MOBILE COUNTY COMMISSION

The Mobile County Commission met in regular session in the Government Plaza Auditorium, in the City of Mobile, , on Monday, January 23, 2012, at 10:00 A. M. The following members of the Commission were present: Connie Hudson, President, Merceria Ludgood and Mike Dean, Members. Also present were John F. Pafenbach, County Administrator/Clerk of the Commission, Jay Ross, County Attorney, and Joe W. Ruffer, County Engineer. President Hudson chaired the meeting.

The invocation was given by Commissioner Merceria Ludgood.

President Hudson called for a moment of silent prayer for two (2) victims who lost their lives in a tornado in the Birmingham, Alabama area earlier this morning, which have also affected communities in Chilton and Monroe Counties, Alabama.

PRESENT RESOLUTION/PROCLAIM JANUARY 27, 2012 AS EARNED INCOME TAX CREDIT (EITC) AWARENESS DAY

President Hudson presented a resolution to the following members of nonprofit organizations:

Diana Brinson, HandsOn South Alabama Raymond Huff, Internal Revenue Service Lanny Wilson, Goodwill Industries/Easter Seals of the Gulf Coast, Inc. Patsy Herron, United Way of Southwest Alabama Terri Grodsky, Retired Senior Volunteer Program

President Hudson said tax preparation assistance helps low to moderate income families, the disabled, elderly and limited English proficiency individuals to take advantage of federal tax benefits such as, earned income tax credit, child tax credit and receive up to $5,751.00 in tax refunds which is a substantial financial benefit for families struggling to make ends meet. She said in 2011 local nonprofit organizations and numerous volunteers operated sixteen (16) tax sites within Mobile County that have helped 1,738 families claim over $2 million in tax refunds and credits. President Hudson said in recognizing the significant benefits of additional millions of dollars of tax credits for low to moderate income workers, their families and our communities, the Internal Revenue Service is partnering with local elected officials, businesses, educational and financial institutions who are committed to community volunteers and nonprofit groups, to promote the 2012 Earned Income Tax Credit (EITC) Awareness Campaign. She said their goal is to increase claims for earned January 23, 2012

income tax credit (EITC), child tax credit and other state and federal tax credits through free tax preparation assistance, as well as to link low income families and individuals to financial education, asset development and other benefit programs.

The Commission proclaims January 27, 2012 as Earned Income Tax Credit Awareness Day and encourages all eligible residents of Mobile County to claim their earned income tax credit, to visit volunteer tax sites and receive free tax preparation assistance. The Commission further encourages all residents to support the initiative and to promote it in their communities.

Ms. Brinson said as a volunteer action center for the region she is delighted to have been chosen to speak on behalf of a wonderful coalition of nonprofit groups, who have helped promote this program every year for the benefit of working families. She said Friday, January 27, 2012, as part of their continuing earned income tax credit (EITC) awareness they are offering some community training at HandsOn South Alabama. Ms. Brinson said the coalition is growing with the support of so many programs and organizations. She thanked the Commission for their support and said she hopes the Commissioners would continue to promote it to their constituents.

President Hudson said Mobile County is very fortunate to have this program.

