About the Authors Kathryn Wertheim Hexter, director of the Center for Community Planning and Development, joined the Levin College of Urban Affairs in 1986. A planner and public policy analyst, Ms. Hexter has over 25 years of experience in the areas of housing and community development, neighborhood development, and regional collaboration. She has worked extensively with federal, state, and local governmental, philanthropic, and non-profit organizations. She is co-editor of the book The New American City Faces Its Regional Future, A Cleveland Perspective (Ohio University Press, 2000) and co-author of Public Utilities and the Poor: Rights and Responsibilities (Praeger Publishers, 1985). Ms. Hexter holds a bachelor's degree from Washington University in St. Louis, 1976 and a master’s degree in City and Regional Planning from Harvard University, 1978. She is a graduate of the 2003 Rockwood Leadership program and the Foundations and Frontiers in Appreciative Inquiry workshop at the Case Weatherhead School of Management, 2004. Edward W. (Ned) Hill is the Dean of the Maxine Goodman Levin College of Urban Affairs at Cleveland State University. He is also a Nonresident Senior Fellow of the Metropolitan Policy Program at The Brookings Institution and a Nonresident Visiting Fellow of the Institute of Government Studies at the University of California at Berkeley though his membership in the MacArthur Foundation's Research Network on Building Resilient Regions. Hill is author of two books, co-editor of five books, and author of over 90 articles, book chapters, and columns. He was a lead in the Deloitte Consulting-Cleveland State University team that wrote Industry- based Competitive Strategies for Ohio: Managing three portfolios in 2005 and Manufacturing Pennsylvania's Future in 2004. Ohio's Competitive Advantage: Manufacturing Productivity was released in 2001. Ohio's Competitive Advantage has been credited with starting a five-year statewide conversation that resulted in fundamental business tax reform in the state of Ohio. The Cincinnati Enquirer referred to Hill as the "godfather of tax reform" in the summer of 2005. He earned his Ph.D. in both economics and urban and regional planning from the Massachusetts Institute of Technology in 1981 and he is a resident of Lakewood, Ohio. Benjamin Clark joined the Levin College faculty as an Assistant Professor in 2010. Dr. Clark earned his Ph.D. in Public Administration in 2009 from the University of Georgia. His teaching and research focuses on public budgeting and administration. He came to Cleveland State University from a career in public service. Prior to his appointment at the Levin College of Urban Affairs, Dr. Clark worked as a budget analyst for the Unified Government of Athens-Clarke County (Athens, Georgia). He has previously worked in a Washington, DC based public health consulting firm (Futures Group International) to assist foreign governments, multilateral organizations, and NGOs in the development and implementation of HIV/AIDS and reproductive health programs. He is also a former Peace Corps Volunteer in the West African nation of Senegal. Dr. Clark has been published in the Journal of Policy Analysis and Management, Policy Sciences, Public Administration and Development, Science and Public Policy, the Journal of Technology Transfer, and the Asia-Pacific Population Journal. Brian A. Mikelbank is an associate professor of Urban Studies in the Maxine Goodman Levin College of Urban Affairs at Cleveland State University. He is an urban geographer with varied interests in quantitative spatial analysis. His recent research focuses on the spatial analysis of metropolitan housing markets and dynamics of urban-suburban change. Brian teaches classes in housing analysis, quantitative and spatial data analysis, urban geography, urban development, and urban geographic information systems. Charles Post has been a Project Manager / Research Associate in the Maxine Goodman Levin College of Urban Affairs at Cleveland State University since 1992. Previously, he was a Policy Analyst at The Center for Regional Economic Issues (REI) at Case Western Reserve University, a Research Analyst at Mathematica Policy Research (MPR) in Washington, D.C., and a Policy Analyst in the Department of Energy (DOE). Post earned a B.A. in Economics and Math from Earlham College, an M.A. in Economics from Washington University, and an M.S. in Public Policy and Management from Carnegie-Mellon University. RACIAL CARTELS Daria Roithmayr* This Article argues that we can better understand the dynamic of historical racial exclusion if we describe it as the anti-competitive work of "racial cartels." We can define racial cartels to include a range of all-White groups-homeowners' associations, school districts, trade unions, real estate boards and political parties- who gained signficant social, economic and political profit from excluding on the basis of race. Farfrom operating on the basis of irrational animus, racial cartels actually derived significant profit from racial exclusion. By creating racially segmented housing markets, for example, exclusive White homeowners' associations enjoyed higher property values that depended not just on the superior quality of the housing stock but also on the racial composition of the neighborhood.

