Country Policy and Information Note Iraq: Opposition to the government in the Kurdistan Region of Iraq (KRI) Version 2.0 June 2021 Preface Purpose This note provides country of origin information (COI) and analysis of COI for use by Home Office decision makers handling particular types of protection and human rights claims (as set out in the Introduction section). It is not intended to be an exhaustive survey of a particular subject or theme. It is split into two main sections: (1) analysis and assessment of COI and other evidence; and (2) COI. These are explained in more detail below. Assessment This section analyses the evidence relevant to this note – i.e. the COI section; refugee/human rights laws and policies; and applicable caselaw – by describing this and its inter-relationships, and provides an assessment of, in general, whether one or more of the following applies: • A person is reasonably likely to face a real risk of persecution or serious harm • The general humanitarian situation is so severe as to breach Article 15(b) of European Council Directive 2004/83/EC (the Qualification Directive) / Article 3 of the European Convention on Human Rights as transposed in paragraph 339C and 339CA(iii) of the Immigration Rules • The security situation presents a real risk to a civilian’s life or person such that it would breach Article 15(c) of the Qualification Directive as transposed in paragraph 339C and 339CA(iv) of the Immigration Rules • A person is able to obtain protection from the state (or quasi state bodies) • A person is reasonably able to relocate within a country or territory • A claim is likely to justify granting asylum, humanitarian protection or other form of leave, and • If a claim is refused, it is likely or unlikely to be certifiable as ‘clearly unfounded’ under section 94 of the Nationality, Immigration and Asylum Act 2002. -

Synopsis: The Chaldean Archdiocese of Erbil has asked MCC to provide a minimum of 3 and not more than 6 English teachers to teach English language skills to teachers, seminarians, nuns and members of the Chaldean community in Ankawa, Iraq. Three English language teachers will have primary responsibility for working together to teach English vocabulary, grammar and reading/listening and speaking/writing skills to Iraqi teachers at Mar Qardakh School. Additional teachers will provide English language instruction to members of the Chaldean community who are not teaching at Mar Qardakh School but who need to improve their English skills. Classes will be held each day, Sunday – Thursday, from 9:00 am – 12:30 PM. The program for students will begin on Sunday, July 5 and end on Thursday, July 30, 2015. Financial arrangements. The partner organization will cover food, lodging, travel to and from the assignment as well as work-related transportation. The short term teacher will cover all other expenses including visa costs, health insurance, medical costs and all personal expenses. Qualifications: 1. MODERN CONFLICTS: CONFLICT PROFILE Iraq (Kurds) (1961 - 1996) The Kurds are an ethnic group in northern Iraq and neighboring Turkey and Iran. There are longstanding conflicts between the Kurds and the governments of all three countries (see also Turkey-Kurds conflict profile). Sustained warfare between the Iraqi government and Kurdish fighters dates from 1961. In the first phase of the war, the Iraqi government controlled the cities and major towns, while Kurdish peshmerga fighters controlled the mountains. Iraq used aerial bombardment while the Kurds relied mainly on guerrilla tactics. An agreement that would have granted autonomy to the Kurds in was almost signed in >> MODERN CONFLICTS 1970, but the two parties could not agree to the division of oil rights and the fighting HOME PAGE resumed. With increased support from the U.S. Central Intelligence Agency and the Iranian government, the Kurds escalated the war. In 1975, when the CIA and Iran cut off >> CONFLICTS MAP their support, the Kurdish forces were significantly weakened. This phase of the war was >> CONFLICTS TABLE characterized by mass displacements, summary executions, and other gross human rights >> PERI HOME PAGE violations. In 1979, when Saddam Hussein became president of Iraq, he intensified the repression against the Kurds. Though Kurds resisted, large-scale fighting did not resume until the mid-1980s when Iran, now fighting its own war with Iraq, renewed support for the peshmerga. In 1987, Saddam Hussein appointed his cousin, General Ali Hassan al-Majid, to subdue the Kurds. “Chemical Ali,” as he came to be known because of his use of chemical weapons, launched the Anfal campaign that resulted in the deaths of approximately 100,000 Kurds, the displacement of hundreds of thousands of others, and the destruction of more than 2,000 Kurdish villages. -