RESCIND AWARD/BID #140-11/COMPACT TRACK LOADER/ENVIRONMENTAL SERVICES DEPARTMENT

Joey Jernigan, President, Bobcat of Mobile, addressed the Commission opposing Agenda Item #17, rescind award of Bid #140-11, one new compact track loader for the Environmental Services Department. He said his company entered the bid process twice over the last six (6) months for a compact track loader and won the bid twice. Mr. Jernigan said in the middle of November, 2011, G. William Melton, Environmental Services Director, and Joe W. Ruffer, County Engineer, stopped receiving his telephone calls because the time lapse between his bid and awarding of the bid had taken too long, although, federal money was set aside for that particular equipment and not the County’s money. Mr. Jernigan said his company went through a lot to meet the bid obligations, including the number of employees, number of parts and so forth. He said his company’s equipment was more than legitimate for the specifications required by the County, but he was told by the Environmental Services Department that the County Legal staff was now handling it and he would need to speak to Jay Ross, County Attorney. Mr. Jernigan said Mr. Melton returned from his vacation around Christmastime and told him the equipment was not needed anymore and they would rescind the bid. He said he was told by a company in Pensacola, Florida, who does not have an office in Mobile, Alabama, that they have the attachment for the equipment and are waiting on a Purchase Order (P.O.) from the County. Mr. Jernigan said it is not fair, his company is located in Mobile, Alabama, he won the bid twice and he deserves to be awarded the bid, but now the bid is being January 23, 2012

rescinded and the company in Pensacola, Florida, has high hopes they are going to get the Purchase Order (P.O.) for this same bid. He said the Environmental Services Department instructed the company in Pensacola, Florida, to pick up the attachment to make sure it fits on their equipment which was not fair. Mr. Jernigan said the bid has been a part of his company for the last six (6) months, he is a taxpayer and a resident of Mobile County, and it is disheartening to know the award of the bid to his company is going to be rescinded and the Purchase Order (P.O.) for the same compact track loader is being passed on to an out-of-state company.

President Hudson asked Mr. Ross, Mr. Melton or Mr. W. Bryan Kegley, Assistant County Engineer, to explain the circumstances surrounding this situation.

Mr. Ross said Mr. Jernigan’s company was the lowest bidder on the second bid, but there was confusion on the definition of the attachment. He said the definition of the attachment was ambiguous and because it was federal money he recommended the Environmental Services Department not to accept the bid. Mr. Ross said some of the other vendors’ prices were different and the definition of the bid as a U. S. Forestry Package was controversial. He said the Environmental Services Department reviewed the State Bid list, but they have decided they do not need the equipment anymore. Mr. Ross said the Environmental Services Department is perfectly in compliance with every aspect of Bid #140-11. He said sometimes they get into those areas where there is not enough information created on the definition, one of the vendors said it was not defined within the bid package and that is when ambiguity arose. Mr. Ross said Bobcat of Mobile was the lowest bidder, but the dispute arose over the attachment and the definition was not sufficiently described in the bid documents so that all bidders would have a clear understanding.

President Hudson asked if they needed to decide whether or not the equipment is needed and if it is needed would they need to authorize a rebid and would the definition problem be resolved?

Mr. Ross said correct. He said Mr. Jernigan’s company met the bid criteria as it was presented, but another vendor asked questions about the definition. Mr. Ross said the bid is okay to rebid with the clarification if that is what Environmental Services Department wants to do. He asked Mr. Melton if that was a fair overview of the situation?

Mr. Melton said yes, except they have done four (4) rebids for this item and each time a vendor contested the results. He said because it is federal money in itself lends to a circumstance of uncomfortableness in having to deal with the Inspector General and for the County’s best interest he has chosen not to rebid the item. Mr. Melton said the window of opportunity of use for the equipment has come and gone and if they could use the equipment in the future at that time they would revisit the subject.

President Hudson told Mr. Melton in future endeavors make sure the definitions are concise and accurate. She said it is an inconvenience for those companies who bid and because of legal issues with definitions the bids are rejected. President Hudson told Mr. Jernigan that she understands his concerns about the bid and she apologized for the inconvenience, but she said Mr. Melton has told the Commission the equipment is no longer needed by the January 23, 2012

County and would not be purchased at this time.

Mr. Jernigan said his equipment is the only one that meets the U. S. Forestry Package for the type of environment it would be used in. He said it was not until after Mr. Melton told his company that the equipment was no longer needed that the company in Pensacola, Florida, was contacted and directed to pick up the attachment to make sure it fits their equipment and they are now waiting to receive the County’s Purchase Order (P.O.). Mr. Jernigan said he wants to emphasize to the Commission that after Mr. Melton told him the equipment was no longer needed, someone from his office contacted the company in Pensacola, Florida, and directed them to come and pick up the attachment to make sure it attaches to their piece of equipment. He said it was after the fact of Mr. Melton making that announcement to him that the company in Pensacola, Florida, took action.