Happiness will begin to blossom only when he finds a way to get out of his physical trap into improved surroundings. Harold Cruse* I. INTRODUCTION Housing is basic to human survival. When properly constructed and maintained, it provides an essential element for life: shelter from the forces of nature. The 1949 Housing Act' recognized the importance of housing by enunciating the national goal of a "decent home and a suitable living envi- ronment for every American family." The impact of housing quality on so- cietal well being is undeniable. For example, the quality and character of the family living unit significantly affects the nature of organized family life.2 Moreover, poor housing has been shown to cause mental and physical illness and is a contributing factor to the cause of crime.3 The demonstrated importance of housing quality supports the assertion that the right to habitable housing is a personal interest which is "implicit in the concept of ordered liberty"4 and thereby deserving of constitutional pro- tection. Yet, in Lindsey v. Normet5 the Supreme Court held that access to housing of a particular quality is not a fundamental interest which requires application of a strict standard of review under the Equal Protection Clause of the Fourteenth Amendment. Thus, governmental action which curtails a person's ability to obtain habitable housing need only bear a rational rela- tionship to a permissible governmental objective.6 Because the range of per- missible governmental objectives is broad, a rational relationship can usually be established and a challenged governmental action upheld.7 * H.

Mobile is the historic capital of the French Colony of Louisiana and the proud originator of the American Mardi Gras. At nearly 500,000 in population, the Mobile metro area has equal numbers of African American and Caucasian citizens with growing immigrant populations as well. The City of Mobile’s population in 2010 was estimated at 195,000, a decrease from its peak of over 203,000 in 1960. This history is important to understand in the context of a City that distances itself from the state of Alabama but is fiercely proud of its own identity. Mobile has more than 140 historic buildings and seven districts on the National Register. During the mid 19th century Mobile and its port served as the gateway to Alabama’s fertile Black Belt. Fueled by rich cotton production and export trade with Europe, Mobile was an economic powerhouse of the Southern U.S. This wealth helped create deep cultural traditions and a gentile, educated population. Mobile’s influence continued through the civil rights era of the 1950s and ‘60s – Alabama’s oldest city was considered “more respectful” than other Southern cities to the concerns of integration. Downtown Mobile had suffered the typical late 20th century urban decay – with much of its middle class population moving across the bay to smaller communities such as Spanish Fort, Fairhope and Daphne.

The link for the final article is: https://journals.sagepub.com/doi/10.1177/1538513218791466 Abstract: Stringent architectural and building restrictions were put in place as the Van Sweringen Company laid out Shaker Heights, Ohio, an exclusive planned community, incorporated in 1912. In 1925, as African Americans and Jews sought to purchase property there, the company devised and implemented a new restriction that, while containing no overtly discriminatory language, succeeded in achieving the company’s discriminatory objective. The company and, later, the City of Shaker Heights, would continue to enforce this restriction well beyond 1948 when the U.S. Supreme Court ruled religious and racial covenants unenforceable.     CHAPTER 10 : CIVIL RIGHTS Historically, minority and low-income populations have been underrepresented in the transportation planning and project development process. Inadequate access to decision-making and information increases the potential that a specific population will be adversely effected by a transportation project and the likelihood that their specific needs or concerns will not be fully addressed. Since 1964, federal laws and policies have been developed to ensure that the civil rights of minority and low-income populations will be protected and that the decision- making process for those projects is free from discrimination. Primary among these federal laws and policies are Title VI of the Civil Rights Act of 1964, as amended and Executive Order 12898 as signed by President Clinton in 1994. Title VI of the Civil Rights Act of 1964 provides that, "No person in the United States shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.” Executive Order 12898, Federal Actions to Address Environmental Justice in Minority Populations and Low-income Populations, calls for strategies to identify and address disproportionately high and adverse human health and environmental impacts of federal actions on low-income and minority populations. In compliance with Executive Order 12898, the U.S. Department of Transportation (USDOT) issued USDOT Order 5610.2 on Apri1 15, 1997 establishing an environmental justice strategy.
