Thisproposal is for inappropriatedevelopment in theGreen Belt. Howeverthe applicant has put forwarda numberof planningconsiderations which he considersare material.lt is consideredthat theseare of sufficientweight to amountto the very specialcircumstances necessary to overridethe presumptionof refusalfor thatinappropdate development. These considerations are the extant 2007planning permission; the fact that an extensionto the hotelof thissize has been accepted in principle,the scale and volume of theproposal is slightlyless than the 2007 consent, the cunent proposalhas less impact on theopenness of theGreen Beit than the 2007 consent, and hat there areno othermaterial adverse impacts. C. The Borough Council is the Local Planning Authoriry for the purposesof the Act for the Borough of North Warwickshirewithin whichBorough the ApplicationLand is situated

D. The BoroughCouncil is a PrincipalCouncil within the meaningof theLocal GovemmentAct 1972

E. The Ownersare the ownersofthe ApplicationLand

F. The Mortgageesare the beneficiariesof a RegisteredCharge dated 30tnApril 1999

NOW THIS AGREEMENTWITNESSETH as follows:-

StatutoryAuthority

1.1 This Deed and each covenantcontained herein is a planning obligationand is madepursuant to Section106 ofthe Act t.2 The obligations containedherein shall be enforceableby the BoroughCouncil

Liability

1.3 The covenantshereinafter contained are all madewith the intent that the covenantswill bind the ApplicationLand and be bindingon and enforceableagainst the successorsin title or assignsand those derivingtitle underthe Ownersor the Applicantto the Application Land or any part thereofPROVIDED THAT without prejudiceto I

the enforcementof covenantsagainst successors in title no person shall be liable for any breachor non performanceof the covenants containedherein or for the performanceof any obligation hereunder in respectof any land that he is no longerseised save in respectof anyprior subsistingbreach

1.4 Nothing in this Agreement shall prohibit or limit the right to develop any part of rhe Application Land in accordancewith a planning permission(other than ttre Planning Permissionas defined herein or any renewalthereof ) ganted (whether or not on appeal) after the date of this Agreementin respectof which development this Agreementwill not apply

1.5 The covenantscontained in this Agreementshall not be enforceable against statutory undertakers in relation to any parts of the Application Land acquired by them for elecuicity sub'stationsgas governorstations or pumping stations.

Contingencies

1.6 The covenantscontained in clause2 in this Agreementshall be of no effectuntil the Commencementof Developmenthas occurred

1.7 ln the event of the Planning Perrnissionexpiring and not being rcnewed without the Developmenthaving been begun or in the event of the revocationof that permissionthe obligationsunder this Agreementshall cease absolutely

Referenceto Expert

1.8 Any dispute which arises between the parties hereto and the Borough Council at any time in connectionwith this Deed shall be refened to a person having appropriateprofessional qualifications and experiencein such matters('lhe expert") appointedjointly by the parties or in default by the Presidentfor the time being of the Royal Institution of CharteredSurveyors (or on his behalf) on the applicationof either party who shall act as an expert and not as an arbitrator and whose decision shall be final and binding upon the partiesand the following provisionsshall apply to the Expert

i The chargesand expensesof the Expert shall be bome equally betweenthe parties betweenwhom the difrerence lies unless the Expert directsotherwise

ii The Expert shall give the parties an opportunity to make representationsto him beforemaking his decisiontogether with one counter representationon the initial representationof the other party iii The Expert shall be entitled to obtain opinionsAom othersifhe so wishes

iv The Expert shall give reasonsfor his decision

v The Expert shall comply with any time limits or other directionsagreed by both panies

1.4 Nothing in this Agreement shall prohibit or limit the right to developany part of the ApplicationLand in accordancewith a plaming permission(other than the PlanningPermission as defined herein or any renewal thereof ) granted(whether or not on appeal) after the date of this Agreementin respectof which development this Agreementwill not apply

1.5 The covenantscontained in this Agreementshall not be enforceable against statutory undertakers in relation to any parts of the Application Land acquired by them for electicity sub-stationsgas govemorstations or pumpingstations.

Contingencies

1.6 The covenantscontained in clause2 in this Agreementshall be of no effect rurtil the Commencementof Developmenthas occurred

1.7 ln ttre event of the Plarning Permissionexpiring and not being rcnewed without the Developmenthaving been begun or in the eventof the r€vocationof that permissionthe obligationsunder this Agrcementshall cease absolutely

Referenceto Expert

1.8 Any dispute which arises between the parties hereto and the Borough Council at any time in connectionwith this Deed shall be referred to a p€rson having appropriateprofessional qualifications and experiencein such matters("the expert") appointedjointly by the parties or in default by the Presidentfor the time being of the Royal lnstitution of CharteredSuweyors (or on his behalf) on the applicationof either party who shall act as an expert and not as an arbitrator and whose decision shall be final and binding upon the partiesand the following provisionsshall apply to the Expert

The chargesand expensesof the Expert shall be bome equally betweenthe parties betweenwhom the differcnce lies unless the Expert directsotherwise

Introduction

This item is reportedto the Board for determinationbecause of the recommendation involvingthe issueof a RevocationOrder.