President Hudson asked Mr. Melton if there was an attachment to the equipment purchased from the company in Pensacola, Florida?

Mr. Jernigan said the attachment was already owned by the County and part of the bid was the compact track loader needed to be able to attach to it and run that attachment. He said it has been sitting idle at the County’s facility on Schillinger Road and his company went and looked at it to make sure their equipment would match up to it and after all that was done in the middle of December, 2011, the company in Pensacola, Florida, received a telephone call directing them to pick up that attachment and bring it to their office to make sure their equipment would run that attachment. He said it was all done after his company was told the equipment was no longer needed at all, anymore, which was after his company had won the bid twice. Mr. Jernigan said Mr. Melton’s time line does not match up, he said one thing and then did something totally different.

President Hudson said the problem is the definition of the equipment and they need to make sure in the future they do not bid four (4) different times because of legal snafus or definition problems, if there is anyway to avoid it.

She said she could not speak on the telephone calls that were made and she does not know what happened in those circumstances, but at this point in time the County would not be purchasing that equipment and she asked Mr. Melton was that correct?

Mr. Melton said yes.

President Hudson asked if the action on the agenda today is to rescind awarding bid #140-11?

Mr. Melton said yes.

Commissioner Dean asked if there was any preference in using local vendors in their bids and if not, could they put it in the bid documents to make sure they spend the money locally?

Mr. Melton said there is no legal preference, but there is a personnel preference.

Al Sessions, County Treasurer, addressed the Commission and said he is presenting information about the Treasurer’s Office because he finds it quite disturbing of what has been said since he has announced his plans to retire. He said the office of Mobile County Treasurer is authorized by Act No. 336 and was approved by Alabama State Legislature, March 1, 1881, as an elected official position. Mr. Sessions said throughout the years there have been amendments to clarify or revise the duties and responsibilities of the Treasurer. He said the Treasurer’s term of office is four (4) years and his first term of office began January 15, 2001. Mr. Sessions said it has been his honor to have been re-elected twice and at the last Commission meeting he announced that he would not seek a fourth term because he has decided to retire so he could spend more time with his family. He said since his announcement of his retirement plans there have been considerably incorrect, misleading and demeaning statements as to the duties and responsibilities of the County Treasurer. Mr. Sessions said the function of the Treasurer’s Office is more than “cutting checks” and “exercising minimal control over investments”. He said the Treasurer’s Office does not maintain a “separate set of books” and there is no “duplication” or “redundant” work performed by the Treasurer’s Office as characterized by the local newspaper. Mr. Sessions said the Finance Department and the Treasurer’s Office have worked very well together in the performance of duties and responsibilities of each entity. He said as County Treasurer, it is his responsibility to serve as custodian of all County funds administered by the County Commission. Mr. Sessions said the County Commission, as the local government administrator, approves a balanced budget for each department of local government and each local government entity prepares a budget for the County Commission to use in establishing a balanced budget for their departments. He said there are several local governmental departments that collect funds for use to support the budgets approved by the County Commission and they are the Revenue Commission which collects various tax assessments and transfers the funds to the County Treasurer monthly, the License Commission collects various tax assessments, license fees and permit fees that are transferred to the County Treasurer monthly and the State of Alabama collects taxes and assessments that are transferred to the County Treasurer monthly. Mr. Sessions said all funds collected have a designated purpose for which they may be expended and there are a total of fifty four (54) accounts handled by the County Treasurer for the County Commission. He said the County Commission approves the expenditures for the County funds and the County Treasurer’s office prepares a check from the appropriate account. Mr. Sessions said in addition to serving as custodian of all the accounts for the County Commission, the County Treasurer serves as the fiduciary agent for some thirty six (36) other local governmental entities’ funds accounts which are the Revenue Commission, License Commission, Sheriff’s Department, District Attorney’s Office, Law Library, Racing Commission and Treasurer accounts. He said he cuts those checks for payment for the approved voucher or bill provided by the local governmental entities. Mr. Sessions said the County Treasurer in addition to handling various accounts of local governmental entities, also manages with the assistance of a “County Investment Team” funds that are not currently on demand for the budget which are invested with local banks in “money market” and “certificate of deposit” accounts. He said he also has two (2) major investment firms to handle the purchase of various approved investment instruments such as, stocks, bonds, federal government notes and approved commercial January 23, 2012