LEAGUE OF NATIONS CONSTITUTION OF ‘IRAQ (ORGANIC LAW) Note by the Secretary- General : The Secretary-General communicated to the Council, on August 23rd, 1924 (document C.412.1924.VI, C.P.M. 166),1 a letter from the British Government transmitting a translation of the Organic Law of ‘Iraq passed by the Constituent Assembly of ‘Iraq on July 10th, 1924. In a letter dated November 28th, 1928, the British Government transmitted the following document : The ‘Iraq Constitution, March 21st, 1925, recently published by the Government of ‘Iraq. The British Government points out, in the above-mentioned letter, that the publication of the document in question was necessitated by the discovery of considerable discrepancies between the Arabic text of the Organic Law, as passed by the ‘Iraq Constituent Assembly in July 1924, and the English translation which was communicated to the Secretariat in 1924. The British Government adds that the new text embodies the modifications introduced by the Organic Law Amendment Law, 1925,2 and was approved by the ‘Iraq Government as superseding all translations of the law hitherto published. It examines the relationship between ethics, politics and power by discussing how Kurdish issues have been shaped by the political landscape of the twenty- first century. It opens up a dialogue on the contested meaning and shape of human rights, and enables a new avenue to think about foreign policy, ethically and politically. It bridges political theory with practice and reveals policy implications for the Middle East as a region. Using the approach of a qualitative, exploratory multiple-case study based on discourse analysis, several Kurdish issues are examined within the context of democratization, minority rights and the politics of exclusion. Data was collected through semi-structured interviews, archival research and participant observation. Data analysis was carried out based on the theoretical framework of critical theory and discourse analysis. Further, a discourse-interpretive paradigm underpins this research based on open coding. Such a method allows this study to combine individual narratives within their particular socio-political, economic and historical setting. -
The Contemporary Roots of Kurdish Nationalism in Iraq
THE CONTEMPORARY ROOTS OF KURDISH NATIONALISM IN IRAQ Introduction Contrary to popular opinion, nationalism is a contemporary phenomenon. Until recently most people primarily identified with and owed their ultimate allegiance to their religion or empire on the macro level or tribe, city, and local region on the micro level. This was all the more so in the Middle East, where the Islamic umma or community existed (1)and the Ottoman Empire prevailed until the end of World War I.(2) Only then did Arab, Turkish, and Iranian nationalism begin to create modern nation- states.(3) In reaction to these new Middle Eastern nationalisms, Kurdish nationalism developed even more recently. The purpose of this article is to analyze this situation. Broadly speaking, there are two main schools of thought on the origins of the nation and nationalism. The primordialists or essentialists argue that the concepts have ancient roots and thus date back to some distant point in history. John Armstrong, for example, argues that nations or nationalities slowly emerged in the premodern period through such processes as symbols, communication, and myth, and thus predate nationalism. Michael M. Gunter* Although he admits that nations are created, he maintains that they existed before the rise of nationalism.(4) Anthony D. Minority rights in Iraq and prospects for the Iraqi Turkmen within Iraq Stefan Wolff [email protected] | www.stefanwolff.com | @stefwolff Introduction Turkmen are the third-largest population group in Iraq with between 600,000 and 2 million members who have a strong sense of their distinct identity and have preserved their native language. They live concentrated in the north of Iraq in the Kurdistan Region and in the so-called disputed territories. The largest concentration of Turkmen live in the city and province of Kirkuk. Approximately 60% of Iraqi Turkmen are Sunni Muslims. Turkmens’ suffering under Saddam Hussein has been officially recognised in the Preamble of the Iraqi Constitution of 2005. Yet even in the new Iraq, Turkmen continue to be affected by ethnic and sectarian violence and discrimination. The legal framework of minority rights in Iraq The relevant legal framework for the rights of Turkmen (and other communities) in Iraq consists of applicable international standards, the Iraqi Constitution of 2005, and the Kurdistan Regional Constitution of 2009. So far, no comprehensive minority rights or anti-discrimination law has been passed, and provisions in existing legislation (such as the Criminal Code or the labour Code) allow for potential discrimination. Applicable international legal standards Iraq is a signatory to various relevant international documents, including (in chronological order): the ILO Convention 111 concerning Discrimination in Respect of Employment and Occupation (1958), the International Covenant on Civil and Political Rights (1966), the International Covenant on Social, Economic and Cultural Rights (1966), and the International Convention on the Elimination of All Forms of Racial Discrimination (1965). -

The Kurdish Diaspora in Canada: A Study of Political Activism and The Uses of The Kurdish Language Esengul Tasdemir Thesis submitted to the University of Ottawa in partial fulfillment of the requirements for the Master of Arts School of Sociological and Anthropological Studies Faculty of Social Sciences University of Ottawa Ó Esengul Tasdemir, Ottawa, Canada, 2019 Abstract This thesis focuses on the Kurdish people of Turkey, who have struggled and advocated for a separate nation-state of their own. The Turkish state’s denial of Kurdish identity, and its heavy assimilation and oppression of the Kurdish people have turned some Kurds into political activists, both in Turkey and in the diaspora. In addition, the historical ban and current stigmatization of the Kurdish language have crystallized the importance and centrality of the language, particularly for both Kurdish identity and the Kurdish movement. This thesis explores the forms of political activism in Canada of the Kurds originating in Turkey, and the role of the Kurdish language in their activism. Using a qualitative research design, interviews with activists and participant observations were conducted in the cities of Toronto and Montréal. The findings draw attention to the significance of community centres as umbrella institutions for political activism, and as sites for the enactment of different forms of collective resistance. The study also illustrates that the role of the Kurdish language in activism is more salient at a representational level. That is, the Kurdish language is represented as the main identity marker fuelling activism, implying that speaking Kurdish is an act of resistance and thus political. -

Country Information and Guidance Iraq: Religious minorities Version 1.0 August 2016 Preface This document provides country of origin information (COI) and guidance to Home Office decision makers on handling particular types of protection and human rights claims. This includes whether claims are likely to justify the granting of asylum, humanitarian protection or discretionary leave and whether – in the event of a claim being refused – it is likely to be certifiable as ‘clearly unfounded’ under s94 of the Nationality, Immigration and Asylum Act 2002. Decision makers must consider claims on an individual basis, taking into account the case specific facts and all relevant evidence, including: the guidance contained with this document; the available COI; any applicable caselaw; and the Home Office casework guidance in relation to relevant policies. Country Information The COI within this document has been compiled from a wide range of external information sources (usually) published in English. Consideration has been given to the relevance, reliability, accuracy, objectivity, currency, transparency and traceability of the information and wherever possible attempts have been made to corroborate the information used across independent sources, to ensure accuracy.