The Site

This Hotel is locatedjust north of Lea Marston,and to the eastof Jrurction9 on the M42 Motorway off the 4'4091 Tamworth Road. It is quite a substantialone and two storey building with a frontage car park to Haunch Lane and a surrounding golf course. ln total the hotel has 88 bedroomsand 9 Conferencerooms together with ancillaryaccommodation, including a leisureclub. Extemally there is a ninehole golf course,a ninehole pitch andput course,and a drivingrange.

Thereis a scatterofother residentialproperties next to the frontageotherwise the site is surroundedby agriculturalland.

The Proposals

In 2007, planning permissionwas grantedfor a fourteenbedroom extension over part of the frontageto the hotel. This was taken up through a material start being madeon some of the foundationworks. However it was not completed.It is proposedto "exchange"this permissionfor a newdevelopment comprising fourteen bedrooms but this time as a ground floor extensionat the rear of the hotel, rernoving an existing tenniscourt. Because of the slopesof the landhere, the extensionwould appearto be "sunken" and this would be emphasisedthrough additional bunds and planting. Its 'hrf'this heightwould be some4.2 menesto its low pitch roof. It is proposedto roof. The floor spaceof this proposalis equivalentto that of the 2007 permission- namely580 squaremetes. The volumeof the 2007permission is 2036cubic metres andthat of the currentproposal is 1800cubic metres.

The reasonfor the "exchange"is saidto be economic.The constructionof the 2007 consent would involve extensive strengthening of formdations, and internal scaffolding in the atrium which would leave the ground floor accommodation undemeathout ofaction for severalmonths, and the corridors at ground floor are said to be critical "arterial" circulation routes.

In terms of exfa car parking space,it is said that that has already been provided consequentto the 2007permission. DevelopmentPlan

Representations

The Parish Council objects on the groundsthat the extensionwill be in the Green Belt.

The ColeshillCivic Societyhas no objectionon balancebearing in mind the 2007 permission.The new schemehas a low profile and doesnot impact on the opennessof theGreen Belt. The"green roof is welcomed.

Observations

This bedroom extensionis not consideredto fall into any of the categoriesof new buildingsas definedby paragraph3.4 of PPG2,which would makethe development appropriatein the Green Belt. As such there is a presumptionthat this application should be refused planning permission, unless there are material planning considerationsof suchweight to add up to the 'aery specialcircumstances" necessary to override this presumption.In this casethe applicant has put forward a numberof suchconsiderations for the Council to evaluate.

The frrst of these is that the Council has very recently, in 2007, granteda planning permission for a bedroom extensionhere at the hotel. It is said therefore that the principle of an extensiorl on the groundsof supportfrom the economicdevelopment and tourism objectivesof the Council as expressedthrough the DevelopmentPlan, has alreadybeen accepted by the Council. It is then suggestedthat there has beenno materialchange in DevelopmentPlan policy since 2007, to warranta re-assessmentof that decisionas a matter of principle. This argumentis accepted.There has beenno changeto the relevantpolicies since 2007, andttrere has beenno new policy adopted that would weigh againstthose economicdevelopment and tourism objectives.Thus the principle behind the recent acceptancefor a fourteen bedroom extensionat the hotel can be carried forward to the current scheme,and this will carry sigrrificant weight.

The secondof the applicant'sconsiderations, is that the currenl proposalis effectively the samescale as that alreadyapproved, if not slightly smaller.As a matterof fact this hasto be accepted,although this on its own doesnot carry significant weight. regard to the provision of annual monitoring reports as provided for by Section9 ofrhat Plan. Reason:ln orderto reducetraffic generatedby thehotel.

Policies: As set out above

Justification: This proposalis for inappropriatedevelopment in the Green Belt. However the applicanthas put forward a numberofplanning considerationswhich he considersare material. It is consideredthat these are of sufficient weight to arnount to the very special circumstancesnecessary to override the presumption of refrrsal for that inappropriate development. These considerations are the extaat 2007 planning permission;the fact that an extensionto the hotel of this size has been acceptedin principle, the scaleand volurne of the proposalis slightly lessthan the 2007 consent, the currentproposal has lessimpact on the opennessof the GreenBelt than the 2p007 consent, and that there are no other material adverse impacts. The applicant additionallyhas agreed to the Revocationofthe 2007planning permission. In essence this currentproposal is seen as being a "better" proposalthan the 2007 extant permission,and is thus worthy of "exchange"with that extantpermission.