paper. Mr. Sessions said the Commission investment portfolio is a little over One Hundred Thirteen Million Dollars ($113,000,000.00) and investments are at various maturity intervals to meet the needs of the approved budget. He said the County Treasurer’s Office has five (5) merit system employees and an elected Treasurer, the merit positions are classified as Investment and Treasury Officer, Accountant II, Fiscal Officer I, Fiscal Clerk II and Office Assistant II. Mr. Sessions said the Treasurer’s staff are dedicated public servants that deserve praise and appreciation for a job well done, not disparaging remarks about the duties and responsibilities they perform. He said the misleading statements and derogatory comments about the elected County Treasurer’s duties and responsibilities are an effort to gain support to abolish the elected County Treasurer position. Mr. Sessions said it has been the objective of several members of the Commission over the years to eliminate the elected County Treasurer’s position and place the Treasurer‘s Department under the Finance Director which simply would not be a wise or prudent decision, it would be too much power and control for a three (3) member Commission to wield. He said power tends to corrupt, two (2) Commissioners have been removed from office for wrongdoing during his tenure as County Treasurer and two other Commissioners were also removed from office. Mr. Sessions said he opposes abolishing the elected County Treasurer position and he would do all he could to prevent the abolishment of the elected County Treasurer position. He said it was stated that the effort to abolish the elected County Treasurer position was to make the County government more efficient. Mr. Sessions said the County Commission has not been able to manage their responsibilities efficiently in several areas and it has been more than eleven (11) years that they have been trying to convert to a new payroll system. He said they canceled the first vendor’s contract after spending over a million and a quarter dollars and it looks like by the end of this year they would have successfully worked out all of the problems with the conversion to a new payroll system. Mr. Sessions said the County Commission came up short of funds by approximately a million and a quarter dollars for an economic development program and the shortfall required a more aggressive investment plan by the County Treasurer to make up for the shortfall. He said through the diligent effort of his investment team they were able to make up the shortfall. Mr. Sessions said the County Commission decided to have an out-of-town firm handle some investment activities for one of their bond issues, they did well, too well, the County ended up with an arbitrage problem that resulted in the County having to pay a large penalty. Mr. Sessions said the County Commission does not need to take over another department when they cannot efficiently manage the tasks they already have at hand. He said the County Commission should not be trying to reduce the voice of the citizens of Mobile County, because more representation, not less, should be the hallmark of good government, to allow people to elect any position serves the citizens of Mobile County better than taking over another department. Mr. Sessions said he has been quite disturbed about some of the comments in the newspaper, he said he discussed it with President Hudson and she assured him that some of the comments were taken of out context. He said he is totally and unequivocally opposed to the County Commission abolishing the County Treasurer’s elected position. Mr. Sessions said he has a good working relationship with the Finance Department and the current County Commission has opened many doors and reached out to the elected officials working diligently to try to resolve their shortfall in funds. He said they have turned the corner in some areas of cooperation, but they need to have a more open government, more diligent discussions of problems and not try to filter and January 23, 2012 conceal things. Mr. Sessions said over the years he has discussed numerous problems with Commissioner Dean, who has had a very good open door policy with him, he thanked Commissioner Dean for his willingness to work with him over the years to resolve problems. He said he appreciates the County Commission’s service to Mobile County.

