ESUHSD Board Meeting Highlights

Dear Staff,

Items during last night's board meeting included the following:

Presentation regarding the Silicon Valley Career Technical Education (SVCTE) program Information and discussion regarding the Yale National Initiative program Update on the Community Wireless Network Update on the Proposed Ground Lease Agreement with KIPP Bay Area Schools

I have completed six Leading Learner Chats at your sites. I have enjoyed our invigorating discussions and this puts us one step toward improving our KPMs. During this month's cabinet meeting, we discussed several topics regarding issues that came up during the 2015-16 Leading Learner Chats and have begun addressing some of the systemic issues. When I complete my last chat, I will compile the information and send it out district wide.

We have a Board Study Session on November 3, 2016 where we will be discussing SPED and LCAP measures.

The next Board meeting will be on November 17, 2016.

Silicon Valley Career Technical Education Program

This annual presentation regarding the Silicon Valley CTE program and course offerings was provided to the Board. Below is a partial list of courses:

Yale National Initiative San Jose

Presentation regarding the Yale National Initiative (YNI) in San Jose. It is a partnership between Yale University and urban public school districts throughout the country.

YNI is a a professional development program that seeks to strengthen content area teaching in public schools by establishing new Teachers Institutes in school districts with high-needs populations.

The San Jose program is a partnership between East Side Union High School District, Franklin McKinley School School District and San Jose Unified School District.

Current ESUHSD fellows below. These teachers spend 2 weeks of intensive sessions at Yale University in July.

More than 30 San Jose YNI fellows have published curricula on teachers.yale.edu. Next steps include establishing a District-University partner with a local university and to establish the first local Teacher's Institute in the west coast.

There will be an informational meeting on November 17th at FMSD in the Board room to meet past and current fellows and encourage other teachers to join YNI.

Community Wireless Network

ESUHSD Administration has been in discussions with the City of San Jose regarding a potential joint community wireless project. The District and the City share an interest in providing greater access to the internet for students, staff, parents and the District community within the District and City boundaries. Greater internet connectivity in school communities will help advance student academic achievement, provide opportunities for student to research career and university possibilities, and will help foster student safety during out of school time.

At the June 23, 2016, board meeting, the board approved authorization to negotiate and enter into a community wireless network installation agreement with the City of San Jose for subsequent presentation to, and ratification, by the Board.

Pursuant to the draft agreement, the District will fund up to $2.7 million dollars:

(i) for the purchase and installation of wireless access points and equipment at various City facilities, such as light poles, traffic signals, towers, community centers and other structures to modernize, integrate and enhance existing District technological equipment and facilities (ii) to provide and enhance wireless internet connectivity by students, staff and other District-authorized users within the attendance boundaries of the District's James Lick, W.C. Overfelt and Yerba Buena high schools (iii) whereby the City would also manage the installation project and maintain the wireless network for the term of the agreement

The purchase of the required equipment and the construction and installation work and project management for the community wireless installation project would be the responsibility of the City. The City Council unanimously approved the contract.

The Board of Trustees unanimously approved the Funding Agreement with the City of San Jose. This is a pilot program that we hope to expand district wide with the next round of Ed-Tech bonds that are sold.

Proposed Ground Lease Agreement with KIPP Bay Area Schools for Prop. 39 Charter School Facilities at District's Education Center Site

At the February 4, 2016, board meeting, the Board authorized the Administration to enter into discussions and negotiations with KIPP San Jose Collegiate charter school for a Proposition 39 ground lease agreement for a portion of the Education Center (EC) property for the construction of public charter high school facilities by KIPP to relocate the KIPP charter school from Independence High School site to the EC property.

KIPP has proposed to enter into a long-term lease agreement with the District at the District's EC (830 N. Capitol Avenue) to meet KIPP San Jose Collegiate's Prop. 39 facilities needs on a long- term basis. Under such an arrangement KIPP would finance and construct its own school facilities on the land for use as KIPP's charter school facilities.

The material terms of the proposed agreement include the following:

The agreement would be for a term of twenty-five (25) years with 3 options to renew the term for 5 year each (total possible lease term of 40 years) KIPP shall pay rent to the District of $1.00 per square foot per year (approx. $103,000 per year) in lieu of its pro rate facilities share under Prop. 39 and KIPP shall pay its own utilities and operating expenses and shall be responsible for maintaining and repairing the facility and improvements KIPP shall commence paying rent under the lease on the earlier of: (i) the date that KIPP substantially completes construction of its facility improvements and is using the improvements; or (ii) July 1, 2018 Rent shall be adjusted in accordance with the Consumer Price Index every 5 years after the rent commencement, provided that any CPI adjustment increase shall be no less than 3% and no greater than 10% The District will provide temporary housing to KIPP on the Independence site during the construction period, subject to the terms of the existing Facilities Use Agreement So long as the lease is in effect, KIPP will not seek or have the right to obtain additional facilities from the District pursuant to Prop. 39 for KIPP San Jose Collegiate charter school KIPP may pledge its interest in the lease as security for financing for the construction and equipping of its facilities, but shall not encumber the District's title interest in all or any portion of the EC site At the end of the lease term title in all facilities built by KIPP will vest in the District. The Board of Trustees authorized and approved the ground lease agreement as presented with a vote of 4 to 1. A thorough vetting process on community and environmental impact factors, including traffic concerns, are part of this next phase.