Application 25/1lll0 ParishCouncil Objection 8/12l10 Civic Society No objection 20/l2ll0 The third considerationis that the applicantconsiders that there is less impact on the opennessof the Green Belt with the current proposalscompared to that arising Aom the approvedscheme. Members should be awarethat the 2007permission is extantin that a material start has been made and it could thus be completed.It is therefore consideredthat this "fall back" sihrationof comparingthe two schemesis relevant. The 2007 schemeis at first floor, and thoseworks would be visible from aroundthe hotel complex.This is illustratedat Appendix A. The currentproposal would certainly be less visible due to its locatioq its designand the surroundingground levels; however it would still impact on opennessbecause the existing footprint of the hotel would be expanded.It has to be acceptedthat permissionwas ganted for the 2007 scheme,and that at that time, weighing up all of the arguments,that proposal was consideredto be acceptable.It is thus usefirl to ueat it as a "baseline". It is considered that becauseof this and the mattersraised above, the current proposaldoes have less impact on opennessthan the 2007 scheme, to the extent that it is a material improvementover that base-line,and not just a minor alteration.

The fourth considerationis that the currentproposal has no worse impactsthan that of the 2007 approvedscheme. This is accepted.The drainageimpact will be the same; the car parking rcquirement is not altered, and the applicant has also included the Green Travel Plan which was approvedn 2007. ln this case however, the energy effrciency measuresare much improved- ie the greenroof reducessurface water run off and assisr in insulationmeasures.

It is consideredthat overall. there are material considerationshere which warranta re- evaluationof the 2007 approvedscheme. ln short, the current proposalis a "better" proposalwith less impact on the opennessof the GreenBelt. As a consequencethis conclusion provides the 'aery special circumstance" that supports the current proposals.It is important to recognisethat this is a "site specific" circumstanceand thus can not be repeatedelsewhere.

Recommendation

That, subjectto tlre ownersof the land agreeingto the making ofa RevocationOrder under Section97 of the 1990Town and Country PlanningAct, with no claim for compensation,in respectof planningpermission 2007/0029 dated 5 March 2007,then planningpermission be grantedsubject to the following conditions:

, Thesite is locatedwithin the GreenBelt and has been developed over a periodof about20 yearsfrom its original beginnings as a golfdriving range, with primitive facilities,to whatis nowa wellestablished and successful tourist venue.

Thegradual development of the sitehas been the resultof detailedconsultation and co-operationwith the PlanningAuthority, Police, Highways etc, as wellas local residents.

Extensiveplanting and landscaping has been carried out and has matured considerablysince the inceptionof the project.

Thedesign concept has always been to employa relativelylow profile massing, usinghigh quality material to enhancethe buildingand itsGreen Belt setting.

Theculminating success of the complexhas resulted in ourClients requirements to providefurther bedroom accommodation, to fulfil the increasingdemand of the local touristindustry and leisurerequarements.

PlanningPermission (Ref: PAP/200710029) was obtained for a 1stfloor extension for 14 bedrooms.

The originalplanning consent (ref: PAP/2007/0029) granted is for 14 newrooms abovethe ground floor and corridors abutting the Atrium lounge and PerryBarton conferenceand banquetingsuite. The projectrequires a "scaffolded"temporary roof ,,

forthe major parr of a 10month conshuction period incruding construction througn the glassAtrium roof consequenflythe Atrium wil be outof actionfor mostof the 10months. This room is cruciarto the mainrestaurant and perry Barton suite as a receptionarea. Arso due to bedroomsand corridorsbeing constiucted direcfly above existingones, it is expected that the onesberow wiil be un-useabrefor arouni haf of the project duration.The corridorberow is the main aderiarco'idor from hotel receptionto all otherareas of the hotel.

EconomicAssessment

In making the originarapprication the increasecosts of buirdingwere anticipated. however the economiccrimate has worsened to an extentunforeseen and the companyDirectors cannot place the businessat riskwith the disruption that would resurton itsgenerar businessrevers which are arready suppressed by theeconomy. TheDirectors don'texpect this situation to changefor severaryears and wourd thereforeseek to swapthis pranning consent for a simirardeveropment that is much lessdisruptive and potentially risky to thesurvival of thebusiness.

Dueto the probremsdefined above it is proposedto swapthe pranningpermission for the firstfloor bedrooms with a new permission(if granted)for the samenumber of bedrooms(14 doublerooms) locatedin a groundfloor extension on what is now a tenniscoun.