President Hudson thanked Mr. Sessions and said the Commission has the utmost respect for him as an individual and an elected official, his staff and the work he has done for the County. She said she would not say or do anything to devalue that and the idea came forward on the possibility of consolidating and merging the function of the Treasurer’s Office with the Finance Department to reduce the cost of government. President Hudson said they are not trying to be less accountable or less transparent, there are three (3) Commissioners and they must reach a consensus with two (2) to decide anything. She said the Finance Department is audited every year with glowing remarks and their intent is to function more efficiently, to streamline operations where they can. President Hudson said there are sixty four (64) counties in Alabama that have merged their operations and Jefferson County is in the process of advertising a bill to do the same thing. She said that is their only motivation, it was an opportunity, they had to advertise the bill and through individual conversations with their attorney, he instructed their lobbyist to move forward and advertise the bill, it does not have a sponsor at this time, but to get it in for the next session it had to be advertised. President Hudson said they are looking at the feasibility of the bill and she does not know what would transpire of it. She told Mr. Sessions it is not personally against him or any member of his department, they are very valuable employees and would continue to be employees of Mobile County regardless of what happens. President Hudson said their motivation is for the County to be more streamlined and efficient with taxpayers’ dollars.

Mr. Sessions said he appreciates their desire and merging the Treasurer’s office with the Finance Department would add personnel and not reduce it. He said Commissioner Dean is the only member on the current Commission panel who has come to the Treasurer’s office and discussed the Treasury Department with him.

Commissioner Ludgood told Mr. Sessions that is not true, she has been in the Treasurer’s office and if he is going to say it, he needs to be accurate. She said she has been to the Treasurer’s office, sat with Mr. Sessions and discussed issues with him.

Mr. Sessions said Commissioner Ludgood has never met with him in the Treasurer’s office as long as he has been the County Treasurer, but he has visited Commissioner Ludgood in her office and his personal note on that is that he respects her enough to come to her office and she does not have to come to his.

President Hudson told Mr. Sessions the Commission appreciates him, and his comments are well taken. She said they are all trying to work together in tough economic times to cut costs so they would not have to layoff employees and do things they absolutely do not want to do. President Hudson said Mr. Sessions vacating the Treasurer’s Office has given them the opportunity to look at the possibility of merging the two. She told Mr. Sessions the Commission respects him and appreciates the work he has done.

Commissioner Dean thanked Mr. Sessions and said the twelve (12) years he has been with the County Commission they have had a lot of problems and some of them have been corrected. He said January 23, 2012 because of the meetings with Mr. Sessions they were able to solve some of the problems. Commissioner Dean said he commends Mr. Sessions and his staff for the job they have done. He said Mr. Sessions is his friend and that is why he visits the Treasurer’s Office. Commissioner Dean said Mr. Sessions has a lot of knowledge, he has been in County government for many years and they discuss the direction in which they would like to see the County headed. He said he respects Mr. Sessions opinion and sometimes they differ, but Mr. Sessions’ staff has worked with Administration staff and they have accomplished great things for the County. Commissioner Dean said Mobile County is known as one of the most progressive counties in the whole state and they have a window of opportunity to take a look at saving the taxpayers some money, but right now the County looks really good and he likes the way it is going.

He said Mobile County has a great opportunity in the next four (4) to ten (10) years to lead the whole southeast in jobs and economic development. Commissioner Dean wished Mr. Sessions a great retirement.

Mr. Sessions thanked the Commission.

