The institutions listed on the following pages have been requested to be added to the list of Indian residential schools recognized by the Indian Residential Schools Settlement Agreement. These requested institutions have been researched by Indian and Northern Affairs Canada and assessed against the test in Article 12 of the Settlement Agreement for determining whether the institutions should be considered an Indian residential school. The decision about whether the institution will or will not be included in the Settlement Agreement is set out on the following pages, as well as the brief reason for the decision. If no decision is set out on the following pages, the institution is currently under review. Please note that, although a decision may have already been made with respect to a certain institution, you are entitled to submit a further request for that institution. Indian and Northern Affairs Canada will revisit its decision on a particular institution based on any new information or supporting documentation you are able to provide. Indian and Northern Affairs Canada will respond to all requests directly to the requestor in writing. In order for an institution to be added to the settlement, Article 12 of the Settlement Agreement requires that the institution satisfies both parts of the following two-part test: (i) The child must have been placed in a residence away from the family home by or under the authority of Canada for the purpose of education; and (ii) Canada must have been jointly or solely responsible for the operation of the residence and care of the children resident there (e.g. the institution was federally owned; Canada stood as a parent to the child; Canada was at least partially responsible for the administration of the institution; Canada inspected or had a right to inspect the institution; Canada stipulated the institution as an Indian Residential School). The test focuses on the residential component of the institution. The institution must have a residence, and Canada must have been jointly or solely responsible for the operation of that residence. November 2010 Two institutions added to the list of Indian residential schools The Settlement Agreement sets out a list of eligible Indian Residential Schools that were agreed upon by all parties of the Settlement Agreement. The criteria and process for adding institutions to the list of eligible Indian Residential Schools are clearly outlined in Article 12 of the Settlement Agreement, and were agreed to by all parties to this Agreement, which is supervised by the Courts. Based on the information in the Government of Canada’s possession, the Fort George Hostels, located in Fort George, Quebec meet the eligibility criteria set out in Article 12 of the Settlement Agreement, for the period of September 1, 1975 to June 30, 1978. The Wawanosh Home, located in Sault Ste. Marie, Ontario, meets the eligibility criteria set out in Article 12 for the period January 1879 and August 5, 1892. Background Fort George Hostels: St. Philip’s (Fort George Anglican) Indian Residential School closed in June 1975. Following a request from the Fort George Band Council, the Government of Canada converted the former student residence into classrooms and constructed hostel facilities in Fort George to accommodate students attending school locally. Eight student hostels were built at Fort George. Each was designed to hold up to 12 students. The hostels were operated under an agreement between the Government of Canada, the Fort George Band Council and the Hostel Parents. The responsibility for the operation of the student hostels at Fort George was transferred to the Cree School Board on July 1, 1978. This transfer was the outcome of commitments made in the James Bay and Northern Quebec Agreement, signed on November 11, 1975. Wawanosh Home: The Wawanosh Home was established in September 1877 as an industrial school for Indian girls. It was founded by the same Church of England clergyman who founded the nearby Shingwauk Home, later the Shingwauk Indian Residential School. The Department of Indian Affairs began its involvement in January 1879, when a grant was made towards building expenses. The Home then received annual maintenance grants from the Department until its amalgamation with the Shingwauk Indian Residential School in 1893. The Wawanosh Home closed in the autumn of 1894. In 1900, a new Wawanosh Home opened at the Shingwauk site as the girls’ section of the Shingwauk Indian Residential School. Departmental correspondence makes reference to the Wawanosh Home as an element of the Shingwauk Indian Residential School until 1922.