The tenniscourt' which can be regardedas previousrydeveroped rand, is rarelyused by Hotel users. lt is proposedto buirda rowrise extension with a rowpitctred ,green roof. The siteis in a naturarhoilow wilhin the randscape and with additionar moundingand randscapingwiil considerabry reduce the v,suar impact of this extension'This canbe seencrearry on drawingnumber 4117107 proposed and existingsite elevations. comparedto theapproved first floor extension the proposednew approved ground floorextension - wiilhave ress of an impacton thegreen bert for the iotto*rng reasons:- a) Themaximum heightof thefirst floor extension is g.6m,where as the proposedground floor extension is onlv4.2m. b) Thefloor area of thefirst floor extension is 587m2,where as the groundfloor extensionis 583m2. c) The volumeof the first floorextension is 2036m3,whereas the proposed groundfloor extension is 1800m3.

Thedesign of the buildingis to blendinto the landscape.The single storey provides a domesticscale. With the enhancements to theexisting landscape around the 'hollow' in whichthe extension sits the buildingfrom outside of the sitewill be hidden andfrom within the sitewill only show the green roof, (except from the existing bedroomwing and at closequarters.)

1.1 ThisSupporting Planning Statement has been prepared by Hasker Architectson behalfof RSM LeisureLimited who havesubmitted a planningapplication for ground floor bedroom extension for the constructionof 14 new bedroomsat Lea MarstonHotel. Lea Marston, Warwickshire.

1.2 The purposeof the reportis to explainthe rationalefor the submission of a comprehensiveproposal for the siteand how the applicationis consistentwith the predominantsurrounding land use (hotel and countryclub). The PlanningApplication has been submitted in fullto allowthe LocalPlanning Authority the opportunityto studythe proposalsin depth,

1.3 Thesite is allocatedin the NorthWarwickshire Local Plan as being withinthe GreenBelt. Thereis a commitmentby the LocalAuthori$ to a 14 bedroomextension at first floor(ref'. PAP12007/0029), which justifiesthe developmentof a groundfloor bedroomextension on the land. Thisis demonstratedlater in the report.

'1.4 The applicationsite extendssome 583 sq m in size and is situated withina hoteland leisure complex set within extensive grounds and two t holegolf courses.The applicationsite relatesto a groundfloor area.

1.5 A key drivingforce behind the applicationfor a bedroomextension has arisenfrom significant demand for furtherbedroom accommodation to fulfulthe increasingdemand of the localtourism industry and leisure requirements.lt is acknowledgedthat the siteis locatedwithin the GreenBelt, however the site has been developed over a periodof about 20 yearsfrom its original beginnings as a golfdriving range with facilitiesto whatis nowa wellestablished and successful tourist venue.

1.6 Accordingly,in orderto addressthe issueof developmentwithin the GreenBelt, we firstdescribe the natureof theapplication site and its relationshipwith adjoining land uses, the design and impact of the proposedextension will be analysedand it willbe concludedthat no adverseimpact into the purposeor functionof the GreenBelt will be feltby thegranting of planningpermission, nor any additional impact on the opennessof the GreenBelt.

1.7 Next,we describethe relevantplanning policy background set out at national,regional and local levels.

1.8 We thenanalyse the relevantissues, an exercisewhich enables us to reachconclusions regarding the suitabilityof thescheme. In carrying out this analysiswe referto meetingsheld with the LocalAuthority duringwhich relevant issues have been discussed and we describe how thesematters have been dealt with by the applicant. 2.0 DESCRIPTIONOF APPLICATIONSITE AND SURROUNDINGAREA

2.1 Theapplication site itself comprises mainly of the areaof the hotelto whichthe extension relates. This is identifiedclearly by the redline on the siteplan; as suchthe applicationsite only covers a smallarea of 583sq m. Theapplication site is adjacentto the builtform of the restof the hotel,the majorityof whichis twostoreys in height.The application site cannotbe vieweddirectly from the frontof the hotel;it can be viewedfrom windows inside the hoteland fromthe hotel'sorivate rear carpark.

2.2 The applicationsite is situatedadjacent to the existingfootprint of the 4 starLea Marston Hotel. The hotelsits in 54 acresof groundswhich containa golfdriving range and two t holegolf courses. The hotel facilitiesinclude 88 bedrooms,conference / function rooms, swimming pool,gymnasium and leisure club facilities and associated parking.

2.3 Thehotel is locatedjust to the northof thevillage of LeaMarston in Warwickshire.8 milesaway from Birmingham International Airport and BirminghamInternational Station, the hotelis localedclose to Junction 9 of the M42. The hotelhas an extensivefrontage onto Haunch Lane, with the hotelcar parksituated between the roadand the mainhotel. The applicationsite cannotbe seenoff the highwaydue to the two storeyelevation of the front partof the hoteland the locationand designof theextension.