Commissioner Dean moved, seconded by Commissioner Ludgood, that the Board adopt the following resolution:

WHEREAS, Breland Homes, LLC as the abutting property owner of the following described drainage easement adjacent to Scott Dairy Loop West and West Lake Road have petitioned the County Commission of Mobile County, Alabama to assent to the vacation and closing by them as the abutting owner of the easement hereinafter described:

WHEREAS, it has been shown to the satisfaction of the Mobile January 23, 2012

County Commission that said Breland Homes, LLC owns all of the property abutting said easement, that the same is not needed as a public road in Mobile County, Alabama, that no property owner or owners own lots or parcels that will be cut off from access thereby over same other reasonable and convenient way, and that it would be to the best interests of the Mobile County Commission to vacate the same; and

WHEREAS, County Commissioner Mike Dean, in whose district the subject property is located, has moved for approval of said Petition for Vacation;

NOW, THEREFORE, BE IT RESOLVED, by the County Commission of Mobile County, Alabama that its assent be, and the same hereby is given to Breland Homes, LLC as abutting property owner, to the vacation and closing by them of the following described right of way, more particularly described as follows:

BE IT FURTHER RESOLVED, by the County Commission of Mobile County, Alabama, that its assent be, and the same hereby is, given to vacate and annul any portion of any map recorded in the Office of the Judge of Probate of Mobile County, Alabama, which shows the hereinbefore described right of way in accordance with the laws of the State of Alabama. The filing of this Resolution in the Probate Court of Mobile County, Alabama, shall divest all public rights and liabilities, including any rights which may have been acquired by prescription, in that part of the street, alley, highway or easement vacated. Title and all public rights, including the right to close the street, alley, highway or easement vacated shall vest in the abutting landowners, pursuant to Code of Alabama (1975), Sections 23-4-20 and 23-4-2, provided that entities with utility lines, equipment

or facilities in place at the time of vacation shall have the right to continue to maintain, extend and enlarge their lines, equipment and facilities to the same extent as if the vacation had not occurred. The County Commission hereby finds that it is in the interest of the public that this street, alley, highway or portion thereof be vacated. January 23, 2012

Commissioner Ludgood moved, seconded by Commissioner Dean, that the Board approve a thirty six (36) month equipment lease agreement renewal with Pitney Bowes for upgrading the mailing machine for the Commission in the amount of $1,341.00 per month. This agreement is obtained through the State Bid list, and authorize the President of the Commission to execute the agreement on behalf of Mobile County.

APPROVE REPEAL OF MOBILE COUNTY, ALABAMA U. S. CITIZEN OR LEGAL ALIEN POLICY

President Hudson asked for a brief explanation of this item for the viewing audience?

Martha Hennessy, Chief Staff Attorney, said the policy was adopted by the Commission a couple of years ago and required all contractors awarded a County contract at the request of or on the recommendation of the Engineering or Road & Bridge departments, to assign only legal aliens or legal citizens of the United States of America to work on such contracts. She said the new Alabama immigration law succeeded this policy.

President Hudson asked if those requirements were being fulfilled by the new Alabama immigration law.

Ms. Hennessy said yes.

Commissioner Ludgood moved, seconded by Commissioner Dean, that the Board approve the repeal of the Mobile County, Alabama, U. S. Citizen or Legal Alien Policy.

WHEREAS, the Mobile County Commission is required by Act Number 812 of the Regular Session of the Alabama Legislature of 1965 to designate a voting center in each ward and precinct in the County, and to determine the number of voting machines at each center deemed necessary to serve adequately the voters at an election;

NOW, THEREFORE, BE IT RESOLVED, that the Mobile County Commission designates the voting centers for the March 13, 2012 primary election, at the locations shown on the list attached hereto and made a part hereof; and, further, assigns for each such voting center the number of ballot counters also shown on the attached list, finding and determining that such number is adequate to serve the voters at each center; and directs that one AutoMark device, compliant with the requirements of the Americans with Disabilities, shall also be placed at each voting center.

