ORDERS Sri Hafeez Ansari has filed 2nd appeal dated 10-01-2018 which was received by this Commission on 12-01-2018 for not getting the information sought by him from the Public Information Officer/ Mandal Educational Officer, Pargi Mandal, Vikarabad District and the First Appellate Authority/ the District Educational Officer, Vikarabad District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 04-05-2017 before the Public Information Officer requesting to furnish the information under Sec. 6(1) of the RTI Act, 2005TSIC on the following points mentioned: (P.T.O) Note: This is system generated copy and no signature is required. -2- Stating that the appellant did not get any response from the Public Information Officer, he filed 1st appeal dated 09-06-2017 before the First Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. The District Educational Officer, Vikarabad District through Letter dated -06-2017 directed the Public Information Officer/ Mandal Educational Officer, Pargi mandal to furnish the sought information to the appellant and submit copy to their office. Stating that the appellant was not satisfied with the reply of the First Appellate Authority, he preferred this 2nd appeal before this Commission requesting to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. Basing on the material papers available on record, the appeal is taken on file and notices were sent to the parties concerned directing them to appear before this Commission for hearing on 28-11-2019 at Hyderabad. The case is called on 28-11-2019. The Appellant is absent. Sri G. Mohan Babu/Computer Operator/Authorized representative of Public Information Officer / Mandal Educational Officer, Pargi Mandal, Pargi, Vikarabad District is present. Heard the Authorized Representative and perused the records. The Authorized Representative of the Public Information Officer through affidavit submitted that the reply was furnished to the Appellant on 22-06-2017 & 23-11-2019, but there is no postal receipt as proof of service. On perusal of the material papers available in the case file, it is noticed that 6(1) application was filed by the appellant on 04.05.2017 and the Mandal Educational Officer, Pargi Mandal, Vikarabad District vide letter dated 20.04.2019 furnished the information. The Commissioner further noticed that the information furnished by the Public Information is not a correct information as per 6(1) application of the appellant and the PIO TSICalso submitted information after a long time i.e. on 20.04.2019. In view of the above, the present Public Information Officer is directed to furnish complete information to the appellant as sought in the 6(1) application dated 04.05.2017 within one week from the date of receipt of a copy of this order by Registered post with acknowledgement due under intimation to this Commission. A Show Cause Notice is being issued separately to K.Anjilaiah, Ex. Mandal Educational Officer, Pargi who is presently working as Gazetted Head Master, Zilla Parishad High School No.1 Pargi, Pargi Mandal, Vikarabad District for not furnishing the information to the appellant within the stipulated time as per the R.T.I. Act. With the above direction the case is closed.