2.4 The hotelis surroundedprimarily by openfields; with nearbydwellings includingfarms, a horsestud and kennels. There will be no visual impactcaused by the proposalson nearbyproperties with the extensioneffectively being screened from view by theexisting built formof the hotel.

2.5 The hoteland the applicationsite containedwithin its footprintare allocatedwithin the NorthWaruickshire Local Plan as beingsituated withinthe GreenBelt and as suchattention must be paidto national, regionaland local Green Belt planning policies. 3.0 DESCRIPTIONOF APPLICATIONSCHEME el Theplanning application proposals comprise the construction of a groundfloor extension to accommodate14 additionalbedrooms for the LeaMarston Hotel. This extension comprised with the minor alterationsto 2 no existingbedroom windows at groundfloor level will increasethe total number of bedroomsatthe hotelfrom 88 to 102.

3.2 Theground floor proposals do notincrease the existing overall volume of the hotel(ground floor if the approvedfirst floor extensionref: PAP|2007lO029is taken into consideration) and the design of the extensionis notonly sympathetic to the hotelsrural surroundings and in keepingwith the existingbuilt form of thehotel, but has been designedto blendinto the landscapeby its lowheight and the useof a 'green'roof.

3.3 Theneed for the proposeddevelopment has occurred due to increased demandfor accommodationat the LeaMarston Hotel, which is currentlyconsidered as one of the leadingindependent 4 star hotelsin the Midlands.The hotel has conference and function facilities and is a majorgolfing resource.

3.4 Thehotel is a majorlocal source of employmentand currently employs 69 fulltime members of staffand 139part time members of staff leadingto a totalof 208. Thecontinued growth and prosperity of the hotelgives rise to bothjob securityand job creationand has wide reachingeconomic benefits for the localarea.

2E TheClient will relinquish the extant planning permission (Ref: P4P1200710029)for the 14 bedroomfirst floorextension should a planningpermission be obtainedfor thisground floor extension for 14 bedrooms.

4.O THEDEVELOPMENT PI.A,N

4.1 TheTown and Country Planning Act 1990(as amended) and the Planningand Compulsory Purchase Act 2004states at Sections54A and38(6) respectively, that in makinga planningdecision regard must be hadto the DeveloomentPlan and other malerial considerations. Forthe purposeof theAct, the DevelopmentPlan is consideredto LocalPlan adopted July 2006.

4.2 TheNorth Warwickshire Borough Local Plan was adopted in July 2006and contains policies to guidethe future development of the Boroughup to 2011. Withinthe LocalPlan Strategy Chapter overarchingcore policiesset out the strategicdevelopment principles. Containedwithin this chapterCore Policy4 is concernedwith Green Belt;it states,'The opennessof theGreen Belt in the Boroughwill be maintainedand there will be a generalpresumption against inappropriatedevelopment". As has beenpreviously stated the proposeddevelopment will not be visiblefrom outside of the hoteland as suchwill have no additionalimpact on the opennessof the Green Beltin relationlo the hotelstructure which is alreadyin existence. Furthermorethe proposed ground floor extension in termsof volume anddesign will have less impact than the previouslyapproved first floorproposals.

4.3 CorePolicy 4 crossreferences to EnvironmentalPolicy ENV.2 ENV2 is situatedwithin the Naturaland Built Environment Chapter of the LocalPlan; it statesthat, "The outer extent of theWest Midlands GreenBelt in NorthWarwickshire is shownon the ProposalsMap. \Mthinthis area, Government Policy Guidance Note 2 GreenBelts applies.Areas within development boundaries area excluded from the GreenBelt". The application site lies within the GreenBelt and outside ofa defineddevelopment boundary, as suchfull attention has been paidto PlanningPolicy Guidance Note 2; thisis setoutwithin Section 5 of this supportingstatement.

4.4 PolicyENV13 is concernedwith building design. This policy states that extensionsto existingbuildings will only be permittedwhere; the scale, massing,height and appearance of the proposalpositively integrates intothe surroundingsand the materialsand detailing used respect and enhancelocal distinctiveness. The proposedextension will be in keepingwith the existing building, but more importantly will become partof the landscapewhen viewed from the greenbelt, particularly becauseof the lowprofile and green roof.

4.5 PolicyENV14 Access Design states that the design of accessto and withindevelopment should demonstrate that priority has been given to pedestrians,cyclists and those using public transport. The planning applicationfor a groundfloor bedroom extension is accompaniedby a Designand Access Statement and a comprehensiveTravel Plan; these addressthe issueof accessboth to andwithin the development. The TravelPlan sets out the provisionsto be madefor the useof public transportand sustainable modes of transportto be increasedby employees,hotel guests and visitors to the hotels.