President Hudson thanked Donna Jones, General Services Director, her staff, and John Pafenbach, County Administrator, for work they have done on this item. She said it has been a two (2) year endeavor and it gives County employees an option to go to an onsite and wellness clinic or to their regular physician. President Hudson said the first year they would break even, but in future years they are looking at substantial savings in healthcare costs. She congratulated them for their work and said Mobile County is the only entity participating in this program, they are working outside of the box and it is a good thing because it would help bring the County’s healthcare costs down.

Commissioner Ludgood moved, seconded by Commissioner Dean, that the Board approve a contract with Infirmary Medical Clinics, P. C. to operate and manage an onsite clinic and wellness program for County employees and retirees upon review and approval of the contract by the Legal staff, and authorize the President of the Commission to execute the contract on behalf of Mobile County.

Commissioner Dean asked if there are any additional appointees they need to make for this committee?

John Pafenbach, County Administrator, said he would recheck, but he has two (2) appointees from Commissioner Dean, two (2) appointees from President Hudson, two (2) appointees from Commissioner Ludgood, an appointee for the insurance representative, Joe Ruffer, County Engineer, only wants to name three (3) spots from the Engineering Department and there would be a representative from the Legal staff.

Commissioner Dean asked if the Commission has already approved his appointees?

Mr. Pafenbach said yes.

President Hudson asked if the positions for the appointees to the Board have been approved?

Mr. Pafenbach said yes.

President Hudson said the Engineering Department could move forward to set up the meeting for the Mobile County 2012 Residential Building Code Advisory Committee.

ADOPT RESOLUTION APPROVING EXTENSION/ PURCHASE AGREEMENT/AXIS ENVIRONMENTAL, LLC

Commissioner Ludgood moved, seconded by Commissioner Dean, that the Board adopt the following resolution:

WHEREAS, the Mobile County Commission and Axis Environmental, LLC previously entered into a purchase and sales agreement as jointly entered on May 2, 2011 for the Axis’ purchase of approximately a 70.3 acre parcel of real property located at the “Acordis site”; and

WHEREAS, the purchase and sales agreement was for a term of 180 days which expired on or about November 2, 2011; and

WHEREAS, the County and Axis have jointly agreed to extend the time frame for the purchase and sale agreement to include March 30, 2012, and for the execution of an appropriate extension agreement; and

NOW, THEREFORE, BE IT RESOLVED, that the Mobile County Commission agrees to extend the purchase and sales agreement with Axis Environmental, LLC to and including March 30, 2012.

ADOPT RESOLUTION APPROVING REQUEST/IT DEPARTMENT/ DISPOSE OF VEHICLE FROM FIXED ASSETS INVENTORY LIST, DECLARE AS SURPLUS PROPERTY AND AUTHORIZE DISPOSAL BY LAWFUL MEANS

Commissioner Ludgood moved, seconded by Commissioner Dean, that the Board adopt the following resolution:

WHEREAS, the Mobile County Commission has control of all property belonging to the county and is authorized by state law to dispose of the same by order entered upon its minutes; and January 23, 2012

WHEREAS, there is presently located in County Administration Vehicle #1113, a 17-year old Jeep Cherokee, having 190,252 miles, which is in unsafe condition and no longer needed;

NOW, THEREFORE, be it resolved by the Mobile County Commission that the aforesaid Vehicle #1113 be, and it is hereby, declared SURPLUS and removed from all applicable inventory lists, to be disposed of by lawful means. It is further DIRECTED that a copy of this resolution be entered upon the minutes of the regular meeting of the Mobile County Commission convened on the 23rd day of January, 2012.

AGENDA #26

COMMISSION ANNOUNCEMENTS AND/OR COMMENTS

Commissioner Dean said he has read the comments in Mobile Press Register Sound Off section and he has also spoken with citizens throughout Mobile County about sidewalks and bicycle trails. He asked what would it cost to expand some of the roads to include sidewalks such as, Cottage Hill Road to Dawes Road? Commissioner Dean said they are expanding Schillinger Road from one interstate to the next and that would be a good bicycle trail. He said there is more and more interest for sidewalks in the County January 23, 2012

and he asked how could they do it legally with the Pay-As-You-Go Program?

