward / West End Cumulative Impact Area) – Granted under delegated powers prior to the hearing.

Pepe Italian Street Food, Basement and Ground Floor, 27 Old Compton Street, W1 (West End Ward / West End Cumulative Impact Area) – This was an application for a variation of a premises licence to extend the hours for late night refreshment and the closing hours from Thursday to Saturday until 03:00. The Sub-Committee clarified that there was no proposed extension for the sale of alcohol (this would cease at 23:00) or regulated entertainment (this would be background music). No outside area was sought. The Applicant had agreed with the Police that a minimum of 1 SIA licensed door supervisor would be on duty at the premises from 22:00 until close on Thursday, Friday and Saturday evenings. The Police and Environmental Health informed Members that their key concerns had been addressed as a result of conditions being agreed by the Applicant. They and the Licensing Authority had maintained their representations due to the hours applied for in the West End Cumulative Impact Area.

The Sub-Committee explored with the Applicant whether he was willing to accept the Council’s model restaurant condition after midnight. Members heard that takeaway was provided during the day under the existing premises licence but the Applicant was willing to accept all the terms of the restaurant condition, including substantial table meals being provided (including pizza and pasta dishes) and waiter/waitress service. This meant that there was therefore no presumption against the application. The Sub- Committee granted the application, attaching a condition that there would be no consumption of alcohol after 01:00 to prevent customers from stocking up alcohol at midnight in order to consume it until the closing hour. Members noted the willingness of the Applicant to agree conditions that would promote the licensing objectives including employing a door supervisor, no extension to the sale of alcohol. There was a limited capacity of 20 people.