4.6 Economypolicy ECON10 is concernedwith the development of tourismas partof the Borough'seconomic strategy. This policystates; 'Outsidethe MainTowns, Green Belt Market Town and Local Service Centres,small scale development in connectionwith existing tourism facilitieswill be permittedsubject to:

(i) Thescale, siting and design of facilitiesrespecting the character of thearea and its surroundings (iD The developmentnot generatingtraffic of a type or amount Inappropriateto the characterof localroads (iii) Theproposal having a directfunctional relationship with the tourismor heritagesite concerned, or to useand enjoyment of the canalnetwork (iv) Any jobs createdmeeting a localneed

Theproposals contained within the planningapplication are in conformitywith the abovepolicy. The proposedelitension is of an appropriatescale and sympathetic design to theexisting hotel development;and will aid in theexpansion and prosperity of the hotel andthe enhancement of tourismin the localarea.

Summary

4.7 Thepolicies contained within the DevelopmentPlan are in supportof welldesigned, sustainable developments in appropriatelocations. The applicationscheme is welldesigned, in scaleand has arisen as a result of a needfor additional accommodation which has occurred through thegrowth and success of the LeaMarston Hotel. lt is appreciatedthat the applicationsite is locatedwithin the GreenBelt, however, the proposeddevelopment would not cause harm to thefunction or purposeof the GreenBelt. The extensioncannot be seenfrom the highwayand the proposedgreen roof and low profile within the landscapeproposals will hide the building ftom view from outside the site. Furthermore,the parking,transportation requirements and sustainabilityare exactlythe sameas the approvedscheme (Ref:PAP2007/0029)

5.0 NATIONALPLANNING POLICY GUIDANGE

5.1 GovernmentPolicy Guidance is a materialconsideration in the determinationof applicationsfor planning permission. Relevant PlanningPolicy Guidance is containedin PlanningPolicy Guidance Notes(PPG) and Planning Policy Statements (PPS). Applications will be determinedin accordancewith the DevelopmentPlan unless materialconsiderations indicate otherwise.

PPSI - CreatingSustainable Communities (2005)

5.2 PPS1sets out the Government'shigh level of policyobjectives for planning,providing a frameworkfor specific policies which are set in individualPlanning Policy Statements. PPSl placesa strong emphasisupon achievement of sustainabledevelopment within communities.PPS1 identifies four key principles in the attainmentof sustainabledevelopment, these are;

a Sustainableeconomic development a Socialinclusion a Technicalenhancement of theenvironment a Prudentuse of resources 5.3 ln seekingto achievethese four goals, sustainable development, planningshould promote rural regeneration, and bring forward sufficientland of a suitablequalig in the rightlocation. PPS1 reinforcesthe importanceof the plan led systemindicating that planningapplications are to be determinedin accordancewith the developmentplan unless material considerations indicate othenvise.

PPG2- GreenBelt (1995)

5.4 Thereare five purposes of includingland within the GreenBelt;

o To checkthe unrestrictedsprawl of largebuilt up areas. e To preventneighbouring towns from merging into one another. o To assistin safeguardingthe countryside from encroachment. . To preservethe settingand specialcharacter of historictowns . To assistin urbanregeneration, encouraging the recyclingof derelict andother urban land.

5.5 The proposeddevelopment for a groundfloor bedroom extension for 14 bedroomswould not be visiblefrom outsideof the site. lt wouldnot therefore,have an adverseeffect on the purposeof the GreenBelt. Nordoes it precludethe GreenBelts function as preventing neighbouringtowns from mergingin with one another. lt is contended thatthis Applicationsupports the five purposesof the GreenBelt.

5.6 Theother purposes for includingland within the GreenBelt, as stated in paragraph1.5, would not be impededthrough the ground floor developmentof a bedroomextension. Built development has already occurredon siteand whilst it is proposedto increasethe builtfootprint, the proposalis to providea designthat hides the extension and removesthe originalfirst floor approval.

5.7 Therole of the GreenBelt has a Dositiveinfluence on theachievement of sixobjectives stipulating paragraph '1.6 of PPG2.The first two of thesebeing;

. To provideopportunities for accessto the opencountryside for the urbanpopulation; and . To provideopportunities for outdoorsport and recreationnear urbanareas.