President Hudson said there is nothing legally that excludes sidewalks and bicycle trails from being included in the road paving plans and she asked has it only been a matter of the cost?

Mr. W. Bryan Kegley, II, Assistant County Engineer, said yes and they would need to take several considerations up front to implement that type of project such as the cost, the additional right-of-way that would be necessary for widening the roads and things of that nature.

President Hudson asked if it was hard to go back after construction began to include a sidewalk that had not been included in the right-of-way project?

Mr. Kegley, II, said yes, it would need to have been included at the origin of the planning.

Commissioner Dean asked if there were some grants they could go after? He said James D. Foster, Traffic Manager, obtained some grants to pave sidewalks for the City of Theodore and he would like to pursue some of those same types of grants.

President Hudson said it is something to consider in certain areas.

Commissioner Dean said some of the roads they could build four (4) to five (5) foot wider. He said in Grand Bay, Alabama, they built bicycle trails around the schools. Commissioner Dean said maybe he could work with the Engineering Department throughout Mobile County in widening the roads around schools to create a walking path for children. He said he would like for this to be put on their to do list, especially going after grants.

Commissioner Ludgood said there is a pile of money for sidewalks that creates a path to schools.

President Hudson said it is called “Safe Routes To School” Program.

Commissioner Dean said he would like for that to be pursued.

Commissioner Ludgood said she is in transition from her Blackberry cellular telephone and it has been very difficult. She said her iPhone 4S is much more smarter than she is and she thought she had wiped out her calendar. Commissioner Ludgood commended Susan Heyer, Telecommunications System Coordinator, and Darren Martin, IT Director, for their superb instructions and taking the time from their busy day to navigate her through the various applications to retrieve her calendar. She said she appreciates them.

President Hudson said it is comforting to know they have Ms. Heyer and Mr. Martin.

John Pafenbach, County Administrator, said yes it is. President Hudson announced the Bicentennial Commission of Mobile County would be celebrating the Portersville Bay Historical Marker Dedication Thursday, January 26, 2012, at 10:00 A. M., at Rolston Park in Bayou La Batre. She said in the January 23, 2012

early 1900's Portersville Bay was a resort community and was called the Coney Island of the South. President Hudson announced the Senior Bowl would be at Ladd-Peebles Stadium, January 28, 2012, at 3:00 P. M. and it would be televised on the NFL Network. She said all of the collegian stars would be there and NFL scouts looking at draft potentials. President Hudson announced a Cuisine For Kids Day in Mobile County, to benefit the Child Advocacy Center, Tuesday, January 24, 2012. She said there are thirty eight (38) restaurants at forty two (42) locations who have agreed to donate some of their proceeds from that day to the Child Advocacy Center for its mission to help child abuse victims. President Hudson said a list of the participating restaurants could be reviewed on the Child Advocacy Center website www.cacmobile.org and she encourages all to dine out at one of those restaurants so the Child Advocacy Center could receive the proceeds. President Hudson said a letter was sent to Cleophus Tolbert, Building Inspector I, Road & Bridge Department, from Wallace and Barbara Davis expressing their sincere appreciation for the inspection services received on the addition to their home. She said the Davis wrote that from the staff to Administrative Assistants who answered the telephones and all of the other inspectors were very cordial and nice and the inspectors did a quality job of inspection on the addition to their home; the inspectors knew far more than them and knew about the standard requirements and on numerous occasions insisted on a better product; the inspectors caught things they would have never thought of and as a result their home is safer and stronger; the inspectors worked with various technicians and contractors treating them all with respect; they appreciate the inspectors perspective which was fair, did not cut any slack and that was good for all, they sincerely appreciate the quality assurance the inspectors provided to the new addition to their home. President Hudson said kudos to the Building Inspection Department and said the Commission appreciates the fine work they do.