5.8 By allowingthe development of a groundfloor bedroom e)dension on the site,the role of the GreenBelt concerning the positiveachievement of thesetwo objectives would, in noway, be compromised.A ground floorbedroom extension would not preclude nor prevent opportunities for accessto the opencountryside. By allowingthe bedroomextension thiswould increase capacity for theoccupancy rate of thehotel and thereforewould enhance opportunities for outdoorsport and outdoor recreationsuch as golfingholidays, in whichcase opportunities for outdoorsport and outdoor recreation would be significantlyincreased throughthe proposedground floor bedroom extension.

5.9 Theapplication site is situatedat groundfloor level lt doesnot detract fromthe objective of paragraph1.6 of PPG2,'to retainattractive landscapesand enhancedlandscapes near to wherepeople live'. The modestbedroom extension which is adjacentto theexisting two storey hotelcomplex would not devalue the aestheticvalue on offerto the localcommunity through the GreenBelt.

5.10 Thefinal three objectives listed in paragraph1.6 of PPG2are;

o To improvedamage on derelictland around town. . Securenature conservation interest. . To retainland in agricultural,forestry and related uses.

5.11 Oncemore the development of a groundfloor bedroom extension on theapplication site will have no effecton the GreenBelt influence, and in the successof thesethree objectives. Development of the site is in keepingwith the surroundingsingle or twostorey elements of the hotel. The site is of no natureconservation interest, nor is it currentlyused for agricultural,forestry or relatedpurposes. Furthermore, the use of landscapework and green roofs hides the building

5.12 Thereis a presumptionagainst inappropriate development in the GreenBelt and development should not be approvedexcept in very specialcircumstances.

5.13 Paragraph3.2 states that inappropriate development is, by definition, harmfulto thegreenbelt. lt is forthe applicantto demonstratewhy permissionshould be granted.Very special circumstances to justiff inappropriatedevelopment will not exist unless the harmby reasonof inappropriateness,and any other harm, is cleadyoutweighed by other considerations.In view of the presumptionagainst inappropriate development,the Secretaryof Statewill aftach substantial weight to the harmof the GreenBelt when considering the planningapplication or appealconcerning such development.

5.14 Bygiving consideration to the purposeof includingland in the Green Beltand the objectiveswhich the GreenBelt function helps to fulfil,it canbe arguedthat harm through the reasonof inappropriatenessand anyother harms, is clearlyoutweighed by otherconsiderations. The proposeddevelopment does not preclude any of thefive purposes for the inclusionof landwithin the GreenBelt. Thistherefore implies that the sitecurrently plays a minimumfunction as GreenBelt Land. Shouldthe site be situatedoutside the GreenBelt then the proposed developmentwould not be classifiedas inappropriateand therefore harmful. Indeedthis argument must have been accepted by the LocalAuthority whenconsidering the granting of PlanningPermission for the 14 bedroomsat firstfloor (PAP42007l0O29).This Application offers to rescindthe extant Application in favourof thisnew 14 bedroomground floor extension.(See 3.6).

5.15 Theproposed application is fora groundfloor bedroom extension whichwould not increase the floor area or overallheight of the existing building(including extant permission). The design and location of the extensionmeans that it willnot be seenfrom outside the site and indeedclose to the site. Thisis stillthe caseeven though lhe siteis cunentlysituated within the GreenBelt. The developmentof the site for a groundfloor bedroom extension would have no impacton the GreenBelts role in fulfillingthe six objectiveslisted in paragraph6 of PPG2. Moreoverit wouldenhance the characterof the localarea by the introductionof highquality landscaping and green roofs to replace hardstanding.

5.16 Paragraph3.15 of PPG2states that the visual amenities of the Green Beltshould not be injuredby proposalsfor developmentwith or conspicuousfrom the Green Belt which, although, they would not prejudicethe purposeof includingland in GreenBelts, might be visuallydetrimental by reasonof theirsitings, materials or design.The proposeddevelopment would not injure the visual amenities of the GreenBelt, on the contrary,it wouldserve to improveand enhance them. Thedevelopment would result in a groundfloor bedroom extensionwhich would be in keepingwith the existingsingle and two storeydevelopment which forms the majorityof the existingbuilt developmentof the hotel.The proposedmalerials would be in keeping with the existingdevelopment of the hoteland thereforethe proposed extensionwould look like part of theexisting hotel at closequarters. The useof thegreen roof will hide the buildingfrom a distance.

PPST- SustainableDevelopment in RuralAreas (2004)

5.17 TheGovernment objectives contained within PPST include promotion of 'goodquality, sustainable development' and whereby development is proposedon Greenfieldland it is ensuredthat the landis notused wastefully.The proposedbedroom extension at the Lea MarstonHotel is an appropriateand sustainable ulilisation of a groundfloor brownfield plot.

5.18 PPSTconsiders an importantaspect of sustainabledevelopment is that it is 'goodquality, carefully sited accessible development'. The applicationsite being a groundfloor extension is carefullysited on an existingplaying surface in a naturalhollow to hidethe building.

Summary 5.19 All of the NationalPlanning Policy Guidance referred to above encouragesthe sustainabledevelopment of sitesand the application proposalsare consistent with the clear thrust of NationalPlanning PolicyGuidance. 6.0 PLANNINGISSUES AND OTHERMATERIAL GONSIDERATIONS

6.1 ThisGovernment guidance is a materialconsideration to Planning Applicationsand replaces Planning Policy Guidance Note 21 on Tourism.This guidance is proactivein relationto tourismdevelopment andseeks to enhancethe industryas partofthe nationaleconomy, as is statedin paragraph2.7. Concerning tourism development in rural areasthe guidancestates that wherever possible, tourist and visitor facilitiesshould be housedin existingor replacementbuildings, particularlywhere they are locatedoutside existing settlements.

6.2 AnnexA in theguidance deals with different forms of tourist accommodation,the generalprinciples contained within this annex statethat whateverthe type of hotelaccommodated and whereverit is located,it should:fit in wellwith its surroundings, having regard to its siting,scale, design, materials and landscaping; and be in harmony withthe localenvironment.

6.3 In particular,concerning extensions to existinghotels the guidance statesin Annex A at paragraph12; "Similarly, moderate sized extensionsto an existinghotel or publichouse, including the addition of bedroomaccommodation, can help to ensurethe future viability of suchbusinesses. This may satisfy a localneed as wellas a tourism one,by fullyutilising the potential of thesite but without any disproportionateincrease in scale".

6.4 It is consideredthat the applicationproposals demonstrate a modest bedroomextension which is in keepingwith the characterof the hotel andsurrounding area. Theextension is requiredby thehotel as it is currentlyat capacityand needs to expandif it is to remainas oneof the premierhotel, golf and leisure facilities in boththe Countryand the Region.

6.5 Emergingplanning policy relating to the siteneeds to be addressed throughthis supporting statement. Although emerging policy is not consideredto be partof the DevelopmentPlan, it is consideredto be a materialconsideration and an indicationtowards future policy emphasis.

7.0 CONCLUSIONS

7.1 Thisstatement supports a fullplanning application for a groundfloor bedroomextension at the Lea MarstonHotel. Lea Marston. Warwickshire. 7.2 Thereare site specific material considerations solely applicable to this applicationwhich justifies the development of a groundfloor bedroom extensionon the applicationsite. Thesehave been set out inthis supportingstatement and other documents.

7.3 It is acknowledgedthat the applicationsite is allocatedas beingsited withinthe GreenBelt; however, evidence has been put forward through thisstatement that demonstrates the applicationproposals do not prejudicethe function or purposeof the GreenBelt. Theapplication is for a groundfirst floor extension which cannot be viewedfrom the highway.The malority of theexisting structure of the hotelis singleor twostoreys and as suchthe proposalsare in keepingwith the scale, heightand massing of theexisting hotel development and will be seen as partof theexisting landscape,

7.4 Theapplication site constitutes brownfield land as the previoususe wasfor a tenniscourt and the Designand Access Statement and the TravelPlan which accompanies the planningapplication conclude that the proposeddevelopment of a groundfloor bedroom extension is acceptableon the applicationsite.

7.5 The layoutplans submitted with the planningapplication provide a comprehensivescheme for the proposedextension, making the best useof landin linewith National Government Guidance.

7.6 In conclusionthis Application is basedon a swopof theextant permissionfor 14 bedrooms(ref: PAP1200710029)with this 14 bedroom groundfloor extension. The LocalAuthority accepted all the previous argumentstor a 14 bedroomeritension, which are no differentto this newApplication.

Theincrease in volumewas agreed previously and this Application seeksno greatervolume than approved, which will be compensatedby the lossof theextant permission.

The proposednew development is proposedon previouslydeveloped land.

The proposednew 14 bedroomextension is singlestorey is locatedin a hollowand designed to be partof the landscapewith the green roof hidingthe building. lt offersimproved landscape design.

Consideringthe wider objectives, the proposalsimprove the prospects of tourismto the countryand formspart of the hotelslong term strategyto encouragetourism, such as the promotionof golfingbreaks.

The unprecedentedeconomic down turn has now made the prospects of developingthe first floor extant permission as unviable. Thispermission addresses the economic difficulties of constructinga 14bedroom extension whilst the business remains operational and unaffected. Themerits of theapplication are commended to the BoroughCouncil, andsupport of the Council through the granting of planningpermission is sought. NorthWarwickshire BoroughCouncil
